Ave. intersection. 6. OZ -03 -01 — A request to rezone approximately 5. 01 acres, more or less from AG (Agricultural General District) to IL (Industrial Light District). The subject property is located on the north side of W. 2nd St. approximately 1600 feet west of the W. 2nd St. and Main St. intersection. 7. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF DECEMBER 9, 2002 REGULAR MEETING - The Commission reviewed the minutes of December 9, 2002 Regular Meeting, Charles Willey moved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Charles Willey - Yes Dewey Brown - Yes Dale Prevett - Yes Bill Williams - Yes The motion carried 5 -0. 4. Annexation Request - A request for the annexation of property containing approximately 20.65 acres, more or less. The subject property is located on the east side of N. 97th E Ave. approximately 2640 feet north of the N. 97th E Ave. and E. 116' St N. intersection. The Chair introduced the item and the staff review was given by Robert Moore. The applicant is requesting this annexation in order to construct RS -3 homes on the property. The subject property meets all of the requirements included in the Annexation Policy. Staff published legal notice for three consecutive weeks. No calls have been received. The Owasso Technical Advisory Committee reviewed the request at their December 30, 2002 regular meeting. The Annexation Committee also reviewed and unanimously recommended approval. Staff recommends approval of the request, to annex into the corporate limits 20.65 acres, more or less. Mr. Patrick Shumacher, the applicant /owner, OWASSO PLANNING January 13, 2003 Page No. 2 was present to address any concerns. Ray Haynes and Charles Willey questioned whether it was advantageous to annex the subject property. Interpretations of the State Statue regarding the annexation of contiguous property were also discussed. Robert explained that the property to the south will possibly be annexed into the city limits at a later date and it is Staff's opinion the annexation of this property is advantageous to the City of Owasso. He also stated that the annexation request does meet City policy and is adjacent to the public right -of -way. Robert suggested tabling this item until the February Planning Commission meeting. Ray questioned that if the item is tabled could anything change if the applicant's attorney would be present. After discussion, Bill Williams moved to deny the annexation request. The motion was seconded by Charles Willey. A vote on the motion was recorded as follows: Ray Haynes - Yes Charles Willey - Yes Dale Prevett - Yes Dewey Brown - Yes Bill Williams - Yes The motion carried for denial 5 -0. 5. OZ -02 -10 - A request to rezone approximately 15.00 acres, more or less from AG (Agricultural General District) to RS -3 (Residential Single Family High Density District). The subject property is located on the south side of E. lW' St N. approximately 1700 feet east of the E. 116' St. N. and N. Garnett Rd. intersection. The Chair introduced the case and Robert presented the item. The surrounding land use and surrounding zoning was described. The Owasso 2010 Master Plan identifies the subject property as having future land use of public and low density residential. Staff feels that this proposal is consistent with the Master Plan for several reasons. The Master Plan labels the north half of the property as having a future land uses as public. If this property did develop as a public use, it would be the third such land use category in this section, a use of high intensity residential would further opportunities for home ownership. The Master Plan identifies the southern half of the site as a future use of low intensity residential. The plan defines low density residential as having a density of 2 - 5 dwelling units per acre. The Morningwood Preliminary Plat contains 58 lots on 15.00 acres with a density of 3.8 units per acre. The Technical Advisory Committee reviewed the request at their December 30, 2002 meeting. No comments were received. Staff recommends approval of the rezoning from AG (Agriculture) to RS -3 (Residential Single Family High Density District). The access easement to the west was discussed. Mr. David Charney requested a brief presentation to the Commissioners. He stated that Owasso Land Trust feels that it was very important to develop this property in an OWASSO PLANNING COMMISSION January 13, 2003 Page No. 3 attractive way. The price range of the homes will be approximately $100,000.00 and up with two car garages, brick exterior, upscale shingles, etc. Mr. Charney also offered significant fencing requirements written into the covenants. The following are comments from residents of the area that were present: Mr. Randy Conrad - 11818 E 116 St No - His property faces the proposed subdivision and would like to see less houses per acre. Mr. Frank Franklin - 11822 E 116 St No - He enjoys his privacy. Mr. Ron McMillin - 11326 N 123 E Ave - He enjoys his privacy and also has livestock; afraid they might be disturbed by this development. Ray Haynes moved to approve OZ- 02 -10, rezoning approximately 15.00 acres more or less, from AG to RS -3, Dale Prevett seconded the motion. Preliminary Plat - Morningwood- A request for the review of a preliminary play for the Morningwood Addition containing approximately 15.00 acres, more or less. The Morningwood Preliminary Plat contains 58 lots within 2 blocks. The subject property is located on the south side of E. 116' St. N. approximately 1700 feet east of the E. 116'h St N. and N. Garnett Rd. intersection. The Chair introduced the case and the staff review was given by Robert. He described the surrounding land use and the surrounding zoning. The Technical Advisory Committee reviewed the Morningwood Preliminary Plat at the December 30, 2002 meeting. Several comments were noted by the staff and utility providers. Staff recommends approval of the Morningwood Preliminary Plat, subject to the following staff and Technical Advisory Committee conditions: 1. Community Development - The northern most east -west street shall be named E. 115` Ct. N. 2. Community Development - The middle most east -west street shall be named 1140 Ct N. OWASSO PLANNING COMMISSION January 13, 2003 Page No. 4 3. Community Development - The southern most east -west street shall be named E. 113'h Ct. N. 4. Community Development - The western north -south street shall be named N. 1201h E. Ave. 5. Community Development - N. 120' E. Ave. is considered a residential collector and is required to have an additional 5' of right -of -way on both the east and west sides. 6. Community Development - The legal description should be corrected, (states, ... "southeast quarter (SEA) of the of the northeast quarter (NE /4)," take out one "of the ". 7. Community Development - The east 20' of the access easement shown along the western boundary of the subject property should be vacated prior to final plat submittal. 8. Community Development - Addressing should be labeled on the final plat submittal. 9. Community Development - Covenants shall be submitted prior to final plat approval. 10. Community Development - A covenant stipulating that, "All residential structures will front and be addressed on the street with the greatest building setback line ", shall be added. 11. Community Development - The plat shall show 11' interior easements between rear lot lines and a perimeter 17.5' easement is required along the southern boundary. 12. Community Development - The property is subject to a $16.00 per acre siren fee or $241.44. 13. Community Development - Detention locations shall be shown on the Final Plat submittal. 14. Public Works - Sanitary Sewer main -line connections must be approved by the City's Engineering Department. 15. PSO /AEP - Side lot easements of 5' are required. 16. Tulsa County Engineering - Limits of No Access are required along the side lot lines of those lots adjacent to E. 116'h St. N. 17. Tulsa County Engineering - Should be notified at such time that the acceleration /deceleration lanes are constructed. 18. Public Works - Acceleration/Deceleration lanes are required on E. 116'h St. N. 19. Public Works - Sidewalks are required along E. 116°i St. N. Water detention and drainage of the subject property was discussed. Charles Willey suggested that Mr. Charney meet with surrounding property owners to discuss perimeter fencing issues, also the type of street lighting that will be used. OZ -02 -11 - A request to rezone approximately 49.99 acres more or less from AG (Agricultural General District) to RS -3 (Residential Single Family High Density District). The subject property is located on the east side of N. 97h E Ave. approximately 800 feet south of the N. 97h E. Ave. and E. 116' St. N. intersection. The Chair introduced the item and Robert reviewed the staff report. Staff feels the rezoning proposal is consistent with the 2010 Master Plan. The Technical Advisory Committee reviewed the rezoning at their December 30, 2002 regular meeting. No comments were received by staff or utility providers. Letters were mailed to surrounding property owners and legal advertisement was published. Staff recommends approval of OZ- 02 -11, rezoning approximately 49.99 acres, from AG (Agricultural General District) to RS -3 (Residential Single Family High Density District). Mr. Brian Kellogg was present representing the applicant. Discussion was held regarding the construction of a fence which would run parallel with the railroad tracks. Charles Willey stated that a requirement of a fence in Metro Heights II was stated in the minutes but has yet to be constructed. He explained to Mr. Kellogg that he would like to see something in writing regarding screen fencing between the houses and railroad tracks when the Preliminary Plat is reviewed for this property_ Bill Williams moved to approve the rezoning of OZ- 02 -11, Dewey Brown seconded the motion. Final Plat - Attic Business Park - A request for the review of a final play for the Attic Business Park containing approximately 5.45 acres, more or less. The Attic Business Park Final Plat contains 1 lot within 1 block. The subject property is located on the east side of N. Garnett Rd. approximately 2500 feet north of the N. Garnett Rd and E. 86' St. N. intersection. The Chair introduced the case and review was given by Robert. The applicant is requesting this review to construct a business park with mini- storage units as the primary use of the property. The applicant was present to address any concerns. There were questions regarding the architectural fagade. The Owasso Technical Advisory Committee reviewed the Final Plat at the December 30, 2002 regular meeting. The items below are comments made at that meeting. Staff recommends approval of the Final Plat, subject to the following conditions: 1. Community Development - The property is subject to a $16.00 per acre siren fee ($16.00 x 5.45 acres = $87.20). The fee must be paid prior to releasing the final plat for signatures. 2. Community Development - An additional 30' of right -of -way is required along N. Garnett Rd. 3. Community Development - Minimum required frontage is 150' feet for CG zoning district development. 4. Community Development - Sidewalks are required along N. Garnett Rd. 5. Community Development - Western easement book and page number are required prior to City Council approval. 6. Public Works - Acceleration/Deceleration lanes are required along N. Garnett Rd. 7. Public Works - Reserve areas for detention must be shown on the plat prior to City Council approval. 8. Tulsa County - Limits of No Access must be shown along the area not included in the proposed curb cuts. 9. Tulsa County - Must be notified at the time acceleration/deceleration lanes were constructed. Ray Haynes moved to approve the Final Plat of Attic Business Park, subject to the above staff and TAC recommendations, Charles Willey seconded the motion. Site Plan - The Storage Source - A request for the review of a site plan for the Storage Source containing approximately 1.89 acres, more or less. The subject property is described as Lots 12 and 13, Block 5, Hale Acres Addition and is located on the west side of N. Garnett Rd. approximately 200 feet north of the N. Garnett Rd. and E. 112" St. N. intersection. The Chair introduced the item and Robert reviewed. The subject property is zoned CG (Commercial General District) which permits mini- storage units by right. The Owasso Technical Advisory Committee reviewed the site plan. The comments from staff and utility providers are listed below. Staff recommends approval of the site plan for The Storage Source as shown and subject to the following conditions: 1. Community Development - Handicapped parking spaces shall be shown as 12' X 20' not the 9' X 20' as shown on the site plan. 2. Community Development - All signage will be approved by a separate permit. 3. Community Development - The address of the subject property shall be as follows: -Phase I & II - 11220 N. Garnett Rd. -Phase III - 11222 (A - D) N. Garnett Rd. 4. Community Development - An official copy of the shared access agreement with the property owner to the south is required to be submitted to the City of Owasso. Community Development Department prior to the issuance of building permits. 5. Fire Department - Fire hydrant locations must be reviewed, approved and coordinated with the City of Owasso Fire Department. 6. Tulsa County Engineering - Must be notified at the time curb cuts were constructed. The site plan does contain the recommended changes. Access into the property was discussed along with a brief discussion regarding the building fagade. The applicant was present and stated that he would discuss a shared access with Mr. Vines, the property owner, as soon as possible. Ray Haynes explained that he would like to see the entire access, which would include the subject property and the property to the south, be complete prior to the business opening. Ray Haynes moved to approve the site plan for The Storage Source subject to the above staff and TAC recommendations and subject to the shared access to be complete prior to the issuance of a Certificate of Occupancy. Dale Prevett seconded the motion. Final Plat - Garrett Creek Estates - A request for the review of a final plat for the Garrett Creek Estates Addition containing approximately 23.12 acres, more or less. The Garrett Creek Estates Final Plat contains 84 lots with 7 blocks. The subject property is located southeast of the N. 129" E. Ave. and E. 1161' St. N. intersection. The Chair introduced the item and staff review was given by Robert. The plat contains 87 residential lots and 7 blocks. After review of the final plat application, staff found that the plat is consistent with the approved OPUD- 02 -02. The Owasso Technical Advisory Committee reviewed the subject plat at their December 30, 2002 meeting. Below are the comments made at that meeting by staff and utility providers. 1. Community Development Department - Street labels and addressing shall be shown on the final plat prior to City Council approval. 2. Community Development Department - A covenant stipulating that "all residential structures will front and be addressed on the street with the greatest building setback line" is to be added to the plat prior to City Council approval. 3. Community Development - Acceleration/Deceleration lanes are required along E. 116' St. N. and N. 129" E. Ave. 4. Community Development - An additional 10' of right -of -way is required along N. 129' E. Ave. 5. Community Development - Section I, C., #2 of the deed of dedication should state that 84 lots will be served, not 62. 6. Community Development - Section II, #4, should also state that all accessory structures must be approved by the City of Owasso. 7. Community Development - Section II., #4 should state, "The design and precise location of any... ", instead of "The design and precise locationy..." 8. Community Development - All covenants related to residential water service shall state that Washington County Rural Water District #3 is responsible for service and the maintenance of those lines instead of the City of Owasso. 9. Community Development - Section II., #11 shall state that all signs within the perimeters of the development shall meet the minimum requirements of the City of Owasso Sign Code. 10. Community Development - Sidewalks are required along E. 116 " St. N. and N. 129ih E. Ave. OWASSO PLANNING COMMISSION January 13, 2003 Page No. 9 11. Community Development - A drainage easement is to be shown in between Lots 7 & 8, Block 2. 12. Community Development - Lots 29, 30, 33, and 34, Block 1, easement does not follow lot lines and shall be corrected prior to City Council review. 13. Community Development - Lot 1, Block 5, easement is excessive and shall be corrected prior to City Council review. 14. Community Development - A $16.00 per acre storm siren fee is required ($16.00 X 23.12 acres = $369.92), prior to releasing the final plat for signatures. 15. Washington County Rural - A 20' easement is required along E. 1161' St. N. 16. Washington County Rural - There is a 20' existing easement along N. 129' E. Ave. and is required to be shown on the plat. 17. Fire Department - Fire hydrant locations must be reviewed, approved and coordinated with the City of Owasso Fire Department. 18. Public Works - Section I., C., /t5 of the deed of dedication should be corrected to state, "Pavement or landscape repair... ", instead of "Pavement of landscape repair... ". 19. Public Works - Lots 3 - 9, Block 3 shall have a 17.5 perimeter easement shown on the plat or 11' with an additional 11' dedicated by separate instrument. 20. Public Works - Lots 18 - 19, Block 1, easement is shown as 7.5 feet and should be corrected to 5'. 21. PSO /AEP - All lots within Block 4 shall have a perimeter 17.5 easement shown on the plat or 11' with an additional 11' dedicated by separate instrument. 22. Tulsa County - Dedication of right -of -way along E. 116' St. must be accomplished by the filing of a separate instrument. 23. Tulsa County - Limits of No Access shall be shown on all areas that are not to be utilized as curb cuts. 24. Tulsa County - Must be notified at the time curb cuts were constructed and acceleration/deceleration lanes were constructed. After a brief discussion regarding the detention of stormwater, Ray Haynes moved to approve the Garrett Creek Estates Final Plat, subject to the above Staff and TAC recommendations. Chairperson Secretary Date CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT OLS -03 -01 (Capital Homes Residential Group) STAFF REPORT BACKGROUND The City of Owasso has received a request from Capital Homes Residential Group for the review of a lot split of Lots 4 & 5, Block 7, Preston Lakes 11 Addition. The subject properties are generally located 250 feet east of the E. 89th Pl. N. and N. 153`" E. Ave. intersection. The applicant is requesting this review in order to correct the placement of a single family structure on Lot 5, Block 7. A general area map and a complete legal description have been attached for your information and review. LOCATION Lots 4 & 5, Block 7, Preston Lakes 11 Addition, further described as approximately 250 feet east of the E. 89th Pl. N. and N. 153d E. Ave. intersection. EXISTING LAND USE Residential — Single Family SURROUNDING LAND USE North: Residential —Single Family South: Vacant East: Residential —Single Family West: Vacant PUD/RS -3 (Planned Unit Development/Residential Single Family High Density District) SURROUNDING ZONING North: PUD/RS -3 (Planned Unit Development/Residential Single Family High Density District) South: PUD/RS -3 (Planned Unit Development/Residential Single Family High Density District) East: PUD/RS -3 (Planned Unit Development/Residential Single Family High Density District) West: PUD/RS -3 (Planned Unit Development/Residential Single Family High Density District) ZONING REQUIREMENTS As mentioned above, the subject properties are currently zoned PUD/RS -3. If the application is approved, Lot 5 would meet the minimum bulk and area requirements of the PUD/RS -3 zoning district. However, approval of this application must be contingent on Board of Adjustment variance approval, as Lot 4 would not meet the minimum lot frontage requirement (65 feet) in the RS -3 zoning district after lot -split approval. ANALYSIS: As mentioned above, the applicant is requesting the review of this application to correct the placement of a single family structure on Lot 5, Block 7. Currently, Lot 5, Block 7, contains a single family structure which encroaches the eastern boundary of Lot 4, Block 7, by approximately 0.3 feet. The applicant's proposal would remove 6 feet from the eastern portion of Lot 4 adding the width to the western boundary of Lot 5, thereby creating sufficient widths on both lots to construct single family structures while still meeting the minimum side yard requirements of the RS -3 zoning district. The proposed lot split would meet all bulk and area requirements of the PUD/RS -3 zoning district with the exception of the minimum lot frontage, of which Board of Adjustment approval is required. Staff has been informed by the applicant that the cause of the mistake was the result of locating the foundation according to the property pins to the south. During the initial "pad - work", the property pins located along E. 89n` Place North were removed. The foundation was pulled from the south by the property pins which are located approximately 6 feet to the west of the Lot 5, Block 7, property lines, thus causing the incorrect placement of the structure. If approved by the Planning Commission, this item is not forwarded to the City Council for action, as the Planning Commission is the approving body for lot split requests. TECHNICAL ADVISORY COMMMEE The OLS -03 -01 application was reviewed at the January 29, 2003 regular meeting of the City of Owasso Technical Advisory Committee. Staff or utility providers provided no comments. Staff recommends conditional approval of OLS -03 -01 subject to the following conditions: 1. The applicant applies for and receives variance approval from the minimum lot frontage requirements in the RS -3 zoning district by the City of Owasso Board of Adjustment on Lot 4, Block 7, Preston Lakes 11 Addition. 2. The applicant provides an official copy of the recorded deed(s) to the City prior to final inspections on Lot 5 and prior to the issuance of building permits on Lot 4. ATTACHMENTS 1. CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT OZ -03 -01 (Owasso Sertoma Club) STAFF REPORT BACKGROUND The City of Owasso has received a request from Bill Williams, applicant on behalf of the Owasso Sertoma Club, for the review of a rezoning for approximately 5.01 acres, more or less. The subject property is located on the north side of W. 2 "d St. approximately 1600 feet west of the W. 2 "d St. and Main St. intersection. The applicant is proposing to rezone the subject property from AG (Agricultural General District) to IL (Industrial Light District). In addition to civic functions, the applicant is proposing to utilize the facility for various auction and retail uses. A general area map and a complete legal description have been attached for your information and review. LOCATION See aaached legal description. According to the City of Owasso Zoning Code, auction houses and retail uses are permitted by right in the IL zoning district. COMPREHENSIVE PLAN CONSISTENCY The Owasso 2010 Master Plan identifies the subject property as having a future land use of park and recreational. The applicant's proposal would seem to be inconsistent with the Comprehensive Plan in that the applicant is requesting an industrial zoning classification. However, staff feels that by the original approval of the construction of the Sertoma building, a change in the development pattern of the area has been created. Furthermore, this approval would seem to be more appropriate than the original 2010 Master Plan designation. Staff { feels that the areas designated as park and recreational to the west of Mingo are more than sufficient to serve the recreational needs of the area and still allow for the construction of viable, sales -tax producing commercial sites. Therefore, staff would be in favor of a CG (Commercial General District) zoning designation rather than an IL (Industrial Light District). A commercial zoning designation would still allow retail and civic uses, but would limit the expansion of industrial uses to the west. Additionally, staff has been made aware of changes that are to occur to the industrial property to the south. The property owner has informed staff that the potential for commercial rezoning requests along the south side of E. 76th N. are inevitable. Staff feels that commercial developments along E. 76`h St. N. are far more appropriate than industrial uses serving as a "gateway" into the City of Owasso. Staff has also been informed by the Community Development Director that both the north and south sides of E. 76th St. N. are proposed for a combination of commercial and park / recreational uses in the current update of the Comprehensive Plan. ANALYSIS As previously stated, the applicant is requesting the review of this application in order to utilize the site for retail purposes in addition to the civic functions currently underway. Staff has received no phone calls or letters regarding this zoning request. Staff does not anticipate public opposition to the request for the rezoning. Letters were mailed to surrounding property owners on January 10, 2003 and the legal advertisement was published on January 16, 2003. The subject property was posted on January 16, 2003. Copies of both the letters to property owners and the legal advertisements are attached for your information and review. TECHNICAL ADVISORY COMMITTEE The rezoning was reviewed at the January 29, 2003 regular meeting of the City of Owasso Technical Advisory Committee. Staff or utility providers provided no comments. Requests for Exceptions to these Regulations or requirements of the Final Plat shall be submitted in accordance with these Regulations. All printing shall be clear and legible. All sheets shall be of a consistent size of twenty-four inches (24 ") by thirty-six inches (36 ") or larger. The drawing surface of any such plat shall have a binding margin of two inches (2 ") at the left side of the plat and a margin of not less than one inch (1") at the right side. Where the proposed plat is of unusual size, the Final Plat may be submitted on two or more sheets of the same dimensions and scales. If more than two sheets are required, an index sheet of the same dimensions shall be filed showing the entire development. Each sheet shall be sealed by a registered professional engineer or surveyor. The Final Plat shall contain or be accompanied by the following: The name of the subdivision, city, county and state. The subdivision name shall not duplicate or too closely resemble names of existing subdivisions in Tulsa or Rogers Counties. The names and addresses of the owner(s) of record, the subdivider(s), and the registered engineer or land surveyor preparing the plat. Official seals of the engineer or surveyor \ are required. y The accurate legal description of the subdivision referenced to the section, range and township, based on an accurate traverse, giving angular and linear dimensions which must mathematically close, the allowable error of closure on any portion of a final plat shall be one foot (1') in five thousand feet (5000'). The location of monuments shown in reference to existing United States Coastal and Geodetic Survey data or the nearest established street lines, including true angles and distances to such reference points or monuments. The date of preparation of the plat, north arrow and scale (written and graphic presentation). Location Map (does not have to be drawn to scale), showing the locations of subdivisions within the mile section. The total acreage and total number of lots of the subdivision shown near the location map. � The names of all adjacent subdivisions and the names, locations and widths of all existing streets, easements, drainageways, and other public ways adjacent to the property. The location of lots, streets, public highways, alleys, parks, building lines, limits of no access and other features, with accurate dimensions in feet and decimals of feet, distances, angles and/or bearings. Where these lines follow a curve, the central angle, the radius, point of curvature, length of curve and length of intermediate tangents shall be shown. V The blocks numbered consecutively throughout the entire subdivision and the lots numbered consecutively throughout each block, with areas to be excluded from platting marked "reserved" or "not for public use ". The location and accurate dimensions of all property to be offered for dedication for public use, and all property reserved for the common use of the property owners within the subdivision, with purpose indicated. This includes, but is not limited to, dedication of streets and alleys, parks drainageways, or other areas dedicated or reserved for public use. "'-f The names of all streets to be dedicated. The dimensions of all lots and lot lines, and the bearings of those lot lines not parallel or perpendicular to the street right -of -way line. The location and dimensions of all easements to be dedicated. All easements shall be denoted by fine dashed lines, clearly identified, and if already on record, the recorded reference of such easements. The width of an easement with sufficient ties to locate it definitely with respect to the subdivision must be shown. \ The easements located outside the boundaries of the plat, required for plat approval. Proof of executed easements shall be provided to the City upon request of a permit to construct. The deed of dedication for all rights -of -way, easements and other properties and any deed restrictions applicable to the subdivision shall be shown. The location of every oil or gas well, or dry hole drilled in search of oil or gas, as certified by the records of the Oklahoma Corporation Commission submitted to the Planning Commission. All lots located in a one hundred (100) year flood plain area of special flood hazard shall have the building pad elevation provided on each lot on a copy of the final plat prior to recording the final plat. That pad elevation shall be a minimum of one foot (1') above the said one hundred (100) year flood elevation as identified by Federal Emergency Management Agency (FEMA) or other authority. A copy of any private restrictions affecting the subdivision or any part thereof attached to each plat. Oklahoma Department of Environmental Quality permits for water and/or sanitary sewer system construction. Reference to any separate instruments which directly affect land being subdivided, including restrictive covenants, filed in the office of the County recorder of deeds. The Developer dedicates to the public, for public use forever, the utility easements as shown on the Plat for the several purposes of constructing, maintaining, operating, repairing and replacing any and all public utilities, including but not limited to, storm and sanitary sewer lines, communication lines, electric power lines, cable television lines, transformers, pedestals, gas and water tines, together with all fittings and equipment for each such facility and any other appurtenances thereto, with the right of ingress and egress to and upon said utility easements for the uses and purposes thereof. 2. Private Streets. The streets and rights -of -way shown on the Plat are private streets for the use and benefit of residents of the Addition. Furthermore, the streets may be used at any time by invitees of said residents, as well as any public utility or emergency service provider. CERTAIN RESTRICTIONS 2. Underground and Electric and Communication Service. In connection with the installation of underground electric, telephone and cable television services, all lots are subject to the fotlowing: A. No overhead pole lines for the supply of electric service, telephone and cable television service may be located in the Addition. Street light poles or standards may be served by underground cable, and elsewhere throughout the Addition, all supply lines shall be located underground in the easement ways reserved for general utilities and streets shown on the plat. Service pedestals and transformers as sources of supply at secondary voltages, may be also located in such easement ways. B. Underground service cables to all residential units which may be located on all lots in said Addition may be run from the nearest service pedestal or transformer to the point of usage determined by the location and construction of such residential units as may be located upon each said lot; provided that upon the installation of such a service cable to a particular residential units, the supplier of electric service, telephone or cable television service shall thereafter be deemed to have a definitive, permanent, effective and exclusive right -of -way easement on each lot covering a five foot RJ strip extending 2.5 feet on each side of such service cable extending from the service pedestal or transformer to the service entrance on said residential unit. C. The supplier of electric, telephone, and cable television service, through its proper agents and employees, shall at all times have the right of access to all such easement ways shown on the plat or provided for in this dedication for the purposes of installing, maintaining, removing, or replacing any portion of said underground electric, telephone, or cable television so installed by it. D. The owner of each residential unit shall be responsible for the protection of the underground electric, telephone, and cable television facilities located on such owner's property and shall prevent the alteration of grade or any construction activity which may interfere with said electric, telephone or cable television facilities. Such utility company will be responsible for ordinary maintenance of underground electric, telephone, or cable television facilities, but the owner will pay for the damage or relocation of such facilities caused or necessitated by acts of the owner, its agents or contractors. E. The foregoing covenants concerning underground electric, telephone, and cable television facilities shall be enforceable by the supplier of electric, telephone or cable television service, and the owner of each residential unit agrees to be bound thereby. 3. Underground Gas Service. Underground service lines to all residential units may be run from the nearest service connection to the point of usage determined by the location and construction of the residential unit; provided, that upon the installation of such a service tine to a residential unit, the supplier of gas service shall thereafter be deemed to have a definitive, permanent, effective and exclusive right -of -way easement on said Lot, covering a five foot (T) strip extending 2.5 feet on each side of such service line, extending from the service connection to the service entrance on the residential unit. A. The supplier of gas service, through its proper agents and employees, shall at all times have right of access to all such easementways shown on the Plat, or provided for in this dedication, for the purpose of installing, maintaining, removing or replacing any portion of said underground gas facilities so installed by it. 91 B. The owner of each residential unit shall be responsible for the protection of the underground gas facilities located on its residential unit and shall prevent the alteration of grade or any construction activity which may interfere with said gas facilities. The supplier of gas services wilt be responsible for ordinary maintenance of underground gas facilities, but such owner will pay for damage or relocation of such facilities caused by acts of such owner or its agents or contractors. C. The foregoing covenants concerning underground gas facilities shall be enforceable by the supplier of gas service, and the owner of each residential unit agrees to be bound hereby. 4. Water. Sanitary and Storm Sewer. The owner of each residential unit shall be responsible for the protection of the public water mains and sanitary/storm sewer facilities located on such owner's lot and shall prevent the alteration of grade in excess of three feet from the original contours or any construction activity which may interfere with said facilities. Said alteration of grade restrictions shall be limited to easement areas. The City or Rural Water District No. 3 - Washington County, as the case may be, shall be responsible for ordinary maintenance of its public sanitary sewer facilities or public water mains, but the owner of each residential unit will pay for damage or relocation of such facilities caused or necessitated by acts of the owner or his agents or contractors. The City or said Rural Water District shalt have the right of access with its equipment to all easement ways shown on the Plat for installing, maintaining, removing or replacing any portion of its underground water and sewer facilities. The foregoing covenants concerning water and sewer facilities shalt be enforceable by the City or said Rural Water District, and the owner of each residential unit agrees to be bound hereby. 5. Landscape and Paving Repair. Unless otherwise expressly assumed by a third party association, the owner of each residential unit shall be responsible for the repair and replacement of any landscaping and paving located within the utility easements in the event it is necessary to repair any underground water, sanitary sewer mains, storm sewers, electric, natural gas, telephone, or cable television service. No residential unit owner shall plant any trees or shrubbery in dedicated utility easements or rights -of -way which would potentially endanger, threaten, or harm any utilities located within said easements or rights -of -way. If it is determined that any trees or shrubbery located within said easements or rights -of -way are damaging or endangering utilities in said easements or rights -of -way, the City or said Rural Water District shalt have the right to remove said trees or shrubbery upon five (5) days notice thereof at the lot owner's expense, or within such time the tot owner may remove same. a 6. Developer's Reserved Rights. A. Submission to Oklahoma Unit Ownership Estate Act. The Developer may, in its sole discretion, submit the Addition to the Oklahoma Unit Ownership Estate Act and file a Declaration of Condominium covering the subject property. B. Inclusion in Property Owners Association. As a part of the development of the Addition, the Developer thereof has created or will create a Watercolours Association, an Oklahoma not - for - profit corporation (the "Association "). The Developer may permit owners of future phases of Watercolours at Coffee Creek. C. Binding Effect: All lawful acts of the Association made under and pursuant to its Certificate of Incorporation and By -Laws shalt be binding upon the lots /units contained in the Addition and the owners thereof. Membership in the Association shall consist of all owners of lots /units in the Addition and all owners of such additional property designated by the Developer. No lot /unit owned by the Developer shall be subject to assessment. D. Assessments: Annual Assessments may be made by the Association on a per lot unit basis, all as more fully set forth in the Association governing documents and in the Covenants, Conditions and Restrictions for Watercolours at Coffee Creek. E. Other Rights: Developer shall have the right and power to execute all documents and do all other acts and things affecting the Addition which Developer determines are necessary or desirable in connection with the rights of Developer under this Declaration, including the execution and filing of various Covenants, Conditions and Restrictions for the Addition. 7. Reserve Areas. Areas designated on the Plat as Reserve Areas are hereby retained by the Developer for possible later conveyance, at the Developer's sole discretion, to the Association or other third party for the purpose of providing green areas, proper visual screening of the Addition from surrounding areas, and for the construction and maintenance of any screening fence or wall, and for other purposes deemed advisable by the Developer or the Association.
