1. CALL TO ORDER — Marilyn Hinkle called the meeting to order at 6:00 PM and
declared a quorum present.

3. CONSIDER APPROVAL OF THE MINUTES OF AUGUST 10, 2009 REGULAR
MEETING — The Commission reviewed the minutes of August 10, 2009 regular meeting.
Charles Brown moved to approve the minutes and Dr. Callery seconded the motion. A
vote on the motion was recorded as follows:

4. Final Plat, Silver Creek Commercial— A request to review and approve a final plat
being two commercial lots, in one block, on approximately five acres of land, located at
the northwest corner of East 86' Street North and North 145' East Avenue.
Marilyn Hinkle explained that the applicant has asked this item to be continued.
5. Proposed Master Plan Amendment — A request to review and approve a proposed
amendment to the Owasso Master Plan, changing the planned use designation for 21 -acre
property located on the south side of East 106'h Street North and the east side of North
145'" East Avenue. The staff will recommend that the Master Plan use designation for the
property be changed from transitional use to residential use.

Marilyn Hinkle presented the item and Eric Wiles reviewed the staff report. The location
and the surrounding land use were described. The staff requests that the Planning
Commission approve an amendment to the Owasso Land Use Master Plan use for this
property. The staff proposes that the use designation for the property be changed to
residential. When updating the use designations on the Master Plan, the City first
considers two primary questions; first, " what is the highest and best use of the property ",
and second, " what is the predominant development pattern already established in the
area ". A significant area of floodplain exists along the western, northern, and eastern
sides of the tract. This floodplain forms an effective buffer from the five -acre tract to the
east, which is planned for future commercial use. With the floodplain situated on the
tract, it is unclear what the highest and best use would be. Staff finds that the future use
of this property ought to be residential. The annexation request was turned down by the
Planning Commission on June 8, 2009. The applicant appealed that decision to the City
Council. The City Council requested the Planning Commission to consider the Master
Plan designation prior to the Council' s consideration of the appeal. Staff recommends
that the Planning Commission change the designated land use for the subject property
from Transitional Use to Residential Use. The following are comments and concerns
from surrounding property owners:
Paula Hamlin - 15052 E. 106 St. No. - Feels that residential is the best use for the
property. Please approve staff' s recommendation.
Lila Martini - 10103 N. 151 E. Ave - Has storm water concerns and doesn' t
want the water flow disturbed. Enjoys the wildlife in the area.
Paul Pennekamp - 14814 E. 104 St. No. - He had questions regarding the
floodplain regulation amendments.
Dale Kunze - 10207 N. 147 E. Ave. - It has been promised to the nearby
property owners that there would not be any multi - family if this property
develops. Has storm water concerns.
Eric explained the steps needed in order to change the floodplain. He also explained that
this item is not about zoning but it is about the different uses. When the property owner
asks for a different zoning the city would process the zoning or planned unit development
application and surrounding property owners would be notified. Eric clarified the
meaning of a planned unit development.
Charles Brown moved to approve the designation from transitional use to residential use.

SUBJECT: FINAL PLAT, SILVER CREEK COMMERCIAL

BACKGROUND:
The City of Owasso has received a request from SLR Owasso, LLC, applicant /owner, for the
review and approval of the Silver Creek Commercial Final Plat. The Final Plat proposes two
(2) lots in one (1) block on 5 acres of property. The applicant wishes to plat the property so
that they may construct uses that are in accordance with the Commercial Shopping Planned
Unit Development Number 14 Zoning Districts.
LOCATION:
The subject property is located at the northwest corner of East 86" Street North and North
145' East Avenue.
EXISTING LAND USE
Undeveloped
SURROUNDING LAND USE
South: Multi - Family Residential (The Greens Apartments)
East: Commercial General (Kum n' Go)
West: Single - Family Residential (Silver Creek)

PRESENT ZONING
The subject property is currently zoned CS Commercial within Planned Unit Development
Number 14.
DEVELOPMENT PROCESS:
The first step in the development of a piece of property in Owasso is annexation. Annexation
is the method whereby land located outside the city limits is made a part of the city. Property
owners and land developers sometimes choose to have their property annexed into Owasso in
order to receive Owasso municipal services, such as police protection, refuse collection, and
sanitary sewer.
The second step in the development of a piece of property in Owasso is rezoning. When a
property is annexed into Owasso, by law it must come in classified for AG Agricultural use.
In order to develop the property, the land must be zoned for particular kinds of uses, such as
residential, office, commercial, or industrial. Rezoning decisions are made in accordance with
the growth policy displayed in the Owasso Master Plan.
One type of rezoning that a developer may choose to seek is a Planned Unity Development, or
PUD. When a development proposes to exhibit a mixture of uses with specific regulations and
standards unique to a particular tract of land, a PUD is often the preferred land use control
mechanism.
The third step in the development of property in Owasso is platting. A preliminary plat is
required for any development that proposes to divide land into two or more lots. Preliminary
plats illustrate the development concept for the property, and are often modified significantly
after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning
Commission. Sometimes, difficult development issues such as existing utility lines, wells, or
easements are brought to light at the preliminary plat stage and must be remedied prior to
development.
After the preliminary plat has been reviewed by the City and various utility companies,
construction plans for the development's infrastructure are typically submitted. These plans
include specifications and drawings for stormwater drainage, streets and grading and erosion
control, waterlines, stormwater detention, and wastewater lines. Often, approval is required of
other agencies, such as the Department of Environmental Quality for wastewater collection and
the US Army Corps of Engineers for properties that may development sensitive.
Once the property development proposal shows a division of lots that is acceptable to both the
developer and the City of Owasso, a final plat application is submitted. A final plat illustrates
the layout and dimension of lots included on the final plat, right -of -way widths, easements, and
other physical characteristics that must be provided for review by the City. After obtaining
approval from the TAC and Planning Commission, the final plat is considered by the City
Council. If approved, the final plat is filed with the office of the County Clerk and governs all
future development on that property.
ANALYSIS:
According to the final plat, the developer would like to create two (2) lots, in one block, on 5
acres of land. The Silver Creek Commercial preliminary plat was reviewed by the Planning
Commission on December 8, 2008. At that time, the following items were recommended as
conditions of approval by the Owasso Technical Advisory Committee, which reviewed the
preliminary plat on November 19, 2008:
1. Match the Legal Description from the text to drawing boundary survey
2. Show the scale bar
3. Show existing adjacent utility easements
4. Submit restrictive covenants
5. Identify Limits of Access
6. Identify Limits of No Access
7. Identify easements to be placed on Lot 2
8. Show a 20 foot landscape buffer on the north side of Lot 2
The items were corrected by the applicant prior to the applicant's submittal of the final plat.
Any development that occurs on the subject property must adhere to all subdivision, zoning
and engineering requirements including but not limited to paced drives and storm water
detention. Sewer service and water service will be provided by the City of Owasso. The
property will be subject to all payback fees including Storm Siren fees of $35 per acre and a
sanitary sewer payback fee of $1580.00 per acre.
RECOMMENDATION:
The staff recommends approval of the Silver Creek Commercial Final Plat.

4. Rieht -of -Way Closure - A request to review and approve a right -of -way closure located
at the southeast corner of East 96°i Street North and North 129" East Avenue.
Marilyn Hinkle presented the item and Larissa reviewed the staff report. The location
and the surrounding land use were described. The property is designated Commercial by
the Comprehensive Plan and is currently zoned CS (Commercial Shopping). The right -
of -way was dedicated to the City of Owasso by the Owasso First Assembly of God
Church to accommodate the expansion of the street intersection in 2003. However, the
legal descriptions that were included in the dedication were erroneous. The purchasers
have requested that the right -of -way be corrected so the issue does not cause a cloud on
the title. City Council will consider the right -of -way closure on November 3, 2009. The
city has notified property owners within 300' of the proposed closing and published in
the Owasso Reporter. The staff recommends approval of the proposed right -of -way

and the surrounding land use were described. The applicant desires to close a portion of
the existing 5' utility easement in order to clean up title work on the property. The
garage of the house was found to be 2 -1/2 inches over the building line. If the easement
closure request were approved, the existing 5' utility easement would be modified to
allow access to utility lines. Owasso Technical Advisory Committee reviewed the closure
at the regular meeting on September 23, 2009. No comments were provided. Staff
recoimnends approval. The applicant was present to answer questions.

The Technical Advisory Committee reviewed the closure at their regular meeting on
September 23, 2009. No comments were provided. Steve Compton, the Chairman of the
Building Committee was present to answer any questions. Mr. Compton stated that the
electric lines and poles would be re- routed.

corrected by the applicant. Sewer service and water service will be provided by the City
of Owasso. The property will be subject to all payback fees including Storm Siren fees of

Morris Engineering was present to answer any questions.

BACKGROUND:
The City of Owasso has received a request for the annexation of approximately 30 acres,
on the northeast corner North Garnett Road and East 106`s Street North. It is the intention
of the property owner to divide the land into two parcels upon annexation, and construct a
single- family dwelling unit on one of the parcels.

A portion of the property contains a driving range.

BACKGROUND:
In order to further facilitate the development of their property for conunercial use, Vines Properties,
Inc, requests that their property be rezoned from a Residential Duplex (RD) Zoning District to a
Commercial Shopping (CS) Zoning District. A general area map is attached for review.
PROPERTY CHARACTERISTICS:
The property is currently developed and is zoned RD (Residential Duplex). The subject site is
.24 acres in size. The property will be served by municipal water, wastewater, police, fire, and
EMS service.
LEGAL CONSIDERATIONS OF ZONING REQUESTS:
Section 1500 of the Owasso Zoning Code outlines the city's policy on zoning amendments. The
code states that amendments will be adopted to recognize changes in the Comprehensive Plan, or to
recognize changing conditions in a particular area or in the jurisdictional area. Zoning changes must
be based on two fundamental questions: 1) Does the requested zoning allow a land use that is
appropriate for the subject property, and 2) Is the requested zoning in conformance with the Owasso
Land Use Master Plan?
Development considerations such as traffic, roads, grading, drainage, stormwater detention, utilities,
rights -of -way, etc, are not to be considered until the platting stage of development. At the platting
(and site planning) stage, the Planning Commission, municipal staff, and the Technical Advisory
Committee work with the applicant to solve these types of specific development concerns.
The proposed development for this property is unknown.
CONFORMANCE TO MASTER PLAN DESIGNATION•
The requested zoning designation, Commercial Shopping (CS), is compatible within the Owasso
Land Use Master Plan's designation for the property.
ANALYSIS:
The subject property lies to the southeast of 2`1 and Atlanta, and is adjacent to compatible
developments. The applicant has requested a Commercial Shopping (CS) Zoning Designation to
allow for the construction of facilities that would support light commercial uses such as retail or
office space. The requested use is found to be in accordance with the Owasso Land Use Master
Plan.
Any development that occurs on the subject property must adhere to all subdivision, -zoning and
engineering requirements including but not limited to paved drives and storm water detention.
Sewer service and Water service will be provided by the City of Owasso.
Letters were mailed to surrounding property owners and the legal advertisement was published
in the Owasso Reporter. Copies of both the letter to property owners and the legal advertisement
are attached for your information and review.
If the Commission approves this application it will then require City Council approval.

BACKGROUND:
The City of Owasso has received a request for the partial closure of a utility easement located in the
rear yard of 13800 East 94 °i Street North. A survey of the site is included with your packet.
PROPERTY CIIARACTERISTICS:
The legal description of the property is Lot 1, Block 5, Nottingham Estates III Addition. The tract is
zoned for RS -2 Single- Family Residential use and is occupied by a 2 -story house. The existing land
use is residential for the subject property, as is land surrounding the site. The property is served by
municipal water, wastewater, police, fire and EMS service.
ANALYSIS:
The applicant desires to close a portion of the existing 25 utility easement in order to clean up
title work regarding the existing swimming pool and pool house that was built over a portion of
the utility easement. All utility companies have been notified, and have accepted the
modification to the utility easement. If the easement closure request is approved, the existing
17.5' utility easement would be modified to allow access to utility lines. The staff finds that this
request will have no detrimental impacts to the subject tract, or the surrounding areas.
TECHNICAL ADVISORY COMMI'T'TEE:
The request for the partial utility easement closure was reviewed by the Owasso Technical
Advisory Committee at their regular meeting on October 28, 2009. Al that meeting, utility
providers and city staff are afforded the opportunity to comment on the application and request

LOCATION:
The subject right -of -way is located at the southeast corner of East 96h Street North and
North 129`h East Avenue. It lies adjacent to the northern undeveloped portion of the
corner owned by the Owasso First Assembly of God Church.
ANALYSIS:
The property at the southeast corner of the intersection is in the process of being sold, and
the purchasers are planning for the development of a commercial shopping use related to
a retail sales facility. The property is designated Commercial by the Owasso
Comprehensive Plan and is currently zoned CS (Commercial Shopping) which allows the
proposed use by right.
The subject right -of -way was dedicated to the City of Owasso by the Owasso First
Assembly of God Church to accommodate the expansion of the street intersection in
2003. However, the legal descriptions that were included in the dedication were
erroneous. Therefore, the purchasers have requested that the right -of -way be corrected so
the issue does not cause a cloud on the title of the property. Consultations with the City
Attorney, the representatives for the purchasers, and Section 42 of the Oklahoma
Municipal Code have resulted in a staff finding that the appropriate resolution for the
issue is to approve an ordinance closing the erroneous right -of -way. A corrective deed is
also being prepared so that the City can retain the right -of -way needed for the full
urbanization of the intersection.
The Owasso City Council will conduct a public hearing on November 3, 2009 to consider
the right -of -way closure ordinance in accordance with statutory requirements. The City
has given written notice of the proposed closing to all franchise holders, all property
owners within three hundred feet of the right -of -way to be closed, and published the
notice in the newspaper.
RECOMMENDATION:
The staff recommends approval of the proposed right -of -way closure as described above.

recognized as St. Henry's Catholic Church. The exact description of the lots where the easement
currently exists is Lots 5, 6, 7, Block 1, Parkview Addition Amended. A site map is included with

PROPERTY CHARACTERISTICS:
The tract is currently zoned for RS -3 Single - Family Residential with a Special Exception for a
church use as granted by the Owasso Board of Adjustment on February 2, 2009. The existing land
use is residential with future plans to expand the St. Henry's Catholic Church.
ANALYSIS:
The applicant desires to close an existing utility easement located on the northerly boundary of
Lots 5, 6, and 7, Block 1, Park View Amended Addition. The reason for the request is so the
church may expand their existing building and parking lot to the south of their existing site. The
property has been acquired by the church, and all legal documents are in order for such request.
If the easement closure request is approved, the existing 5' utility easement would be vacated.
The staff finds that this request will have no detrimental impacts to the subject tract, or the
surrounding areas.

SUBJECT: REQUEST FOR A PARTIAL EASEMENT CLOSURE

BACKGROUND:
The City of Owasso has received a request for the partial closure of a utility easement located in the
side yard of 12324 East 69`h Street North. A site plan and a general area map are included with
your packet.
PROPERTY CHARACTERISTICS:
The legal description of the property is Lot 28, Block 2, Keys Landing. The tract is zoned for RS -3
Single - Family Residential use and is occupied by a single - family dwelling. The existing land use is
residential for the subject property, as is land to the east, south and west.
ANALYSIS•
The applicant desires to close a portion of the existing 5' utility easement in order to clean up
title work on the property. The correction is required because the attached garage of the house
that was built on the lot was found to be 2% inches over the building line. All utility companies
have been notified, and have accepted the modification to the utility easement. If the easement
closure request is approved, the existing 5' utility easement would be modified to allow access to
utility lines. The staff finds that this request will have no detrimental impacts to the subject tract,
or the surrounding areas.
TECHNICAL ADVISORY COMMITTEE•
The request for the partial utility easement closure was reviewed by the Owasso Technical
Advisory Committee at their regular meeting on September 23, 2009. At that meeting, utility
providers and city staff are afforded the opportunity to comment on the application and request
any changes or modifications. No comments were provided.
RECOMMENDATION:
Staff recommends that the request for the partial utility easement be approved.
