Adjournment OWASSO PLANNING COMMISSION MINUTES OF REGULAR MEETING Monday, November 7, 2016 The Owasso Planning Commission met in regular session on Monday, November 7, 2016 at Old Central per the Notice of Public Meeting and Agenda posted at City Hall, 200 S. Main (west side) at 2:00 pm on November 3, 2016. ITEM 1. CALL TO ORDER Dr. Loving called the meeting to order at 6:00 p.m. ITEM 2. Flag Salute ITEM 3. Approval of Minutes from October 10, 2016 Regular Meeting. The Commission reviewed the minutes. Mr. Miller moved, seconded by Ms. Koscelny, to approve the minutes from the October 10, 2016 meeting. A vote on the motion was recorded as follows: YEA: Miller, Vines, Mowery, Dr. Loving, Koscelny NAY: None Motion carried 5 -0. OWASSO PLANNING COMMISSION November 7, 2016 Page No. 2 ITEM 6. OPUD 16 -05 /OZ 16 -08 - The Reunion - Consideration and appropriate action relating to the request for the review and acceptance of a planned unit development (PUD) with the underlying zoning of RM (Residential Multi - family) zoning district. The subject property location is 11921 E 98th St N and is approximately 7.98 acres. Bronce Stephenson presented the staff report. The property location was described. The applicable paybacks and fees were noted. The Owasso Technical Advisory Committee reviewed the final plat at their October 26, 2016 meeting. Staff recommends approval of the planned unit development for The Reunion with underlying zoning of RM (OZ 16 -08) with the following conditions: • Right of Way on E 981h St N dedicated to the City of Owasso • Paved trail from Bailey Ranch Estates to sidewalk on E 98th St N, including a traffic blocking mechanism • Monument sign with a maximum height of four (4) feet • Community garden areas provided in each courtyard • Six (6) foot screening fence or berm and landscaping be provided along the north, east and west side property line • Senior only rentals Mr. Ralph Marler asked to approach the bench. Mr. Marler had concerns regarding the value of his rental property in Bailey Ranch Estates. Mr. Kyle Smalygo, the applicant, asked to approach the bench. He had questions regarding the screen fencing and concerns regarding the eight (8) foot fence. Mr. Vines stated that he would like to see a 6' across the back side, leave or take down the burm. Mr. Stephenson explained that we can get creative with our landscape code and at the site plan review stage. Mr. Vines would also like to have it noted that it is a senior only facility. After discussion, Mr. Vines moved, seconded by Mr. Miller, to approve the planned unit development for The Reunion, subject to the above staff and TAC recommendations. A vote on the motion was recorded as follows: YEA: Mowery, Vines, Miller, Koscelny, Dr. Loving NAY: None Motion carried 5 -0. ITEM 7. OPUD 16 -06 /OZ 16 -09 - Mallard Crossing_ Consideration and appropriate action relating to the request for the review and acceptance of a planned unit development (PUD) with the underlying zoning of RNX (Residential Neighborhood Mixed). The general property location is north of E 106th St N on the west side of N 145th E Ave and is approximately 6.2 acres. OWASSO PLANNING COMMISSION November 7, 2016 Page No. 3 Karl Fritschen presented the staff report and described the property location. The applicable paybacks and fees were noted. The Owasso Technical Advisory Committee reviewed the final plat at their October 26, 2016 meeting. Staff recommends Planning Commission approval of the planned unit development request. Discussion was held regarding the need to amend the Owasso Land Use Master Plan. Mr. Stephenson explained that a lesser use is allowed without an amendment, if it was a higher use we would need to amend. Screening along the north side property line was also discussed. Ms. Koscelny expressed concerns with the children playing under the overhead power lines and maybe the need to move or redesign the parks. Mr. Vines explained that the utility companies have limitations as to what can go beneath the power lines. Tim Miller moved to approve the planned unit development for Mallard Crossing subject to the staff and TAC recommendations. Ms. Koscelny wanted the motion amended to include the concerns with the overhead power lines and the possible relocation or redesign of the parks. Ms. Mowery seconded the motion. A vote on the proposed amendment to the motion was recorded as follows: YEA: Mowery, Koscelny NAY: Dr. Loving, Vines, Miller Motion was denied 2 -3. Mr. Miller moved to approve the planned unit development for Mallard Crossing subject to staff and TAC recommendations. Also, subject to the following additional conditions: • Screening be provided along the north and south side property line • Any amenities that is proposed under the overhead lines be addressed by AEP /PSO at the site plan stage. Mr. Vines seconded the motion. A vote on the motion was recorded as follows: YEA: Miller, Vines, Dr. Loving NAY: Mowery, Koscelny Motion carried 3 -2 ITEM 8. OZ 16 -10 - Rezoning. First Baptist Church of Owasso - Consideration and appropriate action relating to the request for the review and acceptance of a rezoning from AG (Agriculture) to CS (Commercial Shopping) approximately 9.75 acres. The property location is 11409 N 113 E Ave. Mr. Vines disclosed that he owns property across the street from the subject property. The Owasso Technical Advisory Committee reviewed the rezoning at their October 26, 2016 meeting. Staff recommends Planning Commission approval of the rezoning request OZ 16 -10, rezoning the subject property from AG (Agriculture) to Cs (Commercial Shopping). Ms. Liz Wille with the Green Country Mobile Home Village, had a few questions regarding the development. Mr. Miller moved, seconded by Ms. Mowery, to approve the rezoning from AG (Agriculture) to CS (Commercial Shopping), subject to the staff and TAC recommendations. A vote on the motion was recorded as follows: YEA: Mowery, Miller, Vines, Koscelny, Dr. Loving NAY: None Motion carried 5 -0. ITEM 9. Final Plat - First Baptist Church of Owasso Mission - Consideration and appropriate action relating to the request for the review and acceptance of a final plat proposing one (1) lot on one (1) block on approximately 10.06 acres. The property location is 11409 N 113th E Ave. Karl Fritschen presented the staff report and described the property location. The applicable paybacks and fees were noted. The Owasso Technical Advisory Committee reviewed the final plat at their October 26, 2016 meeting. Staff recommends Planning Commission approval of the final plat for First Baptist Church of Owasso Mission. Mr. Vines moved, seconded by Mr. Miller, to approve the final plat, subject to the staff and TAC recommendations. Also, subject to the following condition: • If different ownership occurs and they desire more buildings built, any lot splits shall be done through the replatting process. A vote on the motion was recorded as follows: YEA: Mowery, Miller, Vines, Koscelny, Dr. Loving NAY: None Motion carried 5 -0. ITEM 10. Final Plat - Abbott Farms I - Consideration and appropriate action relating to the request for the review and acceptance of a final plat proposing sixty -five (65) lots in five (5) blocks on approximately 19.55 acres. The property is zoned RS -3 (Residential Single- family) and is located on the northeast corner of E 106th St N and N Mingo Rd. Chairperson Vice Chairperson Date OWASSO PLANNING COMMISSION MINUTES OF SPECIAL MEETING Monday, November 21, 2016 The Owasso Planning Commission met in special session on Monday, November 21, 2016 at City Hall per the Notice of Public Meeting and Agenda posted at City Hall, 200 S. Main (west side) at 3:00 pm on November 14, 2016. ITEM 1. CALL TO ORDER Dr. Loving called the meeting to order at 6:00 p.m. PRESENT David Vines Tim Miller Dr. Paul Loving Renee Mowery A quorum was declared present. STAFF Bronce Stephenson Julie Lombardi Marsha Hensley Morgan Pemberton ABSENT Jennifer Koscelny Mr. Stephenson asked if any Commissioners had a conflict of interest and if so please disclose. Mr. Vines disclosed that he owns property within the District. Ms. Mowery disclosed that she owns property within the District. Mr. Miller disclosed that he owns property within the District. ITEM 3. Consideration and appropriate action to approve a resolution of the Owasso Planning Commission determining that the Owasso Redbud District Project Plan is in conformance with the GrOwasso 2030 Land Use Master Plan and recommending to the City of Owasso approval and adoption of the Owasso Redbud District Project Plan Mr. Stephenson reviewed the staff report. Staff recommends approval of Resolution 2016 -02 of the Owasso Planning Commission, determining that the Owasso Redbud District Project Plan is in conformance with the GrOwasso 2030 Land Use Master Plan and recommending to the City of Owasso approval and adoption of the Owasso Redbud District Project Plan. Ms. Mowery had a few questions regarding the plan. She asked if every property owner pays all of the infrastructure costs? What would the infrastructure costs be? She also asked which infrastructure costs will the city pay and which will go back to the property owners? Ms. Mowery also asked if there will be any other negotiations with developers/ property owners, such as row agreements, land acquisitions? Will everyone no matter how big or small only receive TIFF funds and no other agreements, promises or exchanges OWASSO PLANNING COMMISSION November 21, 2016 Page No. 2 from the City? The need for additional public parking in the area was discussed. Mr. Stephenson explained that the policy guide will be followed closely and it will be a separate item for the City Council to approve at a later date. Mr. Miller asked if the Planning Commissioners would have another chance to review the guidelines and all of the paperwork again? Mr. Stephenson explained that the Commissioners would need to speak to their Councilor if there were any questions or concerns regarding the plan. Mr. Stephenson stated that the Center for Economic Development Law is very experienced in TIF's. It will be a way to boost an economically depressed area. Ms. Mowery moved to approve Resolution 2016 -02 of the Owasso Planning Commission, determining that the Owasso Redbud District Project Plan is in conformance with the GrOwasso 2030 Land Use Master Plan and recommending to the City of Owasso approval and adoption of the Owasso Redbud District Project Plan. Provide language as to how the pond is to be maintained and the shared responsibility of such. Brian Beam stated there was an agreement in place and we agreed that the letter of agreement would be referenced in the deed of dedications. From inspection it doesn't appear that any City utilities were accidently installed in the errored extra 5', (20' -15'), as they were all designed within 15' U/E portions when not in the ROW. However this does not mean that non- City utilities didn't do so on an individual lot basis and should be verified for need of relocation with the utility companies. Applicant is not aware of the easement and requested for approval of the 15' easement. Applicant stated that the only thing in the easement would be a storm pipe from the detention pond. Public Works is okay with the 15' U/E due to this statement however it should be a shared D/E. • Section 1.5 states a filing of acceptance by the City at the court clerk's office.
