AN ORDINANCE IMPOSING AND ESTABLISHING A WATER SERVICE
CHARGE FOR THE COLLECTION, DISTRIBUTION AND SALE OF
WATER WITHIN THE TOWN OF OWASSO; PROVIDING FOR THE
MANNER OF DETERMINATION OF SAID CHARGE AND THE COLLECTION
THEREOF; PROVIDING FOR PENALTIES OF VIOLATION OF THIS
ORDINANCE; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE TOWN OF OWASSO, OKLAHOMA, AS FOLLOWS:
SECTION 1. Definitions. For the purposes of this
ordinance, the following words have the following meanings:
(a) "Water Service" shall mean the distribution
by the Town of Owasso of water through lines, taps,
and meters to residents of the Town of Owasso for
Consumption, residential, commercial or private.
(b) "Water User" shall mean every water
customer within the corporate limits of the Town
of Owasso who purchases, from said Town, water
through a water meter connected to the water lines
of the Town of Owasso, whether said person be an
individual, firm, association or corporation.
SECTION 2. Rates of Charge. For the purpose of
providing funds for the maintenace, repair, extension and
operations of the water system of the Town of Owasso,
Oklahoma, there is hereby imposed and established the
following water service charge or fees:
Seventy-five Cents (75¢) per month to be
charged against each water meter in use
within or without the city limits of the
Town of Owasso.
SECTION 3. Collection. The charges herein established
for the use of the water system of the Town shall be billed
to each user monthly, along with the bill for water, and
will carry the same due date, grace periods and penalties,
as are now or may hereafter be established for water
service bills. The Town Clerk, or any employee authorized
by the Town to accept payment of utility bills, is hereby
authorized to not accept payment of any water bill of any
customer unless payment be made simultaneously of the
sewer service bill and the water service charge, if any
be due.
The town shall have the right and privilege of
continuing water service to any premises for non payment
of this water service charge in the same manner and subject
to the same terms as now or hereafter prescribed by WIT
for discontinuance of water service for non payment of
water bills or sewer service charge, except that no turn-on
charge shall be collected. The Town shall have the further
right, in the event of non payment of the water service
charge herein fixed, to make an actual physical disconnection
of the water service, and the cost of disconnecting and
connecting shall be the obligation of and paid by the
cuMomer then using or thereafter desiring to use said
water service for said premises.
SECTION 4. Severability. In the event any section,
ohrase. nart or warts of this ordinance shall be adludow,,
void by any court of competent jurisdiction, such sectim
phrase, part or parts so adjudged void shall be deemed
severable and separable, and the remainder of this ordinance
shall remain in full force and affect. it is hereby declared
to be the intent of the Board of Trustees that this
ordinance would have been adorted had such void or
unconstitutional provisions, if any, not been included
herein.
SECTICN 5. Emergency. By reason of the serious
financial condition of the Town, an emergency is hereby
declared to exist for the preservation of the nublic
health, peace, safety and welfare by reason whereof this
ordinance shall be in full force and effect immediately
from and after its passage, approval and publication.
PASSED WITH THE EMERGENCY CLAUSE RULED UPON SEPARATELY
AND APPROVED THIS 1ST DAY OF JUNE, 1956.
