C. Authorization to submit a request to the Tulsa County Vision Authority to amend the
Vision 2025 Capital Improvement Agreements for the Community Center Outdoor
Classroom and Gathering Area Project and Owasso Events Facilities - Sports Park
Project #2 by extending the expiration term for each agreement to November 1,
2022
D. Authorization for the Mayor to execute a Temporary Road Easement located within
the northern portion of 11610 North 137th East Avenue, granting access for
municipal use

Staff recommends approval to purchase a Ford Transit T -250 Cargo Van, from John Vance
Fleet Services, of Guthrie, Oklahoma, utilizing the State of Oklahoma's approved contract SW
035, and authorization for payment in an amount not to exceed $31,122.00.

9. Consideration and appropriate action relating to Ordinance 1175, closing to the public use
two utility easements located in the Owasso Medical Campus Plat, more specifically, just north
of 12001 East 961h Street North and just south of the Bailey Ranch Estates 11 subdivision

10. Consideration and appropriate action relating to Ordinance 1176, approving the annexation
(OA 21 -01) of approximately 4.19 acres, located at the southwest corner of East 106th Street
North and US Highway 169, and approving the rezoning (OZ 21 -01) of said property from
Agriculture (AG) to Commercial Shopping (CS)

11. Consideration and appropriate action relating to a Final Plat for property located on the north

MINUTES OF REGULAR MEETING
Tuesday, March 2, 2021
The Owasso City Council met in regular session on Tuesday, March 2, 2021, in the Council
Chambers at Old Central, 109 North Birch, Owasso, Oklahoma per the Notice of Public Meeting
filed Friday, December 11, 2020; and the Agenda filed in the office of the City Clerk and posted
at City Hall, 200 South Main Street, at 6:00 pm on Friday, February 26, 2021.

4. Consideration and appropriate action relating to items removed from the Consent Agenda

5. Consideration and appropriate action relating to an amendment to the construction contract
between Crossland Heavy Contractors Inc, and the Owasso Public Works Authority for the
Wastewater Treatment Plant and Main Plant Lift Station Expansion Project
Roger Stevens presented the item, recommending to amend the construction contract by
adding the City of Owasso as a third party and authorization to execute the necessary
documents.
There were no comments from the audience. Mr. Bonebrake moved, seconded by Mr. Dunn
to amend the contract and authorize execution of the documents, as recommended.

Julie Lombardi presented the item, recommending the City Council enter into executive
session.
Mr. Bonebrake moved, seconded by Mr. Kelley to enter into executive session, as
recommended.

At 7:19 pm, the City Council, along with Chris Garrett and Julie Lombardi, entered into
executive session. At 7:32 pm, the City Council returned to open session.
11. Consideration and appropriate action relating to the payment of court ordered fees in the
amount of $129,500.00 to Christopher Camp, Attorney, resulting from litigation styled, Patrick
D. Ross vs. City of Owasso, CV- 2013 -00898
Julie Lombardi presented the item, recommending to approve payment of court ordered
fees in the amount of $129,500.00, and authorization to sign an agreed order by the court
reflecting the same.
There were no comments from the audience. Mr. Kelley moved, seconded by Mr. Dunn to
approve the payment of fees and authorize signature of the agreed order, as
recommended.

Michele Dempster presented the item and discussion was held. It was further explained this

Warren Lehr introduced Linda Jones to present item A. Mr. Lehr reported Bailey Medical Center
and St. John Owasso were recently listed in a nationwide ranking of Best Maternity Hospitals,
and commented on Owasso Fire Department staffing.

Mr. Bonebrake and Mr. Bush commented on attending a Purple Heart Ceremony recently held
at the 138th Fighter Wing in Tulsa, Oklahoma.

BACKGROUND:
Vision 2025 funds are allocated for the Owasso Community Center Project and the Owasso
Events Facilities, Sports Park Project #2, through Capital Improvements Agreements (CIA)
between the City of Owasso and the Tulsa County Board of Commissioners, with oversight given
to the Tulsa County Vision Authority. Capital Improvements Agreements with Tulsa County are
required for each project in order to receive reimbursement through the sales tax collected as
part of the Vision 2025 initiative.
The current CIA's for the Owasso Community Center Project and the Owasso Events Facilities,
Sports Park Project #2 are set to expire November 1, 2021, and staff is seeking authorization for
the City Manager to request an extension of time in which pay advances cease and for
completion of each project to November 1, 2022.
If the extension is approved by the Tulsa County Vision Authority, an amended CIA will be
submitted to the City Council and the Tulsa County Board of Commissioners for consideration
and action.
RECOMMENDATION:
Staff recommends authorization for the City Manager to execute a letter requesting the Tulsa
County Vision Authority amend the following Capital Improvements Agreements:
• Owasso Community Center- extend the term to November 1, 2022
• Owasso Events Facilities, Sports Park Project #2- extend the term to November 1, 2022

The City of Owasso is requesting an updated Capital Improvements Agreement (CIA) for Vision
2025 funding available under Sub -Fund #29. The Recital of the CIA calls for these funds to be
used for "Capital Improvements for Community Enrichment within Tulsa County, Oklahoma."
The funds for Project A, Owasso Community Center Project, were originally allocated to the City
with a Capital Improvements Agreement dated April 30, 2004 in the amount of $1,000,000.00,
with a 5% retainage of $50,000.00. There were four individual projects to be paid for by these
funds, including replacement of the heating and air conditioning units in the Community Center.
All of the projects were completed between 2004 and 2006 for a combined cost of $948,668.77,
leaving $51,331.23 for the City of Owasso to spend on an additional project.
In 2018, the Community Center Outdoor Classroom and Gathering Area Project was approved
with an estimated cost of $57,031.23, of which the city will subsidize $5,700.00, with funds from the
City General Fund.
In order to fully expend the $51,331.23 allocated under the CIA for the Community Center
Outdoor Classroom and Gathering Area Project, the City of Owasso requests an amended CIA
to extend additional time for the reimbursement of the remaining $51,331.23 to November 1,
2022.

The outdoor amenity at the Community Center is an outdoor patio contiguous to the current
facility. Beginning at the northeast corner of the facility, it will wrap around the corner and
extend down the east exterior wall.
What is the primary goal of the proposed project? The project will provide an outdoor space
to host classes, events and meetings, as well as for individuals and groups of people to
gather or have lunch. The Owasso senior population (Owasso Golden Agers), and four
different veteran groups currently consider the Community Center their home location and
will greatly utilize this amenity. Our desire is to incorporate elements of nature through plants
and trees throughout allowing the space to feel open yet secure with railing and fencing.
Furniture pieces will include durable round table seating that can be easily moved for access
or provide additional space.
Describe any matching funds that will be part of this project: The City of Owasso General
Fund will subsidize the additional monies required to complete the project

Sustainability - Vision 2025 funds may only be utilized for capital items. Are there funds
available other than Vision 2025 for maintenance and operations? Yes
If so, what is the source of those funds? The City of Owasso General Fund
What is the intended public benefit of the proposed project? The Project will be a source of
positive benefit for the City of Owasso as an additional gathering place option. It will
strengthen the current City partnerships with the various groups that regularly use the
Community Center, an may increase the number of partnerships resulting in increased
volunteer support, program and resource development and future investments as a result of
those relationships. An outdoor amenity will also enhance the property values for the
Redbud District of Owasso in addition to an increased property value for the Community
Center.
Is there any additional information about the proposed project you would like to provide? As
with any capital improvement to public property, our hope is that this advancement will be
attractive to homebuyers and workers. In addition to the current senior population in and
around the Owasso Community, enhancement of the Community Center will also attract new
retirees since the location is also the gathering site for seniors in Owasso. New seniors /retirees
will increase the tax base of the community while using fewer services; for example, paying
taxes to the school district but not sending kids to attend.

6, 2016, in the amount of $2,496,320.00, then amended to reduce the funding by $347,115.00
and written into a separate CIA for the Sports Park Lighting, leaving $2,149,205.00 for the
following improvements: construction of new parking lots, roadways and paving of existing
gravel parking lots for the Sports Park, including grading, stormwater drainage, utility installation
and lighting, and additional features to tie to future trail heads affiliated with a 5K Trail
throughout the Sport Park.
In 2018, the CIA was further amended by Tulsa County Vision Authority and approved by City
Council to include additional improvements allowed for reimbursement of the $2,149,205.00.
These additional improvements included additional fields and amenities, various shade
structures, and fencing for an enhanced event facility to attract tournaments to the Owasso
Sports Park.
As of March 16, 2021, the City of Owasso has $944,288.48 in unspent Vision 2025 funds for the
Owasso Sports Park. In order to fully expend the $2,149,205.00 allocated under the CIA, the City
of Owasso requests an amended CIA to extend additional time for the reimbursement of the
remaining $944,288.48 until November 1, 2022.
The additional improvements will exceed the amount allocated under the CIA by approximately
$55,000.00 and will be subsidized by an alternate funding source of the City. The City of Owasso
requests that the Tulsa County Vision Authority authorize an updated CIA for Sub -Fund H -9, to
extend additional time for the reimbursement for Owasso Events Facilities - Sports Park Project
#2.

SUBJECT: Execution of a Temporary Road Easement- Lissau Landing

BACKGROUND:
As part of the development of the Lissau Landing property, there are several easements
needing to be filed to facilitate the development of the new Warren Clinic. One such easement
is a temporary road easement on the north portion of the internal service road (North 137th East
Avenue). A temporary cul -de -sac will be built at this location until such time as the road is
extended to the north. As such, a temporary road easement instrument needs to be executed
to allow the encroachment on the adjoining properties to the east and west of the road. When
North 1371h East Avenue is eventually extended north, these easements will no longer be
necessary.
RECOMMENDATION:
Staff recommends authorization for the Mayor to execute the temporary road easement
granting access for municipal use.

A budget amendment for Fund 77 General Liability /Property Self- Insurance Fund.
BACKGROUND:
The General Liability /Property Self- Insurance Fund (Fund 77) is used to account for the fees paid
to self - insure for general liability, property and vehicle collision risk. The General Liability /Property
Self- Insurance Fund is financed through billings to the General Fund and Owasso Public Works
Authority.
On March 2, 2021, City Council approved the payment of court ordered fees in the amount of
$129,500 to Christopher Camp, Attorney, resulting from litigation styled, Patrick D. Ross vs. City of
Owasso, CV -2013- 00898. This amount was paid from the General Liability /Property Self- Insurance
Fund. The final order, which necessitated payment of attorney fees, was received by the
appellate court after the 2020 -2021 budget was submitted and it is now necessary to request an
increase in revenues and expenses, in the amount of $129,500.
RECOMMENDATION:
Staff recommends approval of a budget amendment in the General Liability /Property Self -
Insurance Fund, increasing the estimated revenues by $129,500 and increasing the
appropriation for expenditures by $129,500.

SUBJECT: Emergency Medical Services (EMS) Supply Van Purchase

PROPOSED PROJECT:
Staff is proposing the purchase of an EMS Supply Van, utilizing the State of Oklahoma's
approved contract list.
BACKGROUND:
In 2020, the Owasso Fire Department responded to a total of 4,872 EMS related calls. The
majority of these calls require usage of medical supplies and /or medications. Stations #1, #2
and #3 each have a small EMS stock room and are resupplied throughout week from the main
supply room by the EMS Manager, which is housed at Station #4. All EMS supplies are ordered,
commonly in bulk, shipped to Station #4, and are inventoried, organized and packaged for
distribution to the outlaying stations. Currently, staff utilizes a support vehicle, if available, and
the packaged supplies are then driven to each individual station for resupply, several times per
week, sometimes several times per day. This same support vehicle can also be used for
transportation to and from training classes, meetings for other admin personnel or as a reserve
vehicle for the Battalion Chiefs. If it is not readily available to the EMS Manager, he /she is forced
to delay the distribution of supplies.
Staff is requesting the purchase of a dedicated EMS supply van to house and distribute vital
inventory to the outlaying stations. In addition, the van will stock spare equipment (monitor,
ventilator, auto - pulse, cot, etc.) and other commonly used items for distribution as needed. It is
intended that the addition of this apparatus will increase efficiency in the EMS supply distribution,
and therefore decrease the frequency that trips are made to each station, each day.
Staff conducted research to determine the type /size of van, and associated implements
necessary to meet the requirements of the department, and a list of criteria was developed.
BIDDING:
Staff reviewed the State of Oklahoma's approved contract list. Based upon the state list, staff
contacted Bill Knight Ford in Tulsa, and John Vance Fleet in Guthrie, to provide comparison price
quotes.

The subject easements are located on property just north of Lowe's Home Improvement located at
12001 East 96th Street North and just south of the Bailey Ranch Estates II subdivision. The subject
property was platted as Lot One (1), Block One (1) and Lot One (1), Block Two (2) Owasso Medical
Campus in 2005. The subject easements are owned by Washington County Rural Water District
(RWD) #3, and were filed via separate instrument (BK 6541, PG 1560). The applicant has provided
Staff with a letter of agreement from Washington County Rural Water District #3, acknowledging
that their Board of Directors consents to these two subject easement closures. The closure requests
are being brought forth for consideration by the City Council because the Owasso Medical Campus
final plat was approved by the City Council on October 19, 2004.
The applicant intends to construct what will be called "Reunion at Owasso," a multi - family housing
facility, with accessory storage garages. The proposed garages would partially encroach on the
two subject easements and as such, the applicant seeks to close the two subject easements.
According to the Alta survey, there are no active lines within this easement. Because the two
easements are empty, the applicant has determined that these easements are unnecessary or
redundant and no longer needed.
All required notices were sent to all franchise holders and utility companies. The City of Owasso
Public Works Department was also contacted regarding the closing of the portion of the easement
and indicated there should be no impact to future utilities. No other utilities appear to be affected
by the closing of this portion of each easement. No utility companies had an issue with the
proposed closing of the easements.
Upon City Council action to close an easement, the applicant is advised to take the item to District
Court and file for vacation of the easements, which will completely remove them from the books.

comments or concerns regarding negative impacts to utilities were expressed at the meeting.

ANALYSIS:
The property is currently zoned AG in Tulsa County, . and is contiguous with City limits on the
northern and eastern boundaries of the property. The applicant is requesting the property be
assigned the CS zoning designation upon annexation, via a concurrent rezoning request (OZ 21-
01). Typically, property is annexed either under Agriculture (AG) zoning or as the County's
corresponding zoning designation under the Owasso Zoning Code. However, an applicant may
request an alternate zoning be applied if said zoning corresponds to the Land Use Master Plan
and is advertised in accordance with statutory requirements. In this case, the GrOwasso 2030

Land Use Master Plan identifies the subject property for future Commercial land uses. Therefore,
assigning a zoning of CS to the property upon annexation is appropriate.
The subject property is currently undeveloped and unplatted. The applicant intends to plat this
property as three (3) separate lots. The western -most lot will remain undeveloped until such a
time when it can be marketed for sale. The applicant intends to construct a mixed -use office
building on the middle lot, consisting of a realty office, title office, and medical office. Finally, the
applicant intends to sell the eastern -most lot to a commercial developer. These proposed future
uses are consistent with the GrOwasso 2030 Land Use Master Plan, as the plan calls out the
subject property for future Commercial uses. The property lies at the intersection of a major
heavily traveled highway and arterial street making it well suited for future Commercial
development.
The subject property is part of the Glenn -Mur Special District, a special area called out for future
annexation and commercial development on the GrOwasso 2030 Land Use Master Plan.
According to the Plan, property in the Glenn -Mur Special District must be at least 9.2 acres in size
to be annexed in to the City; this rule was introduced to prevent piecemeal annexation and
development within the existing rural residential neighborhood. However, since the subject
property is located at the hard corner of East 106th Street North and US Highway 169 an
exception to this minimum acreage requirement is allowed per the Land Use Master Plan. As
such, this annexation request is in harmony with the vision for this special district as prescribed in
the GrOwasso 2030 Land Use Master Plan.
The City of Owasso will provide police, fire, ambulance and sanitary sewer services to the property
upon annexation. Washington County Rural Water District #3 will provide water services to this
property. Any future development that occurs on the subject property must adhere to all
Owasso subdivision, zoning, and engineering requirements.
PLANNING COMMISSION:
The Owasso Planning Commission voted 5 -0 to recommend approval of annexation request OA
21 -01 and accompanying rezoning request OZ 21 -01, at their regular meeting on March 8, 2021.
RECOMMENDATION:
Staff recommends adoption of Ordinance 1176.

Final Plat- Presley Hollow
ANALYSIS:
The proposed Final Plat for Presley Hollow consists of one hundred ninety -seven (197) lots on
twelve (12) blocks and is proposed to be the first of two phases for the Presley Hollow
neighborhood. The applicant is proposing the construction of single - family homes, some of
which will be part of a gated community. The underlying zoning for the property is RS -3, under
OPUD 16 -04. All of the lots depicted on the Final Plat meet the bulk and area requirements
stipulated the Owasso Zoning Code and in OPUD 16 -04.
Per the Owasso Subdivision Regulations, the applicant has one (1) year to secure City Council
approval of a Final Plat once a Preliminary Plat is approved; if they fail to secure approval of a
Final Plat within one (1) year, the Preliminary Plat expires and becomes null and void. The
applicant did not secure approval of this proposed Final Plat within the allowable timeframe,
and therefore voided their Preliminary Plat. Because of this, the Preliminary Plat for this subdivision
was reconsidered and approved by the Owasso Planning Commission at their regular meeting
on March 8, 2021.
Access for the subdivision will be from East 76th Street North, via a proposed drive. There are a
number of stub roads shown on the Plat, that the applicant intends to use to connect to the
future second phase of the Presley Hollow neighborhood.
The Final Plat proposes six (6) reserve areas. Reserve Area "A" is situated in the northwestern
portion of the subject property, where the applicant intends to construct the gated community
portion of the development. This reserve area encompasses all of the private roads within the
subdivision, meant to serve the gated portion of the subject property. Reserve Areas "B ", "C",
"D ", "E ", and "F" are located throughout the subject property, and will serve as stormwater
detention facilities and space for amenities such as open space, walking trails, and a
community gathering space.

The subject property is presently owned by First Assembly Church and formally contained a small
residence. The location of the residence had an underlying zoning of AG, which was likely the
original zoning of this property before it began to develop. Because of this, the subject property
is comprised of two zonings: CS and AG. The applicant is requesting to rezone a larger portion

SUBJECT: Resolution 2021 -04, Project Application Community Development Block Grant
(CDBG 2021)

BACKGROUND:
The primary objective of the national Community Development Block Grant (CDBG) Program is the
"development of viable urban communities by providing decent housing and a suitable living
environment, particularly for persons of low and moderate incomes." All project proposals
submitted for funding through the CDBG Program must document the achievement of at least one
(1) of the following national objectives:
• Provide benefit to low and moderate income persons;
• Aid in the prevention or elimination of slums or blight; and
• Meet other community development needs having particular urgency or posing a serious or
immediate threat to the health or welfare of a community.
ANTICIPATED FUNDING:
On February 9, 2021, the Indian Nation Council of Governments ( INCOG), provided information
regarding the 2021 CDBG application. A completed application, which includes a public hearing,
resolution, and cooperation agreement, is due to INCOG no later than April 2, 2021. Owasso is now
part of an Urban County and as such does not compete for the funding through the State
Department of Commerce. According to INCOG, Owasso will receive an allocation of
approximately $148,601.11 for the 2021 CDBG funding cycle, which does not require a local match.
PAST CDBG PROJECTS:
In the past, Owasso has utilized CDBG monies for sidewalk, sanitary sewer, street, and park
improvements. In 2014, the U.S. Department of Housing and Urban Development (HUD) changed
the income limits that determined if individuals and families qualified as a low to moderate income
household. As a result, Owasso lost much of its former qualifying area in and around the original
town area, leaving only a small area around the Baptist Village neighborhood eligible for funding.
Owasso staff performed income surveys for smaller targeted geographic areas in the summer of
2015, qualifying the Hale Acres neighborhood near North Garnett Road and East l 16th Street North
for a five (5) year period. Since the Hale Acres neighborhood qualified for funding under the revised
HUD income limits, the City has utilized CDBG funds from the FY 2016 through FY 2020 allocations for
replacement of sanitary sewer lines in this neighborhood.
EXPIRATION OF QUALIFIED AREA:
Because the five (5) year qualifying period has expired for the Hale Acres neighborhood, it is
necessary to requalify the neighborhood in order to continue using CDBG funds in this location. In
October 2020, INCOG assisted with this effort by mailing out 175 surveys to Hale Acres residents, of
which 150 are needed for a statistically valid survey. This effort resulted in 40 surveys being returned
or a 26.66% response rate, for short of the needed 150 surveys.

In January 2021, no additional surveys had been received and staff made the decision to send out
another round of surveys to Hale Acres residents using City of Owasso letterhead. Additionally, the
Owasso Strong Neighborhood Initiative (OSNI) Coordinator, Jerry Fowler, communicated with local
neighborhood leaders to help explain the purpose of the survey. Notices of this second survey
were placed on Nextdoor and the City's web page. This effort resulted in 87 surveys being returned
as of March 2, 2021.
On March 6, 2021, staff conducted a door to door survey in the Hale Acres neighborhood in an
attempt to collect the remaining surveys. This effort resulted in an additional 57 being collected,
which brings the overall total to 146, which is 4 short of the 150 need. During the week of March 7,
staff returned to the neighborhood and collected the remaining signatures meeting the minimum
number required. Initial calculations of the surveys indicate the low to moderate income threshold
has been met with 152 total surveys received of which 46 (32 %) were above the low to moderate
income threshold with 146 (68 %) below.
PROPOSED 2021 PROJECT:
Considering the Hale Acres neighborhood appears to be requalified, the proposed project for
the 2021 CDBG funds is the continuation of replacing deteriorated 8" clay the sanitary sewer
pipes. Specifically, this project will replace the existing north -south sewer lines on the south side
of East 114th Street North and should represent the last of the sewer line work in the
neighborhood. The existing 8" clay pipe would be replaced with approximately 1,800 linear feet
(LF) new HDPE 8" inch pipe.
The work, considered Phase IV of the Hale Acres sewer improvements, would continue to
address many years of inflow and infiltration issues in this area of Owasso's collection system,
which was originally installed in the 1960's. The project would be designed in -house by the
Engineering Division of Public Works. A map has been provided with this memo indicating the
general location of the proposed improvements.
Considering the above, staff suggests continuing to utilize the funds for replacement of the sanitary
sewer lines in Hale Acres. This sanitary sewer project should be the last of the sewer work in this
area, and then stormwater work can begin.
PUBLIC HEARING:
On March 9, INCOG informed staff that a separate Public Hearing was required. Staff advertised
the public meeting to be held Monday, March 15, at 4 PM at Old Central in order to receive citizen
input on potential CDBG projects.
RECOMMENDATION:
Staff recommends approval of Resolution 2021 -04, requesting assistance from the Tulsa County
CDBG Urban County Program, approving an application for the 2021 funding cycle, and
authorization to execute all related documents.

WHEREAS, the Housing and Community Development Act of 1974, as amended (24 U.S.C.
93 -383 et seq.), (the "Act'), provides that Community Development Block Grant, ( "CDBG'), funds
may be used for the support of activities that provide decent housing and suitable living
environments and expanded economic opportunities principally for persons of low- and moderate -
income; and,
WHEREAS, CDBG Regulations 24 CFR 570.307(a) allow counties having a total combined
population of 200,000 or more from the unincorporated areas and participating incorporated areas
to qualify as an urban county; and,
WHEREAS, Title I of the Housing and Community Development Act of 1974, Public Law 93 -383, as
amended, authorized the Secretary of Housing and Urban Development, as a representative of the
United States of America, to grant to Tulsa County funds and administrative responsibility for the Tulsa
County CDBG Urban County program; and
WHEREAS, a Cooperation Agreement between Tulsa County and the City has been executed for the
purpose of participation in the Tulsa County Urban County Community Development Block Grant
Program for Federal Fiscal Years 2020 -2022; and,
NOW THEREFORE, BE IT RESOLVED by the Owasso City Council that the City of Owasso desires to
obtain assistance in addressing community development needs and hereby requests the Tulsa County
CDBG Urban County program to provide assistance.
NOW THEREFORE, BE IT FURTHER RESOLVED by the Owasso City Council that the City of
Owasso affirms its commitment to take all action within its power to facilitate the receipt of the
assistance of community development funds, and upon receipt to administer said grant by the rules
and regulations established by the United States of America, the State of Oklahoma, Tulsa County and
all empowered agencies thereof.

The CDBG program is authorized under Title I of the Housing and Community
Development Act of 1974, as amended.
The purpose of this Application Guidance is to provide assistance in preparing a
Community Development Block Grant application for the FY2021 Tulsa County
CDBG Urban County Program.

The proposed project will be a continuation of the replacement of deteriorated 8" clay
tile sanitary sewer pipes. Specifically, this project will replace the existing north -south
sewer lines on the south side of East 114th Street North and should represent the last of the
sewer line work in the neighborhood. The existing 8" clay pipe will be replaced with
approximately 1,800 linear feet (LF) new HDPE 8" inch pipe.
The work, which will be considered Phase IV of the Hale Acres sewer improvements, will
continue to address many years of inflow and infiltration issues in this area of Owasso's
collection system that was originally installed in the 1960s. The project will be designed in-
house by the Engineering Division of Public Works. A map has been provided with this
memo indicating the general location of the proposed improvements.

BACKGROUND:
Elm Creek Park was deeded to the City in October of 1979, by Elm Creek Inc. This park has
served as a popular recreation area for over forty years. There are two parking lots that serve
the park, one on the west side and one on the south side. The parking lot on the south side of
the park is undersized and poorly configured. As such, the Recreation and Culture Department
requested that City Engineering staff look into options for expanding the parking.
Staff began survey and design of the project in September of 2020. Design was completed in
January 2021, with an estimate of $83,393.25 for the base project, and an additional $12900.00
for the additive alternate. The base project consists of expanding the existing parking lot,
modifying the existing entry drive, and repairing a failed portion of the parking lot. The additive
alternate includes a mill and asphalt overlay of the existing parking lot to strengthen the existing
paving and create a consistent surface.
SOLICITATION OF BIDS:
In January 2021, staff completed final bid documents and published advertisements in
accordance with state statutes. A mandatory pre -bid meeting was held on February 3, 2021,
and bids were opened on February 11, 2021, with nine contractors submitting bids.

Staff completed a Bid Tabulation, and Magnum Construction was determined to be the lowest
qualified bidder when the base bid and additive alternate are combined. The bid amount
provided by Magnum Construction is $114,095.00. As explained to the bidders during the bid
process, the low bid would be based off of the total base bid and the alternate combined,

FUNDING:
Funds are available in the Capital Improvement Fund.
RECOMMENDATION:
Staff recommends awarding the base bid and alternate to Magnum Construction, of Broken
Arrow, Oklahoma, in the amount of $114,095.00, and authorization to execute the necessary
documents.

SECTION 00300
AGREEMENT
THIS AGREEMENT is dated as of the 16" day of March. 2021, by and between The City of
Owasso, Owasso Oklahoma (hereinafter called OWNER) and Magnum Construction. Inc
(hereinafter called CONTRACTOR). OWNER and CONTRACTOR, in consideration of the
mutual covenants hereinafter set forth, agree as follows:
ARTICLE 1. WORK
CONTRACTOR shall complete all Work as specified or indicated in the Contract Documents.
The Work is generally described as follows:

CITY OF OWASSO, OKLAHOMA
The project for which the Work under the contract documents may be the whole or only a part, is
described as follows:
Grading, paving, and striping of a parking lot addition within Elm Creek Park. An additive
alternate will, if awarded, involve milling and overlaying the existingparking lot.
ARTICLE 2. ENGINEER
The project has been assigned to the Project Manager or his /her duly authorized representative,
who is hereinafter called ENGINEER and who will assume all duties and responsibilities and will
have the rights and authority assigned to ENGINEER in the Contract Documents in connection
with the completion of the Work in accordance with the Contract Documents.
ARTICLE 3. CONTRACT TIME
3.1 The Work will be substantially completed within Ninety (20) calendar days from the
date of Notice to Proceed; and completed and ready for final payment in accordance with the
General Conditions within One Hundred (100) calendar days from the date of Notice to Proceed,
which will be on or before
3.2 Liquidated Damages. OWNER and CONTRACTOR recognize that time is of the
essence of this Agreement and that OWNER will suffer financial loss if the Work is not
substantially complete within the time specified in paragraph 3.1 above, plus any extensions
thereof allowed in accordance with the General Conditions. They also recognize the delays,

expense and difficulties involved in proving in a legal or arbitration proceeding the actual loss
suffered by OWNER, if the Work is any such proof. OWNER and CONTRACTOR agree that as
liquidated damages for delay (but not as a penalty) CONTRACTOR shall pay OWNER FIVE
HUNDRED Dollars ($500.00) for each consecutive calendar day that expires after the time
specified in paragraph 3.1 for substantial completion until the Work is substantially complete.
After Substantial Completion, if CONTRACTOR shall neglect, refuse or fail to complete the
remaining Work within the time specified in paragraph 3.1 for completion and readiness for final
payment or any proper extension thereof granted by OWNER, CONTRACTOR shall pay OWNER
FIVE HUNDRED Dollars ($500.00) for each consecutive calendar day that expires after the time
specified in paragraph 3.1 for completion and readiness for final payment.
ARTICLE 4. CONTRACT PRICE
4.1 OWNER shall pay CONTRACTOR for performance of the Work in accordance with
the Contract Documents in current funds the amount agreed upon in CONTRACTOR'S bid.
4.2 CONTRACTOR understands that the estimated quantities are not guaranteed and that
the determination of actual quantities and their classification is to be made by the OWNER at the
time of application for payment.
4.3 CONTRACT AMOUNT: Contract Amount is One Hundred Fourteen Thousand,
Ninety Five_Dollars and No /100. ($114.095.00).
ARTICLE 5. PAYMENT PROCEDURES
CONTRACTOR shall submit Applications for Payment in accordance with the General
Conditions on the Pay Estimate Forms included as Exhibit "A" to this Agreement. Applications
for Payment will be processed by OWNER as provided in the General Conditions.
5.1 Progress Payments. OWNER shall make progress payments on account of the Contract
Price on the basis of CONTRACTOR's Applications for Payment in accordance with the City of
Owasso's Payment Schedule included as Exhibit "B" to this Agreement during construction as
provided below. All progress payments will be on the basis of the progress of the Work.
5. 1.1 Progress payments shall not exceed an amount equal to 95% of the WORK
completed until such time as CONTRACTOR shall complete in excess of fifty percent (50 0/0) of
the contract amount.
5.1.2 Upon completion in excess of fifty percent (50 %) of the total contract amount,
OWNER shall pay an amount sufficient to increase total payments to CONTRACTOR to 97.5%
of the Contract Price, less such amounts as OWNER shall determine in accordance with the
General Conditions, provided that OWNER has determined that satisfactory progress is being
made, and upon approval by the Surety.
5.2 Final Payment. Upon final completion and acceptance of the Work in accordance with
the General Conditions, OWNER shall pay the Contract Price.

ARTICLE 6. CONTRACTOR'S REPRESENTATIONS
In order to induce OWNER to enter into this Agreement, CONTRACTOR makes the following
representations:
6.1 CONTRACTOR has familiarized himself /herself with the nature and extent of
Contract Documents, Work, locality, and with all local conditions and federal, state and local laws,
ordinances, rules and regulations that in any manner may affect cost, progress or performance of
the Work.
6.2 CONTRACTOR has studied carefully all reports or explorations and tests of subsurface
conditions at or contiguous to the site and all drawings of physical conditions in or relating to
existing surface or subsurface structures at or contiguous to the site (except underground facilities)
which have been identified in the Supplementary Conditions as provided in the General
Conditions. Contractor accepts the determination set forth in the General Conditions of the extent
of the "technical data" contained in such reports and drawings upon which Contractor is entitled
to rely. Contractor acknowledges that such reports and drawings are not Contract Documents and
may not be complete for Contractor's purposes. Contractor acknowledges that Owner and
Engineer do not assume responsibility for the accuracy or completeness of information and data
shown or indicated in the Contract Documents with respect to underground facilities at or
continuous to the site. Contractor has obtained and carefully studied (or assume responsibility for
having done so) all such additional supplementary examinations, investigations, explorations,
tests, studies and data concerning conditions (surface, subsurface and underground facilities) at or
contiguous to the site or otherwise which may affect cost, progress, performance or furnishing of
the Work or which relate to any aspect of the means, methods, techniques, sequences and
procedures of construction to be employed by Contractor, and safety precautions and programs
incident thereto. Contractor does not consider that any additional examinations, investigations,
explorations, tests, studies, or data are necessary for the performance and furnishing of the Work
at the Contract Price, within the Contract Times and in accordance with the other terms and
conditions of the Contract Documents.
6.3 CONTRACTOR has made or caused to be made examinations, investigations, tests and
studies of such reports and related data in addition to those referred to in paragraph 6.2 as (s)he
deems necessary for the performance of the Work at the Contract price, within the Contract Time
and in accordance with the other terms and conditions of the Contract Documents; and no
additional examinations, investigations, tests, reports or similar data are or will be required by
CONTRACTOR for such purposes.
6.4 CONTRACTOR has reviewed and checked all information and data shown or indicated
on the Contract Documents with respect to existing Underground Facilities at or contiguous to the
site and assumes responsibility for the accurate location of said Underground Facilities. No
additional examinations, investigations, explorations, tests, reports, studies or similar information
or data in respect of said Underground Facilities are or will be required by CONTRACTOR in
order to perform and furnish the Work at the Contract Price within the Contract Time and in

accordance with the other terms and conditions of the Contract Documents, including the General
Conditions.
6.5 CONTRACTOR has correlated the results of all such observations, examinations,
investigations, tests, reports and data with the terms and conditions of the Contract Documents.
6.6 CONTRACTOR has given OWNER written notice of all conflicts, errors or
discrepancies that he has discovered in the Contract Documents, and the written resolution thereof
by OWNER is acceptable to CONTRACTOR.
6.7 CONTRACTOR has obligated himself/herself to the OWNER to be responsible for the
workmanship, labor and materials used in the project for one (1) year after the project has been
accepted by the OWNER.
6.8 CONTRACTOR understands that (s)he will be exempt from all sales tax on materials
and other items necessary for the completion of the project. The OWNER has issued him a
Certification of Tax Exempt Project enclosed as Exhibit "C" of this Agreement.
ARTICLE 7. CONTRACT DOCUMENTS
The Contract Documents which comprise the entire agreement between OWNER and
CONTRACTOR are attached to this Agreement, made a part hereof, and consist of the following:

8.1 Terms used in this Agreement which are defined in the General Conditions shall have
the meanings indicated in the General Conditions.
8.2 No assignment by a party hereto of any rights under or interests in the Contract
Documents will be binding on another party hereto without the written consent of the party sought
to be bound; and specifically, but without limitation, monies that may become due and monies that
are due may not be assigned without such consent (except to the extent that the effect of this
restriction may be limited by law) and unless specifically stated to the contrary in any written
consent to an assignment, no assignment will release or discharge the assignor from any duty or
responsibility under the Contract Documents.
8.3 OWNER and CONTRACTOR each binds himself/herself, his /her partners, successors,
assigns, and legal representatives to the other party hereto, his /her partners, successors, assigns
and legal representatives in respect to all covenants, agreements and obligations contained in the
Contract Documents.

8.3 The Agreement (or remaining portions thereof) should continue in effect, be valid and
binding upon both parties even if a provision or part of the Contract Documents should be held
void or unenforceable by law.

counterpart has been delivered to CONTRACTOR, the other belongs to OWNER. All portions of
the Contract Documents have been signed by OWNER and CONTRACTOR.

Enclosed is Permit No. SL000072210043 for the construction of 3,469 linear feet of eight (8) inch PVC
sanitary sewer line and all appurtenances to serve the Magnolia Ridge - Phase 2, Tulsa County, Oklahoma.
The project authorized by this permit should be constructed in accordance with the plans approved by this
Department on February 4, 2021. Any deviations from the approved plans and specifications affecting
capacity, flow or operation of units must be approved, in writing, by the Department before changes are
made.
Receipt of this permit should be noted in the minutes of the next regular meeting of the City of Owasso,
after which it should be made a matter of permanent record.
We are returning one (1) set of the approved plans to you, one (1) set to your engineer and retaining one
(1) set for our files.

Pursuant to O.S. 27A 2-6 -304, the City of Owasso is hereby granted this Tier I Permit to construct 3,469
linear feet of eight (8) inch PVC sanitary sewer line and all appurtenances to serve the Magnolia Ridge -
Phase 2, located in Section 23, T -21 -N, R -13 -E, Tulsa County, Oklahoma, in accordance with the plans
approved February 4, 2021.
By acceptance of this permit, the permittee agrees to operate and maintain the facilities in accordance with
the "Oklahoma Pollutant Discharge Elimination System Standards - OPDES" (OAC 252:606) rules and to
comply with the state certification laws, Title 59, Section 1101 -1116 O.S. and the rules and regulations
adopted thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.

That the recipient of the permit is responsible that the project receives supervision and inspection
by competent and qualified personnel.
That construction of all phases of the project will be started within one year of the date of approval
or the phases not under construction will be resubmitted for approval as a new project.
That no significant information necessary for a proper evaluation of the project has been omitted
or no invalid information has been presented in applying for the permit.
That wherever water and sewer lines are constructed with spacing of 10 feet or less, sanitary
protection will be provided in accordance with OAC 252:656- 5- 4(c)(3) of the standards for Water
Pollution Control Facility Construction.
That tests will be conducted as necessary to insure that the construction of the sewer lines will
prevent excessive infiltration and that the leakage will not exceed 10 gallons per inch of pipe
diameter per mile per day.
That the Oklahoma Department of Environmental Quality shall be kept informed of occurrences
which may affect the eventual performance of the works or that will unduly delay the progress of
the project.
That the permittee will take steps to assure that the connection of house services to the sewers is
done in such a manner that the functioning of the sewers will not be impaired and that earth and
ground water will be excluded from the sewers when the connection is completed.

8) That any deviations from approved plans or specifications affecting capacity, flow or operation of
units must be approved by the Department before any such deviations are made in the construction
of this project.
9) That the recipient of the permit is responsible for the continued operation and maintenance of these
facilities in accordance with rules and regulations adopted by the Environmental Quality Board, and
that this Department will be notified in writing of any sale or transfer of ownership of these facilities.
10) The issuance of this permit does not relieve the responsible parties of any obligations or liabilities
which the permittee may be under pursuant to prior enforcement action taken by the Department.
11) That the permittee is required to inform the developer /builder that a DEQ Storm Water Construction
Permit is required for a construction site that will disturb one (1) acre or more in accordance with
OPDES, 27A O.S. 2 -6 -201 et. seq. For information or a copy of the GENERAL PERMIT (OKR10)
FOR STORM WATER DISCHARGES FROM CONSTRUCTION ACTIVITIES, Notice of Intent
(NOI) form, Notice of Termination (NOT) form, or guidance on preparation of a Pollution Prevention
Plan, contact the Storm Water Unit of the Water Quality Division at P.O. Box 1677, Oklahoma City,
OK 73101 -1677 or by phone at (405) 702 -8100.
12) That all manholes shall be constructed in accordance with the standards for Water Pollution Control
Facility Construction (OAC 252:656 -5 -3), as adopted by the Oklahoma Department of
Environmental Quality.
13) That when it is impossible to obtain proper horizontal and vertical separation as stipulated in Water
Pollution Control Facility Construction OAC 252:656- 5- 4(c)(1) and OAC 252:656- 5- 4(c)(2),
respectively, the sewer shall be designed and constructed equal to water pipe, and shall be
pressure tested using the ASTM air test procedure with no detectable leakage prior to backfilling,
in accordance with the standards for Water Pollution Control Facility Construction OAC 252:656-5 -
4(c)(3).
Failure to appeal the conditions of this permit in writing within 30 days from the date of issue will constitute
