7. PUBLIC HEARING - The City Council will conduct a public hearing for the purpose of receiving
citizen input on a proposed amendment to the list of Capital Improvement Projects eligible
for funding from the Capital Improvements Fund to include East 76th Street North and US 169
Bridge /Interchange improvements

Development (OPUD 21 -02) for 33.97 acres located at the southeast corner of the East 96th

said property from Agriculture (AG) to Commercial Shopping (CS) and Residential
Neighborhood Mixed (RNX)

9. Consideration and appropriate action relating to Ordinance 1183, closing to the public use
two (2) drainage easements located within a portion of the Garrett Creek Center Phase II

and according to Recorded Plat No. 6054 and Plat No. 6801

10. Consideration and appropriate action relating to a renewal agreement with Grand Gateway
Economic Development Authority for Pelivan Transit services

Staff recommends approval of the Purchase of Service Agreement with Grand Gateway
Economic Development Association ( Pelivan Transit) of Big Cabin, Oklahoma, in the amount
of $51,000.00, and authorization to execute the agreement.
11. Consideration and appropriate action relating to the acceptance and final payment of the
Owasso Sports Park Detention Pond and Mitigation Project

Staff recommends acceptance of the Owasso Sports Park Detention Pond and Mitigation
Project, and authorization for final payment to Cherokee Builders, Inc., of Tulsa, Oklahoma, in
the amount of $215,952.99.
12. Consideration and appropriate action relating to an agreement for engineering services for
miscellaneous stormwater and erosion control projects

Staff recommends approval of the Agreement for Engineering Services with Meshek &
Associates, LLC, of Tulsa, Oklahoma in the amount not to exceed $50,000.00 and
authorization to execute the agreement.

The Owasso City Council met in special session on Tuesday, August 3, 2021, in the Council
Chambers at Old Central, 109 North Birch, Owasso, Oklahoma per the Notice of Special Public
Meeting and the Agenda filed and posted in the office of the City Clerk at City Hall, 200 South
Main Street, at 5:00 pm on Tuesday, July 27, 2021.

The Owasso City Council met in regular session on Tuesday, August 3, 2021, in the Council
Chambers at Old Central, 109 North Birch, Owasso, Oklahoma per the Notice of Public Meeting
filed Friday, December 11, 2020; and the Agenda filed in the office of the City Clerk and posted
at City Hall, 200 South Main Street, at 6:00 pm on Friday, July 30, 2021.

7. Consideration and appropriate action relating to a request for approval of the Consent
Agenda. (All matters listed under "Consent" are considered by the City Council to be routine
and will be enacted by one motion. Any Councilor may, however, remove an item from the
Consent Agenda by request. A motion to adopt the Consent Agenda is non - debatable.)

C. Accept public infrastructure improvements consisting of a public water line and
all appurtenances at Attic Storage located at 11500 East 80th Street North
D. Accept public infrastructure improvements consisting of roadways, sidewalks,
stormwater system, and sanitary sewer system at Morrow Place Phase II,
residential subdivision, located on the southeast corner of North 129th East Avenue
and East 126th Street North
Ms. Lewis moved, seconded by Mr. Fruga to approve the Consent Agenda, as presented
with claims totaling $690,151.54.

9. Consideration and appropriate action relating to the appointment of Jeri Moberly to serve
the remainder of a vacated term on the Owasso Planning Commission, said term to expire
June 30, 2024
Mayor Bush presented the item recommending the appointment of Jeri Moberly to the
Owasso Planning Commission, term ending June 30, 2024.
There were no comments from the audience. Mr. Bonebrake moved, seconded by Mr. Dunn
to appoint Jeri Moberly, as recommended.

10. Consideration and appropriate action relating to a sole source purchase of body worn
cameras
Jason Woodruff presented the item, recommending authorization for the sole source
purchase of nine (9) Axon body camera systems through Axon Enterprises, Inc., of
Scottsdale, Arizona, in the amount of $65,409.30 of which $18,753.30 will be paid in Fiscal
Year 2022, and subsequent payments for Fiscal Year 2023 through Fiscal Year 2026 are
contingent upon annual appropriations by the City Council.
There were no comments from the audience. After discussion, Mr. Bonebrake moved,
seconded by Ms. Lewis to authorize the purchase, as recommended.

11. Consideration and appropriate action relating to bids received for the FY 2020 -2021
Pavement Striping Project
Daniel Dearing presented the item, recommending to award the construction bid to Direct
Traffic Control, Inc., of Muskogee, Oklahoma, in the amount of $56,554.20, and authorization
to execute the necessary documents.
There were no comments from the audience. After discussion, Mr. Bonebrake moved,
seconded by Mr. Dunn to award the bid and authorize execution of the necessary
documents, as recommended.

12. Consideration and appropriate action relating to an agreement for the purpose of leasing
various city fleet vehicles
Chris Garrett presented the item, recommending approval of the Master Equity Lease
Agreement between the City of Owasso and Enterprise Fleet Management, Inc., of Clayton,
Missouri, and authorization for the Mayor to execute the agreement.
There were no comments from the audience. After discussion, Mr. Dunn moved, seconded
by Mr. Bonebrake to approve of the agreement and authorize the Mayor to execute the
agreement, as recommended.

13. Report from City Manager
Warren Lehr introduced Roger Stevens to provide the monthly Public Works project status
report. Mr. Lehr reported on Owasso Day at Tulsa Driller's Stadium to be held August 20, 2021,
and August Gathering on Main activities related to the Tulsa Driller's.

The Owasso City Council, Owasso Public Works Authority (OPWA), and Owasso Public Golf Authority
(OPGA) met in a joint regular meeting on Tuesday, August 10, 2021, in the Council Chambers at Old
Central, 109 North Birch Street, Owasso, Oklahoma, per the Notice of Public Meeting filed Friday,

Teresa Willson and Roger Stevens presented the item and discussion was held. It was further
explained the required public hearing will take place during the August 17, 2021, City Council
meeting.

Warren Lehr introduced Linda Jones to present item A, and discussion was held. Mr. Lehr
reported on various City events to include staff monitoring of the COVID pandemic. Mr. Lehr
announced the arrival of Fahren, a service therapy dog, currently in training with the Fire
Department, and Owasso Day at Tulsa Driller's Stadium to be held August 20, 2021.
6. City Councilor /Trustee comments and inquiries
Councilor Bonebrake commented on the Police Department's traffic control efforts as school is
now back in session.

DATE: August 12, 2021
BACKGROUND:
The subject commercial development is located on North 135th East Avenue between East 1061h
Street North and East 116th Street North. The public infrastructure improvements consist of a
concrete approach and sidewalk.
FINAL INSPECTIONS:
Final inspections for the infrastructure components were completed in July 2021, by the Public
Works Department. All standards for acceptance have been met. Additionally, the construction
contractor and design engineer have supplied the necessary two -year maintenance bond and
required record drawing.
RECOMMENDATION:
Staff recommends acceptance of the public infrastructure improvements on North 135th East
Avenue between East 106th Street North and East l 16th Street North of a concrete approach and
sidewalk.

EXECUTIVE SUMMARY:
The City Council conducts a public hearing regarding any project being considered for the list of
projects eligible for funding from the Capital Improvement Fund. The project being considered at
this time is East 76th Street North and US 169 Interchange Improvements.
BACKGROUND:
In 2003, The City Council adopted Resolution 2003 -14 establishing the procedure for amending
the list of projects eligible to receive funding from the Capital Improvements Fund, also known as
the permanent third penny sales tax. The procedure consists of a recommendation from the
Owasso Capital Improvement Committee, followed by a public hearing before the City Council,
and finally a resolution amending the project listing. The City Council must continue the matter for
at least two weeks from the public hearing before taking action to amend the listing of projects.
EAST 76TH STREET NORTH AND US 169 INTERCHANGE IMPROVEMENTS:
In 2014, Oklahoma Department of Transportation (ODOT) included the East 76th Street North and
US 169 Bridge /Interchange Improvements in their 8 -year plan. The engineering design and utility
relocation commenced in 2019. Then in 2020, City staff met with ODOT to discuss the scope of the
work and the potential to include additional improvements. In February 2021, ODOT agreed to
the changes, if the City would provide the necessary funding for the additions. Construction is
anticipated to commence in January 2022.
The proposed additional scope of work would include traffic signal, signage, service road access
improvements, stormwater bridge expansion, and bridge art work. The total interchange
improvement project cost is anticipated to be $8,000,000. If approved for Capital Improvement
funding, the City's portion, comprising the additional improvements in this project, is estimated to
be $400,000.
CURRENT PROJECT PRIORITIES:
Adopted June 18, 2019, Resolution 2019 -13 designated the following list of projects as eligible for
funding from the Capital Improvements Fund:

CAPITAL IMPROVEMENTS COMMITTEE RECOMMENDATION:
On June 27, 2021, the Capital Improvements Committee held a meeting in accordance with the
Oklahoma Open Meeting Act and City Council Resolution 2003 -14. The purpose of the meeting
was to consider a recommendation to the City Council to amend the current list of projects
eligible to be funded through the Capital Improvements Fund. Committee members discussed
the proposed interchange improvements. At the conclusion of the discussion, the Capital
Improvements Committee voted unanimously to submit a recommendation to the City Council
amending the list of eligible projects to include:

PUBLIC HEARING:
In accordance with the procedure for amending the capital improvement projects list, the City
Council must conduct a public hearing to receive and consider citizen input relevant to the
recommendation made by the Capital Improvements Committee.
Notice of the public hearing was published in the Owasso Reporter August 11, 2021, as required
by Resolution 2003 -14, as well as posted to the Public Notices section of the City website. The
public hearing is scheduled to be conducted on August 17, 2021.

The East 76th Street North and US 169 Interchange is a heavily used roadway that conveys
residential and commercial traffic through the area, as well as commuter traffic to and from
Tulsa. Currently, the East 76th Street North corridor conveys approximately 12,500 vehicles per
day.
In 2014, Oklahoma Department of Transportation (ODOT) included the East 761h Street North and
US 169 Bridge /Interchange Improvements in their 8 -year plan. In 2019, ODOT commenced with
the engineering design and utility relocations followed soon after. In 2020, City staff met with

CONCEPT OF A PUD:
A PUD, is a development concept that allows for greater creativity and flexibility than typically
allowed under traditional zoning and planning practices. For example, PUDs often allow
developers to place different zonings and land uses in close proximity to each other. Developers
may also have more flexibility in certain aspects of development, such as building setback
requirements and building height limitations, which can be more restrictive in standard zoning
districts.
However, a PUD should not be considered as a tool to circumvent the City's Zoning Code and
Subdivision Regulations. All aspects of the PUD application are subject to public comment as
well as consideration and approval from the Community Development Department, the Owasso
Technical Advisory Committee, the Owasso Planning Commission, and the Owasso City Council.
PUD applications presented to the Planning Commission and City Council are for approval of
the uses and the overall conceptual development plan as it relates to the context of the
surrounding area.
GROWASSO 2030 LAND USE MASTER PLAN CONSISTENCY:
The GrOwasso 2030 Land Use Master Plan is a document that acts as a moderately flexible tool for
evaluating development proposals. Currently, the Land Use Master Plan identifies the entirety of
the subject property for commercial land uses, but it further describes that multi - family uses as a
possible use. In most cases, this means that the multi - family use is a component of a larger
mixed -use project. For this project specifically, the single - family detached homes will be owned
and operated by a single entity, thus making this portion of the property effectively function as a
horizontal multi - family use. Considering this, the requested zonings of RNX and CS are
appropriate for this PUD request.
ANALYSIS:
The subject property was annexed into Owasso City Limits with Ordinance 495 in 1995. In order to
accommodate the proposed uses outlined within this PUD request, the current zoning of AG needs
to be changed. The applicant is seeking to apply the CS zoning designation to approximately 16.79
acres, which covers most of the frontage along East 96th Street North and North Garnett Road. The
applicant is also seeking to apply the RNX zoning designation to the portion of the property that lies
to the interior of the site, behind the proposed commercial development. The RNX zoning
designation will comprise approximately 17.18 acres of the total development area.
The Development Area Plan submitted for this PUD identifies five (5) development tracts. Tracts A, B
and C are designated for commercial development, Tract D is called out for residential
development and Tract E is denoted as a wetland reserve area, which the applicant intends to
keep as undeveloped open space. The proposed commercial area tracts will be comprised of
approximately 14.86 acres total, to be subdivided into individual lots at a later time. The applicant
has indicated that they envision general retail and commercial uses in this portion of the
development, along the frontages of the two arterials that surround the subject property.
The residential area of the proposed PUD comprises of approximately 12.88 acres and is located in
the south - central interior portion of the subject property. The applicant intends to develop single -
family detached homes on what will eventually be platted as approximately sixty -four (64)
individual lots. A single management company will own all of the lots, which will be rented to future
residents. The residential portion of this PUD will also feature two (2) pocket parks, one of which the
applicant plans to center around the existing silo that was part the original home site of the Smith
Farm parcel, thus integrating the history of the property into the project.

Between the residential and commercial areas of the PUD lies a jurisdictional wetland, which will be
set aside as a reserve area approximately 6.22 acres in size. The reserve area will function not only
as a buffer between the proposed residential and commercial uses to the west and north, but also
as an additional amenity feature for future residents. Further, there is an existing landscape buffer
yard running along the southern and eastern boundaries of the subject property. This buffer yard
contains a stand of mature evergreen trees and a privacy fence, both of which will buffer the
proposed residential use from the existing commercial uses to the south and east.
The development lies within the US -169 Overlay District and as presented the PUD appears to
conform to the requirements for said overlay district. As each site plan is submitted for different
areas within the development, they will be reviewed independently to ensure they meet the
requirements of the Overlay as well as other design requirements of the Zoning Code. The PUD
proposes two multi- tenant 25 -foot pylon signs, to be located at each of the two main entrances to
the development. Additionally, 12 -foot monument -style signs will be allowed within the commercial
area of the development; the exact number and placement of said signs will be determined once
the commercial area is platted. It should be noted, that if the property were parceled out
separately under CS zoning, signage would be allowed to be 20 feet in height. All signage will be
consistent with the standards set forth in the Owasso Zoning Code.
Access to the development is proposed off both East 96th St North and North Garnett Road, via two
main entrance drives. Smaller, secondary drives into the various commercial parcels will be
permitted, provided that they all adhere to the regulations set forth in the Owasso Zoning Code.
The final determination of all access points will occur at the time the property is platted. An internal
private road will connect the two main entrance drives; this private road will also serve to provide
internal circulation in the residential portion of the development. Additionally, the applicant is
proposing the construction of a trail system that will connect to the residential area's sidewalks and
allow residents of the development access to the wetland reserve area.
The private street system, landscaped entryways around the two main entrances, amenity areas
like the pocket parks, and the wetland reserve area will all be maintained by the Smith Farm Village
Homeowners' Association. Said Association will be established once the residential portion of the
property is platted.
A conceptual landscape plan showing various landscape buffer yards between the proposed
residential use and the adjacent commercial uses has been provided with the PUD documents. A
fully detailed landscape plan will be required to be submitted for City staff approval at the time of
site plan review for each phase of the development. All landscaping and off - street parking will be
required to meet the requirements identified in the Owasso Zoning Code.
The City of Owasso will provide water, sanitary sewer, fire, police, and ambulance services to the
property. Any future development that occurs on the subject property must adhere to all
Owasso subdivision, zoning, and engineering requirements.
HARMONY WITH THE EXISTING AND EXPECTED DEVELOPMENT:
After considering the existing zoning and land uses on the surrounding properties, staff has
determined that the proposed mixed -use development with a zoning of CS and RNX is
appropriate for this location. The subject property is located on the periphery of one of the City's
larger commercial corridors, so a mixed -use development such as the one proposed with this
PUD request does fit with exiting surrounding land uses. Further, the concept plan is designed to
complement surrounding uses and employs good transitional planning principals to protect the
proposed residential area from the adjacent commercial uses.

PLANNING COMMISSION & COUNCIL CONSIDERATION:
When evaluating a PUD, future planning issues must be considered. According to the Owasso
Zoning Code, the Planning Commission and City Council shall hold a public hearing on any PUD
application and determine the following:
1. Whether the PUD is consistent with the GrOwasso 2030 Land Use Master Plan.
2. Whether the PUD is in harmony with the existing and expected development of
surrounding areas.
3. Whether the PUD is a unified treatment of the development possibilities of the project
site.
4. Whether the PUD is consistent with the stated purpose and standards of the PUD
Ordinance, which are:
a. To permit innovative land development while maintaining appropriate limitation
on the character and intensity of use assuring compatibility with adjoining and
proximate properties;
b. To permit flexibility within the development to best utilize the unique physical
features of the particular site;
c. To provide and preserve meaningful open space; and
d. To achieve a continuity of function and design within the development.
PLANNING COMMISSION:
The Owasso Planning Commission voted 4 -0 to recommend approval of OPUD 21 -02 with
accompanying rezoning request OZ 21 -05, at their regular meeting on August 9, 2021.
RECOMMENDATION:
Staff recommends adoption of Ordinance 1182.

I. Development Concept
Smith Farm Village is a proposed ±33.97 acre mixed use development located on the
southeast corner of the intersection of North Garnett Road and East 96th Street North.
The tract has approximately 1,525 LF of frontage along both North Garnett Road and
East 96th Street North.
The property is abutted on the north, across East 96th Street North, by partially
developed Commercial zoned land (CG), to the east and south by the Commercial (CS)
zoned land that is developed as the Smith Farm Marketplace and to the west by partially
developed Commercial (CS and CG) zoned land, with the northern portion of this area
developed as the Fairway Market. The project site is currently zoned Agriculture (AG).
Submitted concurrently with this PUD application is a zoning request to re -zone the
PUD parcel to RNX, Residential Neighborhood Mixed, and CS, Commercial Shopping.
The site is characterized by moderately sloping terrain, with a drainageway that runs
northeast to southwest in the central portion of the project site. (See Exhibit `D' —
Existing Conditions Plan). There is no on -site FEMA 100 -year floodplain, but there are
USACE jurisdictional wetlands and a jurisdictional "blueline" located in the central
drainageway This wetlands area has a significant number of mature trees and the goal
will be to maintain most of the existing trees and create a nature preserve for this area.
The site geometry for the site's developable area is impacted by the centrally located
wetlands area which creates three distinct, irregularly shaped development areas; hence
it is felt that a PUD is the best way to develop this site.
The soil types found on the project site are typical for the area and should pose no
unusual developmental problems. The location of the PUD has very favorable
accessibility, location and visibility from surrounding roadways.
Smith Farm Village will feature three distinct land uses - commercial shopping tracts
along the arterial frontages of North Garnett Road and East 96th Street North, single -
family detached homes located on a private, gated street system in the south - central
interior portion of the PUD and a reserve /open space /nature preserve area where the
wetlands are situated between the northwest commercial tracts and south - central
residential uses. The private streets, in the residential portion of the PUD, will be
constructed to the City of Owasso standards. Access into the site will be from either
North Garnett Road or East 96th Street North. The access points into the commercial
tracts will be limited to eight (8), inclusive of the two (2) access points into the
residential area, and will be reviewed at the platting stage. All internal drives will be
privately owned and maintained.
The amenities that are to be provided at Smith Farm Village will be as required by the
City of Owasso Zoning Code and approved by the Community Development
Department. There is proposed to be a trail system that will connect the residential
area's sidewalks and internal pedestrian circulation and allow pedestrian access to the
nature preserve area, which will feature active and passive open space and a wildlife
viewing deck. The residential area will also feature a number of amenities for the

enjoyment of the neighborhood at Smith Farm Village. Two pocket parks are proposed
that will feature a combination of picnic areas, a pavilion/gazebo and a tot lot/playground
(each individual pocket park may feature some, but not all of these amenities). One of the
parks will seek to retain the existing Smith Farm silo, which will be integrated into this
park area. A Homeowners Association will be established for the residential portion of
the development that will have the responsibility of maintaining all reserve and amenity
areas in the residential and nature preserve area, as well as the landscaped entryways.
It is anticipated that Smith Farm Village will be developed in multiple phases, with
development commencing as soon as the appropriate approvals have been received.

VIII. Sidewalks
All sidewalks will meet the City of Owasso Zoning Ordinance and Subdivision
Regulations.
IX. Homeowners' Association
The Smith Farm Village Homeowners' Association, to be established for the Residential
portion of the PUD, will have as its main objective, the maintenance of the private street
system, landscaped entryways, amenity areas, pocket parks and reserve /nature preserve
area. Membership in Smith Farm Village Homeowners' Association will be mandatory
for all residential lot owners.
The Final documents for Smith Farm Village Homeowners' Association will be
included in the Deed of Dedication and Restrictive Covenants and will be on file in the
Tulsa County Clerk's office, along with the Final Plat, and will include the maintenance
agreement and other specific rights and requirements for association members.
X. Sign Standards
Unless otherwise noted, signs shall be installed in accordance with "Section 10.6.14
Signage" of the Owasso Zoning Ordinance.
XI. Site Plan Review
For the purpose of the site plan review requirements for the residential development
area, the approved final plat shall constitute the required detail site plan. Development
Area `E' - Reserve /Wetlands shall not be required to be included in the Final Plat.
XII. Schedule of Development
The initial development of Smith Farm Village is expected to commence after final
approval of the PUD and the platting of the property.

BACKGROUND:
The Community Development Department received an application for review and approval of the
closing of two (2) drainage easements located and described as follows:
CLOSURE OF A 15' DRAINAGE EASEMENT
The platted 15' drainage easement running along the southwest corner of Lot 3, Block 2, of
The Re -Plat of Lot 2, Block 1, Garrett Creek Center Phase IL
CLOSURE OF A 15' DRAINAGE EASEMENT
The platted 15' drainage easement running through the western portion of Lot 3, Block 1,
Garrett Creek Center Phase II.
The subject easements are located on property approximately one - quarter mile south of East 116th
Street North, on the west side of North 1351h East Avenue. The subject property was originally platted
as Lot 3, Block 1, and Lot 2, Block 1, Garrett Creek Center Phase II in 2006. A portion of the property
was re- platted in 2018 as Lot 3, Block 2, of The Re -Plat of Lot 2, Block 1, Garrett Creek Center Phase II.
The subject easements were platted with the original Garrett Creek Center Phase II plat in 2006 (Plat
#6054). The closure requests are being brought forth for consideration by the City Council because
the Garrett Creek Center Phase II Final Plat and The Re -Plat of Lot 2, Block 1, Garrett Creek Center
Phase II Final Plat were both approved and accepted by the City Council.
The applicant intends to construct a three -story multi -use office and commercial building on the
subject property. The proposed building would partially encroach on the two subject easements
and as such, the applicant seeks to close the two (2) easements. The easements were platted using
a conceptual site plan that was never realized. The applicant is currently in the process of
dedicating a new drainage easement that will complement the newer site plan that has been
approved to serve the proposed development. As such, the applicant has determined that these
easements are unnecessary and no longer needed.
All required notices were sent to all franchise holders and utility companies. The City of Owasso
Public Works Department was also contacted regarding the closing of the drainage easements and
indicated there should be no impacts to future utilities. No other utilities appear to be affected by
the closing of these easements. No utility companies had an issue with the proposed closing of
these easements.
Upon City Council action to close the easements, the applicant is advised to take this item to District
Court and file for vacation of the easements, which will completely remove them from the books.

BACKGROUND:
Pelivan Transit is a demand - response transportation service operated by the Grand Gateway
Economic Development Association. Pelivan Transit is a non - profit organization, operating
primarily on funding from government and corporate entities, including federal and state grants.
Pelivan Transit focuses on providing transportation to individuals who do not consistently have a
private means of transportation.
Now in its thirteenth year of operation in Owasso, the program has developed a stable customer
base.
Pelivan Transit began its Owasso operations in December 2007, following City Council action to
approve a one -year agreement for transportation services between the City of Owasso and
Grand Gateway in the amount of $41,975. Following a surge in the price of fuel, the City's
contribution increased in the second year of operation to $49,393. The City's contribution
remained the same for the third and fourth year of operation as Grand Gateway continued to
receive additional state and federal grant funding. The FY 2013 request was $49,393, and the
requests for FY 2014 through FY 2021 were $51,000.
For the FY 2022, Pelivan Transit is again requesting $51,000 from the City of Owasso to cover the
local match, 19% of the total operating budget. These funds were included in the City's annual
budget.
RECOMMENDATION:
Staff recommends approval of the Purchase of Service Agreement between the City of Owasso
and Grand Gateway Economic Development Association (Pelivan Transit) of Big Cabin,
Oklahoma, in the amount of $51,000, and authorization to execute the agreement.

As you can see the numbers have dropped by over 5% since FY -19. This drop was significate because of
the state shut -down. Service are slowly returning to steady level, and as a herd immunity is developed
with the help of the COVID -19 vaccinations available we look to be close to full capacity by end of fiscal
year 2021.
Pelivan will be extending/expanding service options in the Owasso area on June 1, 2021 with the
implementation of PICK Transportation. PICK Transportation is a mobility service offering on
demand/curb to curb option Monday -Friday (5 PM -10 PM) and Saturdays (10 AM -2 PM) covering 21
counties in the state of Oklahoma with Pelivan acting as lead agency.
We are requesting $51,000 for required local match funding for the support of Capital, Administration
and Operational costs of a three (3) vehicle operation to the City of Owasso for FY -22. The total budget
for FY -2022 is $265,550 and the requested local match from the City of Owasso is 19% of this amount.
We have secured $240,550 through federal, state and other local grants for this valuable service. Please
let us know if you are interested in discussing this possibility. We have not requested any local match for
vehicle procurement since the inception of this service to Owasso began. Our only concern continues to
be growing demand and popularity of this successful program for the citizens of Owasso. It would be easy
to operate a four vehicle service and extend hours daily and offer weekend transit services as well. If the
City of Owasso decides to expand these services, then let us know and we will prepare a budget estimate
for additional services for future planning needs.
I am available to clarify any budget information and can certainly attend any meetings, if needed. If the
requested amount is granted, then please execute the enclosed copies of the Purchase of Service
Agreement and return to us for Ed's signature. We will return a completed contract for your files. If there
are any changed, then please contact me for the adjustments accordingly. It is a pleasure to serve the
Owasso area residents in their transportation needs.

Purchase of Service Agreement
This agreement establishes a Purchase of Service Agreement made and entered into on the _
day of 2021, between the City of Owasso and Grand Gateway Economic Development
Association/PELIVAN TRANSIT regarding the financial assistance to the Association for the operation
of a demand - response Public Transportation System operated by Pelivan Transit for FY -2022,
Whereas, the City of Owasso and area business leaders have identified certain community needs
and set certain goals for the economic development of the community.
Whereas, there is a need to implement programs for the City of Owasso to meet a need to provide
services to attract and serve the elderly and retirees in order to become a more desirable retirement
community, as well as providing a much needed service to all citizens of the community;
Whereas, the Grand Gateway Economic Development Association is operating a Transportation
Program established under the Oklahoma Department of Transportation Section 5311 Transportation
Program which will provide public transportation for the citizens of Owasso and has requested the City to
assist in financing this program.
Whereas, the City of Owasso will provide $51,000 to the Association for Grand Gateway's
service in providing public transportation to the citizens of Owasso, Oklahoma Payments may be
rendered in ten (10) monthly payments of $5,100 or a lump sum payment payable to Grand Gateway
E.D.A. /Pelivan Transit, P.O. Drawer B, Big Cabin, OK 74332. Grand Gateway /Pelivan Transit will
provide ridership totals for the previous month based on actual ridership with each monthly billing.
Whereas, Grand Gateway's Pelivan Transit will assign three (3) vehicles with drivers, and one (1)
dispatcher for the City of Owasso located at the Pelivan Transit headquarters in Big Cabin, Oklahoma for
the transportation needs of the citizens of Owasso and the surrounding area commencing October 1, 2021
through September 30, 2022 (FY -2022) to operate the demand- response city /rural/variable distance routes
from 8:00 a.m, to 4:00 p.m. Monday through Friday with the exception of Holiday's as listed below:

if the Federal funding is discontinued. The State assumes no responsibility to fund this program if there is
a failure of Federal Funding.
CONTINUING LOCAL ASSISTANCE: This AGREEMENT is for the period indicated above
and is subject to early renewal by the governing body of the City of Owasso.
INSURANCE: Grand Gateway Economic Development Association, d/b /a Pelivan Transit, shall
maintain liability insurance on all vehicles covered by this AGREEMENT with limits of liability in the
amount of Five Million and no /100 dollars ($5,000,000.) for any number of claims arising out of a single
occurrence or accident, and shall provide proof of coverage to the City of Owasso when requested.
Whereas, the terms of this letter of agreement may be changed only through mutual agreement by
both parties.

BACKGROUND:
In November 2019, City Council awarded Cherokee Builders, Inc., of Tulsa, Oklahoma, a
$4,592,794.33 contract for the Owasso Sports Park Detention Pond and Mitigation Project. Work
within the contract included construction of a regional detention pond to detain stormwater
from Hale Acres and Meadowcrest subdivisions, and future undeveloped adjacent areas. The
project also included mitigation work to accommodate wetlands, ponds, and a jurisdictional
stream channel.
In July 2021, Cherokee Builders Inc., completed all work within the contract. City staff has
inspected the work and agree that all requirements and standards have been met. The final
payment of $215,952.99, which includes $6,000.00 in liquidated damages, results in a final
contract amount of $4,433,059.93, a contract underrun of $159,734.40.
FUNDING:
Funding for this project is available in the Stormwater and Capital Improvement Funds.
RECOMMENDATION:
Staff recommends acceptance of the Owasso Sports Park Detention Pond and Mitigation
Project and authorization for final payment to Cherokee Builders, Inc., of Tulsa, Oklahoma, in the
amount of $215,952.99.

For many years, the City of Owasso's rapid development has been monitored by the City
Engineer's office. The City Engineer's office reviews plats for subdivisions and commercial
properties throughout the City to make sure streets, storm water conveyance systems, and water
and sewer lines are designed and constructed to City standards.
Stormwater detention and erosion control are critical aspects of development within the City of
Owasso. With the constantly changing regulations, an annual contract with a consulting firm
specializing in stormwater management was established in 2007 to review stormwater plans in
order to protect the interests of the City. The consultant works on an "as needed" basis and
charges are based on an hourly rate schedule. The City Engineer's office determines plans that
can be reviewed "in- house" and those that need analysis by the expert consultant.
Since 2007, a firm has been retained annually on a contractual basis to provide these services
for the fiscal year. Engineering selection for these services has been quality based with emphasis
on past performance. Meshek & Associates, LLC, performed these services in 2007, and from
2009 to present. The Benham Companies provided these services in 2008.
With the expiration of the existing agreement, the annual contract to retain Meshek and
Associates for the miscellaneous stormwater and erosion control engineering projects for FY
2021 -2022 is recommended for consideration. If approved, the expiration date will be June 30,
2022.
FUNDING:
Funding for engineering services is included in fhe Stormwater Fund budget.
RECOMMENDATION:
Staff recommends approval of the Agreement for Engineering Services with Meshek &
Associates, LLC, of Tulsa, Oklahoma, in an amount not to exceed $50,000.00, and authorization
to execute the agreement.

AGREEMENT FOR ENGINEERING SERVICES
FOR THE CITY OF OWASSO, OK
MISCELLANEOUS STORMWATER AND EROSION CONTROL ENGINEERING PROJECTS
THIS AGREEMENT, made and entered into this 17th day of August, 2021 between the City
of Owasso, Oklahoma, a Municipal Corporation, of Oklahoma, hereinafter referred to as
CITY, and Meshek & Associates, LLC, hereinafter referred to as ENGINEER;
WITNESSETH:
WHEREAS, CITY intends to analyze various stormwater or erosion control issues for
existing infrastructure, to review existing ordinances for possible revision, to provide
stormwater reviews of development projects and to assist the City in general stormwater
review or design services, hereinafter referred to as the PROJECT; and,
WHEREAS, CITY requires certain professional services in connection with the PROJECT,
hereinafter referred to as the SERVICES; and,
WHEREAS, ENGINEER, is prepared to provide such SERVICES;
WHEREAS, funding is available for the PROJECT through the fiscal year 2021 -2022
Stormwater Management Budget;
NOW THEREFORE, in consideration of the promises contained herein, the parties hereto
agree as follows:
1. SCOPE OF PROTECT. The scope of the PROJECT is described in Attachment A,
SCOPE OF PROJECT, which is attached hereto and incorporated by reference as part
of this AGREEMENT.
2. SERVICES TO BE PERFORMED BY ENGINEER. ENGINEER shall perform the
SERVICES described in Attachment B, SCOPE OF SERVICES which is attached
hereto and incorporated by reference as part of this AGREEMENT.
3. CITY'S RESPONSIBILITIES. CITY shall be responsible for all matters described in
Attachment C, RESPONSIBILITIES OF THE CITY, which is attached hereto and
incorporated by reference as part of this AGREEMENT.
4. COMPENSATION. CITY shall pay ENGINEER in accordance with Attachment D,
COMPENSATION, and further described in Attachment E, BILLING RATE SHEET,
which are attached hereto and incorporated by reference as part of this
AGREEMENT.
5. SCHEDULE. ENGINEER shall perform the SERVICES described in Attachment B,
SCOPE OF SERVICES, in accordance with the schedule set forth in Attachment F,
SCHEDULE attached hereto and incorporated by reference as part of this
AGREEMENT.
6. STANDARD OF PERFORMANCE. ENGINEER shall perform the SERVICES
undertaken in a manner consistent with the prevailing accepted standard for similar
services with respect to projects of comparable function and complexity and with the
applicable laws and regulations published and in effect at the time of performance of
the SERVICES. The PROJECT shall be designed and engineered in a good and
workmanlike manner and in strict accordance with this AGREEMENT. All

engineering work shall be performed by or under the supervision of Professional
Engineers licensed in the State of Oklahoma, and properly qualified to perform such
engineering services, which qualification shall be subject to review by CITY. Other
than the obligation of the ENGINEER to perform in accordance with the foregoing
standards, no warranty, either express or implied, shall apply to the SERVICES to be
performed by the ENGINEER pursuant to this AGREEMENT or the suitability of
ENGINEER'S work product.
7. LIMITATION OF RESPONSIBILITY.
7.1. ENGINEER shall not be responsible for construction means, methods,
techniques, sequences, procedures, or safety precautions and programs in
connection with the PROJECT.
7.2. The presence of ENGINEER's personnel at a construction site is for the
purpose of providing to the CITY a greater degree of confidence that the
completed construction work will conform generally to the construction
documents and that the integrity of the design concept as reflected in the
construction documents has been implemented and preserved by the
construction contractor(s).
7.3. In soils, foundation, groundwater, and other subsurface investigations, the
actual characteristics may vary significantly between successive test points
and sample intervals and at locations other than where observations,
exploration, and investigations have been made. Because of the inherent
uncertainties in subsurface evaluations, changed or unanticipated
underground conditions may occur that could affect total PROJECT cost
and /or execution. These conditions and cost /execution effects are not the
responsibility of ENGINEER.
7.4. Record drawings will be prepared, in part, on the basis of information
compiled and furnished by others, and may not always represent the exact
location, type of various components, or exact manner in which the PROJECT
was finally constructed. ENGINEER is not responsible for any errors or
omissions in the information from others that is incorporated into the record
drawings.
7.5. ENGINEER's deliverables, including record drawings, are limited to the
sealed and signed hard copies. Computer - generated drawing files furnished
by ENGINEER are for CITY or others' convenience. Any conclusions or
information derived or obtained from these files will be at user's sole risk.
8. OPINIONS OF COST AND SCHEDULE.
8.1. Since ENGINEER has no control over the cost of labor, materials, equipment,
or services furnished by others, or over contractors', subcontractors', or
vendors' methods of determining prices, or over competitive bidding or
market conditions, ENGINEER'S cost estimates shall be made on the basis of
qualifications and experience as a Professional Engineer.
8.2. Since ENGINEER has no control over the resources provided by others to
meet construction contract schedules, ENGINEER'S forecast schedules shall

be made on the basis of qualifications and experience as a Professional
Engineer.
9. LIABILITY AND INDEMNIFICATION.
9.1. The ENGINEER shall indemnify and hold the CITY and the CITY's officers
and employees harmless from and against damages, losses and judgments
arising from claims by third parties, including reasonable attorneys' fees and
expenses recoverable under applicable law, but only to the extent they are
caused by the negligent acts or omissions of the ENGINEER, its employees
and its consultants in the performance of professional services under this
Agreement. The ENGINEER's duty to indemnify the CITY under this
provision shall be limited to the available proceeds of insurance coverage.
9.2. ENGINEER shall not be liable to CITY for any special, indirect or
consequential damages, such as, but not limited to, loss of revenue, or loss of
anticipated profits.
10. CONTRACTOR INDEMNIFICATION AND CLAIMS.
10.1. CITY agrees to include in all construction contracts the provisions of Articles
7.1, and 7.2, and provisions providing contractor indemnification of CITY
and ENGINEER for contractor's negligence.
10.2. CITY shall require construction contractor(s) to name CITY and ENGINEER
as additional insureds on the contractor's general liability insurance policy.
11. COMPLIANCE WITH LAWS. In performance of the SERVICES, ENGINEER shall
comply with applicable regulatory requirements including federal, state, and local
laws, rules, regulations, orders, codes, criteria and standards. ENGINEER shall
procure the permits, certificates, and licenses necessary to allow ENGINEER to
perform the SERVICES. ENGINEER shall not be responsible for procuring permits,
certificates, and licenses required for any construction unless such responsibilities
are specifically assigned to ENGINEER in Attachment B, SCOPE OF SERVICES.
12. INSURANCE.
12.1. During the performance of the SERVICES under this AGREEMENT,
ENGINEER shall maintain the following insurance:
12.1.1. General Liability Insurance with bodily injury limits of not less than
$1,000,000 for each occurrence and not less than $1,000,000 in the aggregate,
and with property damage limits of not less than $100,000 for each
occurrence and not less than $100,000 in the aggregate.
12.1.2. Automobile Liability Insurance with bodily injury limits of not less
than $1,000,000 for each person and not less than $1,000,000 for each accident
and with property damage limits of not less than $100,000 for each accident.
12.1.3. Worker's Compensation Insurance in accordance with statutory
requirements and Employers' Liability Insurance with limits of not less than
$100,000 for each occurrence.

12.1.4. Errors and Omissions Insurance to remain in effect during the
PROJECT and the term of any legal liability. Errors and Omissions coverage
to be for a minimum of $1,000,000.
12.2. ENGINEER shall furnish CITY updated certificates of insurance upon
request at anytime throughout the duration of the contract.
13. OWNERSHIP AND REUSE OF DOCUMENTS.
13.1. All documents, including original drawings, estimates, specifications, field
notes and data shall become and remain the property of the CITY.
13.2. CITY'S reuse of such documents without written verification or adaptation
by ENGINEER for the specific purpose intended shall be at CITY'S risk.
14. TERMINATION OF AGREEMENT.
14.1. The obligation to continue SERVICES under this AGREEMENT may be
terminated by either party upon fifteen days written notice in the event of
substantial failure by the other party to perform in accordance with the terms
hereof through no fault of the terminating party.
14.2. CITY shall have the right to terminate this AGREEMENT, or suspend
performance thereof, for CITY'S convenience upon written notice to
ENGINEER; and ENGINEER shall terminate or suspend performance of
SERVICES on a schedule acceptable to CITY. In the event of termination or
suspension for CITY'S convenience, CITY shall pay ENGINEER for all
SERVICES performed to the date of termination in accordance with
provisions of Attachment D, COMPENSATION. Upon restart of a suspended
project, ENGINEER's contract price and schedule shall be equitably adjusted.
15. NOTICE.
Any notice, demand, or request required by or made pursuant to this AGREEMENT
shall be deemed properly made if personally delivered in writing or deposited in the
United States mail, postage prepaid, to the address specified below.

15.1. Nothing contained in this Article shall be construed to restrict the
transmission of routine communications between representatives of
ENGINEER and CITY.
16. UNCONTROLLABLE FORCES, Neither CITY nor ENGINEER shall be considered to
be in default of this AGREEMENT if delays in or failure of performance shall be due
to forces which are beyond the control of the parties; including, but not limited to:

fire, flood, earthquakes, storms, lightning, epidemic, war, riot, civil disturbance,
sabotage; inability to procure permits, licenses, or authorizations from any state,
local, or federal agency or person for any of the supplies, materials, accesses, or
services required to be provided by either CITY or ENGINEER under this
AGREEMENT; strikes, work slowdowns or other labor disturbances, and judicial
restraint.
17. SEVERABILITY. If any portion of this AGREEMENT shall be construed by a court
of competent jurisdiction as unenforceable, such portion shall be severed herefrom,
and the balance of this AGREEMENT shall remain in full force and effect.
18. INTEGRATION AND MODIFICATION. This AGREEMENT includes
ATTACHMENTS A, B, C, D, E, and F and represents the entire and integrated
AGREEMENT between the parties; and supersedes all prior negotiations,
representations, or agreements pertaining to the SCOPE OF SERVICES herein, either
written or oral. CITY may make or approve changes within the general Scope of
Services in this AGREEMENT. If such changes affect ENGINEER's cost of or time
required for performance of the services, an equitable adjustment will be made
through an amendment to this AGREEMENT. This AGREEMENT may be amended
only by written instrument signed by each of the Parties.
19. DISPUTE RESOLUTION PROCEDURE. In the event of a dispute between the
ENGINEER and the CITY over the interpretation or application of the terms of this
AGREEMENT, the matter shall be referred to the City's Director of Public Works for
resolution. If the Director of Public Works is unable to resolve the dispute, the matter
may, in the Director's discretion, be referred to the City Manager for resolution.
Regardless of these procedures, neither party shall be precluded from exercising any
rights, privileges or opportunities permitted by law to resolve any dispute.
20. ASSIGNMENT. ENGINEER shall not assign its obligations undertaken pursuant to
this AGREEMENT, provided that nothing contained in this paragraph shall prevent
ENGINEER from employing such independent consultants, associates, and
subcontractors as ENGINEER may deem appropriate to assist ENGINEER in the
performance of the SERVICES hereunder.
21. APPROVAL. It is understood and agreed that all work performed under this
AGREEMENT shall be subject to inspection and approval by the Public Works
Department of the City of Owasso, and any plans or specifications not meeting the
terms set forth in this AGREEMENT will be replaced or corrected at the sole expense
of the ENGINEER. The ENGINEER will meet with the City staff when requested and
will be available for public meetings and City of Owasso presentations.
22. CONTRACT EXTENTIONS. Upon approval of the Public Works Department and the
Consultant, this contract may be extended for three (3) successive, one (1) year terms
if agreed to by both parties in writing not less than sixty (60) days prior to the
expiration of the initial one (1) year or of any successive one (1) year term. Hourly rate
changes from the consultant and maximum contract are subject to change. This
extention is the first extention of a maximum of three (3) extentions.
23. KEY PERSONNEL. In performance of the SERVICES hereunder, ENGINEER has
designated Chris Duncan as Project Manager for the PROJECT. ENGINEER agrees

that no change will be made in the assignment of this position without prior
approval of CITY.
IN WITNESS WHEREOF, the parties have executed this AGREEMENT in multiple copies
on the respective dates herein below reflected to be effective on the date executed by the

SCOPE OF PROTECT. The PROJECT shall consist of civil engineering services for the
following categories of assignments:
1. Review of hydrology and hydraulic reports and studies for development projects;
2. Assistance in the development of policies and ordinances related to stormwater, erosion
control or the Municipal Separate Stormsewer System (MS -4);
3. Specific assignments related to hydrology and hydraulics that may arise with regard to
existing installed infrastructure or proposed development projects;
4. Review of hydrology and hydraulic reports for developments as they relate to the City
of Owasso Master Drainage Plan;
5. Review of floodplain issues regarding FEMA regulated floodplains and floodways; and
6. Any other Stormwater or erosion control issues that the City requests assistance.

The services to be performed by the ENGINEER, Meshek & Associates, LLC, under this
AGREEMENT will consist of providing civil engineering services for the categories of
assignments presented in Attachment A, as directed individually by the City by a work
order.
Further, it is understood and agreed that the date of beginning, rate of progress, and the
time of completion of the work to be done hereunder for each assignment are essential
provisions of this AGREEMENT; and it is further understood and agreed that the work
embraced in this AGREEMENT shall commence upon execution of this AGREEMENT and
receipt of Notice to Proceed for each assignment. It is further understood that all reviews
and conceptual designs will be prepared in accordance with the City of Owasso design
criteria and specifications for construction.
B.1. Basic Services of ENGINEER. The basic services of the ENGINEER shall
include, but are not limited to the following tasks:
B.l.a) Provide miscellaneous stormwater engineering review of development
projects as directed by the City. The work will include:
B.1.a) 1. General review of engineering plans and reports for
compliance with City criteria and policies.
B.l.a) 2. If specifically directed by the CITY, to model a proposed
development or other infrastructure project in the applicable
HEC -HMS and HEC -RAS watershed model for the City of
Owasso.
B.1.b) Provide analysis and conceptual design of stormwater or erosion control
improvements, when directed individually by the City. The work will
generally include the following elements:
B.1.b) 1. Preparation of detailed hydrologic and hydraulic models of
localized areas.
B.1.b) 2. Preparation of conceptual plans to deal with the flooding
problems.
B.1.b) 3. Prepare of conceptual cost estimates for budget purposes.
B.1.b) 4. Preparation of a letter report documenting findings.
B.1.b) 5. Review of existing city ordinances or preparation of new city
ordinances addressing stormwater or erosion control issues.

Responsibilities of the City
Attachment C
RESPONSIBILITIES OF THE CITY. The CITY agrees:
C.1 Reports, Records, etc. To furnish, as required by the work, and not at expense to the
ENGINEER:
C.1.1 Records, reports, studies, plans, drawings, and other data available in the
files of the CITY that may be useful in the work involved under this
AGREEMENT.
C.1.2 Standard construction drawings and standard specifications.
C.1.3 ENGINEER will reasonably rely upon the accuracy, timeliness, and
completeness of the information provided by CITY.
C.2 Access. To assist in providing access to public and private property when required
in performance of ENGINEER's services.
C.3 Staff Assistance. Designate the City Engineer (or another individual designated in
writing) to act as its representative in respect to the work to be performed under this
AGREEMENT, and such person shall have complete authority to transmit
instructions, receive information, interpret and define CITY'S policies and decisions
with respect to materials, equipment, elements and systems pertinent to the services
covered by this AGREEMENT.
C.3.1 Furnish staff assistance in locating, both horizontally and vertically, existing
CITY owned utilities and in expediting their relocation as described in
Attachment B. Further, CITY will furnish assistance as required in obtaining
locations of other utilities, including "potholing'.
C.3.2 Furnish legal assistance as required in the preparation of bidding,
construction and other supporting documents.
CA Review. Examine all studies, reports, sketches, estimates, specifications, drawings,
proposals and other documents presented by ENGINEER and render in writing
decisions pertaining thereto within a reasonable time so as not to delay the services
of ENGINEER.

Compensation
Attachment D
COMPENSATION. The CITY agrees to pay, as compensation for services set forth in
Attachment B, the following fees, payable monthly as each Phase of the work progresses;
and within 30 calendar days of receipt of invoice. ENGINEER shall submit monthly
invoices based upon actual hours or work, invoiced according the Rate Schedule provided
in ATTACHMENT E, completed at the time of billing. Invoices shall be accompanied by
such documentation as the CITY may require in substantiation of the amount billed.
D.1 Total Compensation.
D.1.1 For the work under this project the total maximum billing including direct
costs and subconsultant services shall be Fifty Thousand Dollars and no cents
($50,000.00) which amount shall not be exceeded without further written
authorization by CITY.
D.2 Subconsultants and Other Professional Associates. Services of subcontractors
and other consultants shall be compensated for at actual cost. Use of sub -
consultants shall be authorized in advance by CITY.
D.3 Other Direct Costs.
D.3.1 Travel and subsistence shall be compensated for at actual cost. Local travel
by personal or firm automobile shall be compensated for at the rate currently
allowed by the IRS.
D.3.2 Printing expenses shall be compensated for as shown in ATTACHMENT E.
D.3.3 Any other direct costs shall be compensated for at actual when authorized in
advance by CITY.
DA Additional Services. Unless otherwise provided for in any accepted and
authorized proposal for additional services, such services shall be
compensated for on the same basis as provided for in Attachment D.
D.5 Terminated Services. If this AGREEMENT is terminated, ENGINEER shall
be paid for services performed to the effective date of termination.
D.6 Conditions of Payment.
D.6.1 Payments shall be made based on actual hours worked using the rates in
ATTACHMENT E and expenses incurred as indicated within this
AGREEMENT and shall be due and owing within thirty days of
ENGINEER'S submittal of his progress payment invoices.

D.6.2 If CITY fails to make payments due ENGINEER within sixty days of the
submittal of any progress payment invoice, ENGINEER may, after giving
fifteen days written notice to CITY, suspend services under this
AGREEMENT.
D.6.3 If the PROJECT is delayed, or if ENGINEER'S services for the PROJECT are
delayed or suspended for more than ninety days for reasons beyond
ENGINEER'S control, ENGINEER may, after giving fifteen days written
notice to CITY, request renegotiation of compensation.

BACKGROUND:
Annually, street rehabilitation sites are evaluated and selected based on a comprehensive
assessment of roadway conditions. The selection process is aimed at maximizing the taxpayer's
return on investment by increasing roadway lifecycle and minimizing future maintenance costs,
while enhancing overall roadway driving conditions and public safety.
PRIORITY STREET REPAIRS /MAINTENANCE IDENTIFIED:
In July 2021, the Public Works staff completed an update to the City's street inventory. The data
collected for the model was adjusted to reflect changes in segment conditions and a new
priority listing was generated. A map depicting the location of the proposed priority sites is
attached for City Council's consideration.
The estimated cost for the base project is $1,733,000. In order to maximize funding, should the
base bid be less than estimated, staff has included five (5) alternates in an estimated amount of
$505,000.
PROJECT FUNDING:
Funding for this project in the amount of $1,000,000 is available in the Capital Improvements
Fund. In addition, the Half -Penny Sales Tax Fund has $800,000 allocated for this fiscal year's
street repair program. As a result, total funding available for the annual program is $1,800,000.
RECOMMENDATION:
The staff recommends approval of the 2022 Street Rehabilitation Program priority sites.

Pursuant to O.S. 27A 2 -6 -304, the City of Owasso is hereby granted this Tier I Permit to construct 4,086
linear feet of eight (8) inch PVC sanitary sewer line and all appurtenances to serve the Hawk's Landing,
located in Section 34, T -21 -N, R -14-E, Tulsa County, Oklahoma, in accordance with the plans approved
July 23, 2021.
By acceptance of this permit, the permittee agrees to operate and maintain the facilities in accordance with
the "Oklahoma Pollutant Discharge Elimination System Standards - OPDES" (OAC 252:606) rules and to
comply with the state certification laws, Title 59, Section 1101 -1116 O.S. and the rules and regulations
adopted thereunder regarding the requirements for certified operators.
This permit is issued subject to the following provisions and conditions.
That the recipient of the permit is responsible that the project receives supervision and inspection
by competent and qualified personnel.
That construction of all phases of the project will be started within one year of the date of approval
or the phases not under construction will be resubmitted for approval as a new project.
That no significant information necessary for a proper evaluation of the project has been omitted
or no invalid information has been presented in applying for the permit.
That wherever water and sewer lines are constructed with spacing of 10 feet or less, sanitary
protection will be provided in accordance with OAC 252:656- 5- 4(c)(3) of the standards for Water
Pollution Control Facility Construction.
That tests will be conducted as necessary to insure that the construction of the sewer lines will
prevent excessive infiltration and that the leakage will not exceed 10 gallons per inch of pipe
diameter per mile per day.
That the Oklahoma Department of Environmental Quality shall be kept informed of occurrences
which may affect the eventual performance of the works or that will unduly delay the progress of
the project.

7) That the permittee will take steps to assure that the connection of house services to the sewers is
done in such a manner that the functioning of the sewers will not be impaired and that earth and
ground water will be excluded from the sewers when the connection is completed.
8) That any deviations from approved plans or specifications affecting capacity, flow or operation of
units must be approved by the Department before any such deviations are made in the construction
of this project.
9) That any notations or changes recorded on the official set of plans and specifications in the
Oklahoma Department of Environmental Quality files shall be part of the plans as approved.
10) That the recipient of the permit is responsible for the continued operation and maintenance of these
facilities in accordance with rules and regulations adopted by the Environmental Quality Board, and
that this Department will be notified in writing of any sale or transfer of ownership of these facilities.
11) The issuance of this permit does not relieve the responsible parties of any obligations or liabilities
which the permittee may be under pursuant to prior enforcement action taken by the Department.
12) That the permittee is required to inform the developer /builder that a DEQ Storm Water Construction
Permit is required for a construction site that will disturb one (1) acre or more in accordance with
OPDES, 27A O.S. 2 -6 -201 et. seq. For information or a copy of the GENERAL PERMIT (OKR10)
FOR STORM WATER DISCHARGES FROM CONSTRUCTION ACTIVITIES, Notice of Intent
(NOI) form, Notice of Termination (NOT) form, or guidance on preparation of a Pollution Prevention
Plan, contact the Storm Water Unit of the Water Quality Division at P.O. Box 1677, Oklahoma City,
OK 73101 -1677 or by phone at (405) 702 -8100.
13) That all manholes shall be constructed in accordance with the standards for Water Pollution Control
Facility Construction (OAC 252:656 -5 -3), as adopted by the Oklahoma Department of
Environmental Quality.
14) That when it is impossible to obtain proper horizontal and vertical separation as stipulated in Water
Pollution Control Facility Construction OAC 252:656- 5- 4(c)(1) and OAC 252:656- 5- 4(c)(2),
respectively, the sewer shall be designed and constructed equal to water pipe, and shall be
pressure tested using the ASTM air test procedure with no detectable leakage prior to backfilling,
in accordance with the standards for Water Pollution Control Facility Construction OAC 252:656-5 -
4(c)(3).
