CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:04 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF August 11, 2003 REGULAR MEETING - The Commission reviewed the minutes of August 11, 2003 Regular Meeting, Charles Willey moved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Dale Prevett — Yes Dewey Brown - Yes Bill Williams — Yes Charles Willey - Yes The motion carried 5 -0. 4. OLS -03 -10 — A request from Capital Homes for a lot split of Lot 11, Block 3 in Coffee Creek Addition, Owasso, Tulsa County, Oklahoma. Also known as 10220 N. 141" E. Ave. Duane presented the item and described the location. The applicant is requesting a lot split on Lot 11, Block 3, Coffee Creek Addition. The requested action will take a sliver containing approximately 0.01 acres from Lot 11 and transfer it to Lot 10 to the south. The house on Lot 10 is built over the property line shared by Lots 10 and 11. Mr. Stuart Gallagher of Capital Homes was present and explained to the Commissioners that the structure is encroaching approximately 7 feet. He also presented a memo stating that Capital Homes, LLC will from this point forward require a form survey on all residential construction. Ray Haynes expressed concern with the lot split request. He stated that he would like this item to be reviewed by the City Council. A brief discussion was held regarding the acceptance of an ordinance, which would require all structures to have a stemwall survey. Site Plan - A request from Dan Draper for the review of a Site Plan of Dan Draper Mini - Storage proposing a 36,150 square foot mini- storage facility on 2.55 acres, more or less. The property is located in the southwest comer of 116`s St. N. and 97" E. Ave. (Mingo Rd). Duane presented the item and described the property location. The property is currently zoned CS and a mini- storage facility is allowed by Special Exception granted by the Board of Adjustment. The developer has addressed the concerns that were expressed during the July Board of Adjustment meeting. Screening will be established through the use of concrete panels along the entire parameter bordering residential uses. The Technical Advisory Commission reviewed the site plan and the following comments were made: 1. Provide a 17.5 easement on the north side of the property. 2. Locate an additional fire hydrant on the west side of the site. Move the existing fire hydrant north on the site. 3. Establish a Deceleration lane on 116' St. N. Staff recommends approval of the Dan Draper Mini- Storage site plan, subject to the applicant successfully executing the above Staff and TAC recommendations. Site Plan - A request from Owasso Land Trust for the review of a Site Plan of Owasso Land Self Storage proposing a 91,518 square foot mini- storage facility on 5.63 acres, more or less. The property is located on Lot 1, Block 1 of Attic Business Park, Owasso, Tulsa County, Oklahoma, also described as 2500 ft. north of E. 86' St. N. on the East side of Garnett Rd. Duane presented the item and described the property location. The property is currently zoned CG and a mini- storage facility is allowed by right in CG zoning districts. Some parking is provided at the entrance of the site while the remainder of the required parking spaces will be scattered throughout the site. The Technical Advisory Committee reviewed the site plan, the following comments were noted: 1. Provide at least 18 parking spaces, with one being handicapped accessible. 2. Move building along N. Garnett Rd. behind the 50' building line. 3. Remove all buildings from the easements along the parameter of the site. 4. Provide accel/decel lanes to the site along N. Garnett Rd. Staff recommends approval of the Owasso Land Self Storage Site Plan, subject to the above Staff and TAC recommendations. A discussion was held regarding the type of screening fence required. Brian Doyle with Owasso Land Trust stated that a decorative fence would be constructed along US Highway 169 to provide screening. Ray Haynes moved to approve the site plan subject to the above Staff and TAC recommendations and contingent upon the construction of a decorative fence along US Hwy 169. Charles Willey seconded the motion. Final Plat - A request from Owasso Land Trust for the review of a Final Plat for the proposed Remmington Place Addition containing 57 lots on two (2) blocks on 15.09 acres, more or less. The property is located 1/2 mile west of N. 129' E. Ave. on the south side of 116' St. N. Duane presented the item and described the property location. The development will be served by City of Owasso sewer and Washington County water. The proposed addition is in conformance with the Owasso 2010 Land Use Master Plan. Establish sidewalks along the entire northern frontage of 116" St. N. 2. Establish accel /decal lanes approaching and leaving the addition along 1161 St. N. 3. Increase the rear Utility Easement of the southern most lots in Block One (1) just north of the reserve area to 15. Final Plat - A request from Bencor for the review of a Final Plat for the proposed Bencor /Owasso, L.P. addition containing 1 lot on 1 block on approximately 1.642 acres located in the southwest corner of N. 129'' E. Ave. and E. 96" St. N. Duane presented the staff report and surrounding property was described. The Final Plat is in anticipation of Walgreen's locating a full service pharmacy /neighborhood convenience retail center. Easements have been established along right -of -ways and shared lot lines to enable development services. A 100' easement is established on the east side of the lot to provide space for Grand River Dam Authority. The Technical Advisory Committee reviewed the final plat at the August 27" regular meeting. No conditions were noted at that meeting. Staff recommends approval of the Bencor /Owasso, L.P. Final Plat. Mr. Malek Elkhoury with Khoury Engineeting was present to address any concerns. He stated that drainage plans would be presented at the Site Plan stage. Runoff water will probably be directed toward the parking lot or in the pond to the southwest. The Technical Advisory Committee reviewed the plat at the August 27a' meeting. Staff recommends approval of the Final Plat for the proposed Oklahoma National Bank. Oklahoma National Bank proposes to build a 5,412 square foot structure on 0.87 acres. The Technical Advisory Committee reviewed the site plan at the August 27' regular meeting. The following comments were submitted: 1. Relocate the northern entrance to the site so that it is at least 100' from the nearest street intersection. 2. Provide additional landscaping along the northern and eastern sides of the site. 3. Place sidewalks along the east service roadway. Chairperson Secretary Date CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT OZ 03 -11 (Bethel Baptist Church) STAFF REPORT BACKGROUND The City of Owasso has received a request from Bethel Baptist Church, applicant(s) /owner(s), for the rezoning of approximately 5. 11 acres, more or less from its current designation of RS -3 (Residential) to CS (Commercial). It is the intention of the property owner only to improve their signage. Current Zoning Designation: Proposed Zoning Designation: RS -3 (Residential Single - Family) CS (Commercial Shopping) LOCATION Bethel Baptist Church is located in the northwest comer of Cedar St. and 86th St. N. EXISTING LAND USE Church SURROUNDING LAND USE North: Single- family residential South: Single - family residential West: Mexico Lindo and Apartments East: Larry's Fried Chicken, Post Office, and single - family residential PRESENT ZONING RS -3 (Residential Single - Family District) SURROUNDING ZONING North: RS -3 (Residential Single - Family District) South: RS -3 (Residential Single- Family District) East: CG (Commercial General), RS -3 (Residential Single - Family) West: CG (Commercial General), RM -1 (Residential Multi- family) ANALYSIS The purpose of the Bethel Baptist Church's rezoning request is to classify the property for commercial use so that the church may modify their sign along 86th St. North. The church wishes to improve their sign on 86`h Street however, because the property is currently zoned RS -3 they are not allowed (according to the Owasso sign code) to have a large sign on the property. As a remedy, the church has two options: request a variance from the sign code that would allow them to make a one time change or rezone the property to a classification that would allow signs. The church decided to request a rezoning to a designation that would allow a modification of their signage. The rezoning desired is consistent with the commercial pattern currently established along the north side of 86`h Street North and this request is consistent with the Owasso 2010 Land Use Master Plan. However, the rear portion of the church property encroaches into a residential neighborhood to the north. If the property were ever to be developed as commercial there would need to be some screening established between the site and any adjacent residential property. Staff published legal notice of the rezoning request in the September 17, 2003 edition of the Owasso Reporter and sent notices to property owners within 300' of the property and posted a notification of a rezoning request sign on the property. Staff received one phone call concerning the potential use of the site. It was the concern of the caller that the rezoning would allow the church to sell the property in the future to commercial interest. He was mostly concerned with potential commercial development of the lots on the northern section of the churches property. Staff informed him that the intentions of the church at this time were only to modify their sign and that they gave us no indication they would sell their property to a commercial interest. RECOMMENDATION Staff recommends rezoning Bethel Baptist Church's southern most lot (on which the main structure is situated)adjacent to 86`h Street North to CS (Commercial Shopping district) and rezoning lots 5 -9 of block 10 in Ator Heights to OL (Office Light intensity district). Both zoning classifications would allow the church to place signs within their property. The CS zoned property along 86`h St. will establish a consistent developable pattern along that corridor and the OL zoning on the northern lots would (along with allowing the sign) would provide a smoother transition in intensity from Commercial to Residential. Uses typical in OL zoned districts share similar characteristics to Residential zoning therefore the potential for conflict is minimized. ATTACHMENTS 1. General Area Map 2. The subject property was recently annexed into the city and rezoned from AG to RS -3. LOCATION The subject property is located in the general vicinity of 707 N. Carlsbad St. in the Original Town section of Owasso. The Planning Commission may approve a lot split that creates not more than three (3) lots fronting on an existing, dedicated street, not involving any new street or road, or the extension of municipal facilities, or the creation of any public improvements, and not in conflict with any provision or portion of the Comprehensive Plan, Major Street and Highway Plan, Zoning Ordinance (unless approved by the Board of Adjustment) or these regulations. The applicant is requesting a Lot Split of approximately a.93 acre parcel of property recently annexed into the city and rezoned to RS -3. The proposed lot split would create three (3) lots from the one currently existing. Of the proposed lots, two (2) would be 150' X 75' and front N. Carlsbad St. to the west of the church the one remaining lot is proposed to be 150' X 150' and would be located adjacently behind the church. It is intentions of the applicant to sell the two (2) lots on Carlsbad St. to a developer who would in turn construct two single family homes on them. The third and larger lot would be kept by the church for the expansion of the parking and recreation facilities. The new lots would be served by City of Owasso sewer and water and meet all Owasso Zoning Code requirements. Sidewalks will be required as a condition of any building permit approval for any construction on the two lots fronting Carlsbad St. The proposed lot split will not involve any new streets, or the extension of municipal facilities, or the creation of any public improvements, and it will not adversely affect the remainder of the parcel or adjoining property. In addition, the proposed lot split will not be in conflict with any provision or portion of the Comprehensive Plan, Major Street and Highway Plan, Zoning Ordinance or Subdivision Regulations. TECHNICAL ADVISORY COMMITTEE The Technical Advisory Committee reviewed the proposed lot split at the October 1°` regular meeting. At that meeting, utility providers and city staff are afforded the opportunity to comment on the application and request any changes or modifications. The ROC Owasso III addition is located in the southeast comer of N. 137h E. Ave. and E. 86h St. N., north of the Greens apartments. The ROC Owasso III final plat contains two (2) lots, one (1) block and one (1) reserve area on approximately 3.149 acres, more or less. The plat intends to accommodate commercial development fronting onto E. 86 Street North. Commercial development on this property is compatible with the Owasso Master Plan and consistent with current development trends in the general area. Infrastructure is (or will be) adequate to accommodate this potential growth. The proposed final plat is satisfactorily meets the requirements established in the Owasso Zoning Code. Necessary (utility and drainage) easements have been established along the parameters and within the lots of the proposed plat to accommodate essential utility placement and facilitate drainage from lot 1 to the detention pond. The developer has been working diligently with the City of Owasso in regards to the widening of 861s Street North on the north side of the subject property. The needed Right -of -Way for 86s Street has been established with the proposed plat and the developer has made arrangements for sidewalks and access points to be established satisfactorily. To satisfy the ingress /egress requirements for the plat a Mutual Access Easement will be created within the development along the eastern boundary of Lot 1. The easement will guarantee access to /from 86t11 Street North to both lots in the development. No other access points will be established along 86'11 St. N. At the present time (9/2003) there will also be no access granted to the private road on the western edge of the plat. Finally, a reserved area will be established in the southeast comer of the platted area. The Walgreens facility proposes a full service pharmacy /neighborhood convenience retail center on 1.642 acres, more or less. LOCATION The subject property is located in the Southwest corner of 96`s St. N. and 129h E. Ave. directly north of the Home Depot store presently under construction. A full service pharmacy /neighborhood convenience retail center is categorized under Use Unit 11 and 13 (Offices and Studios, and Shopping Goods and Services respectively) in the Owasso Zoning Code and both uses are allowed by right on the subject site as it is zoned CS. By reason of potential adverse effects on public services or to neighboring land uses, site plan review and approval is required for any commercial developments for the purposes of assuring proper accessibility, circulation, functional relationships of uses, and compatibility with adjoining and nearby development. No building permit shall be issued nor use commenced within this development except in accordance with an approved site plan. Walgreens proposes to build a 14,738 square foot structure on 1.642 acres, providing accommodations for in -store and drive through pharmacy and limited supply shopping. Patrons would gain access from the proposed service road (which is presently in the process of being established by separate instrument) on the west side of the development and N. 129th East Avenue; no access will be permitted directly from 96th St. N. Utility service is accommodated with the establishment of adequate utility easements along the entire parameter of the site. Easements on the north and eastern sides of the lot are extraordinarily large to accommodate a city water line (on the north) and Grand River Dam Authority power lines (on the east). Despite the unusual size of the easements Walgreens is able to properly situate an adequately sized building on the site. The Walgreens site plan satisfactorily meets the requirements set forth in the Owasso Zoning Code and Subdivision regulations with the exception of the requirements stated as part of the Technical Advisory Committee recommendations. The lot and block specifications for this site are more than adequate for the placement and accommodation of concurrent requirements imposed on commercial facility's such as that proposed in this site plan. TECHNICAL ADVISORY COMMITTEE The Technical Advisory Committee reviewed the site plan at the October 1 ' regular meeting. At that meeting, utility providers and city staff are afforded the opportunity to comment on the application and request any changes or modifications. The Technical Advisory Committee submitted the following comments: 1. Establish a drainage plan, approved by Public Works, before any building permit is issued. 2. Establish an escrow for the sidewalk along 96th St. N. 3. Plant a row of hedges between the sidewalk and the retaining wall on the eastern portion of the site. 4.
