SUBJECT: Project Application Community Development Block Grant (CDBG FY 2021)

BACKGROUND:
The primary objective of the national Community Development Block Grant (CDBG) Program is the
"development of viable urban communities by providing decent housing and a suitable living
environment, particularly for persons of low and moderate incomes." All project proposals
submitted for funding through the CDBG Program must document the achievement of at least one
(1) of the following national objectives:
Provide benefit to low and moderate income persons;
Aid in the prevention or elimination of slums or blight; and
➢ Meet other community development needs having particular urgency or posing a serious or
immediate threat to the health or welfare of a community.
ANTICIPATED FUNDING:
On February 9, 2021, the Indian Nation Council of Governments ( INCOG), provided information
regarding the FY 2021 CDBG application. A completed application, which includes a public
hearing, resolution, and cooperation agreement, is due to INCOG no later than April 2, 2021.
Owasso is now part of an Urban County and as such does not compete for the funding through the
State Department of Commerce. According to INCOG, Owasso will receive an allocation of
approximately $142,053.33 for the FY 2021 CDBG funding cycle, which does not require a local
match.
PAST CDBG PROJECTS:
In the past, Owasso has utilized CDBG monies for sidewalk, sanitary sewer, street, and park
improvements. In 2014, the U.S. Department of Housing and Urban Development (HUD) changed
the income limits that determined if individuals and families qualified as a low to moderate income
household. As a result, Owasso lost much of its former qualifying area in and around the original
town area, leaving only a small area around the Baptist Village neighborhood eligible for funding.
Owasso staff performed income surveys for smaller targeted geographic areas in the summer of
2015, qualifying the Hale Acres neighborhood near North Garnett Road and East 1161h Street North
for a five (5) year period. Since the Hale Acres neighborhood qualified for funding under the revised
HUD income limits, the City has utilized CDBG funds from the FY 2016 through FY 2020 allocations for
replacement of sanitary sewer lines in this neighborhood.
EXPIRATION OF QUALIFIED AREA:
Because the five (5) year qualifying period has expired for the Hale Acres neighborhood, it is
necessary to requalify the neighborhood in order to continue using CDBG funds in this location. In
October 2020, INCOG assisted with this effort by mailing out 175 surveys to Hale Acres residents, of
CDBG

which 150 are needed for a statistically valid survey. This effort resulted in 40 surveys being returned
or a 26.66% response rate, far short of the needed 150 surveys.
In January 2021, no additional surveys had been received and staff made the decision to send out
another round of surveys to Hale Acres residents using City of Owasso letterhead. Additionally, the
Owasso Strong Neighborhood Initiative (OSNI) Coordinator, Jerry Fowler, communicated with local
neighborhood leaders to help explain the purpose of the survey. Notices of this second survey
were placed on Nextdoor and the City's web page. This effort resulted in 87 surveys being returned
as of March 2, 2021.
Because the needed 150 surveys have not yet been received, staff asked INCOG if a project could
be approved subject to obtaining the needed signatures. INCOG responded this would be
acceptable. Therefore, the FY 2021 CDBG project recommendation is subject to staff receiving the
required number of surveys. Once all of the surveys are obtained, a minimum of 51 % must meet the
low to moderate income thresholds identified on the survey forms or the CDBG funds may not be
spent in Hale Acres,
PUBLIC HEARING:
Staff consulted with INCOG regarding the requirement of holding a separate Public Hearing and
was told that "since the project is a continuation of the same activity that the City has been doing
for several years in the same location, then no separate Public Hearing is required ".
PROPOSED FY 2021 PROJECT:
Assuming that the Hale Acres neighborhood is requalified, the proposed project will be a
continuation of the replacement of deteriorated 8" clay the sanitary sewer pipes. Specifically,
this project will replace the existing north -south sewer lines on the south side of East 1 14'h Street
North and should represent the last of the sewer line work in the neighborhood. The existing 8"
clay pipe will be replaced with approximately 1,800 linear feet (LF) new HDPE 8" inch pipe.
The work, which will be considered Phase IV of the Hale Acres sewer improvements, will continue
to address many years of inflow and infiltration issues in this area of Owasso's collection system,
which was originally installed in the 1960's. The project will be designed in -house by the
Engineering Division of Public Works. A map has been provided with this memo indicating the
general location of the proposed improvements.
Considering the above, staff suggests continuing to utilize the funds for replacement of the sanitary
sewer lines in Hale Acres. This sanitary sewer project should be the last of the sewer work in this
area, and then stormwater work can begin.
PRPOPOSED ACTION:
Staff has placed an item on the March 9, 2021, Worksession agenda for additional discussion.

The CDBG program is authorized under Title I of the Housing and Community
Development Act of 1974, as amended.
The purpose of this Application Guidance is to provide assistance in preparing a
Community Development Block Grant application for the FY2021 Tulsa County
CDBG Urban County Program.
Eligible Entities
Entities included for FY2021 funding, the funding allocation to the entity, and the
percentage of low and moderate income population for each is listed below:

expenditure rates and failure of select Entities to expend funds in a timely
manner, the following expenditure criteria have been established and will be

following Threshold Requirements:
100% of 2018 grant expended;

RESOLUTION
WHEREAS, the Housing and Community Development Act of 1974, as amended (24 U.S.C. 93-
383 et seq.), (the "Act'), provides that Community Development Block Grant, ( "CDBG'), funds may
be used for the support of activities that provide decent housing and suitable living environments
and expanded economic opportunities principally for persons of low- and moderate - income; and,
WHEREAS, CDBG Regulations 24 CFR 570.307(a) allow counties having a total combined
population of 200,000 or more from the unincorporated areas and participating incorporated areas
to qualify as an urban county; and,
WHEREAS, Title I of the Housing and Community Development Act of 1974, Public Law 93 -383, as
amended, authorized the Secretary of Housing and Urban Development, as a representative of the
United States of America, to grant to Tulsa County funds and administrative responsibility for the
Tulsa County CDBG Urban County program; and
WHEREAS, a Cooperation Agreement between Tulsa County and the City has been executed for the
purpose of participation in the Tulsa County Urban County Community Development Block Grant
Program for Federal Fiscal Years 2020 -2022; and,
NOW THEREFORE, BE IT RESOLVED by the Owasso City Council that the City of Owasso desires
to obtain assistance in addressing community development needs and hereby requests the Tulsa
County CDBG Urban County program to provide assistance.
NOW THEREFORE, BE IT FURTHER RESOLVED by the Owasso City Council that the City of
Owasso affirms its commitment to take all action within its power to facilitate the receipt of the
assistance of community development funds, and upon receipt to administer said grant by the rules
and regulations established by the United States of America, the State of Oklahoma, Tulsa County
and all empowered agencies thereof.

BACKGROUND:
The Community Development Department received an application for the review and approval
of a Final Plat for Lissau Landing, a proposed medical clinic. The Final Plat proposes one (1) lot on
one (1) block and the subject property is located at 11610 North 137th East Avenue, just north
and east of the intersection of US Highway 169 and East 116th Street North (State Highway 20).
The subject property is approximately 11.48 acres in size, and is currently zoned Commercial
Shopping (CS) under ordinance 1155. The proposed development will consist of a single building
that will house a medical clinic.

ANALYSIS:
The proposed Final Plat for Lissau Landing consists of one (1) lot on one (1) block on 11.48 acres,
to accommodate a medical clinic facility. The underlying zoning for the property is Commercial
Shopping (CS). The proposed lot as depicted on the Final Plat meets the bulk and area
requirements stipulated in both the Owasso Zoning Code for the CS zoning district.
There will be a total of three (3) access points for this lot from a new frontage road (North 137th
East Avenue) to be constructed as part of a new medical clinic project. The new frontage road
will be established by separate instrument at the applicant's request, pending approval of the

Final Plat- Lissau Landing
Final Plat. A site plan has been approved for the new medical clinic and the plat represents the
last significant component requiring approval from any review bodies.
The Final Plat provides all the necessary perimeter utility easements to service the proposed
development. The City of Owasso will provide police, fire, ambulance, and sanitary sewer
services to the property. Water will be provided by Washington County Rural Water District #3.
Any development that occurs on the subject property shall adhere to all development, zoning,
and engineering requirements of the City of Owasso.
PLANNING COMMISSION:
The Owasso Planning Commission will consider this item at their regular meeting on March 8,
2021.

BACKGROUND:
The Community Development Department received an application for the review and approval
of a Final Plat for Garnett Medical Center, a proposed optometrist clinic. The Final Plat proposes
one (1) lot on one (1) block. The subject property is located at the northwest intersection of East

ANALYSIS:
The proposed Final Plat for Garnett Medical Center consists of one (1) lot on one (1) block on
2.156 acres. The underlying zoning for the property is CG, under OPUD 06 -04. The proposed lot as
depicted on the Final Plat meets the bulk and area requirements stipulated in both the Owasso
Zoning Code and in OPUD 06 -04.

There will be two points of access for this subdivision. One point of access is off of East 103rd
Street North, via an existing Mutual Access Easement (MAE) and drive that also serves the
memory care facility directly to the west of the subject property. The second point of access is
off of North Garnett Road, via a thirty (30) foot drive. This drive will cover a portion of another
MAE that the applicant intends to file, connecting the subject property to the unplatted land to
the north. This arrangement will create a shared drive scenario reducing the number of curb cuts
along Garnett Road.
The Final Plat provides all the necessary perimeter utility easements to service the proposed
development. The City of Owasso will provide police, fire, ambulance, water and sanitary sewer
services to the property. Any development that occurs on the subject property shall adhere to
all development, zoning, and engineering requirements of the City of Owasso.
PLANNING COMMISSION:
The Owasso Planning Commission will consider this item at their regular meeting on March 8,
2021.

BACKGROUND:
The Community Development Department received an application for the review and approval
of a Final Plat for Presley Hollow, a proposed residential subdivision, The Final Plat proposes one
hundred ninety -seven (197) lots on twelve (12) blocks. The subject property is located on the
north side of East 76th Street North, approximately three - fourths (314) of a mile west of North 161st
East Avenue. The subject property is approximately 66.85 acres in size, and is currently zoned

The proposed Final Plat for Presley Hollow consists of one hundred ninety -seven (197) lots on
twelve (12) blocks and is proposed to be the first of two phases for the Presley Hollow
neighborhood. The applicant is proposing the construction of single - family homes, some of
which will be part of a gated community. The underlying zoning for the property is RS -3, under
OPUD 16 -04. All of the lots depicted on the Final Plat meet the bulk and area requirements
stipulated the Owasso Zoning Code and in OPUD 16 -04.
Per the Owasso Subdivision Regulations, the applicant has one (1) year to secure City Council
approval of a Final Plat once a Preliminary Plat is approved; if they fail to secure approval of a
Final Plat within one (1) year, the Preliminary Plat expires and becomes null and void. The
applicant did not secure approval of this proposed Final Plat within the allowable timeframe,
and therefore voided their Preliminary Plat. Because of this, the Preliminary Plat for this subdivision
will be reconsidered by the Owasso Planning Commission at their regular meeting on March 8,
2021. The proposed Final Flat, if recommended for approval by the Owasso Planning
Commission, would then be presented to City Council for consideration and action at their
regular meeting on March 16, 2021.
Access for the subdivision will be from East 76th Street North, via a proposed drive. There are a
number of stub roads shown on the Plat, that the applicant intends to use to connect to the
future second phase of the Presley Hollow neighborhood.
The Final Plat proposes six (6) reserve areas. Reserve Area "A" is situated in the northwestern
portion of the subject property, where the applicant intends to construct the gated community
portion of the development. This reserve area encompasses all of the private roads within the
subdivision, meant to serve the gated portion of the subject property. Reserve Areas "B ", "C ",
"D ", "E ", and "F" are located throughout the subject property, and will serve as stormwater
detention facilities and space for amenities such as open space, walking trails, and a
community gathering space.
The Final Plat provides all the necessary perimeter utility easements to service the proposed
development. The City of Owasso will provide police, fire, ambulance and sanitary sewer
services to the property. Water service will be provided by Rogers County Rural Water District
#3. Any development that occurs on the subject property shall adhere to all development,
zoning, and engineering requirements of the City of Owasso.

BACKGROUND:
The City of Owasso received an application for review and approval of the closing of two (2) utility
easements located and described as follows:
CLOSURE OF A PORTION OF A 17.5' UTILITY EASEMENT
A total of 2,298 square feet of the south 7.5' of the platted 17.5' utility easement on Lot One (1),
Block One (1), Owasso Medical Campus.
CLOSURE OF A PORTION OF A 17.5' UTILITY EASEMENT
A total of 6,878.5 square feet of the south 7.5' of the platted 17.5' utility easement on Lot One (1),
Block Two (2), Owasso Medical Campus.
The subject easements are located on property just north of Lowe's Home Improvement located at
12001 East 96th Street North and just south of the Bailey Ranch Estates II subdivision. The subject
property was platted as Lot One (1), Block One (1) and Lot One (1), Block Two (2) Owasso Medical
Campus in 2005. The subject easements are owned by Washington County Rural Water District
(RWD) #3, and were filed via separate instrument (BK 6541, PG 1560). The applicant has provided
Staff with a letter of agreement from Washington County Rural Water District #3, acknowledging
that their Board of Directors consents to these two subject easement closures. The closure requests
are being brought forth for consideration by the City Council because the Owasso Medical Campus
final plat was approved by the City Council on October 19, 2004.
The applicant intends to construct what will be called "Reunion at Owasso," a multi- family housing
facility, with accessory storage garages. The proposed garages would partially encroach on the
two subject easements and as such, the applicant seeks to close the two subject easements.
According to the Alta survey, there are no active lines within this easement. Because the two
easements are empty, the applicant has determined that these easements are unnecessary or
redundant and no longer needed.
All required notices were sent to all franchise holders and utility companies. The City of Owasso
Public Works Department was also contacted regarding the closing of the portion of the easement
and indicated there should be no impacts to future utilities. No other utilities appear to be affected
by the closing of this portion of the easement. No utility companies had an issue with the proposed
closing of the easement.
Upon City Council action to close an easement, the applicant is advised to take the item to District
Court and file for vacation of the easements, which will completely remove them from the books.

TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee reviewed the request at their February 17, 2021, meeting. No
comments or concerns regarding negative impacts to utilities were expressed at the meeting.
PROPOSED ACTION:
An item has been placed on the March 9, 2021, Worksession agenda for discussion.

ANALYSIS:
The property is currently zoned AG in Tulsa County, and is contiguous with City limits on the
northern and eastern boundaries of the property. The applicant is requesting the property be
assigned the CS zoning designation upon annexation, via a concurrent rezoning request (OZ 21-
01). Typically, property is annexed either under Agriculture (AG) zoning or as the County's
corresponding zoning designation under the Owasso Zoning Code. However, an applicant may
request an alternate zoning be applied if said zoning corresponds to the Land Use Master Plan
and is advertised in accordance with statutory requirements. In this case, the GrOwasso 2030

Land Use Master Plan identifies the subject property for future Commercial land uses. Therefore,
assigning a zoning of CS to the property upon annexation is appropriate.
The subject property is currently undeveloped and unplatted. The applicant intends to plat this
property as three (3) separate lots. The western -most lot will remain undeveloped until such a
time when it can be marketed for sale. The applicant intends to construct a mixed -use office
building on the middle lot, consisting of a realty office, title office, and medical office. Finally, the
applicant intends to sell the eastern -most lot to a commercial developer. These proposed future
uses are consistent with the GrOwasso 2030 Land Use Master Plan, as the plan calls out the
subject property for future Commercial uses. The property lies at the intersection of a major
heavily traveled highway and arterial street making it well suited for future Commercial
development.
The subject property is part of the Glenn -Mur Special District, a special area called out for future
annexation and commercial development on the GrOwasso 2030 Land Use Master Plan.
According to the Plan, property in the Glenn -Mur Special District must be at least 9.2 acres in size
to be annexed in to the City; this rule was introduced to prevent piecemeal annexation and
development within the existing rural residential neighborhood. However, since the subject
property is located at the hard corner of East 106th Street North and US Highway 169 an
exception to this minimum acreage requirement is allowed per the Land Use Master Plan. As
such, this annexation request is in harmony with the vision for this special district as prescribed in
the GrOwasso 2030 Land Use Master Plan.
The City of Owasso will provide police, fire, ambulance and sanitary sewer services to the property
upon annexation. Washington County Rural Water District #3 will provide water services to this
property. Any future development that occurs on the subject property must adhere to all
Owasso subdivision, zoning, and engineering requirements.
PLANNING COMMISSION:
The Owasso Planning Commission will consider this item at their regular meeting on March 8,
2021.

ANALYSIS:
The subject property is presently owned by First Assembly Church and formally contained a small
residence. The location of the residence had an underlying zoning of AG, which was likely the
original zoning of this property before it began to develop. Because of this, the subject property
is comprised of two zonings: CS and AG. The applicant is requesting to rezone a larger portion
of the lot (0.7234 acres) to the CS district designation to ensure there are not gaps in the zoning
and to unify the property under one zoning district. The property is proposed to be developed

BACKGROUND:
The City provides water, sewer, refuse, recycling, and stormwater management services to
residents. In 2016, the Owasso Public Works Authority (OPWA) implemented a five -year rate plan
to address the following:
• Depletion of the OPWA and Stormwater fund balances
• Rising operational costs
• Funding for necessary capital infrastructure including an upgrade of the
wastewater treatment plant
• Oklahoma Water Resources Board (OWRB) debt requirements
In conjunction with approval of the five -year rate plan, the City Council requested City staff
perform an annual review of the five -year rate plan to evaluate progress in achieving a
balanced budget to comply with City Ordinance and OWRB debt requirements.
The results of the comprehensive review of utility operations will be presented at the March
Worksession.
CITY MANAGER CONTRACT AND EVALUATION PROCESS:
In June 2019, the City Council and the City Manager entered into a two year contract,
continuing Mr. Lehr's position as City Manager, a position he has held since 2014. Based on the
importance of an annual review the City Council has an established practice of providing the
City Manager an annual evaluation in conjunction with contract renewal discussions. The
annual evaluation process that has been used in the past includes the following:
• An anonymous online evaluation completed by the Directors, with a corresponding self -
assessment completed by the City Manager.
• An online evaluation completed by the City Council, with a corresponding self -
assessment completed by the City Manager.
• A self - evaluation completed by the City Manager addressing current goals, future goals,
obstacles, and achievements.
TIMELINE
Staff will initiate the online evaluation process in March and schedule an Executive Session to
discuss the evaluation and contract renewal with the City Manager during the May 11, 202,1
Worksession. Prior to the May Executive Session, the City Council will receive the results from the
Directors and City Council online evaluations along with the average comparisons to the City
Manager's self- assessment. The City Council will receive the City Manager's self - evaluation
addressing goals and accomplishments during the Executive Session discussion.
Mr. Lehr's current contract expires June 30, 2021. This timing would allow City Council the
opportunity to discuss a contract renewal prior to June 30.

SUBJECT: Proposed amendments to the Comprehensive Master Rate and Fee Schedule

BACKGROUND:
Resolution 2020 -01, approved by the City Council during the January 4, 2020 meeting, established
the 2020 Master Schedule for the various rates and fees charged to customers for services
provided by the City and its Trust Authorities. This comprehensive fee schedule is aimed to clarify
information for customers and provide a single vehicle to amend rates and fees in future years.
Staff has completed an annual review of the rates and fees. The following amendments to the
current fee schedule are being proposed. Proposed fee changes generally fall into three
categories:
Fee increase or decrease - Existing fees that are recommended to be increased or
changed;
New related fees - Fees that are related or similar to existing fees, but would change or
restructure those charges or would be a new charge for services; and
Completely new fees - New fees for services that have previously been free or
unregulated.
PROPOSED AMENDMENTS:
The Fire Department has a review and inspection fee under Building Services. The Department is
proposing to decrease the base rate of the plan review fee, change the existing fee criteria, and
add new fees related to Fire Department inspections. Following a review of the fees charged by
surrounding cities, the Department noted that each fee schedule varies, making it difficult for side
by side comparison. In their review, Chief Hurst identified the current fee structure for Fire
Alarm /Sprinkler fee was established during a time of significant new commercial growth using a
building's square footage, and does not take into account a commercial remodel of a smaller
portion of the same building. Additionally, Chief Hurst identified various inspections being
performed without an associated fee.
To make the Fire Alarm /Sprinkler inspection fee more equitable for smaller remodel projects, the
Department is proposing to decrease the base fee from $300.00 to $50.00, and charge the current
$.02 per square foot across the board, eliminating the "greater than 15,000 sq. ft." criteria.
Additionally, the following new related fees are proposed:
• Commercial Kitchen Hood - plans are submitted to the Fire Department for review and
an inspection is made to ensure the equipment is installed per the plans. Proposed
$35.00 base fee and $30.00 per re- inspection
