ORDINANCE 1195
AN ORDINANCE APPROVING ZONING APPLICATION NUMBER OZ 22 -06 AND REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
WHEREAS, public hearings have been held regarding the request for rezoning of the
property herein described as being located immediately west of 13402 E 86th Street North, Owasso,
Oklahoma, and;
WHEREAS, the Owasso City Council has considered the recommendation of the Owasso
Planning Commission and all statements for or against the rezoning of the property referenced in
Application OZ 22 -06.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OWASSO, OKLAHOMA,
THAT TO WIT:
SECTION 1.
A tract of land lying in Lot 7, Block 1 of ROC Owasso and Lot 1, Block 1 of ROC Owasso II, additions to
the City of Owasso, Tulsa County, State of Oklahoma, being more particularly described as follows:
BEGINNING AT THE NORTHWEST CORNER OF SAID LOT 7, BLOCK 1; THENCE N88 051'47 "E ALONG
THE NORTH LINE OF SAID LOT 7 AND LOT 1, FOR A DISTANCE OF 218.00 FEET; THENCE SO] 025,30"E
FOR A DISTANCE OF 491.04 FEET; THENCE S88049'38 "W ALONG THE SOUTH LINE OF SAID LOT 1,
BLOCK 1 FOR A DISTANCE OF 218.00 FEET; THENCE NOlo25'29 "W FOR A DISTANCE OF 491.18 FEET
TO THE POINT OF BEGINNING. SAID TRACT CONTAINING 2.46 ACRES, MORE OR LESS
The same is hereby zoned from Office (0) and Commercial Shopping (CS) to Commercial Shopping
(CS).
SECTION 2.
All ordinances or parts of ordinances, in conflict with this ordinance are hereby repealed to the
extent of the conflict only.
SECTION 3.
If any part or parts of this ordinance are deemed unconstitutional, invalid or ineffective, the
remaining portion shall not be affected but shall remain in full force and effect.
SECTION 4.
The provisions of this ordinance shall become effective thirty (30) days from the date of final
passage as provided by state law.

The Community Development Department received a rezoning request for property located
immediately west of the new Encompass Rehabilitation Facility at 13402 E 861h Street North. The
subject property is approximately 2.46 acres in size, and is zoned Office (0) and Commercial
Shopping (CS). The property encompasses a portion of Lot 1, Block I of the ROC Owasso 11 final
plot and all of Lot 7, Block I of the ROC Owasso final plat. The applicant is requesting a rezoning
to Commercial Shopping (CS) for the entirety of the property.

• The applicant desires to eliminate the 0 zoning on the subject property.
o The 0 portion of the property is a remnant left over from when the property was
split in June 2021 (OLS, 21-04).
o In order to unify the zoning on the property, in anticipation of selling it to a
developer, the applicant would like the entirety of the property to be zoned CS.
The GrOwasso 2030 Land Use Master Plan identifies the subject property for future
commercial development.
o As such, assigning the subject property a zoning designation of CS would be in
accordance with Land Use Master Plain, and thus in accordance with the long-
range vision for the subject property.
• Per the Owasso Zoning Code, the minimum lot frontage required for CS-zoned properties
is one hundred and twenty-five feet (125') along arterial roads.

o The subject property is approximately two - hundred eighteen feet (218') wide,
and is therefore considered conforming with regards to the bulk and area
standards specified in the Owasso Zoning Code for CS -zoned property.
• The City of Owasso will provide police, fire, ambulance, water and sanitary sewer
services to the subject property.
• Any development that occurs on the subject property must adhere to all subdivision,
zoning, and engineering requirements of the City of Owasso.
