CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:05 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF MARCH 10, 2003 REGULAR MEETING - The Commission reviewed the minutes of March 10, 2003 Regular Meeting, Charles Willey moved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Charles Willey — Yes Dewey Brown — Yes Dale Prevett - Yes The motion carried 4 -0. 4. OZ -03 -02 — DG & S Properties — A request to rezone approximately 11.33 acres, more or less from AG (Agriculture General District) to RS -3 (Residential Single Family High Density District). The subject property is located on the west side of N. Garnett Rd, approximately 2,640 feet north of the E. 116' St. N. and N. Garnett Rd. intersection. The Chair introduced the case and Robert presented the item. The applicant is requesting this review in order to complete Country Estates VI. The applicant has completed the infrastructure and utility construction. Letters were mailed to surrounding property owners and the legal advertisement was published in the Owasso Reporter. No calls have been received. The Technical Advisory Committee reviewed the request on March 26, 2003, Staff or utility provided no comments. Staff recommends approval of OZ- 03 -02, rezoning approximately 11.33 acres, from AG to RS -3. Chairperson Haynes asked if there were any comments regarding this item from audience. Ms. Jennifer Pinkstaff (11111 E 121 St No) has concerns with speeding vehicles in the neighborhood. She would like to see a "Slow Children Playing" sign posted or speed bumps. OPP -03 -01 - Country Estates VI - A request for the review of a preliminary plat for the Country Estates VI Addition containing approximately 11.33 acres, more or less. The Country Estates VI Addition contains 37 residential lots within 3 blocks. The subject property is located on the west side of N. Garnett Rd., approximately 2,640 feet north of the E. 116' St. N. and N. Garnett Rd. intersection. The Chair introduced the case and staff review was given by Robert. The surrounding land use was described along with the surrounding zoning. This plat contains 37 residential lots within 3 blocks. The Technical Advisory Committee reviewed this request at the March 26, 2003 meeting. Ray Haynes had questions regarding acceleration/deceleration lanes along Garnett Road and landscaping around the detention pond. Staff recommends approval of the Country Estates VI, subject to the following conditions: 1. Community Development - Addressing will be provided prior to the final plat submittal. 2. Community Development - An addition to the covenants stating, "All single family residential structures shall front to the street with the greatest building setback ", is required. 3. Washington County RWD #3 - Covenants are required to contain the normal Washington County RWD maintenance language. 4. Washington County RWD #3 - Eastern most easement is existing. Please add appropriate book and page number. 5. Tulsa County - Provide Limits of No Access along N. Garnett Rd 6. Tulsa County - Provide copies of drainage and paving plans. 7. Fire Department - Provide one additional hydrant at the entrance to the subdivision. Ray Haynes moved to approval the Preliminary Plat request subject to the above TAC and staff recommendations, along with the addition of Item #8 stated below. 8. OZ -03 -03 - Scott Mood v - A request to rezone approximately .32 acres, more or less from RS -3 (Residential Single Family High Density District) to CG (Commercial General District). The subject property is located at the southwest corner of the S. Birch St. and E. 3rd Ave. intersection, further described as 304 S. Birch St. The Chair introduced the item and Robert reviewed the staff report. The applicant is proposing to rezone in order to accommodate a lawn care and landscaping office. The Owasso 2010 Master Plan and Owasso Downtown Development District Plan was discussed. Letters were mailed to surrounding property owners and legal advertisement was published in the Owasso Reporter. Staff has received several phone calls in opposition. The Technical Advisory Committee reviewed the application at their March 26, 2003 meeting. Staff recommends approval of OZ- 03 -03, rezoning approximately .32 acre, from RS -3 to CG. Mr. Scott Moody, the applicant, was present to answer any questions and requested a brief presentation. He stated that the facility will be used for a meeting place in the mornings and evenings. Also, there will be inside storage for vehicles and an office. He proposes to build a 40' x 60' metal building, paved and striped parking lot with landscaping. Privacy fencing will be used to obstruct any vehicles or machinery left outside. Employee parking was discussed along with noise concerns. Below are a few of the comments made by surrounding property owners which were in attendance: Melody Hayes - 404 South Birch - Does not want commercial buildings in the neighborhood. Had comments regarding a portion of the Owasso Downtown Development Plan. Albio Daniel - 305 South Main Street - Questioned the appearance of the proposed building and fencing. Doesn't mind commercial businesses in the area. Delores Haves - 408 South Birch - Had a problem with privacy fences in the neighborhood. This neighborhood has supported the community since the subdivision was constructed. Wants homes in the neighborhood not businesses or industry. Ray Haynes moved to approve OZ -03 -03 rezoning request, Dale Prevett seconded the motion. Easement Closure - National Steak Processors Inc - A request to close the southern 17.5 foot utility easement for a part of the E/2 of the NE /4 of Section 31, Township 21 North, Range 14 East. The subject property is located approximately 600 feet west of the E. 5' Ave. and U.S. Hwy 169 Service Road intersection, further described as 301 E 5`' Ave. The Chair introduced the item. Robert reviewed the staff report and requested Item #7 and Item #8 be reviewed concurrently. National Steak Processors has received Board of Adjustment approval for the encroachment into the minimum 50 foot building setback line. The Owasso Technical Advisory Committee reviewed the request at their March 26, 2003 meeting. Mr. Ken Cox, the representative for National Steak Processors, Inc., was present on their behalf. Mr. Cox stated that a marked barricade will be located at the southeastern corner of the addition and will coincide with the construction of the building addition. He also explained that there are Federal guidelines that must be met regarding the internal flow of the meat processing procedure. Charles Willey stated that he approves of the easement closure request but does have a problem with the right -of -way closure. Parking requirements were discussed briefly. Also discussed was the distance between the back of the curb to the building. Mr. Cox stated that the measurement from the curb to the building could be as much as 15 feet. Charles Willey stated that he would feel comfortable with no less than 12 feet from the back of the curb to the building. Mr. David Charney, developer and surrounding property owner, confirmed to the Commissioners that he was comfortable with both closure requests. Mr. Tom Kimball, developer and local business owner, also expressed appreciation towards the positive impact National Steak Processors has on the City of Owasso. Mr. Rickey Haynes, Owasso Economic Development Director, explained to the Commissioners that NSP has approximately 284 employees; with this proposed expansion 50 new employees will be added to their payroll. Staff recommends approval of the request to close a portion of the southern 17.5' utility easement for a part of the E/2 of the NE /4 of Section 31, Township 31 North, Range 14 East, subject to the following conditions: 1. Community Development - The City of Owasso City Council must approve the easement closure. 2. Community Development - The applicant must provide an official copy of the easement vacation to the Community Development Department after District Court approval. 3. Public Works - The applicant must construct a collision barricade. The construction of the barricade must coincide with the construction of the building addition. Right- of -Wav Closure — National Steak Processors, Inc. — A request to close a portion of the E. 5' Ave, right -of -way for a part of the E/2 of the NE /4 of Section 31, Township 21 North, Range 14 East. The subject property is located approximately 600 feet west of the E. Y' Ave. and U.S. Hwy 169 Service Road intersection, further described as 301 E. 5`s Ave. The Chair introduced the item and Robert reviewed the staff report. The applicant is requesting this right -of -way closure to permit the expansion of the existing National Steak Processors facility. The addition would provide several new employment opportunities. The Board of Adjustment approved the encroachment into the minimum 50 foot building setback line at the March 25, 2003 meeting. The Technical Advisory Committee reviewed the request at their March 26, 2003 meeting. Below are continents noted at that meeting. Staff recommends approval of the request to close a portion of the northern 40' right -of -way along E. 5' Ave., subject to the following conditions: 1. Community Development — The City of Owasso City Council must approve the easement closure. 2. Community Development — The applicant must provide an official copy of the easement vacation to the Community Development Department after District Court approval. 3. Public Works — The applicant must construct a collision barricade. The construction of the barricade must coincide with the construction of the building addition. Ray Haynes moved to approve the right -of -way closure request subject to the above staff and TAC recommendation, along with the addition of Item #4 which states: 4. The building addition can not encroach nearer than 12 feet from existing roadway. Dale Prevett seconded the motion. OPP 03 -02 — Preston Lakes III — A request for the review of a preliminary plat for the Preston Lakes III Addition containing approximately 44.78 acres, more or less. The Preston Lakes III Addition contains 139 residential lots within 5 blocks. The subject property is located in the E/2 of Section 22, Township 21 North, Range 14 East and adjacent to the Preston Lakes II Addition. The Chair introduced the item and Robert reviewed the staff report. The surrounding land use and surrounding zoning was described. The Technical Advisory Committee reviewed the preliminary plat at the March 26, 2003 meeting. Below are the comments noted at that meeting. Staff recommends approval of the Preston Lakes III preliminary plat, subject to the following conditions: 1. Community Development — Addressing will be provided prior to the final plat submittal. 2. Community Development — An addition to the covenants stating, "All single family residential structures shall front to the street with the greatest building setback ", is required. 3. Public Works Department — Question whether Lot(s) 28 & 29, Block 1 and Lot 24, Block 3 can accommodate residential structures. Please provide copies of house plans that can be accommodated on these lots. 4. Public Works Department — Please provide an access point along N. 161 E. Ave. 5. Fire Department — Hydrant locations must be coordinated with the City of Owasso Fire Department. Mr. David Charney and Mr. Pete Kourtis were present to answer questions. Discussion was held regarding a possible access point along N. 161` E. Ave. Ray Haynes moved to approve the preliminary plat request subject to the above recommendations, Dale Prevett seconded the motion. OPP 03 -03 - Metro Lakes - A request for the review of a preliminary plat for the Metro Lakes Addition containing approximately 65 acres, more or less. The Metro Lakes Addition contains 158 residential lots within 5 blocks. The subject property is located at the southeast corner of the E. 116' St. N. and N. 97' E. Ave. intersection. The Chair introduced the item and Robert reviewed the staff report. The applicant is requesting this review in order to accommodate single family residential uses. The preliminary plat application is consistent with the OPUD -01 -01 abandonment and the City of Owasso zoning code. The Owasso Technical Advisory Committee reviewed the plat at their March 26, 2003 meeting. Below are the comments submitted. Staff recommends approval of the Metro Lakes preliminary plat, subject to the following conditions: 1. Community Development - Addressing will be provided prior to final plat submittal. 2. Community Development - An addition to the covenants stating, "All single family residential structures shall front to the street with the greatest building setback ", is required. 3. Community Development - Major street right -of -way corners must be a minimum 40' radius. Please correct. 4. Community Development - Additional rear and side easements are required in Block 2. 5. Community Development - The southern most cul -de -sac must be a minimum 50' radius. 6. Fire Department - Hydrant locations must be coordinated with the City of Owasso Fire Department. 7. Washington County RWD #3 - This subdivision is subject to a $50.00 per tap fee. 8. Tulsa County - Please provide Limits of No Access along N. 97" E Ave. and E. 116' St. N. 9. Tulsa County - Please provide a copy of the hydrology study. Mr. Brian Kellogg, with Kellogg Engineering, was present to address any concerns. Mr. Kellogg explained that the proposed drainage flow will run from the west and south into the drainage areas. Ray Haynes had concerns regarding the maintenance of the lakes. Mr. Kellogg explained that the Metro Lakes Homeowners Association will be responsible for the upkeep. Fencing along the railroad tracks was discussed. Ray Haynes moved to approve the preliminary plat request subject to the above Staff and TAC recommendations, Dewey Brown seconded the motion. The preliminary plat application is consistent with the approval and subsequent abandonment of the OPUD -01 -01 application. ANALYSIS: If the application is approved, the subject property would be zoned RS -3 (Residential Single Family Residential High Density District). Then, the property would be available for residential development. The Owasso 2010 Master Plan identifies the subject property as having a fixture land use of residential. Accordingly, the staff finds the proposal to be consistent with the Owasso 2010 Master Plan. Staff has received no phone calls or correspondence in opposition of the request. Letters were mailed to surrounding property owners on April 10, 2003 and the legal advertisement was published in the Owasso Reporter on April 17, 2003. Both 129th East Avenue and 96" Street North, arterial roads in the property's vicinity, are listed as top priorities on Owasso's Capital Improvements Plan and widening projects for these two roads are planned to begin next year. ANALYSIS: If the application is approved, the subject property would be zoned CS (Commercial Shopping Center District). Then, the property would be available for commercial development. The Owasso 2010 Master Plan identifies the subject property as having a future land use of public /parks. However, the subject property is an anticipated growth area for the community. The master plan describes how it differentiates between land uses and how anticipated growth areas are delineated graphically: The future direction of growth is determined by many factors, but probably the most important ones are municipal utilities such as water and sewer service, transportation improvements, and vacant land. The Owasso 2010 Master Plan was developed making future assumptions about the factors mentioned above and density and intensity of use are directly related to them. The Plan was developed based on the best available information about utilities, transportation improvements, and vacant land tracts available at the time. City staff would agree that the above described method of making future assumptions based on current situations is the best method to date to direct future growth. However, city planners can only assume what will happen in a particular area, but cannot determine other factors such as capital improvements, shifting development patterns and shifts in the market economy. Since the approval of the Owasso 2010 Master Plan, the City of Owasso has seen tremendous growth in sales tax receipts and commercial development in the area of this application. Some estimates have concluded that the City's sales tax receipts were increased by 20% in 2000 and 15% in 2001. With an increase of sales tax receipts, the City has further opportunities to expand facilities and services. This expansion also tends to spill-over into capital improvement programming. The current Capital Improvements Committee is to approve an estimated $8 million worth of street improvements in this area that include a $5.3 million improvement for the expansion and widening of N. 129`s E. Ave. and an estimated $2.6 million improvement for the E. 96' St. N. and U.S. 169 interchange. These improvements clearly could not have been anticipated at the time the Owasso 2010 Master Plan was formulated or approved. Furthermore, and as the Master Plan states, the most important determining factors in deciphering future growth are transportation improvements, water and sewer service on -site and vacant land. All of these factors are present on this site and were more than likely a determining factor for The Home Depot in choosing this area. Furthermore, as an update is currently underway for the Owasso 2010 Master Plan, which is a clear indication of changes in the development make -up of a city, city planners have already concluded that the site in question deserves a high- intensity commercial/office classification. Staff should also point out that any additional commercial growth would benefit the City of Owasso. Additional commercial growth provides for further spending opportunities for both Owasso residents and those who spend money in Owasso from outside the corporate limits. Accordingly, the staff finds the proposal to be consistent with the Owasso 2010 Master Plan. The staff has received one phone call in opposition of the request. Letters were mailed to surrounding property owners on April 10, 2003 and the legal advertisement was published in the Owasso Reporter on April 17, 2003.
