AN ORDINANCE PROVIDING FOR THE WORK OF THE STREETS AND ALLEYS;
DEFINING THE DUTIES OF THE STREET COMMISSIONER IN RELATION THERETO
AND PROVIDING A PENALTY FOR THE VIOLATION HEREOF.
SECTION 1. That all male citizens between the ages of Twenty-one (21)
and Fifty (50) years of age are subject and required to work the
streets and alleys as hereinafter provided. The residenance of any
person shall be held to be where his family resides and the residence
of any other person shall be held to be where he boards or lodges,
provided that any person who is engaged in permanent business,
occupied or engaged iwthin the corporate limits of the town shall be
deemed to be a resident of the town for the purpose of this ordinance,
and further provided that all persons must have resided in the town
limit thirty (30) days.
SECTION 2. That the Street Commissioner shall be appointed by the
Board of Trustees and shall give reasonable and sufficient bond and
said Street Commissioner shall receive One Dollar andFifty Cents
($1.50) per day for his services. All persons are required to work
the streets and alleys four (4) days in each year, performing eight (8)
hours per day.
SECTION 3. All persons who are required to work the streets and alleys
may send a lawful substitute, or pay the overseer One Dollar ($1.00)
per day, which shall be used in the District from which all moneys are
received. One Dollar ($1.00) per day for a team shall be allowed
when used, at the discretion of the Street Commissioner.
SECTION 4. The Street Commissioner shall give notice to persons
residing in the District liable to be charged with the road tax, of
the time and place he will attend, and direct the work to be performed
as aforesaid. The Street Commissioner may direct what implements
such person shall bring with which to perform such work.
SECTION 5. Any person liable to perform road work as required by
law, having been duly notified to perform such work, who shall fail
or reguse to comply with such notice and perform such work or furnish
a substitute therefore as requried by law, shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be fined not less than
Ten Dollars ($10.00) nor more than Twenty-fire Dollars ($25.00).
SECTION 6. That in shall be the duty of the Street Commissioner to
file a complaint before a justice of the peace in the district against
such person so refusing or failing to comply with such notice, within
ten (10) days after such failure or refusal. Any Street Commissioner
failing to file such complaint shall be guilty of a misdeameanor and
punished as in this section provided for the person so refusing.
