HomeMy WebLinkAbout2000.04.04_OPWA MinutesOWASSO PUBLIC WORKS AUTHORITY MINUTES OF REGULAR MEETING Tuesday, April 4, 2000 The Owasso Public Works Authority met in regular session on Tuesday, April 4, 2000 in the Council Chambers at the Owasso Community Center per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 4:00 p.m. on Friday, March 31, 2000. ITEM 1 CALL TO ORDER Chairman Wilken called the meeting to order at 6:30 p.m. ITEM 2: INVOCATION The invocation was offered by Human Resources Director Allan Harder. ITEM 3: FLAG SALUTE Assistant City Manager Tim Rooney led in the flag salute. ITEM 5: ROLL CALL PRESENT ABSENT Mark Wilken, Chair Maly Lou Barnhouse, Vice Chair Denise Bode, Trustee Melinda Voss, Trustee H C "Will" Williams, Trustee STAFF Larry Mitchell, City Manager Ronald D Cates, Authority Attorney Marcia Boutwell, Authority Secretary A quorum was declared present. ITEM 5: CONSIDERATION AND APPROPRIATE ACTION RELATING TO A REQUEST FOR APPROVAL OF THE CONSENT AGENDA. A. Approval of the Minutes of March 21, 2000 Regular Meeting. B. Approval of Claims. The consent agenda included minutes of the March 21, 2000 regular meeting, by reference made a part hereto. Item B on the consent agenda included the following claims: (1) Owasso Public Works Authority $142,892.77; (2) OPWA Capital Improvements $31,179.31; (3) OPWA Sales Tax $124,828.75; (4) Payroll $30,739.33. Mr Williams moved, seconded by Ms Voss, to approve the consent agenda. AYE: Williams, Voss, Bode, Banihouse, Wilken NAY: None Owasso Public Works Authority Motion carried 5-0. April 4, 2000 ITEM 6: CONSIDERATION AND APPROPRIATE ACTION RELATING TO OPWA RESOLUTION #2000-01, A RESOLUTION ESTABLISHING SEWER RATES AND SANITATION SERVICE RATES FOR RURAL WATER DISTRICT CUSTOMERS RESIDING WITHIN THE CORPORATE LIMITS OF THE CITY OF OWASSO, OKLAHOMA. Ms Bishop said that in December 1999 the City Council and the OPWA Trustees approved agreements with Rural Water District #3, Rogers County and with Rural Water District #3, Washington County, listing shared responsibilities for utility operations in areas within the city limits of Owasso that are served by a rural water district. The agreements state that the rural water districts will be responsible for billing and collections of the City°s utility charges for sanitary sewer, sanitation, and ambulance subscription services. OPWA Resolution #2000-01 creates a lump sum charge for all city utilities, including an administrative fee to be retained by the rural water district, and establishes brackets for ranges of water usage to set sanitary sewer fees. The amounts set in the resolution for each utility are based on the current rates for all customers residing inside the city limits. Dr Bode moved, seconded by Ms Voss, to approve OPWA Resolution #2000-01, establishing utility rates for rural water district customers residing inside the corporate limits of the City of Owasso. AYE: Bode, Voss, Williams, Barnhouse, Wilken NAY: None Motion carried 5-0. ITEM 7: CONSIDERATION AND APPROPRIATE ACTION RELATING TO OPWA RESOLUTION #2000-02 A RESOLUTION AUTHORIZING AN INTERIM CONSTRUCTION LOAN FROM THE OKLAHOMA WATER RESOURCES BOARD IN THE TOTAL AGGREGATE PRINCIPAL AMOUNT OF NOT TO EXCEED $2,620,000; APPROVING THE ISSUANCE OF A PROMISSORY NOTE IN THE TOTAL AGGREGATE PRINCIPAL AMOUNT OF NOT TO EXCEED $2,620,000, SECURED BY A PLEDGE OF REVENUES AND AUTHORIZING ITS EXECUTION; APPROVING AND AUTHORIZING THE EXECUTION OF A LOAN AGREEMENT FOR INTERIM CONSTRUCTION CLEAN WATER SRF _LOAN; RATIFYING LEASE, AS AMENDED BY AN AMENDMENT TO LEASE - APPROVING VARIOUS COVENANTS, APPROVING AND AUTHORIZING PAYMENT OF FEES AND EXPENSES; AUTHORIZING DOCUMENTS PERTAINING TO A YEAR-TO-YEAR PLEDGE OF CERTAIN SALES TAX REVENUE; AND CONTAINING OTHER PROVISIONS RELATING THERETO Mr Allan Brooks, Bond Counsel for the OPWA, presented the item. The Oklahoma Water Resources Board (OWRB) operates the State Revolving Fund (SRF) loan program and Financial Assistance Program (FAP). These programs provide low interest financing for eligible projects. -2- Owasso Public Works Authority April 4, 2000 The OPWA currently has three notes with the OWRB. The OPWA applied, and has been approved, for a Clean Water State Revolving Fund loan. On February 15, 2000, the OPWA Trustees accepted a Letter of Binding Commitment from he OWRB for an interim construction loan for an amount not to exceed $2,620,000 at 4.25% interest, plus an administrative fee of 0.5% on the outstanding balance. The loan matures not later than two years following the completion of construction, at which time permanent financing will be arranged with the OWRB. OPWA Resolution #2000-02 authorizes an interim construction loan with the OWRB, approves the issuance of a promissory note and loan agreement, and approves and authorizes various other documents and actions necessary to complete the financing. The resolution authorizes an amount not to exceed $2,260,000, however, the final amount will most likely be $2,581,000. Mr Williams moved, seconded by Ms Voss, to approve OPWA Resolution #2000-02. AYE: Williams, Voss, Bode, Barnhouse, Wilken NAY: None Motion carried 5-0. ITEM 8: REPORT FROM OPWA MANAGER No report. ITEM 9: REPORT FROM OPWA ATTORNEY. No report. ITEM 10: NEW BUSINESS. None ITEM 11: ADJOURNMENT Dr Bode moved, seconded by Mr Williams, to adjourn.
