Adjournment OWASSO PLANNING COMMISSION MINUTES OF REGULAR MEETING Monday, March 13, 2017 The Owasso Planning Commission met in regular session on Monday, March 13, 2017 at Old Central per the Notice of Public Meeting and Agenda posted at City Hall, 200 S. Main (west side) at 1:00 pm on March 9, 2017. ITEM 1. CALL TO ORDER Dr. Loving called the meeting to order at 6:00 p.m. ITEM 2. Flag Salute ITEM 3. A vote on the motion was recorded as follows: YEA: Miller, Vines, Dr. Loving, Mowery, Horton NAY: None Motion carried 5 -0. OWASSO PLANNING COMMISSION March 13, 2017 Page No. 2 ITEM 6. Specific Use Permit 17 -01 - Montessori Academy of Owasso - Consideration and appropriate action relating to the request for the review and acceptance of a specific use permit to allow for a private school on property zoned RS -3 (Residential Single- family) and AG (Agriculture) Districts. The subject property is located at 708 North Atlanta and is approximately 1.35 acres. David Vines recused himself from this item. Karl Fritschen presented the staff report. The property location was described as well as the zoning. There is a utility easement located beneath the western building on the property, which is in the easement closing process. Staff believes this is a very good use for this property. Staff is asking for a Plat Waiver along with this request. Staff and TAC recommends the following conditions be applied to the property: • No additional lighting shall be installed other than what exists on the site without Staff approval; • No additional signage shall be installed. If the applicant choses to use a new sign, a sign permit shall be obtained and approved by Staff; • No digital signage shall be used on the property; • A minimum six foot opaque screening fence shall be required along the north, west, and south property lines. The screening fence already in place along the west boundary may be used as part of the screening requirements, but in the event the fence falls into disrepair, it shall be repaired or replaced by the applicant; and • Landscaping shall be provided on the site as depicted on the attached site plan and shall be inspected by Staff prior to issuing an Occupancy Permit. The following are comments made by surrounding property owners: Nicholas Plotter - He feels this project is good for the neighborhood and a great opportunity for Owasso. Richard Mullenix - He stated that this property had been a school previously. He likes the idea of the property being fixed up. He keeps an eye on the property and feels that a chain -link fence would be more appropriate. Christina Branham - She is a parent of a student that attends the school and is in support of the project. Also in support of the 6 foot opaque privacy fence. Matthew Christensen, Doerner, Saunders, Daniel & Anderson, LLP - He is representing the applicant. He and the applicant agree and accept all staff recommendations. He handed out presentation material to the Commissioners (attached). After a brief discussion, Mr. Miller moved, seconded by Ms. Mowery, to approve Specific Use Permit 17 -01, subject to the above Staff and TAC recommendations. The Plat Waiver request was included in this motion. Main (west side) at 3:00 pm on March 23, 2017. ITEM 1. CALL TO ORDER Dr. Loving called the meeting to order at 3:00 p.m. ITEM 2. Review and Discussion on the Update of the Owasso Zoning Code. No official action will be taken on this item by the Planning Commission. Chapters 13 through 23 and the definitions section were reviewed and discussed. The following are comments and /or suggestions that were discussed: Chapter 19 - Flood Hazard Regulations - Bronce stated that this chapter may be reduced because the City is not authorized to enforce. Chapter 20 -Signs - Bronce explained that the City is considering a location in town that you can put up community signs, concentrated to one specific area. The following was discussion /suggestions regarding the placement of real estate signs: • Maybe talk to local real estate brokers regarding the sign requirements, where they can and cannot be placed. • Possibly allow the display of real estate signs on the weekends only. • Maybe change the Matrix Charts. OWASSO PLANNING COMMISSION March 30, 2017 Page No. 2 Definitions section was discussed briefly and a few additions were suggested, such as Pop -up Shops and Loft Apartments. Bronce explained the CD (Commercial Downtown) Zoning District and a brief discussion was held. ITEM 4. Adjournment Mr. Miller moved, seconded by Mr. Horton, to adjourn the meeting. The subject property is approximately 4 acres in size and is part of the Morrow Place PUD. The applicant is requesting that the zoning be changed from AG (Agriculture) to CS (Commercial Shopping). The Owasso Land Use Master Plan calls for commercial uses at this location, so applying CS (Commercial Shopping) zoning to the property is appropriate. The property immediately to the west is also denoted as commercial according to the Land Use Master Plan. The subject property is part of PUD 05 -02A, and the conceptual development plan shows commercial uses at this location, however the underlying zoning for this particular tract was never defined and remains as Agriculture. The rezoning will ensure conformity with the conceptual development plan that was approved as part of PUD 05 -02A. This area of the community is relatively undeveloped. However, this is expected to change upon the completion of the Morrow sanitary sewer lift station. This project is expected to be completed in the fall of 2017, after which development will likely to intensify in this area. Further, because this property has excellent access and visibility, one can expect it to be highly sought after for commercial development. Future development on the subject property must adhere to all subdivision, zoning, and engineering requirements of the City of Owasso, including but not limited to paved streets, landscaping, and sidewalks. The subject property also lies within the US- 169 Overlay District, and must adhere to those requirements as well. The City of Owasso would provide sanitary sewer to the property, while Washington County Rural #3 would provide the water service. RECOMMENDATION: Staff recommends approval of the rezoning request OZ 17 -02 for the subject property from AG (Agriculture) to CS (Commercial Shopping). RECOMMENDATION: Staff recommends Planning Commission approval of the annexation (OA 17 -03) and rezoning (OZ 17 -03) requests to annex the subject property into the corporate limits of the City of Owasso with an assigned zoning of CS (Commercial Shopping).
