property would be brought into the City Limits of Owasso as RS -3 (Residential Single- family).
The property is located at 1 1 121 North 129th East Avenue, Owasso, OK and is approximately
9.95 acres.
OLS 21 -03 - Lot Split, Garrett Creek -Mixed Use Building - Consideration and appropriate
action relating to the request for the review of a lot split request located on North 135th East
Avenue. The proposed lot split spans over two different lots, and would split approximately
1.93 acres off of the southwestern corner of Parent Tract 1 and approximately 0.49 acres off
of the northwestern corner of Parent Tract 2. The lot split would result in the creation of three
new lots (Tracts A, B, and C). The property is zoned CS (Commercial Shopping under OPUD
02 -02).
8. OLS 21 -04 - Lot Split, ROC Owasso 11- Consideration and appropriate action relating to the
request for the review of a lot split request located at] 3600 East 86th Street North (Lot 1, Block
1, ROC Owasso 11). The proposed lot would split a parent tract of approximately 14.27 acres
into three (3) tracts. The proposed Tract A would be approximately 1.71 acres, Tract B
would be approximately 6.91 acres and Tract C would be 5.65 acres. The property is zoned
O (Office) and CS (Commercial Shopping).
9. Change of Access, ROC Owasso If - Consideration and appropriate action relating to the
request for the review of a change of access request located at 13600 East 86th Street North
(Lot 1, Block 1, ROC Owasso II). This proposed change of access would shift three (3) limits
of access points and eliminate two (2) limits of access points. The property is zoned O
(Office) and CS (Commercial Shopping).

The Owasso Planning Commission met in regular session on Monday, May 10, 2021 at Old Central
per the Notice of Public Meeting and Agenda posted at City Hall, 200 S. Main (west side) at 9:45am
on May 6, 2021.

ITEM 6. OA 21 -02 De- Annexation - The Wharf @ Stone Canyon - Consideration and
approval, denial, amendment, or other appropriate action relating to the request
for the review of a De- Annexation request. The approximate location is near
North 177th East Avenue and North Patriot Drive and is approximately 10.81 acres.
The current zoning is Residential Single - Family (RS -3) and is part of the Stone
Canyon PUD.
Mr. Fritschen presented the staff report. The location was described. The Technical Advisory
Committee reviewed this request at the April 21, 2021 meeting. Staff recommends approval
of the De- annexation request. A representative for the applicant was present to answer any
questions or address any concerns.

ITEM 7. OLS 21 -02 - Lot Split - A New Leaf - Consideration and approval, denial,
amendment, or other appropriate action relating to the request for the review of
a Lot Split request. The general location of the property is south and east of the
southeast corner of East 86th Street North and North Memorial Drive. The Lot Split
would divide a 49.82 acre tract into an approximate 8.9 acre parcel and a 41.53
remaining acre parcel. The property is zoned Agriculture (AG) under PUD 17 -03
and is part of The Villas at a New Leaf Development.
Ms. Beemer presented the staff report. The location was described. The Technical Advisory
Committee reviewed this request at the April 21, 2021 meeting. A representative for the
applicant was present to answer any questions or address any concerns. Staff recommends
approval of the Lot Split for A New Leaf, subject to TAC and Staff recommendations.
Mr. Balthrop moved, seconded by Mr. Utturkar, to approve the Lot Split, subject to TAC
comments.

BACKGROUND:
The Community Development Department received a request for the annexation and rezoning
of property located at 11121 North 1291h East Avenue. The subject property is composed of
approximately 9.95 acres of land and is currently zoned Agriculture (AG) in Tulsa County. Upon
annexation, the applicant is requesting the property be brought into Owasso City limits as
Residential Single - Family High Density (RS -3) via an accompanying rezoning request (OZ 21 -04).

ANALYSIS:
The property is currently zoned AG in Tulsa County, and is contiguous with City limits on the
northern and eastern boundaries of the property. The applicant is requesting the property be
assigned the RS -3 zoning designation upon annexation, via a concurrent rezoning request (OZ
21 -04). Typically, property is annexed either under Agriculture (AG) zoning or as the County's
corresponding zoning designation as per the Owasso Zoning Code. However, an applicant may
request an alternate zoning if said zoning corresponds to the Land Use Master Plan and is
advertised in accordance with statutory requirements. In this case, the GrOwasso 2030 Land Use
Master Plan identifies the subject property for future Residential land uses. Therefore, assigning a
zoning of RS -3 to the property upon annexation is appropriate.
The subject property is currently undeveloped and unplatted. The applicant intends to construct
a religious institution on the property, which will require the applicant to secure a Specific Use
Permit (SUP), as religious institutions are not allowed by -(ght in an RS -3 zoning district. The
applicant is aware of requirement, and has indicated they intend to submit a request for an SUP
in the coming months; this annexation and rezoning process is just the first step in the overall
development process.
The GrOwasso 2030 Land Use Master Plan identifies the subject property for future Residential
uses, so the requested zoning of RS -3 is appropriate. Further, while religious institutions are not
usually allowed in areas identified for future Residential uses, this proposed use may be deemed
appropriate for this location if the correct controls are utilized with an SUP. Because the
applicant does intend to secure an SUP on this property, Staff has determined that the proposed
use of a religious institution should indeed be compatible with surrounding existing and future
land uses.
The City of Owasso will provide police, fire, ambulance and sanitary sewer services to the property
upon annexation. Washington County Rural Water District #3 will provide water services to this
property. Any future development that occurs on the subject property must adhere to all
Owasso subdivision, zoning, and engineering requirements.
The Technical Advisory Committee JAC) reviewed this annexation request at their regular
meeting on May 19, 2021. No comments were made regarding this request.
RECOMMENDATION:
Staff recommends approval of annexation request OA 21 -03, annexing the subject property into
Owasso City Limits with an assigned zoning of Residential Single - Family High Density (RS -3) via
rezoning request OZ 21 -04.

BACKGROUND:
The Community Development Department received a Lot Split application for property located
south of 11422 N 1341h E Ave. The subject property comprises a portion of Lot 3, Block 2 of the
Replat of Lot 2, Block 1 of the Garrett Creek Center Phase II subdivision (Parent Tract 1), and a
portion of Lot 3, Block 1 of the Garrett Creek Center Phase 11 subdivision (Parent Tract 2). The
proposed lot split spans over two different lots, and would split approximately 1.93 acres off of
the southwestern corner of Parent Tract 1 and approximately 0.49 acres off of the northwestern
corner of Parent Tract 2. The lot split would result in the creation of three new lots (Tracts A, B,
and C). All the subject properties are zoned Commercial Shopping (CS) under Owasso Planned
Unit Development (OPUD) 02 -02. The properties are being split to facilitate the sale Tract A to a
private developer who wishes to construct a multi -use office /commercial building.

ANALYSIS:
The subject properties span over two separate lots that are located in two subdivisions. As such,
there are two Parent Tracts involved in this Lot Split request. Parent Tract 1 refers to a portion of
Lot 3, Block 2 of the Replat of Lot 2, Block 1 of the Garrett Creek Center Phase II subdivision,
which was approved in 2018. Parent Tract 2 refers to a portion of Lot 3, Block 1 of the Garrett
Creek Center Phase II subdivision, which was approved in 2006. The proposed Lot Split divides
approximately 1.93 acres off of the southwestern corner of Parent Tract 1 and approximately
0.49 acres off of the northwestern corner of Parent Tract 2. These two pieces of property that
have been split off will be combined via a lot tie instrument to form Tract A, which will be
approximately 2.42 acres in size. Tract B will be comprised of the remainder of Parent Tract 1,
and will be approximately 9.35 acres in size. Tract C will be comprised of the remainder of Parent
Tract 2, and will be approximately 10.90 acres in size.
A Lot Split request located on the subject properties was previously heard by Planning
Commission in January of 2021 (OLS 20 -08). The deeds reflecting the approved Lot Split request
OLS 20 -08 were never signed and filed. Further, the applicant has changed the configuration of
the proposed new lots, thus necessitating this new Lot Split request.
The purpose of this lot split is to allow for the sale of Tract A to a private developer, who has
indicated that they intend to construct a three -story, multi -use office /commercial building on
the newly created tract. Tract B and Tract C will remain under their current ownership.
The subject properties are zoned CS under OPUD 02 -02; staff has determined that each of the
resulting tracts meet the dimensional requirements for lots within the CS zoning district. Further,
the PUD document relating to OPUD 02 -02 does not specify additional dimensional requirements
for commercial lots. As such, staff has determined that each of the resulting tracts meet the
dimensional requirements for commercial lots under OPUD 02 -02. Access to Tract A will be taken
from North 135th East Avenue, via a private road that the purchaser of Tract A intends to
construct. Said purchaser is currently working to file a Mutual Access Easement (MAE) on the
subject property to ensure perpetual access to Tract A from North 135th East Avenue. Access to
Tracts B and C will be determined at the time of their development.
Any development that occurs on the subject properties must adhere to all City of Owasso
subdivision, zoning, and engineering requirements.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed this item at their May 19, 2021 meeting.
Comments from that meeting have been attached to this memo.
RECOMMENDATION:
Staff recommends approval of Lot Split request OLS 21 -03, subject to TAC comments and subject to
the filing of a Mutual Access Easement instrument.

ANALYSIS:
A lot split requires Planning Commission approval on previous platted property and produces
new deeds for each tract that are filed in the county of record. The proposed Lot Split divides a
14.27 acre parent lot into three (3) separate tracts, Tract A, B and C. Tract A, which is 1.71 acres
in size, is zoned CS and undeveloped. It will be combined with Lot 7, Block 1 ROC Owasso
which is 0.75 acres in size. Upon tying these two lots together the total acreage becomes 2.46.
The lot combination will ensure that the minimum frontage requirement of 125 feet in the CS
(Commercial Shopping) zoning district is met. Tracts B and C are zoned O (Office) and are 6.91
and 5.65 acres respectively. Tract B is undeveloped and is planned for a new medical facility.
Tract C contains an existing medical facility. Each of these tracts meets the minimum frontage
and dimensional requirements of the O districts.
As mentioned the property is platted with utility easements identified on the filed plat. Access to
Tract A and B will be in the form of a 40 foot mutual access to be filed by separate instrument.
Tract C is proposed to take access from a relocated 40 foot access location with an
accompanying change of access application. However, staff will recommend that a 60 foot
mutual access easement and corresponding access width be provided as part of the lot split
approval. The Owasso zoning code requires that commercial and office lots sharing a common
boundary utilize a shared access. The purpose of this requirement is to create drive
consolidation and reduce the number of curb cuts onto arterial streets.
Any future development that occurs on the subject properties must adhere to all City of Owasso
subdivision, zoning, and engineering requirements.

BACKGROUND:
The Community Development Department received a request for a change of access for Lot 1,
Block 1 of ROC Owasso II. The subject property is proposed to be developed for a medical
facility. The conceptual site plan for the medical clinic project indicates access points that differ
from those that were identified with the filed ROC Owasso II Plat. The applicant requests a
change of access to alter the limits of access points shown on the filed plat in order to
accommodate the driveways shown on their proposed site plan.

APPROVAL PROCESS:
A change of access to a filed plat requires Planning Commission approval and a favorable
recommendation by the City Engineer. An instrument signed by the City Engineer and Planning
Commission Chairman is recorded with the Tulsa County Clerk, officially amending the platted
limits of access for the subject property.

ANALYSIS:
The applicant is requesting a change to the access locations depicted on the ROC Owasso II
filed plat (plat #5428). The plat depicted five (5) access points and the applicant proposes to
amend these locations by removing two (2) of them and relocating the remaining 3 to
accommodate a proposed new medical facility and outparcel to be created with a lot split
(OLS 21 -04).
The proposed access change would improve the overall arrangement of the driveways along
this section of East 86th Street North, as one of the driveways will be aligned with the one across
the street to the north that leads into the High School and there will be two (2) less access points
overall. The nature and overall size of the proposed development (medical facility) does not
warrant additional curb cuts, as it is not anticipated to generate large volumes of traffic
In summary, this proposal is creating a situation that improves traffic flow and safety by reducing
the number of curb cuts onto a major arterial road and aligning one of the access points with
one along the north side of East 86th Street North. Therefore, staff supports this request.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed this item at their regular meeting on May 19,
2021. Comments were included in your packet.
RECOMMENDATION:
Staff recommends approval of the change of access request for Lot 1, Block 1 of ROC Owasso II.
