Birch AGENDA Call to Order Roll Call Approval of Minutes from the May 30, 2006 Regular Meeting, BOARD OF ADJUSTMENT PUBLIC HEARING OBOA - 06-06— A request for a variance to reduce the required parking spaces to accommodate a commercial development on property zoned CS (Commercial Shopping District). OBOA- 06-07— A request for a variance to reduce the required 10 feet side yard setback to 5 feet in order to accommodate a single family home. OBOA- 06-08— A request for a special exception to allow for a non - permanent vendor in a commercial shopping district. Other Business Adjournment MEMORANDUM TO: BOARD OF ADJUSTMENT CITY OF OWASSO FROM: CHIP MCCULLEY CITY PLANNER SUBJECT: OBOA - 06-06, A REQUEST FOR A VARIANCE TO REDUCE THE REQUIRED PARKING SPACES TO ACCOTNVv10DATE COMMERCIAL DEVELOPMENT ON PROPERTY ZONED COMMERCIAL SHOPPING DISTRICT DATE: July 18, 2006 BACKGROUND The City of Owasso has received a for a Variance of the Owasso Zoning Code, Section 1013.4, Off - Street Parking Requirements, to reduce the required number of parking spaces in order to accommodate a commercial development. LOCATION The property is located at Lot 1, Block 1 Tyann Plaza VIII. A general area map is attached. EYISTL IG LAND USE Undeveloped PRESENT ZONING CS (Commercial Shopping) ANALYSIS The applicant is requesting a variance from the Owasso Zoning Code Development Standards to allow for the construction of a 16,139 sq. ft. commercial facility proposing 90 parking spaces. This request would equal a 1:187 parking ratio. The Owasso Zoning Code calls for a 1:100, allowing 109 spaces. The staff has looked at other developments of this nature and concluded that only 75 to 80 parking spaces are used during typical operations. Therefore staff believes that all criteria have been met relative to the variance language in the Owasso Zoning Code. Staff finds that the application is consistent with stated intent of the zoning code and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Letters were mailed to all property owners within three- hundred (300) feet of the subject property and the request was advertised in the Owasso Reporter. LOCATION The property is located at 14304 East 87b Street North. A general area map is attached. EXISTING LAND USE Undeveloped PRESENT ZONIN G RS -3 (Residential Single - Family) ANALYSIS The applicant is requesting a variance from the Owasso Zoning Code Development Standards to allow for the construction of the Single Family Residence, in The Village of Silvercreek Addition at 14304 East 87`" Street North. A site map is included with this memorandum. The Village of Silvercreek Addition allows 5 feet side yard setbacks throughout the development. During the plating process the subject lot was plated with a 10 foot western building line adjacent to the reserve area. Staff believes that the reduction of 5 feet of the western will not be detrimental to the character of the development; it will in fact help carry consistency along the street edge. Staff believes that all criteria have been met relative to the variance language in the Owasso Zoning Code. Staff finds that the application is consistent with stated intent of the zoning code and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Letters were mailed to all property owners within three - hundred (300) feet of the subject property and the request was advertised in the Owasso Reporter. The proposed use of the property is as a farmers' market. LOCATION The farmers' market will operate in the parking lot east of the Owasso Community Center located at 301 South Cedar. PRESENT ZONIN G CS (Commercial Shopping District) APPLICABLE REGULATIONS Owasso Zoning Code, Section 620 - Accessory Uses Permitted in Commercial Districts, Section 1002 — Area wide Special Exception Uses and Section(s) 1400 through 1490 - Board of Adjustment. ANALYSIS According to the Owasso Zoning Code, the Board of Adjustment may grant a special exception after finding that the special exception will be in harmony with the spirit and intent of the code, and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Provided that the Board in granting a special exception shall prescribe appropriate conditions and safeguards, and may require such evidence and guarantee or bonds as it may deem necessary to enforce compliance with the conditions attached. The applicant is requesting a special exception from the Owasso Zoning Code to allow for a non- permanent vendor on a property owned by the City of Owasso. The proposed use of the property is as a farmer's market proposing to operate on Wednesday afternoons between May and October. A site map is included with your packets. Staff believes that all criteria have been met relative to the special exception language in the Owasso Zoning Code. Staff finds that the application is consistent with stated intent of the zoning code and will not be injurious to the neighborhood or otherwise detrimental to the public welfare. Letters were mailed to all property owners within three - hundred (300) feet of the subject property and the request was advertised in the Owasso Reporter. Issues that should be addressed by this Board are related to signage, trash receptacles and the length of time that the use of the property is allowed. Staff would recommend that all signage for the use must be approved by City staff and that on -site trash receptacles must be provided by the applicant RECOMMENDATION Staff recommends approval of OBOA 06 -08, subject to following conditions: 1. All signage be reviewed by the City Staff to ensure the strict adherence to the Owasso Sign Code. 2. The applicant must provide on -site trash receptacles. 3.
