Roll Call Approval of Minutes from the December 9, 2002 Regular Meeting. 4. Annexation Request — A request for the annexation of property containing approximately 20.65 acres, more or less. The subject property is located on the east side of N. 97ah E. Ave approximately 2640 feet north of the N. 97a' E. Ave and E. 116th St. N. intersection. 5. OZ -02 -10 — A request to rezone approximately 15.00 acres, more or less from AG (Agricultural General District) to RS -3 (Residential Single Family High Density District). The subject property is located on the south side of E. 116'" St. N. approximately 1700 feet east of the E. I I6 h St. N. and N. Garnett Rd. intersection. 6. Preliminary Plat — Morningwood — A request for the review of a preliminary plat for the Morningwood Addition containing approximately 15.00 acres, more or less. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF NOVEMBER 11, 2002 REGULAR MEETING - The Commission reviewed the minutes of November 11, 2002 Regular Meeting, Bill Williams moved, seconded by Charles Willey to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Charles Willey — Yes Dewey Brown - Yes Bill Williams - Yes The motion carried 4 -0. 4. Text Amendment — Owasso Sign Ordinance — Staff initiated request for the review of an amendment to the City of Owasso Zoning Code, Appendix F — Owasso Sign Ordinance, repealing said Owasso Sign Ordinance and replacing it with Chapter 17, Owasso Sign Code. The Chair introduced the item and the staff review was given by Robert Moore. Robert explained that the sign ordinance not only controls the location, size and type of signs allowed, but also how those signs relate aesthetically to the City as a whole. Staff has made every effort to accommodate each and every individual who has provided comments. This new format is more "user- friendly ". Ray Haynes asked if anybody in the audience had comments regarding the text amendment. Mr. Ken Robinson wanted to confirm that the billboards, which are under construction on his land, would be permitted. He also had questions concerning the process of billboards damaged by high winds or OWASSO PLANNING COiV BUSSION December 9, 2002 Page No. 2 lightning. Charles Willey explained that Section 17.6.20) in Mr. Gray's letter would eliminate Mr. Robinson's concerns. A brief discussion was held regarding political signs placed in the right -of -way and banner type signs for community or civic organizations. Ray Haynes moved to approve the text amendment subject to the revisions listed in a letter dated December 3, 2002 (attached) from Mr. Stephen Gray, City Attorney. Charles Willey seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Charles Willey - Yes Dale Prevett - Yes Dewey Brown - Yes Bill Williams The motion carried 5 -0. 5- Annexation Request - Buddy McCarty - A request for the annexation of property owned by Buddy McCarty, containing approximately 2.75 acres + / -. The subject property is located on the north side of 96h Street N approximately 300 feet east of the 96' Street N. and Garnett Road intersection. The Chair introduced the case and Robert presented the item. The applicant is requesting this annexation to accommodate commercial development. It is currently zoned AG (Agricultural) in Tulsa County. The subject property meets all of the requirements included within the policy with the exception of tract size. Legal notice was published in the Owasso Reporter. Staff has received no phone calls regarding this request. The Owasso Technical Advisory Committee reviewed the annexation request; no opposing comments were noted. The Owasso Annexation Committee reviewed the petition and unanimously recommended approval. Staff recommends approval of the annexation request. Ray Haynes moved to approve the above annexation request, Dale Prevett seconded the motion. OWASSO PLANNING COMMISSION December 9, 2002 Page No. 3 6. Annexation Request - Phyllis J. Sokolosky Living Trust- A request for the annexation of property owned by the Phyllis J. Sokolosky Living Trust, containing approximately 49.99 acres + / -. The subject property is located on the east side of Mingo Road approximately 800 feet south of the 116`h St. N. and Mingo Road intersection. The Chair introduced the case and the staff review was given by Robert. The surrounding zoning and land use was described. The applicant is requesting this annexation in order to construct single family residential structures. Legal notice was published in the Owasso Reporter. Staff has received no phone calls regarding this request. The Owasso Technical Advisory Committee reviewed the annexation request; no opposing comments were noted. The Owasso Annexation Committee reviewed the petition at their November 27, 2002 Special Meeting. The Annexation Committee recommended approval subject to the following condition: 1. The applicant provides clarification as to whether or not the site is contaminated or requires environmental remediation prior to development. Oklahoma State Department of Mines was contacted for clarification finding no records of any non -coal sites on the above property. Staff recommends approval of the annexation request. Bill Williams moved to approve the annexation request, Charles Willey seconded the motion. OZ -02 -08 - Central Baptist Church - A request to rezone approximately 2.02 acres +/- from RM -1 (Residential Multi - Family Low Density District) to OL ( Office Low Intensity District). The subject property is located at the southeast corner of Birch St. and 2nd St. intersection. The Chair introduced the item and Robert reviewed the staff report. Robert described the surrounding land use and surrounding zoning. If approved the subject property would be zoned OL (Office Low Intensity District). The Central Baptist Church is under contract to sell the facility to the Cherokee Housing Authority for office use. The Technical Advisory Committee reviewed the rezoning request with no comments. Staff has received several phone calls that were of a questioning nature and not in opposition. Staff recommends approval of OZ- 02 -08, rezoning Lots 1, 2, 3, 4, 5, & 6, Block 9, Original Townsite of Owasso from RM -1 (Residential Multi- Family Low Density District) to OL (Office Low Intensity District). Dale Prevett moved to approve the rezoning of Lots 1, 2, 3, 4, 5, & 6, Block 9, Original Townsite of Owasso from RM -1 to OL (Office Low Intensity), Bill Williams seconded the motion. OZ -02 -09 - Vicci Nance - A request to rezone approximately 5.00 acres +/- from RS (Residential Single Family Estate District) to CS (Commercial Shopping District). The subject property is located approximately 2400 feet north of the 96' St. N. and 129'" E. Ave. intersection. The Chair introduced the case and review was given by Robert. The surrounding zoning and land use was described. The applicant is requesting this rezoning in order to accommodate commercial shopping uses and restaurants. Staff did have concerns regarding the fact that the applicant is requesting a "leap -frog" zoning classification, but staff believes that in this case the zoning classification would help expedite the implementation process of the Master Plan. Staff finds that little impact would occur on the surrounding property owners if this application were approved. Letters were mailed to surrounding property owners and legal advertisement was published. Staff has received no phone calls or letters regarding this zoning request. The Technical Advisory Committee reviewed at their November 27, 2002 meeting. Staff provided no comments. Ray Haynes asked if there were any questions or concerns from the audience. Mr. Darren McVey, a nearby property owner, had questions regarding screening requirements on commercial property. Staff recommends approval of OZ- 02 -09, rezoning approximately 5.00 acres + / -, from RE (Residential Estate District) to CS (Commercial Shopping District). Charles Willey moved to approve the rezoning request, Dewey Brown seconded the motion. Partial Easement Closure - Simmons Homes - A request to close the northern 2 feet of the southern 11 foot utility easement for Lot 43, Block 6, Sawgrass Park at Bailey Ranch. The subject property is located approximately 125 feet north of the 103rd St. N. and 115`h E. Ave. intersection, further described as 10305 N 115'h E. Ave. The Chair introduced the item and Robert reviewed. Robert described the surrounding zoning and land use. Staff was informed that the encroachment was made primarily out of confusion between easement locations and setback requirements. The applicant is requesting to close the northern 2' of the southern 11' utility easement of Lot 43, Block 6, Sawgrass Park at Bailey Ranch. The structure encroaches the easement by 1' foot. Staff does not oppose closing only the northern 1' foot due to the fact it would still meet the PUDlRS -3 zoning district setback requirements. Discussion was held regarding the City's sewer line within the easement. The Technical Advisory Committee reviewed the easement closure; the following comments were noted: 1. The City of Owasso City Council must approve the easement closure. 2. The applicant provides an official copy of the easement closure to the Community Development Department 3. The applicant must coordinate the relocation of the City's sewer line with the Public Works Department. 4. Oklahoma Natural Gas Company wanted to clarify that the easement closure did not include the perimeter easements on the west and the east of the property. Staff recommends conditional approval of the request to close the northern 1' foot of the southern 11' foot utility easement of Lot 43, Block 6, Sawgrass Park at Bailey Ranch, subject to the following conditions: 1. The City of Owasso City Council approves the easement closure. 2. The applicant provides an official copy of the easement closure to the Community Development Department. 3. The applicant must coordinate the relocation of the City's sewer line with the Public Works Department. Ray Haynes moved to approve the request to close the northern 1' foot utility easement of Lot 43, Block 6, Sawgrass Park at Bailey Ranch subject to the above Staff and TAC recommendations. Also, the applicant must absorb the costs for the relocation of the OWASSO PLANNING COMMISSION December 9, 2002 Page No. 6 City's sewer line. Charles Willey seconded the motion. Preliminary Plat - New Brunswick - A request for the review of a preliminary plat for New Brunswick containing approximately 10 acres + / -. The preliminary plat contains 42 residential lots on 3 blocks. The subject property is located at the northwest corner of the 96' St. N. and Mingo Rd. intersection. The Chair introduced the item and staff review was given by Robert. Staff finds the preliminary plat consistent with the approved OPUD -02 -03 Outline Development Plan and the City of Owasso Zoning Code. The proposal would allow the construction of garden homes. The Owasso Technical Advisory Committee reviewed the preliminary plat, below are the comments noted at that meeting. The Commissioners had questions concerning the City inspections of acceleration/deceleration lanes. Staff recommends approval of the preliminary plat, subject to the following conditions: 1. Street "A" should be labeled "East 97' Street North" 2. Street "B" should be labeled "North 95'" East Avenue" 3. Street "C" should be labeled "North 96' East Avenue" 4. Sidewalks are required along E. 96' St. No and No Mingo Road. 5. Preliminary Plat will be subject to a $16.00 /Acre emergency siren fee or $160.00 prior to releasing the final plat for signatures. 6. All 7.5' foot utility easements shall be changed to 11' foot utility easements. 7. An addition to the covenants stating that no in or above ground pool may be located nearer than 10' feet to any side or rear property line is required. 8. Article IV, Developer's Rights, Section 4.2, should state that all items discussed in this section shall be in accordance with the City of Owasso Zoning Code. 9. An addition to the covenants should be added stipulating that, "no building, structure, or other above or below ground obstruction shall be placed, erected, installed or permitted on such easement or rights -of -way shown in such a manner that will interfere with the installation, operation, maintenance, repairing, removing, or replacing of utilities. The language stating that the development is included as a part of a master stormwater plan in the Deed of Dedication, #7 shall be removed completely from the plat. 11. Addresses will be provided prior to final plat application. 12. City of Owasso Fire Department should approve fire hydrant locations. 13. The City of Owasso Planning Commission must approve subdivision entry monuments. Ray Haynes moved to approve the preliminary plat subject to the above Staff and TAC recommendations. Bill Williams seconded the motion. Easement Closure - David and Sara Wilson - A request to close the stormwater detention easement located within Lot 1, Block 2, Ram Plaza Addition. The subject property is located 500 feet west of the 86' Pl. N. and 129' E. Ave. intersection. The Chair introduced the item and Robert gave staff review. The applicant is requesting to close the stormwater detention easement to allow the existing retail structure to remain by right in lieu of as a non - conforming structure. Stormwater detention issues for Lot 1, Block 2 were incorporated into the approved plans for the Warehouse Foods (now Dickinson Theatre) and Owasso Ninth Grade Center (now Mid -High School). The Technical Advisory Committee reviewed the site plan at their November 27, 2002 meeting. Staff recommends approval of the request to close the stormwater detention easement located within Lot 1, Block 2, Ram Plaza Addition, subject to the following conditions: 1. The City of Owasso City Council approves the easement closure. 2. The applicant shall provide an official copy of the easement closure to the Community Development Department. Plat Amendment - David and Sara Wilson - A request to amend the Ram Plaza final plat, eliminating the Limits of No Access for Lot 1, Block 2, Ram Plaza Addition. The subject property is located approximately 500 feet west of the 861i Pl. N. and 1291' E Ave, intersection. The Chair introduced the case and Robert gave review. The applicant is requesting to remove the limits of no access to allow the curb cuts that currently serve the retail facility to remain. The existing curb cut is a 40' shared access easement with 20' of access located on Lot 1 and 20' access easement located on Lot 2. A lot split was approved in December 1996 removing the east 28' of Lot 1 and adding it to the west of Lot 2. This lot split removed any legal access to Lot 1. The curb cuts on Lot 1, Block 2 were discussed. The applicants were present and stated that the curb cuts have been in existence for several years without issue. The Owasso Technical Advisory Committee reviewed the site plan at the November 27, 2002 regular meeting. Staff recommends approval of the request to close the stormwater detention easement located with Lot 1, Block 2, Ram Plaza Addition, subject to the following conditions: 1. The City of Owasso City Council approves the limits of no access removal. 2. The applicant shall provide an official copy of the limits of no access removal to the Community Development Department. 3. The applicant must provide the necessary ownership signatures (60% of the owners of property within the Ram Plaza Addition) prior to sending the application to the City Council. Ray Haynes moved to approve the plat amendment subject to the above TAC and Staff recommendations. Also, approval is subject to the restriction of any type barrier being placed at the entrance into Lot 1, Block 2. Charles Willey seconded the motion. Planning Commission Regular Meeting Date - Action to change the regular meeting date from the second Monday of each month to the Monday falling between the two regularly scheduled City Council Meetings each month. The Chair introduced the item and was reviewed by Robert. Robert explained that in the months of April and July 2002 the Planning Commission would meet the day before the regularly scheduled City Council meeting. This time frame does not allow staff the necessary time to forward the required items to City Council. Staff recommends approval of this request amending the current meeting date from the second Monday of each month to the Monday between the two regularly scheduled City Council meetings. Dale Prevett moved to approve to change the regular meeting date to the Monday falling between the two regularly scheduled City Council Meetings each month, Bill Williams seconded the motion. OWASSO PLANNING COMMISSION December 9, 2002 Page No. 10 Chairperson Secretary Date CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT ANNEXATION (Patrick Shumacher— Section 6, T 21 N, R14 E) STAFF REPORT BACKGROUND The City of Owasso has received a request from Patrick Shumacher, applicant/owner, for the annexation of approximately 20.65 acres, more or less. The subject property is located on the east side of N. 97'' E. Ave. approximately 2640 feet north of the N. 97'` E. Ave. and E. 116'' St. N. intersection. A general area map and a complete legal description have been attached for your information and review. LOCATION See attached legal description. EXISTING LAND USE Vacant SURROUNDING LAND USE North: Residential — Single Family South: Residential — Single Family East: Vacant West: Residential — Single Family PRESENT ZONING AG (Agricultural General District) — Tulsa County North: AG (Agricultural General District) — Tulsa County South: AG -R (Agricultural Residential Single Family Rural District) — Tulsa County East: AG (Agricultural General District) —Tulsa County West: AG -R (Agricultural Residential Single Family Rural District) — Tulsa County ANALYSIS The applicant is requesting this petition in order to construct RS -3 typical homes on the subject property. As mentioned above, the subject property totals 20.65 acres and is currently zoned AG (Agricultural General District) in Tulsa County. All property annexed into the City is required to be zoned the lowest zoning classification (AG) or retain the zoning classification obtained in Tulsa County. However, the current Tulsa County zoning, as mentioned above, is AG thereby leaving the applicant with no option but to accept an AG zoning classification. A rezoning request to allow for residential uses would require notification to property owners within 300' as well as publication of a legal advertisement in the Owasso Reporter. Additionally, a rezoning sign would be posted on the property at such time that a rezoning was requested. If the annexation were approved and prior to any development, the applicant would be required to apply for and receive approval from the City of Owasso. This approval would consist of not only the Preliminary and Final Plat reviews by the Technical Advisory Committee and Planning Commission, but also Final Plat approval from City Council. Any development that occurs on the subject property would adhere to all subdivision and zoning requirements including but not limited to paved streets, sidewalks and stormwater detention facilities. A copy of the Annexation Policy is attached for your information and review. The subject property meets all of the requirements included within the policy. Staff feels that it is in the best interest of the City of Owasso to have the City's development standards govern the development of this parcel rather than Tulsa County. Upon development, the subject site would receive residential water and sewer service from the City of Owasso while the burden of extending infrastructure to the site would fall upon the developer. There appear to be no infrastructure issues that would limit the development of the property. Staff published legal notice of the annexation petition for three consecutive weeks beginning in the December 19, 2002 edition of the Owasso Reporter. Staff has received no phone calls or correspondence concerning the request. If this Commission approves the annexation petition, the request will be forwarded to City Council for final review and approval. TECHNICAL ADVISORY COMMITTEE The Owasso Technical Advisory Committee reviewed the proposed annexation at their December 30, 2002 regular meeting. At that meeting, no opposing comments were sited by staff or utility providers. OWASSO ANNEXATION COMMITTEE The Owasso Annexation Committee, at their December 30, 2002 Special Meeting, reviewed the petition and unanimously recommended approval. Staff recommends approval of the request by Patrick Shumacher, to annex into the corporate limits of the City of Owasso approximately 20.65 acres, more or less. ATTACHMENTS 1. General Area Map. 2. While there is no minimum tract size, properties of larger than 20 acres are preferable. 2. All properties should be contiguous to existing City limits. 3. All properties should be annexed into the City limits as the lowest zoning classification, that is, Agricultural (AG). Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the City will be legal, but non- conforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not meet City standards will not be improved by the City until brought to the City standard and accepted by the City Council. Such public facilities must be improved at owners expense by the establishment of a special assessment district or some other financing method. 5. Where a City limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow City employees and citizens to know where the City boundaries are. 6. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. Adopted by City Council on March 1, 1988. The applicant is proposing to rezone the subject property from AG (Agricultural General District) to RS -3 (Residential Single Family High Density District). The applicant is also seeking concurrent approval of the Morningwood Preliminary Plat, an addition to the City of Owasso containing 58 lots within 2 blocks. According to the City of Owasso Zoning Code, single - family residential uses fall within Use Unit 6 (Single Family Dwelling) and are permitted by right in the RS -3 zoning district. COMPREHENSIVE PLAN CONSISTENCY The Owasso 2010 Master Plan identifies the subject property as having a future land use of public and low density residential. The applicant's proposal would seem to be inconsistent with the approved 2010 Master Plan based simply on the fact that the applicant is proposing a high intensity residential use. However, staff feels that the proposal is consistent with the Master Plan for several reasons. First, the Master Plan labels the north half of the subject property as having a future land use of public. Assuming that the north half did develop with a public use, this would be the third such land use category in this section. Staff feels that by approving a use of high intensity residential on this site in lieu of a public use, further opportunities for home ownership would be provided and still be adequately served by the additional surrounding public uses. Second, the plan identifies the southern half of the site as having a future land use of low intensity residential. The applicant's rezoning request is for RS -3 (Residential Single Family High Density District) which would seem to be inconsistent. However, based on the definition of low density residential uses in the Master Plan, the inconsistency would seem to be a matter of semantic confusion. The Master Plan defines low density residential as having a density of 2 — 5 dwelling units per acre. The Morningwood Preliminary Plat, which the applicant is seeking concurrent review with this rezoning petition, contains 58 lots on 15.00 acres with a density of 3.8 units per acre and consistent with the stated definition of low density residential uses per the City of Owasso 2010 Master Plan. ANALYSIS As previously stated, the applicant is requesting concurrent review of this application in order to construct 58 homes on 2 blocks. Staff feels that single family uses are appropriate for this location. Staff finds little if any reason to deny the requested zoning change. As previously stated, the applicant's proposal and that of the Momingwood Preliminary Plat are considered by staff to be consistent with the Owasso 2010 Master Plan. Additionally, staff feels that the proposal would set an aesthetically pleasing precedent in the area and provide for further home ownership opportunities within the City of Owasso. The site, once developed will receive residential water service from Washington County Rural Water District # 3. The subject property will receive sanitary sewer service from the City of Owasso. Staff has received no phone calls or letters regarding this zoning request. Staff does not anticipate public opposition to the request for RS -3 zoning. Letters were mailed to surrounding property owners on December 12, 2002 and the legal advertisement was published on December 19, 2002. The subject property was posted on December 19, 2002. Copies of both the letters to property owners and the legal advertisements are attached for your information and review. Sokolosky Living Trust) STAFF REPORT BACKGROUND The City of Owasso has received a request from D.M. Sokolosky, applicant on behalf of the Phyllis J. Sokolosky Living Trust, for the review of a rezoning for approximately 49.99 acres, more or less. The subject property is located on the east side of N. 97th E. Ave. approximately 800 feet south of the intersection of N. 97 1h E. Ave. and E. 116` St. N. The applicant is proposing to rezone the subject property from AG (Agricultural General District) to RS -3 (Residential Single Family High Density District), which would allow the site to be utilized for single family residential uses. A general area map and a complete legal description have been attached for your information and review. LOCATION See attached legal description. According to the City of Owasso Zoning Code, single - family residential uses fall within Use Unit 6 (Single Family Dwelling) and are permitted by right in the RS -3 zoning district. COMPREHENSIVE PLAN CONSISTENCY The Owasso 2010 Master Plan identifies the subject property as having a future land use of low density residential and park and recreational. Much like the previous application, the proposal would seem to be inconsistent with the City's Master Plan. However, staff feels that the proposal is consistent with the Master Plan for many of the same reasons as the previous rezoning application. The majority of the site is shown as having a future land use of low density single family. As stated in the previous rezoning application and for defmitional purposes, low density residential development is considered to be development of 2 — 5 dwelling units per acres. And, although a preliminary plat has not been submitted, staff is certain that any plat submitted would be consistent with the 2 — 5 dwelling unit per acre density stated in the Master Plan. Staff comes to this conclusion by reviewing the Metro Heights I Addition to the south. Metro Heights I, which was also developed by the applicant for this rezoning, was approved with an RS -3 zoning classification and a density of 3.3 dwelling units per acre (52 lots within 15.42 acres), thereby also being consistent with the definition of low density residential per the City's Master Plan. Secondly, the plan identifies the northern portion of the site as having a future land use of park and recreational. As with any residential development in the City, park and open space locations or a fee in lieu of is required at the time the plat is approved. Given the definitions of low intensity residential in the Master Plan and the City's park and open space requirements at the platting stage of development, staff feels that the proposed rezoning is consistent with the City of Owasso 2010 Master Plan. ANALYSIS As previously stated, the applicant is requesting the review of this application in order to utilize the site in a manner consistent with the subdivision to the south (Metro Heights 1). Staff feels that single family uses are appropriate for this location and given the stated definitions of low density residential development and the park and open space requirements of the City, the application is consistent with the City of Owasso 2010 Master Plan. Upon development, the subject site would receive residential water and sewer service from the City of Owasso while the burden of extending infrastructure to the site would fall upon the developer. There appear to be no infrastructure issues that would limit the development of the subject property. Staff has received no phone calls or letters regarding this zoning request. Staff does not anticipate public opposition to the request for RS -3 zoning. Letters were mailed to surrounding property owners on December 12, 2002 and the legal advertisement was published on December 19, 2002. The subject property was posted on December 19, 2002. Copies of both the letters to property owners and the legal advertisements are attached for your information and review. TECHNICAL ADVISORY COMMITTEE The rezoning was reviewed at the December 30, 2002 regular meeting of the City of Owasso Technical Advisory Committee. Staff or utility providers provided no comments. The Garrett Creek Estates Addition is located southeast of the N. 1290' E. Ave. and E. 1100 St. N. intersection. The plat contains 87 residential lots and 7 blocks on approximately 23.12 acres, more or less.
