HomeMy WebLinkAboutORDINANCE NO. 96ORDINANCE #96 AN ORDINANCE IMPOSING AND ESTABLSHING A SANITARY SEWER SERVICE CHARGE FOR THE COLLECTION AND DISPOSAL OF SEWAGE WITHIN AND WITHOUT THE TOWN OF OWASSO; PROVIDING FOR THE MANNER OF DETERMINATION OF SAID CHARGE AND THE COLLECTION THEREOF; PROVIDING FOR PENALTIES FOR VIOLATIONS OF THIS ORDINANCE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA, AS FOLLOWS: SECTION 1. Definitions. For the purposes of this Ordinance, the following words shall have the following meanings: (a) "Sewers", "sewer mains", "public Sewers", "sewer system", or words of like import shall mean the conduits, pipes, mains, and works used to collect and dispose of sewage, owned by the Town of Owasso or connected to sewers that empty into or connect to sewers owned, maintained or operated by the Town of Owasso. (b) "Sewer user" or "customer" is every water customer of the Town of Owasso who purchases, from said Town, water through a water meter connected to the water lines of the Town of Owasso and whose residence or business is also connected to the sewer system of the Town of Owasso and any other person, firm, association or corporation who uses the sewer system of the Town of Owasso for purposes of disposing of sewage. (c) "Sewage" - Any waste matter, liquid, solid or mixed placed in sewers for disposal except, deleterious substances prohibited by ordinance. SECTION 2. Rates of Charge. For the purpose of providing funds for the maintenance, repair, extension and operation of the Sanitary Sewer system of the Town of Owasso, Oklahoma, and for other purposes, there is hereby imposed and established the following Sanitary Sewer service charges or fees: Seventy-five Cents (75¢) per month to be charged against each water meter in use within or without the city limits of the Town of Wasso. SECTION 3. Collection. Ae charges herein established for the use of the Sanitary Sewer system of the Town shall be billed to each user monthly along with the bill o and will carry the same due date, grace periods and penalties', as are now or may hereafter be established for water service bills. The Town Clerk or any employee authorized by the Town to accept payment of utility bills, is hereby directed to not accept Dayment of any water bill of a customer unless payment be made simultaneausIV of the sewer service bill. if any be due. The Town shall have the right and privilege of discontinuing water service to any premises for non payment of sewer service charges in the same manner and subject to the same terms as now or hereafter prescribed by law for discontinuance of water service for non uayment of water bills, except that no turn-on charge shall be collected. The Town shall have the further right, in the event of non payment of the sewer service charges herein fixed, to make an actual physical disconnection of the lateral or house line from the public sewer or other sewer connecting to the public sewers, and the cost of disconnecting and connecting shall be the obligation of and paid by the customer then using or thereafter desiring to use said sewer for said premises. Section 4. Severability. In the event any section, phrase, part or parts of this ordinance shall be adjudged void by any court of competent jurisdiction, such section, phrase, part or parts so adjudged void shall be deemed severable and separable, and the remainder of this ordinance shall remain in full force and effect. It is hereby declared to be the intent of the Board of Trustees tat this ordinance would have been adopted had such void or unconstitutional provisions, if any, not been included herein. Section 5. Emergency. By reason of the serious financial condition of Town, an emergency is hereby declared to exist for the preservation of the public health, peace, safety and welfare by reason whereof this ordinance shall be in full force and effect immediately from and after its passage, approval and publication.
