OPP 03 -01 — Country Estates VI — A request for the review of a preliminary plat for the Country Estates VI Addition containing approximately 11.33 acres, more or less. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF FEBRUARY 10, 2003 REGULAR MEETING - The Commission reviewed the minutes of February 10, 2003 Regular Meeting, Charles Willey moved, seconded by Dale Prevett to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Charles Willey - Yes Dewey Brown - Yes Dale Prevett - Yes Bill Williams - Yes The motion carried 5 -0. 4. OZ -03 -01 - A request to rezone approximately 1.019 acres, more or less from AG (Agriculture General District) to IL (Industrial Light District). The subject property is located on the north side of W. 2nd St. approximately 1600 feet west of the W. 2 "d St. and Main St. intersection. This item was tabled at the February 10, 2003 Regular Meeting. The Chair introduced the case and Robert presented the item. This request was heard and tabled at the February 10, 2003 regular meeting. The original application requested to rezone 5.01 acres, not 1.019 acres. The application has been corrected and the legal notification was revised. Letters were mailed to surrounding property owners and the legal advertisement was published in the Owasso Reporter. The Technical Advisory Committee reviewed the request at their January 29, 2003 meeting. No comments were provided. Staff recommends a CG (Commercial General District) zoning rather than an OWASSO PLANNING COMMISSION March 10, 2003 Page No. 2 IL (Industrial Light District). A commercial zoning would still allow retail and civic uses, but would limit the expansion of industrial uses to the west. Staff recommends approval of OZ- 03 -01, rezoning approximately 1.019 acres, from AG (Agricultural General District) to CG (Commercial General District). Discussion was held regarding the correct physical address of the property. The rezoning application shows 405 West 2nd Avenue and the staff report indicates the address as being 405 West 2' Street, Ray Haynes moved to approve OZ- 03 -01, rezoning approximately 1.019 acres, from AG to CG (Commercial General District), Charles Willey seconded the motion. Chairperson Haynes urged staff to verify the physical address of this property. OA -03 -02 — DG & S Properties — A request for the annexation of property containing approximately 11.33 acres, more or less. The subject property is located on the west side of N. Garnett Rd., approximately 2,640 feet north of the E. 116th St. N. and N. Garnett Rd. intersection. The Chair introduced the case and staff review was given by Robert. The surrounding land use was described along with the surrounding zoning. The property is currently zoned AG (Agricultural General District) in Tulsa County and would remain upon annexation. An application for rezoning has been received along with a preliminary plat application. Both will be presented at the April Planning Commission meeting. Legal advertisement was published in the Owasso Reporter. The Technical Advisory Committee reviewed the rezoning at the February 26, 2003 meeting. The Owasso Annexation Committee reviewed the request at their February 26, 2003 Special Meeting. Staff recommends approval of OA -03 -02 to annex into the corporate limits of the City of Owasso approximately 11.33 acres, more or less. OA -03 -03 - Michael Ray Sharp - A request for the annexation of property containing approximately 30.54 acres, more or less. The subject property is located on the south side of E. 106' St. N., approximately 1,320 feet east of the N. Garnett Rd. and E. 106`h St. N. intersection. The Chair introduced the item and Robert reviewed the staff report. Tract "A" contains approximately 10.02 acres, Tract "B" containing approximately 6.98 acres and Tract "C" containing approximately 13.54 acres. The applicant is requesting this annexation in order to accommodate residential development. Sewer will be provided by the City of Owasso. Water service will be split between the City of Owasso and Washington County Rural Water, similar to Sawgrass Park @ Bailey Ranch. Staff published legal notice in the Owasso Reporter, no calls have been received. The Owasso Technical Advisory Committee reviewed the request at their February 26, 2003 meeting and the Owasso Annexation Committee reviewed at their February 26, 2003 meeting. Staff recommends approval of the annexation. Questions regarding stormwater drainage were addressed by Mr. Pete Kourtis and Mr. David Charney. Ray Haynes moved to approve OA -03 -03 annexation request, Charles Willey seconded the motion. OA -03 -04 - United Pentecostal Church - A request for the annexation of property containing approximately 2.66 acres, more or less. The subject property is located on the north side of E. Wi St. N., approximately 2,640 feet east of the N. 97' E. Ave. and E. 96' St. N. intersection. The Chair introduced the item and Robert reviewed the staff report. The applicant is requesting this petition in order to construct a medical office facility. The property is zoned RS (Residential Single Family) in Tulsa County and would remain the same zoning. Staff published legal notice in the Owasso Reporter; no calls have been received. Staff recommends approval of the request by the United Pentecostal Church to annex into the corporate limits approximately 2.66 acres, more or less. Charles Willey explained that since the Annexation Policy states all properties should be annexed into the City limits as the lowest zoning classification, that is, Agriculture, we should bring this parcel in as AG. Ray Haynes moved to approve the annexation request, subject to the property being annexed into the City limits as Agriculture (AG), Bill Williams seconded the motion. OA -03 -05 — Allan and Doris Robinson — A request for the annexation of property containing approximately 150.51 acres, more or less. The subject property is located on the south side of E. 76" St. N., at the southeast corner of the N. 97" E. Ave. and E. 76`" St. N. intersection. The Chair introduced the item and Robert reviewed the staff report. The City of Owasso is attempting to locate a large plastic manufacturer along the eastern boundary. Also the applicant is requesting this petition in order to construct sales tax producing commercial sites along E. 76' St N. There also has been discussion regarding the donation of the remainder of land to the City of Owasso for a 100 — 200 acre off -road bike road. Staff published legal notice in the Owasso Reporter; no calls have been received. The Owasso Technical Advisory Committee reviewed the request at their February 26, 2003 meeting and the Owasso Annexation Committee reviewed at their February 26, 2003 meeting. Chairperson Secretary Date CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT OZ -03 -02 (DG &S Properties) STAFF REPORT The City of Owasso has received a request from DG &S Properties, applicant /owner, for the review of a rezoning for approximately 11.33 acres, more or less. The subject property is located on the west side of N. Garnett Rd., approximately 2,640 feet north of the E. 116'' St. N. and N. Garnett Rd. intersection. The applicant is proposing to rezone the subject property from AG (Agricultural General District) to RS -3 (Residential Single Family High Density District) for the purpose of completing Country Estates VI, a residential subdivision. A general area map and a complete legal description have been attached for your information and review. LOCATION See attached legal description. EXISTING LAND USE Vacant North: Residential — Single Family South: Residential — Single Family East: Vacant West: Residential — Single Family AG (Agricultural General District) SURROUNDING ZONING North: RS -3 (Residential Single Family High Density District) South: RS -3 (Residential Single Family High Density District) East: AG (Agricultural General District) — Tulsa County West: RS -3 (Residential Single Family High Density District) If the application is approved, the subject property would be zoned RS -3 (Residential Single Family High Density District). According to the City of Owasso Zoning Code, single - family residential uses fall within Use Unit 6 (Single Family Dwellings) and are permitted by right in the RS -3 zoning district. The Owasso 2010 Master Plan identifies the subject property as having a future land use of low - density residential. The applicant is proposing a zoning classification that is considered high density in nature. This high- density zoning classification would seem to be inconsistent with the future land use; however staff finds the disagreement in designation to merely be a matter of semantic disagreement rather than one of substance. The land use description related to low- density residential in the Owasso Master Plan is comprised of three components. The components are listed below: LOW DENSITY RESIDENTIAL (2 — 5 dwelling units per acre) - Composed of traditional single family detached housing. - Serve as transition zones between higher intensity uses and rural residential. - Suited to areas that contain or are projected to contain municipal sewer service. Assuming a positive recommendation from this Commission, the Country Estates VI preliminary plat is to be heard on the April 7, 2003 agenda and is comprised of the area to be rezoned in this application. The Country Estates VI preliminary plat proposes a density of 3.26 dwelling units per acre, which is well within the stated density discussed in the Owasso 2010 Master Plan. Furthermore, the plat proposes traditional single family detached housing with residential sewer service available on site. Therefore, based on the above definitions and the proposed density of the Country Estates VI preliminary plat, staff finds that the rezoning request is consistent with the Owasso 2010 Master Plan. ANALYSIS The applicant is requesting this review in order to complete Country Estates VI, a residential subdivision. The applicant has completed the infrastructure and utility construction while the property remained in Tulsa County. The applicant has also forwarded copies of the construction plans and preliminary plat to ensure that the property would meet City of Owasso development standards. City of Owasso Public Works Department staff has informed this office that all infrastructure construction completed to date meets City of Owasso development standards. Staff has received no phone calls or letters regarding this zoning request. Staff does not anticipate public opposition to the request for the rezoning. Letters were mailed to surrounding property owners on March 6, 2003 and the legal advertisement was published in the Owasso Reporter on March 13, 2003. Copies of both the letter to property owners and the legal advertisement are attached for your information and review. TECHNICAL ADVISORY COMMITTEE The rezoning was reviewed at the March 26, 2003 regular meeting of the City of Owasso Technical Advisory Committee. Staff or utility providers provided no comments. If this Commission approves the application, this item does require City Council approval. RECOMMENDATION Staff recommends approval of OZ- 03 -02, rezoning approximately 11.33 acres, from AG (Agricultural General District) to RS -3 (Residential Single Family High Density District). The subject property is located at the southwest corner of the S. Birch St. and E. 3`d Ave. intersection. The applicant is proposing to rezone the subject property from RS -3 (Residential Single Family High Density District) to CG (Commercial General District) for the purpose of locating a lawn care and landscaping office. COMPREHENSIVE PLAN CONSISTENCY The Owasso 2010 Master Plan identifies the subject property as having a future land use of low- density residential. The applicant is proposing a zoning classification that is considered commercial in nature. Although the approval of this request would seem to be inconsistent, the approval of the Owasso Downtown Development District Plan should take precedence over the Owasso 2010 Master Plan. The request is, in staff's opinion, consistent with the Owasso Downtown Development District Plan and should not be considered inconsistent by Master Plan standards. The Owasso 2010 Master Plan gives authority to develop and implement the Downtown Development District Plan. The Master Plan attempts to identify several issues or areas related to this issue. In identifying issues, the plan outlines an action statement and a plan to implement those actions. Of all the issues addressed by the plan, staff would like to tam this Commission's attention to Issue #6. Excerpt from the Owasso 2010 Master Plan: Issue #6 A deteriorating and distressed downtown area. Action Statement: Develop a downtown district plan. Action Plan: - Determine the geographic extents of what should be considered downtown. - Develop a downtown redevelopment committee or business association composed of affected landowners, downtown merchants, citizens, and City staff to determine a course of action. - Commission a planning study to assess all possible opportunities and constraints of downtown which could include: overlay zoning controlling landscaping and architecture, extension of N. Is` St. to the service road, and a tax increment financing district to provide funding for public improvements. - Consider the option of allowing a college design studio class to take on the downtown area as a class project. - Develop an overlay zone to assure proper architecture is being considered. Although the portions of the action plan may not directly affect the recommendation of this item, Issue 96 gives sweeping authority to the City of Owasso to develop and implement a downtown plan. This authority however, does not speak to situations arising from a land use designation in the Owasso Downtown Development District Plan that is inconsistent with the Owasso 2010 Plan. The authority is given only to develop, approve and implement a downtown plan. Issues arising from concerned surrounding property owners should have been addressed at the time of the adoption of the Downtown Plan, not as staff is attempting to implement the plan through appropriate rezoning requests. Therefore, staff suggests that the land use designation delineated in the Owasso Downtown Development District Plan would and more importantly, should supercede the Owasso 2010 Master Plan designation. Assuming the above assertion to be true, the discussion should now focus on the land use designation listed in the Owasso Downtown Development District Plan. The plan calls for a mixture of uses in the area of this request. The site is labeled as having a land use of light industrial, warehousing and/or City services. Section 4.5 Owasso Downtown Business Park, governs the future land use of this site. Excerpt(s) from Section 4.5, Owasso Downtown Development District Plan: - The primary emphasis in this area should be to retain and encourage a mixture of uses that continue to provide a variety of employment opportunities, products and services. - The uses in this area are important because they add to the diversification of the downtown area. - Potential redevelopment may occur opportunistically as the business market and economy dictate. - The relocation of residents to more stable and viable living environments (such as north of 76th Street) would provide the opportunity to assemble land, concentrate complementary uses and enhance the business environment in Owasso. Staff feels that land use implementation strategies in this area should support the retention and development of a mixture of uses, business products and services. Mr. Moody's application is requesting a zoning classification that would accommodate a lawn care and landscaping business; a use which has not and is not currently represented in the downtown area. Therefore, staff can come to only one conclusion; the rezoning request by Mr. Moody is consistent with the stated intent and purpose of the Downtown Development District Plan and should therefore receive a positive recommendation. Staff has received several phone calls in opposition of the request. Additionally, staff has made copies of the required legal notification, site maps and copies of the Downtown Development District Plan available to concerned area residents. Staff does anticipate several public statements in opposition of the request for a CG (Commercial General District) zoning designation at the April 7, 2003 Planning Commission Meeting. Letters were mailed to surrounding property owners on March 6, 2003 and the legal advertisement was published in the Owasso Reporter on March 13, 2003. The applicant has informed staff that the request is based solely on the internal workings of this meat processing plant. The internal flow of the meat processing procedure requires that the addition be constructed in the proposed location, rather than the other vacant areas shown on the attached plot plan. City staff agrees. The City of Owasso Community Development Department and Public Works Department have had several opportunities to review the proposed addition. And, after those reviews, all interested departments have concluded that the benefits of such a proposal outweigh any of the potential negative impacts. City engineers have concluded that the only issue that needs to be addressed is the construction of a marked barricade located at the southeastern corner of the addition. The applicant has agreed and the construction of the barricade will coincide with the construction of the building addition. The City of Owasso Public Works Department has authorized the building expansion to come within 5 feet of the existing roadway. However, the applicant has submitted a proposal that would construct the addition within 15 feet of the existing roadway. And, with an existing right -of -way width of 80 feet, staff finds that any future roadway expansion on E. 51h Ave. could be accommodated without issue. Staff should point out that the addition to the existing site would provide several new employment opportunities in the City of Owasso. National Steak Processors, Inc. has concluded that a minimum of 35 with a potential for 50 new jobs will be created by this expansion. And, in this time of economic uncertainty staff feels that the manner in which the new jobs are created would most certainly outweigh any negative impact that the creation may have. National Steak Processors has received Board of Adjustment approval for the encroachment into the minimum 50 foot building setback line on property zoned IL (Industrial Light District). The approval was received at the March 25, 2003 regular meeting. If approved by the Planning Commission, this item does require City Council Action. Kenneth Cox, applicant, on behalf of National Steak Processors, owner, for the partial closing of the northern 40' right -of -way along E. 50' Ave. The subject property is located approximately 600 feet west of the E. 5a' Ave. and U.S. Hwy 169 Service Road intersection, further described as 301 E. 5s' Ave. The applicant is requesting this closure to permit the expansion of the existing National Steak Processors facility. A general area map and complete legal description have been included with your packet. LOCATION See attached legal description. EXISTING LAND USE Industrial SURROUNDING LAND USE North: Residential — Multi - Family South: Industrial East: Vacant West: Industrial PRESENT ZONING IL (Industrial Light District) SURROUNDING ZONING North: RM -1 (Residential Multifamily Low Density District) South: IL (Industrial Light District) East: IL (Industrial Light District) West: IL (Industrial Light District) ANALYSIS The applicant is requesting to close a portion of the northern 40' right -of -way along E. 5a' Ave. in an effort to permit the expansion of the existing National Steak Processors facility. The applicant has informed staff that the request is based solely on the internal workings of this meat processing plant. The internal flow of the meat processing procedure requires that the addition be constructed in the proposed location, rather than the other vacant areas shown on the attached plot plan. City staff agrees. The City of Owasso Community Development Department and Public Works Department have had several opportunities to review the proposed addition. And, after those reviews, all interested departments have concluded that the benefits of such a proposal outweigh any of the potential negative impacts. City engineers have concluded that the only issue that needs to be addressed is the construction of a marked barricade located at the southeastern corner of the addition. The applicant has agreed and the constriction of the barricade will coincide with the construction of the building addition. The City of Owasso Public Works Department has authorized the building expansion to come within 5 feet of the existing roadway. However, the applicant has submitted a proposal that would construct the addition within 15 feet of the existing roadway. And, with an existing right -of -way width of 80 feet, staff finds that any future roadway expansion on E. 5`h Ave. could be accommodated without issue. Staff should point out that the addition to the existing site would provide several new employment opportunities in the City of Owasso. National Steak Processors, Inc. has concluded that a minimum of 35 with a potential for 50 new jobs will be created by this expansion. And, in this time of economic uncertainty staff feels that the manner in which the new jobs are created would most certainly outweigh any negative impact that the creation may have. National Steak Processors has received Board of Adjustment approval for the encroachment into the minimum 50 foot building setback line on property zoned IL (Industrial Light District). The approval was received at the March 25, 2003 regular meeting. If approved by the Planning Commission, this item does require City Council Action, TECHNICAL ADVISORY COMMITTEE: The Owasso Technical Advisory Committee reviewed the proposal at their March 26, 2003 regular meeting. At that meeting, the following comments were noted. 1. Community Development — The City of Owasso City Council must approve the right - of -way closure. 2. Community Development — The applicant must provide an official copy of the right -of- way vacation to the Community Development Department after District Court approval. 3. Public Works — The applicant must construct a collision barricade. The construction of the barricade must coincide with the construction of the building addition.
