action relating to the request for the review and acceptance of an annexation

property is located on the northwest corner of E 106th St N and N Garnett Rd
and is approximately 3.8 +/- acres.
8. OA 17 -07 Annexation - Consideration and appropriate action relating to the
request for the review and acceptance of an annexation. The property is
located on the southeast corner of E 86 St N and N Memorial Dr and is
approximately 70.6 +/- acres. The property is currently zoned AG
(Agriculture), RS (Residential Single- Family), and RMH (Residential Mobile
Home Park) in Tulsa County. Upon annexation, the entire subject property
would be brought into the City Limits of Owasso as AG (Agriculture).
9. Discussion on the Update of the Owasso Zoning Code - No official action will

The Owasso Planning Commission met in regular session on Monday, October 9, 2017 at
Old Central perthe Notice of Public Meeting and Agenda posted at City Hall, 200 S.
Main (west side) at 10:00 am on October 5, 2017.

ITEM 6. OA 17 -05 - Annexation - City of Owasso - Consideration and appropriate
action relating to the request for the review and acceptance of an
annexation of right -of -way. The subject properties are the northwest right -
of -way and the southeast right -of -way of the intersection of E 106{h St N
and N Garnett Road, Owasso, OK. The property size is approximately 1.68
acres total.
Karl Fritschen presented the staff report. The property location was described. Staff
published the legal notice in the Owasso Reporter and mailed notices to property
owners within a 300' radius of the property. Staff recommends approval of the
annexation (OA 17 -05) request to annex the subject property into the corporate limits of
the City of Owasso.
Mr. Horton moved to approve, Mr. Miller seconded the motion, for the approval of
annexation OA 17 -05.
A vote on the motion was recorded as follows:
YEA: Miller, Dr. Loving, Balthrop, Horton, Vines
NAY: None
Motion carried 5 -0.
ITEM 7. PUD 17 -02 /OZ 17 -06 - Mingo Crossing - Consideration and appropriate
action relating to the request for the review and acceptance of a
Planned Unit Development (PUD) with the underlying zoning of RS -3
(Residential Single Family High Density) District. The subject property
contains 21.36 acres and the general location is a quarter mile south of E
106th St N on the east side of N Mingo Road. The property is presently
zoned AG (Agriculture) District.
Morgan Pemberton presented the staff report.. The property location was described.
Staff published the legal notice in the Owasso Reporter and mailed notices to property
owners within a 300' radius of the property.. To protect the intent of front yard setback
requirements in the Code, the sidewalks will be provided throughout the subdivision and
will be constructed along the back of the curb with no grass strip between the sidewalk
and the street. Second, all garages shall be required to meet a high front yard setback
of twenty -two (22) feet.
Discussion was held regarding the amenities at the northeast corner of the property. The
amenities need to be noted more clearly in the development concept.
Staff recommends approval of the Planned Unit Development request (PUD 17 -02) with
the underlying zoning of RS -3 (Residential Single Family High Density) District.
Mr. Vines moved to approve with the above conditions discussed, Mr. Miller seconded
the motion, for the approval of PUD 17 -02 /OZ 17-06.

The Community Development Department received a lot split application for property located
at 7917 N 144th E Ave. The subject property is currently zoned RS -3 (Residential Single - Family
High Density). The applicant is requesting a lot split for property that was combined via deed
through Tulsa County in 2015, thereby returning it to its former platted condition. The property

ANALYSIS:
In August 2015, the applicant combined Lots 30 and 31 into one (1) lot via deed and recorded
the document in Tulsa County for the purposes of building a larger home. However, the
applicant accidentally combined Lots 30 & 31 in Block 1, instead of the intended combination
of Lots 30 & 31 in Block 2. Lot combinations are not required to obtain City approval and are
done via deed within the County of record; therefore City Staff had no oversight of the process.
Because the platted lots were legally combined, the applicant must now split them back apart
into the original platted lots. The applicant will also combine the intended lots in Block 2 to
ensure there are no title issues with the house that was constructed. Staff has determined that
the lot split request meets all requirements of the Owasso Zoning Code and Subdivision
Regulations.
TAC MEETING:
The Technical Advisory Committee (TAC) reviewed this item at their meeting on October 18,
2017. There were no issues with the lot split.
RECOMMENDATION:
Staff recommends approval of the lot split request (OLS 17 -03).

ANALYSIS:
The property is currently zoned AG (Agriculture) in Tulsa County, and the applicant is requesting
annexation into Owasso's corporate limits. The applicant also requests a concurrent rezoning of
the subject property from AG (Agriculture) to CS (Commercial Shopping) upon annexation.
Typically, annexed land is assigned an AG (Agriculture) zoning designation. However, an
applicant can request rezoning of the property, if the requested zoning conforms to the
J GrOwasso 2030 Land Use Master Plan and proper legal notice is provided. The proposed zoning
of CS (Commercial Shopping) for the subject property conforms to the GrOwasso 2030 Land Use
Master Plan, which calls for future Commercial uses at this location. In addition, the property is
surrounded on all sides by property that is also identified for future commercial uses on the Land
Use Master Plan. This arterial intersection is expected to see a great deal of commercial
development in the future. Therefore, Staff supports applying a zoning of CS (Commercial
Shopping) to the property upon annexation.
The City of Owasso would provide sanitary sewer, Fire, Police, EMS, and wafer service to the
property upon annexation. Any future development that occurs on the subject property must
adhere to all Owasso subdivision, zoning, and engineering requirements including but not limited
to paved streets, landscaping, and sidewalks.
ANNEXATION COMMITTEE:
The Owasso Annexation Committee met on October 25, 2017 and voted unanimously to
recommend approval of the annexation request for the subject property (OA 17 -06).
RECOMMENDATION:
Staff recommends approval of the annexation (OA 17 -06) and rezoning (OZ 17 -07) requests to
annex the subject property into the corporate limits of the City of Owasso with an assigned
zoning of CS (Commercial Shopping).
