CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF MAY 12, 2003 REGULAR MEETING - The Commission reviewed the minutes of May 12, 2003 Regular Meeting, Charles Willey moved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Dale Prevett — Yes Charles Willey — Yes Dewey Brown - Yes Bill Williams - Yes The motion carried 5 -0. 4. OLS -03 -04 — Owasso Land Trust — A request for a lot split of 5.32 acres situated in the N/2 of the SE /4 of Section 9, Township 21 North, Range 14 East. The subject property is located on the west side of N. 145' E. Ave. approximately 1,320 feet north of the E. 106'' St. N. and N. 145' E. Ave. intersection. Eric presented the item and described the location. The applicant is requesting this review in order to sell the western property to a user for the purpose of an electric substation. The Technical Advisory Committee reviewed the lot split request at their May 28' meeting. No comments were noted regarding this lot split request. Staff recommends approval of the proposed lot split. Ray Haynes moved to approve the lot split, Charles Willey seconded the motion. OLS -03 -06 - Seayco - A request for a lot split of three lots in Owasso Market II. The property is at the NE corner of 119' E. Avenue and 96'' Street North. Eric presented the item and described the property location. The new lot to be created is an existing access easement. The property is used as a driveway into the commercial development. The Owasso Subdivision Regulations state that no property may be split into more than three properties without being platted. The Zoning Code states that no building permits could be considered for the property unless it's included in a plat. If the lot split is approved, the application will also have to be approved by the Board of Adjustment as the new lot would not be buildable. The applicant's desire is to place the existing access easement into a separate ownership from the other lots. No recommendations were noted at the May 28" meeting of the Technical Advisory Committee. Staff recommends approval of the proposed lot split. Charles Willey questioned the legality of this lot split if approved. He had concerns regarding the property being split into more than three properties without replatting. Mr. Christopher Seay, the owner and developer of the property, requested a brief presentation to the Commissioner. Mr. Seay assured the Commissioners that the 41e lot will be a nonbuildable lot; no building permit will be issued. Discussion was held regarding the curb and guttering. Ray Haynes moved to approve the lot split, subject to Owasso City Attorney verifying the legality of the lot split. Dale Prevett seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Dale Prevett - Yes Charles Willey - Yes Dewey Brown - Yes Bill Williams - Yes The motion carried 5 -0. 6. OLS -03 -07 - Forest Creek - A request for a lot split of one lot into two lots in the Forest Creek Business Park. The property is at the NW corner of the Hwy. 169 frontage road and the private drive going into Forest Creek. Eric presented the item to the Commissioners and described the legal description. The applicant is requesting the lot split in order to facilitate the sale of the newly created lots. The proposed lots would comply with the bulk and area requirements of the zoning code for commercial property. Mr. John Rupe, the applicant, was present to address any concerns. Ray Haynes moved to approve the lot split, subject to the fire hydrant relocation. Bill Williams seconded the motion. OZ -03 -08 - Schumacher - A request to rezone approximately 20 acres from AG Agricultural to RS -3 Single- Family. The subject property is located ih -mile north of 116' Street on the east side of Mingo Road. Eric presented the item. The Owasso 2010 Master Plan identified the property as having a future land use of residential. If approved, the land will still have. to be platted in accordance with municipal regulations prior to development. Letters were mailed to surrounding property owners and legal advertisement was published. Staff has received one phone call in opposition of the request. Staff recommends approval of OZ- 03 -08. Mr. Steve Ingram, a surrounding property owner, wanted assurance that his property would not be affected by the City of Owasso zoning restrictions. Mr. Harold Ledbetter had questions regarding the amount of houses per acre in an RS -3 District. Mr. Tom Kimball discussed tentative plans regarding the subject property, stating that they plan approximately three houses per acre making a total of 60 homes with lot frontage of approximately 68' -75' wide. Mr. Kimball also offered to meet with the surrounding neighbors to discuss any further concerns. Dale Prevett moved to approve the rezoning, Bill Williams seconded the motion. OZ -03 -09 Sokoloskv - A request to rezone approximately 106 acres from AG Agricultural to RS -3 Single - Family. The subject property is located southwest of the intersection of 106' Street North and Mingo Road. OWASSO PLANNING COMMISSION June 9, 2003 Page No. 4 Eric introduced the item to the Commissioners and described the property location. If the rezoning request is approved the property would be available for residential development. The Owasso 2010 Master Plan identifies the property as having a future land use of residential. Letters were mailed to surrounding property owners and legal advertisement was published. Staff has received no opposition to the request. The staff recommends approval of OZ- 03 -09. Access into the property was discussed. Bill Williams moved to approve the rezoning, Dewey Brown seconded the motion. Easement Closure - 13105 E 95h Ct N. - A request to change the width of an easement from 17.5 feet to 10 feet. The property is located at Block 4, Lot 3, Windsor Lake Addition. Eric introduced the item to the Commissioners and described the property location. The applicant desires to place a detached 1,445 square feet garage in the rear yard. The building would encroach 7.5' into the western easement. The Technical Advisory Committee reviewed the request at their May 28°i meeting. An electric service line runs underground beneath the site along with a Cox Cable line. The proposed building exceeds the maximum size of 750 square feet allowed by the zoning code. The bar shown on the building plans constitutes a kitchen; the plan also includes a bedroom. Neither bedrooms nor kitchens are allowed to be included in accessory buildings in single family zoning districts. The applicant was not present. The staff recommends that the request be tabled until the following five items are addressed: 1. The electric service line be relocated so that it will not run underneath the building 2. The cable line be relocated so that it does not lie in the 7.5' proposed to be vacated 3. A variance be obtained to allow an accessory building larger than 750 square feet on the property 4. The bar be removed from the building plan 5. The bedroom be removed from the building plans Ray Haynes moved to table the item until the next meeting or when the above recommendations are shown on resubmitted plans, Dale Prevett seconded the motion. FP 03 -06 - Coffee Creek Office Condominiums - A request for the review of a final plat for the Coffee Creek Office Condominiums containing approximately 4.24 acres. The final plat contains 5 lots. The subject property is located along the northwesterly side of 138' E. Ave. east of Hwy 169. Eric introduced the item to the Commissioners. The applicant is requesting this review in order to construct 4 office condominiums on lots 2 -5. The subject property is zoned OM (Office Medium District). Detention has been provided and was reviewed and approved as part of the PUD. Although, the applicant is considering detention on site in order to save space. Water will be provided by Washington County Rural Water District 113. The Technical Advisory Committee reviewed the request at their May 28°i meeting. The following comment was noted: 1. Covenants language needs to be standardized Staff recommends approval subject to appropriate actions taken to satisfy the TAC concerns. Site Plan - Coffee Creek Office Condominiums - A request for the review of a site plan for the Coffee Creek Office Condominiums containing approximately 4.24 acres. The plan contains 5 lots. The subject property is located along the northwesterly side of 138'` E. Ave. east of Hwy 169. Eric introduced the item to the Commissioners. The applicant is requesting this review in order to construct 4 office condominiums on lots 2 -5. The property is zoned OM (Office Medium District). In order to save space the applicant is considering detention on site. OWASSO PLANNING COMINIISSION June 9, 2003 Page No. 6 Water will be provided by Washington County Rural Water district #3. The Technical Advisory Committee reviewed the Final Plat and had the following comments: 1. A sidewalk be installed along the southern and eastern property lines adjacent to N. 138th E. Ave. 2. A van accessible (16') Handicapped parking space be provided. Mr. Brian Doyle, with Kourtis Properties, was present to answer questions. Staff recommends approval of the Coffee Creek Office Condominiums site plan subject to the appropriate actions taken to satisfy the TAC concerns. There was brief discussion regarding the elevation of the buildings. Mr. Doyle stated that the elevations would be similar to Watercolor Condominiums. Ray Haynes moved to approve the site plan subject to the above staff and TAC recommendations, Dale Prevett seconded the motion. The subject property is located on the north side of 96°i St. N. 1/2 mile east of Mingo Road. Eric introduced the item to the Commissioners and described the surrounding property. The applicant is requesting this review in order to construct 2 office buildings containing a total of 6 office spaces. The property is zoned OM (Office Medium Intensity). The Technical Advisory Committee reviewed the request at their May 28' meeting. The following are conditions noted: 1. Language needs to be inserted into the plat regarding detention, utilities and maintenance of common areas. Staff recommends approval of the Final Plat subject to the above staff and TAC recommendation. Preliminary Plat High Point - A request for the review of a preliminary plat for the High Point, a commercial addition containing five lots on 3.38 acres. The subject property is located 362' south of Highway 20 on the west side of 140' East Avenue. Eric introduced the item to the Commissioners and described the location of the property. The applicant is requesting this review in order to create 5 lots available for cormercial development. The subject property is zoned CS (Commercial Shopping Center District). The Technical Advisory Committee reviewed the site plan at the May 28' meeting and had the following comments: 1. Show water lines, erosion control, sidewalks and detention. Staff recommends approval of the Hi -Point preliminary plat subject to the actions taken to satisfy the TAC concerns. Chairperson Secretary Date CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT OA 03 -06 (New Hope Baptist Church) STAFF REPORT The City of Owasso has received a request from New Hope Baptist Church, applicant(s) /owner(s), for the annexation of approximately .93 acres, more or less. It is the intention of the owners to sell the property for the purpose of single family residential development. LOCATION See attached legal description or in the general vicinity of 707 N. Carlsbad St. EXISTING LAND USE Vacant SURROUNDING LAND USE North: Residential South: Residential West: Residential East: Church PRESENT ZONING AG (Agricultural District) — Tulsa County North: AG (Agricultural District) South: RS -3 (Residential Single - Family District) East: " " West: " c « ANALYSIS The purpose of the applicant's annexation request is to bring the property to code so that two single family homes may be constructed. The applicant has agreed to begin the planning process which at this point includes annexation, rezoning, and a lot split of the property. The property is currently zoned AG (Agricultural General District) in Tulsa County and would remain this same classification upon annexation. Prior to any action relative to a rezoning request, a rezoning sign will be posted on the property and property owners within 300' will be notified. All development that occurs on the subject property must adhere to all subdivision and zoning requirements including but not limited to paved streets and sidewalks. Residential sewer and water service will be provided by the City of Owasso. A copy of the Annexation Policy is attached for your information and review. While the subject property is not larger than 20 acres as preferred by Annexation Policy #1 the subject property (93 acres) is essentially a small island, surrounded by lots currently within the city limits and the annexation of said property will initiate a process that will eventually allow it to be developed in a viable productive manner that is consistent with the existing neighborhood. The subject property will not modify the city limits size in any way, requiring no significant expansion of utilities or infrastructure. The subject property meets the remaining requirements within the policy: #2 All properties should be contiguous to existing City limits #3 All properties should be annexed into the City limits as the lowest zoning classification, that is, Agricultural (AG). #4 All publik infrastructures that do not meet City standards will not be improved by the City until brought to the City standard and accepted by the City Council. #5 Where a City limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. #6 Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. Staff published legal notice of the annexation petition in the June 12, 2003 edition of the Owasso Reporter. Staff has received no phone calls or correspondence concerning the request. TECHNICAL ADVISORY COMMITTEE The Technical Advisory Committee reviewed the request on June 25, 2003. There were no negative concerns regarding the Annexation request. OWASSO ANNEXATION COMMITTEE The Owasso Annexation Committee reviewed the request on June 25, 2003 and recommended approval with no negative concerns. RECOMMENDATION Staff recommends approval of the request by New Hope Baptist Church to annex the property into the corporate limits of the City of Owasso. ATTACHMENTS 1. General Area Map 2. While there is no minimum tract size, properties of larger than 20 acres are preferable. 2. All properties should be contiguous to existing City limits. 3. All properties should be annexed into the City limits as the lowest zoning classification, that is, Agricultural (AG). Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the City will be legal, but non- conforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not meet City standards will not be improved by the City until brought to the City standard and accepted by the City Council. Such public facilities must be improved at owners expense by the establishment of a special assessment district or some other financing method. 5. Where a City limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow City employees and citizens to know where the City boundaries are. 6.
