AN ORDINANCE OF THE TOWN OF OWASSO, OKLAHOMA, FIXING THE RATE AND
CHARGES OF CONSUMERS OF WATER SUPPLIED BY THE TOWN OF OWASSO WHERE SUCH WATER
IS SUPPLIED OUTSIDE THE TOWN LIMITS OF SAID TOWN: ALSO PROVIDING THE CHARGES
FOR THE MAKING OF WATER CONNECTIONS OUTSIDE THE TOWN LIMITS AND FOR THE SETTING
OF METERS OR TAPS IN SUCH CASES AND PROVIDING FOR THE PAYMENT OF SUCH CHARGES:
PROVIDING FROM THE DISCONTINUANCE OF THE SERVICE IN CASES WHERE SUCH CHARGES ARE
NOT PAID: AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE BOARD OF TRUSTEES BY THE TOWN OF OWASSO, OKLAHOMA:
SECTION 1. That the Ordinance of the Town of Owasso, Oklahoma, entitled an
AN ORDINANCE PROVIDING FOR THE DISTRIBUTION O WATER IN THE TOWN
OF OWASSO, OKLAHOMA, APPLICATION FOR WATER SERVICE, PAYMENT OF THE
BILLS, DEFINING RIGHTS OF THE TOWN IN RELATION THERETO, FIXING WATER
RATES, DEFINING CERTAIN UNLAWFUL ACTS AND PROVIDING A PENALTY THEREFOR
AND DECLARING AN EMERGENCY.
be and the same is hereby supplemented and amended so that the rates to consumers
of water outside the Town Limits of said Town shall be as follows:
(a) For each Tap and connection including the setting of a meter $15.00;
(b) For the first one thousand gallons of water used or consumed 2.00;
(c) For the second one thousand gallons of water consumed 1.00;
(d) For the thrid one thousand gallons of water consumed 0.70;
(e) For all amounts over amounts over three thousand gallons 0.50;
PROVIDED the minimum charge in all cases shall be the sum of $2.00, and the
rates fixed above for amounts of 1,000 gallons shall apply to fractional portions
thereof, even though the full 1,000 gallons in each instance may not be consumed.
PROVIDED FURTHER that in cases where the main water line from the Spavanah
conduit from which said town takes its water supply and running to the south town
limits of said town to the pump station crosses lands outside the town limits of
said town and the owners of such lands, parcels or tracts, are permitting such
water line to be maintained on such property, the charges for both installing and
setting meters or taps and also for water consumed shall be at the same rate and
charges as now fixed, or hereafter fixed, for consumers within the town limits of
said town.
SECTION 2. In all cases where any consumer outside the town limits of said town
fails or refuses to pay his water bill within the time fixed by ordinance for con-
cumers within said town the town shall have the right to discontinue service in the
same manner and under the same penalty as in the town itself, and the same charges
shall be made against the consumer for cutting off and turning on water service
as now exits or hereafter fixed by ordinance applicable to consumers in town.
SECTION 3. The President of the Board of Trustees and the clerk of said town are
hereby authorized to enter into wirtten agreements with land owners where the water
line afresaid crosses such owners' land agreeing to furnish water at the rates
fixed in Section 1 hereof, provided such land owners consent to the maintenance of
said water line across their property so long as said town procures its water sup-
ply from the City of Tulsa and its Spavinaw conduit.
ADOPTED this 22nd day of November, 1938, and the emergency clause for
the benefit of the immediate health and safety of said Town of Owasso is hereby
adopted and approved.
