AN ORDINANCE GRATING TO THE OWASSO POWER & LIGHT COMPANY, ITS
SUCCESSORS OR ASSIGNS, THE RIGHT TO ERECT, MAINTAIN, EXTEND AND
OPERATE A SYSTEM OF WORKS IN THE INCORPORATED TOWN OF OWASSO, TULSA
COUNTY, OKLAHOMA, FOR THE PURPOSE OF GENERATING ELECTRICITY WITH WHICH
TO FURNISH HEAT AND LIGHT TO SAID TOWN AND ITS INHABITANTS, AND
CONTRACTING FOR THE FURNISHING OF LIGHTS TO SAID TOWN.
SECTION 1. That the world "grantee" as employed in this ordinance
shall denote the Owasso Power & Light Company, its successors and assigns.
SECTION 2. That the said grantee shall be and is hereby granted a
franchise for the period of Twenty-one (21) years, from and after the
date of approval of this ordinance, with the full right, power and
authority to erect, maintain, extend and operate a plant or machinery,
poles, wires, mains, and all other apparatus and applicances within
the corporate limits of Owasso, Oklahoma, for the purose of generating
and furnishing to the town and its inhabitants electricity for light,
heat and power, and for the purpose of entereing upon and using the
streets, alleys, and public grounds of the city to lay and maintain
thereon such ples, wires, mains, pipes, apparatus and appliances as
may be necessary and proper, subject to the conditions hereinafter
provided.
SECTION 3. That said poles, wire, etc., shall be erected, placed
and laid under the direction fo the Board of Trustees, and in such
places and manner as will consist with necessity, least interfere with
other public use of said streets, alleys and public grounds, and the
said street shall not be unnecessarily obstructed and shall, within
reasonable length of time, be placed nearly as practicable in as good
condition and repair as before such obstruction, at the expense of said
grantee, and said grantee will hold the city harmless from any liability
arisinf from any negligence, act or omission of said grantee.
SECTION 4. The grantee agrees to furnish to the the said incorpoirated Town
of Owasso and the inhabitants thereof, electricity for lighting and
power purposes, but in no case shall the price therefore exceed the
following schedule: for each kilowatt (metered) 20 cents, with a
minimum charge of $1.25 per month or fraction thereof.
SECTION 5. That said grantee shall at all times after tis plant is in
operation, render service to any citizen, whose premises are within
One Hundredd (100) feet of any main or line then in operation, and after
connections have been made to any placee, all future or additional
connections or extensions shall be made at the expnese of the consumer,
which expebse if made by the grantee herein shall be made for Five
Dollars, exclusive of the cost of material, which shall be paid for at the
cost, provided that all wiring and connections shall be installed and
made as provided by the laws of this State.
When application for light or electricity is made a
deposit of Ten Dollars shall be made by such consumer to the said
grantee for each meter, which summ shall be by said grantee so held
during the time such consumer shall use electricity at such place.
SECTION 6. During the term of this franchise, the grantee, in the
consideration hereof, shall furnish to said city and maintain one
street light at such place in said city as may be designated by the
city council; said light to be an all night light, unless otherwise
designated by said city council; and shall furnish free to the school
and to the churches of Owasso such lights as are needed, the said
school and churches to furnish their own wiring and pay for their
connections to the nearest main.
SECTION 7. Nothing in this ordinance shall be construed as to
prevent the said city from granting to other person or corporations
a franchise for for the purposes herein set forth, nor to prevent the said
town, during the term of this franchise, from contracting with any
person or corporation for furnishing the lights herein contracted for,
in the event said grantee shal violate this ordinance or shall fail
to keep or perform any of the conditions of this contract.
