CALL TO ORDER — Vice Chairperson Charles Willey called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF SEPTEMBER 8, 2003 REGULAR MEETING - The Commission reviewed the minutes of September 8, 2003 Regular Meeting, Dewey Brown moved, seconded by Bill Williams to approve the minutes. A vote on the motion was recorded as follows: Charles Willey — Yes Dewey Brown — Yes Bill Williams - Yes The motion carried 3 -0. 4. OZ- 03 -11— A request from Bethel Baptist Church to rezone 5.11 acres from RS -3 to CS. The property is located in the NW comer of 86° St. N. and Cedar St. in Owasso, Oklahoma. The Chair introduced the item and the staff review was given by Duane Cuthbertson. The purpose of this request is to classify the property for commercial use so that the church may modify their sign along 86"' Street North. The rezoning desired is consistent with the commercial pattern established along the north side of 86' Street North. The rear portion of the property encroaches into a residential neighborhood to the north. If the property were ever to be developed as commercial there would need to be some screening established. Legal notification was published in the Owasso Reporter and notices were sent to property owners within 300' of the property. One phone call was received with concerns regarding development of the lots on the northern section. Staff recommends rezoning Bethel Baptist Church's southern most lot adjacent to 8611 Street OWASSO PLANNING COMMISSION October 13, 2003 Page No. 2 North to CS and rezoning lots 5 -9 of block 10 in Ator Heights to OL (Office Light). Duane also asked the Commissioners to also consider rezoning the southern most lot adjacent to 86°i Street North to CS (Commercial), Lots 8 and 9, Block 10 to OL (Office Light) and Lots 5, 6 and 7 to remain RS -3 (Residential). Charles Willey suggested a representative from Bethel Baptist Church to approach the podium to explain their intentions. Mr. Bill Stinson gave explanation of the need for the rezoning request. He stated that they have no intentions of selling the property or building on the property to the north. The intentions are to construct a small sign on Lot 9 and to have the ability to modify the existing sign. The following are comments made by several surrounding property owners: Bob Voigt - 302 East 14th - Does not object to a new sign but would like to see it go before the Board of Adjustment for a variance request. He had concerns regarding the entire plat being zoned commercial and the possibility of the property being sold at a later date. Vernon Beatty - 1301 North Cedar Street - He would like to see a variance granted instead of a rezoning. Bill Williams moved to deny the rezoning request. Mr. Williams stated that he feels this item needs to be presented to the Board of Adjustment for a Variance request. The motion died due to the lack of a second. Charles Willey stated he feels that the southern most lot adjacent to 86'" Street North, should be zoned CS (Commercial). The church is surrounded by commercial property and a commercial zoning is consistent with the Owasso 2010 Land Use Master Plan. He also explained that an OL (Office- Light) zoning is a excellent buffer against residential. Charles Willey moved to table the item until the next Planning Commission meeting, Dewey Brown seconded the motion. A vote on the motion was recorded as follows: Charles Willey - Yes Dewey Brown - Yes Bill Williams - No The motion was denied 2 -1. After discussion, Charles Willey moved to table this item until the November 10, 2003 Planning Commission meeting. Dewey Brown seconded the motion. Lot Split - A request from New Hope Baptist Church for approval of a lot split (1 into 3) of approximately .93 acres located at 707 N. Carlsbad. The Chair introduced the case and Duane presented the item. The proposed lot split would create three (3) lots from the one currently existing. Two lots would front North Carlsbad Street to the west of the church. The applicant intends to sell the two (2) lots on Carlsbad St. to a developer who would construct two single family homes on them. The third lot would be kept by the church for expansion. Staff recommends approval of OLS- 03-11, subject to the TAC recommendations. The Technical Advisory Committee reviewed the proposed lot split at their regular meeting and recommended approval with the following conditions: 1. Establish an 11' easement along the eastern boundary of tracts #2 and #3, and an 11' easement along the western boundary of lot #1. Bill Williams moved to approve the lot split subject to the above Staff and TAC recommendation. Dewey Brown seconded the motion. A vote on the motion was recorded as follows: Charles Willey - Yes Dewey Brown - Yes Bill Williams - Yes The motion carried 3 -0. 6. Final Plat- A request from the KMO Development Group, Inc. for the review of a final plat for the proposed ROC Owasso III addition containing two (2) lots on one (1) block on approximately 3.149 acres located 1/2 mile east of N. 129' E. Ave, on the south side of E. 86`s St No. The Chair introduced the case and the staff review was given by Duane. Location of the property and surrounding land use was described. The plat intends to accommodate commercial development fronting onto E. 86' Street North. To satisfy the ingress /egress requirements a Mutual Access Easement will be created within the development along the eastern boundary of Lot 1. A reserved area will be established in the southeast corner of OWASSO PLANNING COXNHSSION October 13, 2003 Page No. 4 the platted area. The reserve will be a pond -like structure utilized for storm water detention and contains 0.376 acres. The Owasso Technical Advisory Committee reviewed the final plat at the October 1, 2003 meeting. There were no comments. Staff recommends approval of the ROC Owasso III final plat. Charles Willey moved to approve the Final Plat, Dewey Brown seconded the motion. A vote on the motion was recorded as follows: Charles Willey - Yes Dewey Brown - Yes Bill Williams - Yes The motion carried 3 -0. 7. Site Plan - A request from Bencor for the review of a Site Plan for the proposed Walgreens Drug Store facility on approximately 1.642 acres located in the southwest corner of N. 129th E. Ave. and E. 96" St. N. The Chair introduced the item and Duane reviewed the staff report. Walgreens proposes to build a 14,738 square foot structure on 1.642 acres. Access will be gained from the service road on the west side of the development and N. 1291' East Avenue. Staff recommends approval of the Site Plan, subject to the TAC and staff recommendations listed below. The Technical Advisory Committee reviewed the site plan at the October I" regular meeting. The following comments were noted: 1. Establish a drainage plan, approved by Public Works, before any building permit is issued. 2. Establish an escrow for the sidewalk along 96' St. N. 3. Plant a row of hedges between the sidewalk and the retaining wall on the eastern portion of the site. 4. Locate a fire hydrant in the southwest corner of the site, as agreed upon with the fire marshal. Bill Williams moved to approve the Site Plan subject to the above Staff and TAC recommendations. Chairperson Secretary Date CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT OZ 03 -11 (Bethel Baptist Church) STAFF REPORT BACKGROUND The City of Owasso has received a request from Bethel Baptist Church, applicant(s) /owner(s), for the rezoning of approximately 5.11 acres, more or less from its current designation of RS -3 (Residential) to CS (Commercial). It is the intention of the property owner only to improve their signage. Current Zoning Designation: Proposed Zoning Designation: RS -3 (Residential Single - Family) CS (Commercial Shopping) This item was on the October Planning Commission agenda. Staff recommended a tier rezoning beginning with a CS designation for the southern lot, an OL designation for the middle two lots and to maintain the RS -3 designation for the northern three lots. The applicant stated that they would like to have the entire property rezoned CS. Residents from the surrounding neighborhood spoke in opposition to the rezoning request and desired to have all of the property maintain its RS -3 designation. A consensus was not reached between the three commission members present in October and the item was tabled until November. LOCATION Bethel Baptist Church is located in the northwest comer of Cedar St. and 86`h St. N. EXISTING LAND USE Church SURROUNDING LAND USE North: Single - family residential South: Single - family residential West: Mexico Lindo and Apartments East: Larry's Fried Chicken, Post Office, and single- family residential PRESENT ZONING RS -3 (Residential Single - Family District) SURROUNDING ZONING North: RS -3 (Residential Single - Family District) South: RS -3 (Residential Single - Family District) East: CG (Commercial General), RS -3 (Residential Single - Family) West: CG (Commercial General), RM -1 (Residential Multi- family) ANALYSIS The purpose of the Bethel Baptist Church's rezoning request is to classify the property for commercial use so that the church mays modify their sign along 86`h St. North. The church wishes to improve their sign on 86` Street and add a sign within their parking lot to the north however, because the property is currently zoned RS -3 they are not allowed (according to the Owasso sign code) to have a moderately sized sign on the property. As a remedy, the church has two options: request a variance from the sign code that would allow them to make a one time change or rezone the property to a classification that would allow signs. The church decided to request a rezoning to a designation that would allow a modification of their signage. They desired to rezone so that they would not have to return to a review board every time they make a modification. The CS classification desired is consistent with the commercial pattern currently established along the north side of 86`h Street North and any if any commercial development were to occur on this site it would not conflict with the residential neighborhood to the north. This request along 86`h St. N. is consistent with the Owasso 2010 Land Use Master Plan. However, the rear portion of the church property encroaches into a residential neighborhood to the north and allowing commercial type development on those platted residential lots may pose some conflict, such as additional traffic into the neighborhood and more noise and light pollution. Staff published legal notice of the rezoning request in the September 17, 2003 edition of the Owasso Reporter and sent notices to property owners within 300' of the property and posted a notification of a rezoning request sign on the property. Staff received one phone call concerning the potential use of the site. It was the concern of the caller that the rezoning would allow the church to sell the property in the future to commercial interest. He was mostly concerned with potential commercial development of the lots on the northern section of the churches property. Staff informed him that the intentions of the church at this time were only to modify their sign and that they gave us no indication they would sell their property to a commercial interest. RECOMMENDATION Staff is altering its recommendation from last months position in that it recommends rezoning Bethel Baptist Church's southern most lot (on which the main structure is situated) adjacent to 86th Street North to CS (Commercial Shopping district), rezoning lots 8 and 9 of block 10 in Ator Heights to OL (Office Light intensity district) and maintain an RS -3 zoning designation for lots 5 -7 of block 10 in Ator Heights. The zoning classifications would allow the church to place signs within their property and more specifically within their parking lot to the north. The CS zoned property along 86th St. will establish a consistent developable pattern along that corridor and the OL zoning on the middle lots would (along with allowing the sign) provide a smoother transition of intensity from Commercial to Residential. Uses typical in OL zoned districts share similar characteristics to Residential zoning therefore the potential for conflict is minimized. ATTACHMENTS 1. General Area Map 2. Duane Cuthbertson City Planner a CITY OF OWASSO COMMUNITY DEVELOPMENT DEPARTMENT OZ 03 -12 ( Budgget Industries) STAFF REPORT BACKGROUND The City of Owasso has received a request from Budgget Industries (Henry Harker, Jr.), applicant(s) /owner(s), for the rezoning of property from its current designation of CH (Commercial High Intensity) to IL (Industrial Light Intensity). The property owner is not intending to change uses on the site just classifications. Current Zoning Designation: Proposed Zoning Designation: CH (Residential Single - Family) IL (Industrial Light District) LOCATION Budgget Industries is located at 8 South Atlanta, in the south west corner of Atlanta Street and Broadway Street. EXISTING LAND USE Light Manufacturing SURROUNDING LAND USE North: Single - family residential South: Automotive Repair West: Rail Yards East: Automotive Repair/Vacant PRESENT ZONING CH (Commercial High Intensity District) North: RM -1 (Residential Multi - Family District) South:. CH (Commercial High Intensity District) East: CH (Commercial High Intensity District) West: IL (Industrial Light Intensity) ANALYSIS Budgget Industries has been fabricating steel at 8 South Atlanta in Owasso for approximately 25 years. The property is currently zoned CH and according to the Owasso Zoning Code this Light Manufacturing is allowed by special exception granted by the Board of Adjustment, however because the business was in place before the zoning took affect it is classified as a non - conforming use and legal. Henry Harker, Jr. of ('D Budgget Industries has requested a rezoning change so that as the business grows in Owasso he will have the appropriate zoning to allow his company the latitude needed for expansion. The current use is light industrial as steel fabrication is performed on site. This operation has been performed on this site for many years and there is no indication that this will cease to exist on the subject property in the foreseeable future. The requested zoning change will bring the property's use into compliance with the code. In regards to the requested zoning designation the Owasso Zoning Code states "The IL District is designed to provide an environment conducive to the development and conservation of modem industrial and scientific research facilities and to provide areas suitable for manufacturing, wholesaling, warehousing, and other industrial activities which have no objectionable environmental influences" (OZC Section 700.2). The current functions being performed on site fits this description. The priority concern with an industrialized site located within a close proximity to downtown Owasso would be the limitations on environmental influences. Budgget Industries performs steel fabrication and there are no objectionable environmental influences associated with this function as I understand it this function emits no noxious odors and low limited non - continuous noise. The rezoning desired is consistent with the Owasso 2010 Land Use Master Plan as it calls for Industrial uses in this area. The site is accessible from the rail yards and has easy access to the regional highway network. The site does not conflict with adjacent uses as long as the proper screening is applied on the north side of the property facing the residential district. Staff published legal notice of the rezoning request in the October 16, 2003 edition of the Owasso Reporter and sent notices to property owners within 300' of the property and posted a notification of a rezoning request sign on the property. Staff received no phone calls concerning the potential use of the site. RECOMMENDATION Staff recommends rezoning the subject property to IL (Industrial Light Intensity) with the condition that the screening between this site and the adjacent residential district to the north be upgraded. The First United Methodist Church site is located within the Woodridge PUD # 18 as adopted by the City Council. The First Christian Church of Owasso final plat contains one (1) lot on one (1) block on approximately 21.4 acres, more or less. Because the proposed plat is one lot on one block the applicant may proceed straight to the final plat. The plat intends to accommodate a comprehensive church facility. A church facility is compatible with the Owasso Zoning designation for this parcel of RS -3. A church facility is classified as use unit #5 (Community Services, Cultural and Recreational facilities) and is allowed by right on property zoned RS -3. The property is part of the supplemental zoning designation PUD (Planned Unit Development) # 16, "The Lakes at Bailey Ranch ". PUD's are a specified set of guidelines adopted by the City Council in addition to or in some cases superceding the original zoning guidelines. PUD # 16 specifically calls for a church site in the area that the First Christian Church of Owasso proposes to locate. Furthermore, the l proposed church location is consistent with the Owasso 2010 Land Use Master Plan as it calls for Public facilities on the subject site. The site is within the City of Owasso's utility service district. It will be provided water, sewer and trash services by the City of Owasso. The proposed final plat satisfactorily meets the requirements established in the Owasso Zoning Code. Necessary utility easements have been established along the parameters of the proposed plat to accommodate essential utility placement and access. In addition to the easements the plat reserves 50' along its eastern border to satisfy any future Right -of -Way expansion associated with Garnett Road. It is the intention of the owners to develop the property with up to (8) eight single family homes. LOCATION The property is located in the northwest comer of 1050' E. Avenue and E. 98`h Place North, on the northern edge of the Kelley Ann addition. The applicant has agreed to begin the planning process which at this point includes requests for annexation, rezoning, and platting of the property. The property is currently zoned AG (Agricultural General District) in Tulsa County and will remain this same classification upon annexation. Prior to any action relative to a rezoning request, a rezoning sign will be posted on the property and property owners within 300' will be notified as was the case with this annexation request. Any development that occurs on the subject property must adhere to all subdivision, zoning and engineering requirements including but not limited to paved streets and sidewalks. The annexation will require no significant expansion of utilities or infrastructure. A standard road (981h Street North) servicing the property already exists on the southern property line. Residential sewer and water service will be provided by the City of Owasso. A copy of the Annexation Policy is attached for your information and review. While the subject property is not larger than 20 acres as preferred by Annexation Policy #1 the subject property (1.71 acres) is essentially a small strip, surrounded by property on three sides currently within the city limits and the annexation of said property will initiate a process that will eventually allow it to be developed in a viable productive manner that is consistent and compatible with the surrounding area. Established residential developments are located to the south (Kelley Ann) and east (El Rio Vista) and a residential subdivision (Honey Creek) is currently under development to the west. The adjacent property to the north is part of the Lakes at Bailey Ranch PUD which calls for single family development on and near the site. Staff published legal notice of the annexation petition in the October 16, 2003 edition of the Owasso Reporter. Staff has received no phone calls or correspondence in opposition of the request. ANNEXATION COMMITTEE The Owasso Annexation Committee reviewed the request on June 25, 2003 and recommended approval with no negative concerns. Mr. Cuthbertson stated the property would be accessed through 98th Pl. North from the Kelley Ann addition. Discussion turned to the quality of the street serving the property. Mr. Cuthbertson stated that the developer intended to round out the terminus in a form acceptable to the fire marshal and that it was a county road and built to their standards and did possess curb and gutters. Brent Colgan asked why the annexation would not require significant extension of infrastructure and Mr. Cuthbertson stated that most of the infrastructure, to include roads, sewer and water mains were already in place for the development and would not have to be publicly extended. Mr. Colgan motioned to approve the annexation request. Craig Thoendel seconded the motion. The motion carried 7 -0. 4. ANNEXATION REQUEST — OA 03 -08 McPartland Trust - A request for the annexation of property by the Sue McPartland Trust which contains 200 acres, more or less. The general location of the property begins %4 mile east of 129th E. Ave. on the south side fo 76" St. N. Mr. Cuthbertson presented the item. Discussion followed about a potential regional detention system being adequate enough to serve the Crown Colony subdivision to the northwest being part of the development of the property. It was concluded that a regional detention system may be part of the development requirements. Eric Wiles motioned to approve the annexation request. Mr. Rooney seconded the motion. The motion carried 7 -0. 5. ANNEXATION REQUEST — OA 03 -09 Crown Colon v — A request for the annexation of the Crown Colony subdivision consisting of 13.72 acres and containing 47 lots on 4 blocks located' /4 mile east of 129`h E. Ave. on the south side of 76th Street North. Mr. Cuthbertson presented the item. Robert Carr stated that Public Works does not have a file verifying that the subdivision was inspected by the city or meets city standards. Documentation from the county would be obtained to validify the subdivision standards. It was stated that the subdivision was lacking parameter sidewalks, handicap ramps on interior sidewalks and clear detention plans. Where a City limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistence and allow City employees and citizens to know where the City boundaries are. 6. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. Adopted by City Council on March 1, 1988. CALL TO ORDER - Mr. Cuthbertson called the meeting to order at 5:15 PM. 2. APPROVAL OF MINUTES FROM JUNE 25, 2003 MEETING — Tim Rooney moved, seconded by Robert Carr, to accept the minutes as presented. The motion carried 7 -0. ANNEXATION REVIEW ANNEXATION REQUEST — OA 03 -07 Randie Lyn - A request for the annexation of property by Kellogg Engineering (agent for the developer). The subject property contains 1.71 acres, more or less and is generally located in the northwest comer of N. 105' E. Avenue and E. 98`x' Pl. North. Duane Cuthbertson presented the annexation request. Mr. Cuthbertson stated the property would be accessed through 98th Pl. North from the Kelley Ann addition. Discussion turned to the quality of the street serving the property. W. Cuthbertson stated that the developer intended to round out the terminus in a form acceptable to the fire marshal and that it was a county road and built to their standards and did possess curb and gutters. Brent Colgan asked why the annexation would not require significant extension of infrastructure and Mr. Cuthbertson stated that most of the infrastructure, to include roads, sewer and water mains were already in place for the development and would not have to be publicly extended. Mr. Colgan motioned to approve the annexation request. Craig Thoendel seconded the motion. The motion carried 7 -0. 4. ANNEXATION REQUEST — OA 03 -08 McPardand Trust - A request for the 1 annexation of property by the Sue McPartland Trust which contains 200 acres, more or less. J The general location of the property begins '/a mile east of 129th E. Ave. on the south side _ fo 76h St. N. Mr. Cuthbertson presented the item. Discussion followed about a potential regional detention system being adequate enough to serve the Crown Colony subdivision to the northwest being part of the development of the property. It was concluded that a regional detention system may be part of the development requirements. Eric Wiles motioned to approve the annexation request. Mr. Rooney seconded the motion. The motion carried 7 -0. 5. ANNEXATION REQUEST — OA 03 -09 Crown Colony — A request for the annexation of the Crown Colony subdivision consisting of 13.72 acres and containing 47 lots on 4 blocks located %a mile east of 129h E. Ave. on the south side of 76`h Street North. Mr. Cuthbertson presented the item. Robert Carr stated that Public Works does not have a file verifying that the subdivision was inspected by the city or meets city standards. Documentation from the county would be obtained to validify the subdivision standards. It was stated that the subdivision was lacking parameter sidewalks, handicap ramps on interior sidewalks and clear detention plans. Mr. Thoendel moved to table the item until adequate information was provided so that an informed decision could be made. Mr. DeArmond seconded the motion. The motion carried 7 -0. 6.
