The subject property is located at 12600 East 1 16th Street North and is approximately 3.27 acres. The property has a current Tulsa County zoning of AG- R (Agriculture- Residential). Upon annexation, the entire property would be brought into the city limits of Owasso as CS (Commercial Shopping). Ms. Beemer presented the staff report. The location was described. The property is located at 9155 North Owasso Expressway, adjacent to the Hibdon Tire Store. The property is approximately 1.49 acres in size, and is currently zoned Commercial General (CG). The applicant intends to develop an auto collision center facility on the property. Yes; US -169 Overlay Water Provider City of Owasso Applicable Paybacks Storm Siren Fee of ($50.00 per acre) ANALYSIS: The subject property is zoned CG, where the proposed use of an auto collision center is allowed by right. However, the subject property also lies within the US -169 Overlay District and as such a Specific Use Permit (SUP) is required for the type of use proposed with this application. The Specific Use Permit procedure allows staff, Planning Commission, or City Council the opportunity to mitigate any potential negative impacts that the use may create. The subject property was zoned CG under Ordinance 498 in 1995. The subject property lies in a developing corridor of various commercial uses. Adjacent to the property to the south is Page 2 SUP 21 -05 another auto servicing facility, Hibdon Tire. The GrOwasso Land Use Master Plan identifies the property and the immediate surrounding area for commercial uses. Considering this and the existing zoning of CG on the subject property, staff has determined that a commercial land use such as an auto repair facility may be appropriate, if the correct controls are utilized with an SUP. The applicant engaged staff early in the process to determine what would be an acceptable application and as such has designed the site and structure in an appropriate manner that conforms to the design requirements of the Zoning Code as well as the US -169 Overlay. The proposed garage service area has the doors facing north and not towards the frontage road. Additionally, all of the service area, including refuse area, is surrounded with an eight (8) foot fence and landscaping. The building architecture meets the architectural requirements the code with an attractive front facade and all of the rooftop HVAC systems will be screened. All of the remaining design features of the property meet the US -169 Overlay District design standards set forth in the Owasso Zoning Code. The property is platted as Lot 5, Block 1 Tyann Plaza X. Given that the lot is zoned CG, adjoins another similar use and that the Land Use Plan calls out commercial uses in this corridor, staff can support the request with the design controls presented. All development on the property shall include the elements presented in the concept plan provided with the SUP application as well as the requirements set forth in the Owasso Zoning Code and Engineering Design Standards. TECHNICAL ADVISORY COMMITTEE: The Technical Advisory Committee (TAC) reviewed the SUP for Caliber Collison at the September 15, 2021 meeting. Comments from that meeting are attached to this memo. RECOMMENDATION: Staff recommends approval of the Specific Use Permit (SUP 21 -05) for Caliber Collision, subject to TAC comments. The underlying zoning is CS and RNX, within the US -169 Overlay District and under OPUD 21 -02. The applicant has indicated that Blocks 1 through 6 will be used for single - family residences Blocks 7 through 11 will be used for commercial development. All of the proposed lots depicted on the Plat meet the bulk and area requirements stipulated in the Owasso Zoning Code and in the OPUD 21 -02 document. There will be a total of eight (8) points of access for this subdivision. One point of access will be off of North Garnett Road, via a fifty (50) foot wide drive. This drive will be located between Blocks 7 and 8. The second point of access is off of East 96th Street north, via a fifty (50) foot drive between Lots 10 and 11. These access points will function as the two main entrances to the property, and serve both the commercial and the residential portions of the development. Additionally, the Plat depicts one forty (40) foot drive in the center of Block 7, one forty (40) foot drive in the center f Block 8, two forty (40) foot drives into Block 9 off of North Garnett Road, and two forty (40) foot drives into Block 9 off of East 96th Street North. The Plat depicts seven (7) reserve areas. Reserve Area "A" will encompass the entire street network depicted on the plat, including the two main entrances. Reserve Areas "B ", "C ", "D ", "E ", and "F" are all located in the residential portion of the subdivision and will function as open space for drainage and recreational amenities. Reserve Area "G" will be located between the commercial and residential portions of the development, and will function as a natural wetland amenity. The City of Owasso will provide police, fire, ambulance, water, and sanitary sewer services to the property. Any development that occurs on the subject property shall adhere to all development, zoning, and engineering requirements of the City of Owasso. The Plat proposes two (2) lots on one (1) block and the subject property is located at northwest intersection of East 116th Street North and North 126th East Avenue. The subject property is approximately 7.6 acres in size, and is currently zoned Commercial General (CS) and Residential Multi - Family (RM) under Owasso Planned Unit Development (OPUD) 20 -01. There is an existing home on the section of the property zoned CS, which is proposed to remain. Lot 2 is zoned CS and Lot 1 is zoned RM, both of which were approved under PUD 20 -01. The approved PUD that covers this plat restricted access along 116th Street North to one point, which would be taken via a Mutual Access Easement (MAE) in the southwestern corner of Lot 2. On 126th East Avenue the PUD allowed 2 (two) points of access and these are indicated on the plat. One access point would be taken directly into Lot 1, while the other point of access would be shared between Lot 1 and Lot 2 as described in the PUD. Another temporary access point is permitted on Lot 2 at the location of an existing concrete driveway along 116th Street North. This access will be allowed as long as the existing home remains on the property. Once the home is removed and a new development plan is submitted, this access point will be required to be closed. The underlying zoning for the property is RM and CS, under OPUD 20 -01. The proposed lots as depicted on the Final Plat meet the bulk and area requirements stipulated in both the Owasso Zoning Code and in OPUD 20 -01. The Final Plat provides all the necessary perimeter utility easements to adequately serve the proposed development with utilities. The City of Owasso will provide police, fire, ambulance, water and sanitary sewer services to the property. Any development that occurs on the subject property shall adhere to all development, zoning, and engineering requirements of the City of Owasso. TECHNICAL ADVISORY COMMITTEE: The Technical Advisory Committee (TAC) reviewed the Final Plat for Owasso Assisted Living at their regular meeting on September 15, 2021. Comments from that meeting are attached with this memo. RECOMMENDATION: Staff recommends approval of the Final Plat for Owasso Assisted Living, subject to TAC comments.
