HomeMy WebLinkAboutORDINANCE NO. 37Revisied Ordinance #37 EMERGENCY ORDINANCE NO. 33 AN ORDINANCE DECLARING THE POLICY AN PURPOSE OF THE TOWN OF OWASSO, OKLAHOMA, TO EXTEND TO THE EMPLOYEES AND OFFICIALS OF SAID TOWN, NOT EXCLUDED BY LAW OR THIS ORDINANCE, WHETHER EMPLOYED IN CONNECTION WITH A GOVERNMENTAL OR PROPRIE- TARY FUNCTIONS OF SAID TOWN, THE BENEFITS OF THE SYSTEM OF FEDERAL OLD-AGE AND SURVIVORS INSURANCE, AS AUTHORIZED BY THE FEDERAL SOCIAL SECURITY ACT, AND AMENDMENTS THERETO, UPON THE BASIS OF APPLICABLE STATE AND FEDERAL LAWS OR RET- ULATIONS; AUTHORIZING AND DIRECTING THE CHAIRMAN, TOWN BOARD OF TRUSTEES TO EXECUTE AGREEMENTS AND AMENDMENTS THEREOF WITH THE STATE AND FEDERAL LAWS OR REG- ULATIONS; AUTHORIZING AND DIRECTING THE CHAIRMAN, TOWN BOARD OF TRUSTEES TO EXECUTE AGREEMENTS AND AMENDMENTS THERETO WITH THE STATE DEPARTMENT OF PUBLIC WELFARE, AS AGENT OR AGENCY, FOR COVERAGE OF SAID EMPLOYEES AND OFFICIALS; PROVIDING FOR WITHHOLDINGS FROM SALARIES AND WAGES OF EMPLOYEES AND OFFICIALS OF SAID TOWN SO COVERED TO BE MADE AND PAID OVER AS PROVIDED BY APPLICABLE STATE OR FEDERAL LAWS OR REGULATIONS; PROVIDING THAT SAID TOWN SHALL APPROPRIATE AND PAY OVER EMPLOYEE'S CONTRIBUTIONS AS PROVIDED BY APPLICABLE STATE OF FEDERAL LAWS OR REGULATIONS; PROVIDING THAT SAID TOWN SHALL KEEP RECORDS AND MAKE REPORTS AS REQUIRED BY APPLICABLE STATE OR FEDERAL LAWS OR REGULATIONS; EXCLUDING FROM THE ORDINANCE ANY AUTHORITY TO MAKE ANY AGREEMENT WITH RESPECT TO ANY POSITION, EMPLOYEE OR OFFICIAL NOW COVERED OR AUTHORIZED TO BE COVERED BY ANY OTHER ORDINANCE CREATING ANY RETIREMENT SYSTEM FOR ANY EMPLOYEE OR OFFICIAL OF SAID TOWN; EXCLUDING FROM THIS ORDIANCE ANY AUHORITY TO MAKE ANY AGREEMENT WITH RESPECT TO ANY POSITION, EMPLOYEE OR OFFICIAL, COMPENSATION FOR WHICH IS ON A FEE BASIS, OR ANY POSITION, EMPLOYEE OR OFFICIAL, COMPENSATION FOR WHICH IS COVERED UNDER APPLICABLE STATE OR FEDERAL LAWS OR REGULATIONS; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA: SECTION 1. It is hereby declared to be the policy and purpose of the Town of Owasso, Oklahoma, to extend, at the earliest date to the employees and officials thereof, not excluded by law or this Ordinance, and whether employed in connection with a governmental or propristary function, the benefits of the System of Federal Old-Age and survivors Insurance as authorized by the Federal Social Security Act and amendments thereto, including Public Law 734 - 81st Congress. In pursuance of said policy, and for that purpose, the Town shall take such action as may be required by applicable State or Federal laws or regulations. Secition 2. the Chairman of the Board of Trustees of the Town of Owasso, Oklahoma, is hereby authorized and directed to execute all necessary agreements and amendments thereto with the State Department of Public Welfare, as agent or agency, to secure coverage of employees and officials as provided in Section 1, hereof. Section 3. Withholdings from salaries or wages of employees and officials for the purpose provided in Section 1, hereof, are hereby authorized to be made in the amounts and at such times as may be required by applicable State or Federal laws or regulations, and shall be paid over to the State or Federal agency designated by said laws or regulations. Section 4. There shall be appropriated from available funds such amounts at such times as may be required by applicable State or Federal laws or regulations for Employer's contributions; which shall be paid over to the State or Federal agency designatedby said laws of regulations. Section 5. The Town shall keep such records and make such reportas may be required by applicable state or federal laws or regulations ord #37 SECTION 6. There is hereby excluded from this Ordinance any authority to make any agreement with respect to any position or any emplotee or official now covered or authorized to be covered by any other ordinance creating any retirement system for any employee or official of the Town. SECTION 7. There is hereby excluded from this Ordinance any authority to make any agreement with respect to any position, or any employee of official, compensatio for which is on a fee basis, or any position, or any employee of official not authorized to be covered by applicable State or Federal laws or regulations. SECTION 8. It being immediately necessary for the preservation of the public peace, health and safety, an emergency is hereby declared to exist, by reason whereof, this Ordinance shall take effect and be in full force from and after its passage, approved and publication as required by law.
