CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF JUNE 9, 2003 REGULAR MEETING - The Commission reviewed the minutes of June 9, 2003 Regular Meeting, Bill Williams moved, seconded by Dale Prevett to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Dale Prevett — Yes Dewey Brown - Yes Bill Williams - Yes The motion carried 4 -0. 4. OA -03 -06 — New Hope Baptist Church — A request for the annexation of property containing approximately .93 acres, more or less. The subject property is located at 707 N. Carlsbad St. Duane presented the item and described the location. The purpose of this request is to annex the property in order to construct two single family homes. Legal notice was published in the Owasso Reporter. The Technical Advisory Committee reviewed the request along with the Owasso Annexation Committee. No comments or concerns were expressed. Staff recommends approval of the request. Ray Haynes moved to approve the annexation of .93 acres located at 707 North Carlsbad, Bill Williams seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Dale Prevett - Yes Dewey Brown — Yes Bill Williams - Yes The motion carried 4 -0. OWASSO PLANNING COMMISSION July 7, 2003 Page No. 2 5. OLS -03 -08 - Tulsa Teacher's Credit Union - A request for a lot split of property containing approximately 4.16 acres, more or less. The subject property is located at 11725 E. 96`' St. N. or on the north side of E. 96' St. N. '/4 mile east of N. Garnett Road. Duane presented the item and described the property location. The applicant is requesting the lot split in order to sell the northern lot for development. The subject property is zoned CS (Commercial Shopping). Mr. Jerry Emanuel with Sack & Associates was present to answer questions. Discussion was held regarding the placement of a sign for the proposed development. Also discussed was staff's recommendation for the need of a sidewalk located along East 96' Street North, in front of the Tulsa Teachers Credit Union. Mr. Emanuel requested a brief presentation regarding the sidewalk requirement. He explained that the topography of the credit union property is a problem due to the lack of surface area and is not a typical place for a sidewalk. Mr. Emanuel stated that he is aware of the sign issue and will seek permission from the credit union to locate a sign on their property. An assessment will be made on the square footage of the existing sign and what the sign code will permit for the proposed development. Mr. Rodney Ray asked to address the Commissioners. He explained that Staff has researched the feasibility of sidewalks at this location. This is unusual terrain, but there are several options as to the method of construction. After discussion, the Commissioners agreed that it would be acceptable for the applicant to establish an escrow account with the City of Owasso to finance the development of the sidewalk. Ray Haynes moved to approve the lot split subject to an escrow account to be established with the City of Owasso in order to construct a sidewalk along the frontage of the subject property. Also subject to approval from City staff and Tulsa Teachers Credit Union regarding the size and location of signage. Bill Williams seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Dale Prevett - Yes Dewey Brown - Yes Bill Williams - Yes The motion carried 4 -0. 6. Items Previously Forwarded to Council. 7. Chairperson Secretary Date CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT OZ 03 -10 (New Hope Baptist Church) STAFF REPORT BACKGROUND The City of Owasso has received a request from New Hope Baptist Church, applicant(s) /owner(s), for the rezoning of approximately .93 acres, more or less from its current designation of AG (Agricultural) to RS -3 (Residential). The property was one of small number of parcels located in the `Old Town' portion of Owasso not included as a part of the original town site limits. The property owners recently filed a petition for annexation into the City of Owasso which was approved by the City Council on July 15, 2003. It is the intention of the owners to sell the property to a developer for the purpose of constructing two single family residential units along N. Carlsbad St. Current Zoning Designation: Proposed Zoning Designation: AG (Agricultural) RS -3 (Residential Single - Family) LOCATION See attached legal description or site map. Carlsbad St. EXISTING LAND USE Vacant SURROUNDING LAND USE North: Residential South: Residential West: Residential East: Church PRESENT ZONING AG (Agricultural District) SURROUNDING ZONING North: AG (Agricultural District) South: RS -3 (Residential Single- Family District) East: « West: « « ANALYSIS The purpose of the New Hope Baptist Church's rezoning request is to classify the property for residential use so that it may be sold to a developer who intends to construct two (2) single family homes on the site in harmony with the surrounding neighborhood. Before the construction of the home can begin a lot split must be granted by the Planning Commission and a building permit will have to be issued by the Owasso Community Development Department. The property is currently zoned AG (Agricultural General District). The applicant wishes to rezone the property to the RS -3 (Residential High Density District), which is similar to the surrounding zoning in the neighborhood. This designation would authorize the intended construction of two (2) single family residential units which are allowed by right, according to the Owasso Zoning Code, on parcels zoned RS -3 as a part of Use Unit 6 — Single Family Dwelling. In addition, the lot meets all requirements of the Owasso Zoning Code's bulk and area section. The proposed rezoning is in accordance with the Owasso 2010 Land Use Master Plan. The Plan exhibits this area as being residential in character. There are no conflicting or potentially conflicting land uses adjacent to or within close proximity to the subject property. Staff published legal notice of the rezoning request in the July 10, 2003 edition of the Owasso Reporter, sent notices to property owners within 300' of the property and posted a notification of a rezoning request sign on the property. Staff has received one phone call concerning the potential use of the site it was the concern of the caller that there would be duplexes constructed on the site instead of single family homes. Staff informed him that duplexes were not the intentions of the developer and that duplexes are only allowed as a special exception which would have to be approved by the Board of Adjustment and that he would have his chance to oppose duplexes at that time if it were to materialize. Staff believes that the rezoning request and the eventual construction of two single family homes will contribute to the surrounding neighborhood compatibly and in a positive manner. The currently vacant site will become a productive parcel in the City of Owasso. TECHNICAL ADVISORY COMMITTEE The Technical Advisory Committee reviewed the rezoning request on July 30, 2003. There were no concerns regarding the rezoning. RECOMMENDATION Staff recommends approval of the rezoning request by New Hope Baptist Church to change the property's designation from AG to RS -3. Home Depot's USP includes five (5) wall signs and one (1) pole sign (the pole sign will consist of two (2) message cabinets). The five (5) wall signs will encompass 528.13 square feet. The zoning code states that no wall sign shall cover more than 10% of the buildings fagade. Home Depot's wall signs will cover roughly 4% of the buildings fagade which is approximately 13,380 square feet. The signs do not project or separate from the building plane. The sign lighting will not detract from the development. Staff finds that the proposed wall signs comply with the zoning code. The Unified Sign Code states that the total sign square footage may not exceed three (3) square feet of signage per every one (1) linear foot of street frontage of the subject property. In total, the seven (7) signs will consist of 867.78 square feet which will be less than Home Depot's frontage will allow. Home Depot's USP includes a proposal for a 60' pole sign. The sign will be located on the northern side of the site adjacent to the new service road, well off of E. 9e St. N. While staff supports the signs proposed location and design, we recommend that the sign be limited to 30' feet in height, therefore maintaining consistency with the limitations set for similar retail centers and also preserving the orderly appearance and limiting the needless clutter in appearance within the City by signs unreasonable in number and area. Staff recommends approval on all of the elements within the Home Depot Unified Sign Plan (OUSP 03 -01) with exception to the height of the pole sign. The New Brunswick Addition is located at the northwest comer of the 96ffi Street N. and 97h East Ave (Mingo Rd.). The preliminary plat contains 42 residential lots in 3 blocks on approximately 9.92 acres + / -. LOCATION The subject property is described as the SE' /4 of the SE' /4 of Section 13, T 21 N, R 13 E, further described as the northwest comer of the 96`" Street N. and 97`b East Ave. (Mingo Rd.) intersection. Planned Unit Developments are approved with the stipulation that an Outline Development Plan, which guides the layout of the proposed subdivision, is submitted at the time of the PUD application. After careful review of the final plat application, staff finds that the final plat is consistent with the approved OPUD 02 -03 Outline Development Plan and the City of Owasso Zoning Code. ANALYSIS New Brunswick is conceptualized as an area of distinctive landscape and natural beauty. It is the desire and intent of Owasso Land Trust, LLC, to create a residential community in which such beauty shall be substantially preserved and enhanced by the creation and enforcement of development standards. It offers a unique housing opportunity not widely available within the City of Owasso. The proposal would allow for garden homes in a cohesive neighborhood setting that would supplement the City's current housing stock and provide further opportunities for home ownership. In staff's opinion, the proposal would provide for a consistent and well - designed subdivision that staff is certain would prove to be an aesthetically pleasing addition to the City of Owasso.
