The subject property is located at 12600 East 1 16th Street North and is approximately 3.27 acres. The property has a current Tulsa County zoning of AG -R (Agriculture - Residential). Upon annexation, the entire property would be brought into the city limits of Owasso as CS (Commercial Shopping). 7. OLS 21 -07 - Lot Split, Reunion of Owasso - Consideration and appropriate action relating to the request for the review of a lot split that will create two tracts from a 5.98 acre parent tract. Tract "A' will contain 2.99 acres and the remainder Tract "B" will contain 2.99 acres. Main (west side) at 9:45am on August 4, 2021. ITEM 1. CALL TO ORDER Mr. Miller called the meeting to order at 6:00 pm. ITEM 2. Flag Salute ITEM 3. Roll Call PRESENT Dr. Loving Tim Miller David Vines Jeri Moberly A quorum was declared present. Approval of Minutes from July 12, 2021 Regular Meeting. The Commission reviewed the minutes. Dr. Loving moved, seconded by Mr. Vines to approve the minutes from the July 12, 2021 Regular Meeting. A vote on the motion was recorded as follows: YEA: Dr. Loving, Mr. Vines, Mr. Miller ABSTAIN: Ms. Moberly NAY: None Motion carried 3 -1. ITEM 6. OPUD 21 -02 /0Z 21 -05 - Smith Farm Village - Consideration and appropriate action relating to the request for the approval of a Planned Unit Development (PUD) with the underlying zoning of CS (Commercial Shopping) and RNX (Residential Neighborhood Mixed). The subject property is generally located at the southeast corner of the intersection of East 961h Street North and North Garnett Road. The subject property is 33.9651 acres and is zoned AG (Agriculture). Ms. Beemer presented the staff report. The location was described. The Technical Advisory Committee reviewed this request at the July 21, 2021 meeting. Staff recommends approval of the PUD /rezoning request. A representative for the applicant was present to answer any questions or address any concerns. OWASSO PLANNING COMMISSION August 9, 2021 Page No. 2 Mr. Rickey Hayes with Retail Attractions, LLC stated that he represents the commercial developer and would be happy to answer any questions the Commissioners may have. The use of the private streets within the residential portion was discussed. Mr. Nathan Cross, a representative for Capital Homes, explained that the residential portion will be owned by one, single owner and the concept of private streets makes more sense. Dr. Loving moved, seconded by Mr. Vines, to approve the PUD /rezoning request, rezoning the property from Agriculture (AG) to Commercial Shopping (CS) and Residential Neighborhood Mixed (RNX), subject to TAC and Staff comments. A vote on the motion was recorded as follows: YEA: Dr. Loving, Mr. Vines, Mr. Miller, Ms. Moberly NAY: None Motion carried 4 -0. ITEM 7. OLS 21 -06 - Lot Split, Garrett Creek - Consideration and appropriate action relating to the request for the approval of a lot split that will create a 0.70 acre lot from a parent tract of 8.85 acres. The property is located at 11298 North 135th East Avenue (Re -plat of Garrett Creek Center Phase II) and is zoned CS (Commercial Shopping). Mr. Fritschen presented the staff report. The location was described. The Technical Advisory Committee reviewed this request at the July 21, 2021 meeting. Staff recommends approval of the Lot Split request. A representative for the applicant was present to answer any questions or address any concerns. The subject property is composed of approximately 3.27 acres of land and is currently zoned Agricultural - Residential (AG -R) in Tulsa County. Upon annexation, the applicant is requesting the property be brought into Owasso City limits as Commercial Shopping (CS) via an accompanying rezoning request (OZ 21 -06). Typically, property is annexed with Agriculture (AG) zoning or as the County's corresponding zoning designation under the Owasso Zoning Code. However, an applicant may request an Page 2 OA 21 -04, OZ 21 -06 alternate zoning be applied if said zoning corresponds to the Land Use Master Plan and is advertised in accordance with statutory requirements. In this case, the GrOwasso 2030 Land Use Master Plan identifies the subject property for future Commercial land uses. Therefore, assigning a zoning of CS to the property upon annexation is consistent with the Land Use Plan. The subject property is currently unplatted, and contains one (1) single - family residence. The applicant intends to market this property for commercial purposes, which is also consistent with the uses identified in GrOwasso 2030 Land Use Master Plan for this location. Commercial development at this location would complement the emerging commercial corridor just to the east, near the intersection of E 1 161h St N and N 1291h E Ave. The City of Owasso will provide police, fire, ambulance and sanitary sewer services to the property upon annexation. Washington County Rural Water District #3 will provide water services to this property. The underlying zoning is CS, within the US -169 Overlay District. The applicant has indicated that Lot 2, Block 1 of this Preliminary Plat will contain a medical office building. Lots 1 and 3 will remain vacant. All three of the proposed lots as depicted on this Plat meet the bulk and area requirements stipulated in the Owasso Zoning Code for the CS zoning district. There will be two points of access for this subdivision. One point of access will be off of East 106th Street North, via thirty (30) foot wide drive. This Final Plat consists of thirty -seven (37) Lots on six (6) Blocks with one (1) reserve area, encompassing a total area of approximately 1 1.64 acres. Staff has determined that all of the proposed lots within the Plat meet the Bulk and Area Requirements for property zoned RS -3, as laid out in the Owasso Zoning Code. This project is a continuation of the Abbott Farms development, and is the final phase of development for this neighborhood. Phase III, as described in this Plat, is located in between Phases I and II of the Abbott Farms neighborhood. The Plat shows perimeter and interior utility easements that will allow utilities adequate access to provide and maintain service to the proposed development. Stormwater Detention has been accounted with the regional detention pond recently constructed in the Owasso Sports Park. All internal streets will be public and dedicated to the City. There are no amenities provided within this Plat, as it has straight RS -3 zoning and is not part of a Planned Unit Development (PUD), which requires amenities. The City of Owasso will provide water, sanitary sewer, Fire, Police, and EMS services to the proposed residential development.
