OZ- 03 -01— A request to rezone approximately 1.019 acres, more or less from AG (Agricultural General District) to IL (Industrial Light District). The subject property is located on the north side of W. 2nd St. approximately 1600 feet west of the W. 2°d St. and Main St. intersection. This item was tabled at the February 10, 2003 Regular Meeting. 5. OA -03 -02 — DG &S Properties — A request for the annexation of property containing approximately 11.33 acres, more or less. The subject property is located on the west side of N. Garnett Rd., approximately 2,640 feet north of the E. 116d` St. N. and N. Garnett Rd. intersection. 6. OWASSO PLANNING COMMISSION MINUTES OF REGULAR MEETING Monday, February 10, 2003 Owasso Community Center 301 South Cedar, Owasso, Oklahoma MEMBERS PRESENT Ray Haynes Charles Willey Dale Prevett Dewey Brown Bill Williams MEMBERS ABSENT STAFF PRESENT Rodney Ray Robert Moore Rickey Hayes Eric Wiles Marsha Hensley The agenda for the regular meeting was posted at the north entrance to City Hall on February 5, 2003 at 12:00 PM. 1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF JANUARY 13, 2003 REGULAR MEETING - The Commission reviewed the minutes of January 13, 2003 Regular Meeting, Charles Willey moved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Charles Willey - Yes Dewey Brown - Yes Dale Prevett - Yes Bill Williams - Yes The motion carried 5 -0. 4. Request to Address the Planning Commission - A request to address the Planning Commission by Mr. Rodney Ray, City Manager. Chairperson Haynes suggested that the above request be moved to the last item on the agenda. 5. OLS -03 -01 - A request for a lot split of Lots 4 and 5, Block 7, Preston Lakes II Addition. The subject properties are generally located 250 feet east of the E. 891s Pl. N. and N. 153d E. Ave. intersection. The Chair introduced the case and Robert presented the item. The applicant is requesting the review of this application to correct the placement of a single family structure on Lot OWASSO PLANNING COMMISSION February 10, 2003 Page No. 2 5, Block 7. If approved it would remove 6' from the eastern portion of Lot 4 adding the width to the western boundary of Lot 5. Robert explained that the mistake was the result of locating the foundation according to the property pins to the south. Apparently, the property pins along E. 89°i Place North were removed. The Technical Advisory Committee reviewed the request at their January 29, 2003 meeting. No comments were provided. Concerns were addressed regarding the minimum lot area requirement. Robert explained that if approved, Lot 4 would meet the minimum area requirement but not the 65' minimum lot frontage requirement. Staff recommends conditional approval of OLS- 03-01 subject to the following conditions: 1. The applicant applies for and receives variance approval from the minimum lot frontage requirements in the RS -3 zoning district by the City of Owasso Board of Adjustment on Lot 4, Block 7, Preston Lakes II Addition. 2. The applicant provides an official copy of the recorded deed(s) to the City prior to final inspections on Lot 5 and prior to the issuance of building permits on Lot 4. The applicant, Stuart Gallagher, was present and requested a brief presentation. Mr. Gallagher distributed copies of the plat which showed the two lots involved, along with several example plot plans of houses that could fit on Lot 4. He stated that he had purchased Lot 4 in order to straighten out the problem of Lot 5. Ray Haynes expressed appreciation towards Mr. Gallagher for being present but, hopes that he has learned to be more cautious in the future. Ray Haynes moved to approve OLS -03 -01 subject to the above staff recommended conditions, Dale Prevett seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Charles Willey - Yes Dale Prevett - Yes Dewey Brown - Yes Bill Williams - Yes The motion carried 5 -0. 6. OZ- 03 -01- A request to rezone approximately 5.01 acres, more or less from AG (Agricultural General District) to IL (Industrial Light District). The subject property is located on the north side of W. 2 "d St. approximately 1600 feet west of W. 2nd St. and Main St. intersection_ The Chair introduced the case and staff review was given by Robert. The surrounding land use was described along with the surrounding zoning. Robert explained that an industrial zoning classification would seem to be inconsistent with the Comprehensive OWASSO PLANNING COMMISSION February 10, 2003 Page No. 3 Plan which shows a future land use of park and recreational. Staff feels that by the original approval of the construction of the Sertoma building, a change in the development pattern of the area has been created. Staff would be in favor of a CG (Commercial General District) zoning designation rather than an IL (Industrial Light District). Letters were mailed to surround property owners and legal advertisement was published. No phone calls have been received regarding the zoning request. The Technical Advisory Committee reviewed the rezoning at the January 29, 2003 meeting. Staff or utility providers had no comments. Staff recommends approval of OZ- 03 -01, rezoning approximately 5.01 acres, from AG (Agricultural General District) to CG (Commercial General District). Charles Willey reminded the Commissioners that only one acre at the southernmost point was annexed into the City of Owasso. Ray Haynes moved to table the item, Charles Willey seconded the motion. Final Plat — Watercolours at Coffee Creek - A request for the review of a final plat for the Watercolours at Coffee Creek containing approximately 5.96 acres, more or less. The Watercolours at Coffee Creek Final Plat contains 40 townhouse lots within 5 blocks. The subject property is located northeast of the E. 103rd St. N. and N. 138h E. Ave. intersection. The Chair introduced the item and Robert reviewed the staff report. The subject property is zoned PUD /RTH (Planned Unit Development /Residential Townhouse District). The preliminary plat was approved on April 9, 2002. Conditions of approval from the preliminary approval not addressed by the final plat are below: 1. Perimeter sidewalks must be shown on the final plat prior to bring the item to City Council. The Technical Advisory Committee reviewed the final plat at their January 29, 2003 meeting. Below are the comments made by utility providers and staff. Staff recommends approval of the Watercolours at Coffee Creek, subject to the following conditions: 1. Community Development — The property is subject to a $16.00 per acre siren fee ($16.00 X 5.96 acres = $95.36). The fee must be paid prior to releasing the final plat for signatures. 2. Community Development — The property is subject to a $1580.00 per acre fee for OWASSO PLANNING COMMISSION February 10, 2003 Page No. 4 connecting to the Elm Creek sewer facilities ($1580.00 X 5.96 acres = $9416.68). The acreage fee for this plat is equal to the dollar amount of ROW donated for the construction of the Owasso Land Trust sewer line to the north. 3. Community Development - The property is subject to a $1000.00 per acre fee for connecting to the Owasso Land Trust sewer facilities ($1000.00 x 5.96 acres = $5960.00). 4. Community Development - Addressing must be shown on the final plat prior to bring the item to City Council. 5. Community Development - Copies of DEQ permits are required prior to bringing the item to City Council. 6. Community Development - N. 135' E. Ave. should be changed to N. 138' E. Ave. 7. Community Development - Perimeter sidewalks must be shown on the final plat prior to bringing the item to City Council. 8. Community Development - No on- street parking is allowed and must be correctly signed within the development. 9. Community Development - Covenants are numbered incorrectly, please correct. 10. Community Development - Covenants #5 should state that the City, Rural Water District and any interested utility company... 11. Public Works - Reserve areas and detention easements must be shown on the Final Plat prior to bringing the item to City Council. 12.ONG - Requests that the standard easement language related to residential gas service be added to the final plat prior to bringing the item to City Council. Firewall requirements were discussed along with extra parking requirements. The applicant was present and clarified both issues. Ray Haynes moved to approve the final plat, subject to the above staff and TAC recommendations, Bill Williams seconded the motion. OWASSO PLANNING COMMISSION February 10, 2003 Page No. 5 Mr. Ray addressed the Commissioners regarding the history of non - contiguous annexations. He stated that the Annexation Policy has served the City of Owasso extremely well for the past twenty-seven years. The legality of non - contiguous annexation petitions was also discussed. Mr. Ray suggested the Commissioners revisit the Schumacher annexation request, bearing in mind that the 20 acre tract is bordered by at least 60 acres of undeveloped property with potential for growth. Chairperson Haynes stated that the Commissioners will consider what Mr. Ray has brought before them. 8. Report on monthly building permit activity. 9. Chairperson Secretary Date CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT OZ -03-01 (Owasso Sertoma Club) STAFF REPORT The City of Owasso has received a request from Bill Williams, applicant on behalf of the Owasso Sertoma Club, for the review of a rezoning for approximately 1.019 acres, more or less. The subject property is located on the north side of W. 2 "d St. approximately 1600 feet west of the W. 2nd St. and Main St. intersection. The applicant is proposing to rezone the subject property from AG (Agricultural General District) to IL (Industrial Light District). In addition to civic functions, the applicant is proposing to utilize the facility for various auction and retail uses. A general area map and a complete legal description have been attached for your information and review. This item was tabled from the February 10, 2003 Regular Meeting. The application requested to rezone approximately 5.01 acres, not the 1.019 acres of the property that was annexed in August. The application has been corrected and a revised legal notice appeared in the February 20, 2003 edition of the Owasso Reporter. LOCATION See attached legal description. EXISTING LAND USE Civic SURROUNDING LAND USE North: Vacant South: Industrial East: Industrial West: Vacant PRESENT ZONING AG (Agricultural General District) SURROUNDING ZONING North: AG (Agricultural General District) South: IL (Industrial Light District) East: IL (Industrial Light District) West: AG (Agricultural General District) ZONING REQUIREMENTS If the application is approved, the subject property would be zoned IL (Industrial Light District). According to the City of Owasso Zoning Code, auction houses and retail uses are permitted by right in the IL zoning district. COMPREHENSIVE PLAN CONSISTENCY The Owasso 2010 Master Plan identifies the subject property as having a future land use of park and recreational. The applicant's proposal would seem to be inconsistent with the Comprehensive Plan in that the applicant is requesting an industrial zoning classification. However, staff feels that by the original approval of the construction of the Sertoma building, a change in the development pattern of the area has been created. Furthermore, this approval would seem to be more appropriate than the original 2010 Master Plan designation. Staff feels that the areas designated as park and recreational to the west of Mingo are more than sufficient to serve the recreational needs of the area and still allow for the construction of viable, sales -tax producing commercial sites. Therefore, staff would be in favor of a CG (Commercial General District) zoning designation rather than an IL (Industrial Light District). A commercial zoning designation would still allow retail and civic uses, but would limit the expansion of industrial uses to the west. Additionally, staff has been made aware of changes that are to occur to the industrial property to the south. The property owner has informed staff that the potential for commercial rezoning requests along the south side of E. 760i N. are inevitable. Staff feels that commercial developments along E. 760' St. N. are far more appropriate than industrial uses serving as a "gateway" into the City of Owasso. Staff has also been informed by the Community Development Director that both the north and south sides of E. 760' St. N. are proposed for a combination of commercial and park / recreational uses in the current update of the Comprehensive Plan. ANALYSIS As previously stated, the applicant is requesting the review of this application in order to utilize the site for retail purposes in addition to the civic functions currently underway. Staff has received no phone calls or letters regarding this zoning request. Staff does not anticipate public opposition to the request for the rezoning. Letters were mailed to surrounding property owners on February 13, 2003 and the legal advertisement was published on February 20, 2003. The subject property was posted on February 13, 2003. Copies of both the letters to property owners and the legal advertisements are attached for your information and review. TECHNICAL ADVISORY COMMITTEE The rezoning was reviewed at the January 29, 2003 regular meeting of the City of Owasso Technical Advisory Committee. Staff or utility providers provided no comments. If this Commission approves the application, this item does require City Council approval. RECOMMENDATION Staff recommends approval of 02-03 -01, rezoning approximately 1.019 acres, from AG (Agricultural General District) to CG (Commercial General District). ATTACHMENTS 1. The property is bordered on the south, west, and north by Country Estates Ill, IV and V, respectively. The applicant has completed the infrastructure and utility construction while the property remained in Tulsa County. Additionally, the applicant has forwarded copies of construction plans and the preliminary plat to ensure that the property would meet City of Owasso development standards. First, the City of Owasso is aggressively attempting to locate a large plastics manufacturer along the eastern boundary of he subject property. In addition to keeping the City's best interest in ;mind, the applicant has also agreed to begin the planning process which at this point includes annexation, rezoning and eventually, the platting of the property. Upon successful floodplain fill permits along E. 76h St. N., the applicant will begin the rezoning and platting process for this area of the property. Finally, the applicant has had preliminary discussions regarding the donation of the remainder of land to the City. City staff has been working tirelessly with several land owners and government agencies to acquire property in the area described in the annexation petition to construct what could become a 100 — 200 acre off -road bike park. The preliminary plans also include some perimeter walking trails and other family oriented amenities. The land donation, although occurring some time in the future and after floodplain feasibility studies, would become the second phase of the proposed off -road mountain bike park. The property is currently zoned AG (Agricultural General District) in Tulsa County and would remain this same classification upon annexation. Prior to any action relative to a retuning request, a rezoning sign will be posted on the property and property owners within 300' will be notified. All development that occurs on the subject property must adhere to all subdivision and zoning requirements including but not limited to paved streets, sidewalks and sta mwater detention facilities. Residential sewer and water service will be provided by the City of Owasso. A copy of the Annexation Policy is attached for your information and review. The subject property meets all of the requirements included within the policy.
