CALL TO ORDER — Duane Coppick called the meeting to order at 6:00 PM and declared a quorum present. 2. ROLL CALL 3. .CONSIDER APPROVAL OF THE MINUTES OF DECEMBER 11, 2006 REGULAR MEETING - The Commission reviewed the minutes of December 11, 2006 regular Meeting. David Vines moved to approve the minutes, Kevin Vanover seconded the motion. A vote on the motion was recorded as follows: Duane Coppick - Recuse Marilyn Hinkle — Yes David Vines - Yes Kevin Vanover — Yes The motion was approved 3 -0. 4. OZ 06 -09 A request to review and approve the rezoning of approximately 150 acres, located at the southeast corner of East 76 "` Street North and Mingo Road from AG agricultural to IL industrial. Duane Coppick presented the item and the staff report was reviewed by Eric Wiles. The development process was described. If the rezoning is approved, industrial uses such as manufacturing facilities could be considered for the 150 acres on the south side of East 76 1h Street North. The site is bordered by a mixture of industrial, commercial, and undeveloped properties. Several industrial users have reviewed the site, and are considering pursing industrial developments. Letters were mailed to surrounding property owners and legal advertisement was published in the Owasso Reporter. The following are comments /concerns expressed by the public: OWASSO PLANNING COMMISSION January 8, 2007 Page No. 2 Jerry Stokely - Requested a copy of the fill permit to review. He also stated that he is going to have the Oklahoma Water Resources and Corp. of Engineers review the permit. He is against the rezoning. Ken Lavendusky - 6808 North Mingo - He is opposed to the rezoning. He has concerns with storm water run off damaging his property. Sue Pickett - 8500 East 116 Street North - Presented pictures of storm water surrounding her house due to new development in the area. Phyllis Lavendusky - She is opposed to any kind of development on this land. There has been too much fill dirt dumped on this property and it will eventually cause her property to flood. The City needs to check to see how much fill has been brought into that location. Brent Lambert - He is against the rezoning. Has concerns with flooding and is against filling in the property. Pat Wallace - 8210 East 100 Street North - She is against the rezoning. Jim Lavendusky - He is pro - growth but is afraid there is going to be a problem with flood water in the area. He is against the rezoning. Randy Walker - He stated that concrete has been hauled onto the property for fill. The more fill the more surrounding property is going to flood. He is against the rezoning. The earth change permit process was explained by Joe Nurre. Also discussed was the process of receiving a fill permit from the City of Owasso. Mr. Robinson the property owner, requested to make a brief statement. He stated that he will cut back on the fill; he doesn't want to flood the surrounding properties. He also explained that the west part of the property will be a park area. A brief discussion was held regarding the possibility of resubmitting the request in a planned unit development form. Duane Coppick moved to approve the rezoning as written. The motion was seconded by Dan Draper. OPUD Amendment 04 -03 Owasso Medical Campus- A request to review and approve an amendment to a proposed 66.42 acre mixed use Planned Unit Development at the northwest corner of North 129`h East Avenue and the Owasso Expressway, just north of the Owasso Market. Duane Coppick presented the item. Mr. Tim Terral, a representative for the applicant requested a continuance on this hearing until the next Planning Commission meeting which will be held on Monday, February 12, 2007, at 6:OOPM at the Old Central Building. 6. Preliminary Plat - Nottingham Hill - A request to review and approve a preliminary plat proposing 58 residential lots, on approximately 28 acres of property zoned RS -2 (Residential Single Family), located southwest of the intersection of North 145`h East Avenue and East 96h Street North. Duane Coppick presented the item and the staff report was reviewed. The surrounding land use and the development process were described. The applicant is requesting this review in order to facilitate 58 lots, on approximately 28 acres of property zoned RS -2. The Technical Advisory Committee reviewed the plat at the December 27, 2006 meeting and made the following recommendations: 1. The applicant must comply with Right of Way requirements. 2. The applicant needs to indicate perimeter sidewalks. 3. The applicant must coordinate fire hydrant locations with the fire marshal. The above modifications will appear in the final plat for the development. Staff recommends approval of Nottingham Hill preliminary plat subject to the above conditions. Marilyn Hinkle moved to approve the preliminary plat subject to the Staff and TAC recommendations. The motion was seconded by Duane Coppick. The applicant is requesting this review in order to facilitate 2 commercial lots, on approximately 2 acres of property, located on the northeast corner of East 86`h Street North and Main Street. The request was reviewed at the regularly scheduled Technical Advisory Committee meeting on December 27, 2006. At that meeting, the committee recommended approval of the final plat with the following recommendations: 1. The final plat is subject to a $32.00 storm siren fee. Duane Coppick moved to approve the Final Plat for Kum & Go #886 subject to TAC and Staff recommendations, the motion was seconded by Marilyn Hinkle. Site Plan - Kum & Go #886 - A request to review and approve a site plan proposing a 3,365 sq. ft. convenience store and a 1,750 sq. ft. tenant space, located on the northeast corner of East 86' Street North and Main Street. Duane Coppick presented the item and the staff report was reviewed. The development process was explained. The applicant is requesting this review in order to construct a 5,115 sq. ft. commercial facility on approximately 2 acres of property zoned CG (Commercial General District). The development must adhere to the City of Owasso's outdoor lighting, landscaping and sign codes. The request was reviewed at the regularly scheduled Technical Advisory Committee meeting on December 27, 2006. At that meeting, the committee recommended approval of the site plan with the following recommendations: 1. The applicant must show trash enclosure detail. 2. The applicant must indicate screening on east side of property to extend 25' south of the parking spaces. 3. The applicant needs to provide impervious area, with drainage calculations. 4. The applicant must submit cut sheets for lighting. Discussion was held regarding the concrete wall on the east side of the property. Chip stated that there will be a screening fence on the east side because of the multi- family units. Also, traffic circulation and trash truck circulation issues were discussed. Final Plat - Tyann IX - A request to review and approve a final plat proposing 3 commercial lots in 1 block, on approximately 4.70 acres of property zoned CS (Commercial Shopping District), located southeast of East 96' Street North and the Owasso Expressway, just south of the Tyann Plaza Shopping Center. Duane Coppick presented the item and the staff report was reviewed. The development process was explained. The applicant is requesting this .review to facilitate a commercial development. The property is zoned CS (Commercial Shopping). Off site storm water detention has been provided for this development to the south in the storm water detention center currently under construction. The request was reviewed at the regularly scheduled Technical Advisory Committee meeting on December 27, 2006. At that meeting, the committee recommended approval of the final plat with the following recommendations: 1. The applicant needs to indicate sidewalks adjacent to all public right of ways. 2. The applicant needs to show Limits of No Access. 3. The property is subject to a $75.00 storm siren fee. Staff recommends approval of the Tyann Plaza IX Final Plat subject to the above conditions. Site Plan - Tyann IX - A request to review and approve a site plan proposing a 12,800 sq. ft. commercial facility, located on the southeast of East 96 "' Street North and the Owasso Expressway, just south of the Tyann Plaza Shopping Center. Duane Coppick presented the item and the staff report was reviewed. The development process was explained. The applicant is requesting this review to facilitate a 12,800 sq. ft. commercial development on 1.66 acres. The property is zoned CS (Commercial Shopping). The proposed site plan is situated on a highly visible and accessible segment of the Owasso Expressway. Access to and from the site will be gained via the service road. The Owasso Technical Advisory Committee reviewed the site plan at their December 27, 2006 meeting and had the following comments: 1. The applicant must coordinate fire hydrant locations with the fire marshal. 2. Applicant must shield all wall packs on the building. The applicant is requesting this review to facilitate a 2,949 sq. ft. addition, located at the 9222 North Garnett Road. The subject property is zoned AG (Agriculture) however the property is planned for commercial use. A church facility is allowed by right on property zoned AG. The Owasso Technical Advisory Committee reviewed the site plan on December 27, 2006 and had the following comments: 1. The applicant must indicate the amount of additional impervious area. Chairperson Vice Chairperson Date MEMORANDUM TO: PLANNING COMMISSION CITY OF OWASSO FROM: CHIP MCCULLEY CITY PLANNER SUBJECT: ANNEXATION — (OA- 07 -01) DATE: February 2, 2007 BACKGROUND The City of Owasso has received request to review the annexation of approximately 0.33 acres, located north of East 86a` Street North, just east of the Owasso High School. This annexation will be accompanied by a lot tie, combining this small acreage with that of the Owasso High School for the construction of a new Vo -Ag facility. EXISTING LAND USE Owasso FFA Site SURROUNDING LAND USE North: Owasso High School Campus South: East 86u Street North East: Owasso High School Campus West: Owasso High School Campus (Agriculture) Tulsa County DEVELOPMENT PROCESS: The first step in the development of apiece of property in Owasso is annexation. Annexation is the method whereby land located outside the City limits is made a part of the City. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police and fire protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. The third step in the development of a piece of property in Owasso is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. ANNEXATION REVIEW PROCESS The annexation process is initiated when a property owner submits a petition to the City of Owasso requesting that the City bring the property into the City limits. The applicant must submit as part of the request a signed petition requesting the annexation, an accurate legal description and map of the property being requested for annexation and a certified 300' radius report so that staff may send legal notices to surrounding property owners. Upon receipt of all appropriate materials the staff initiates the review process which begins with. a thorough analysis of the request. The annexation request is then presented to the Owasso Annexation Committee for review and recommendation. The Annexation Committee is made up of staff, elected officials and citizens. The Committee reviews the petition for compliance with the Annexation Policy and establishes a recommendation to the Owasso Planning Commission. The Owasso Planning Commission holds a public hearing to determine if the property is compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso City Council. The Owasso City Council will make the final determination to annex the property or refuse annexation. If the property is annexed into the City limits an ordinance officially declaring the annexation is written and adopted by the City Council. Once adopted the ordinance is circulated to appropriate regional and national agencies for recording and altering maps. ANALYSIS The applicant is requesting to annex approximately 0.33 acres, located north of East 86`i Street North, just east of the Owasso High School. It is the applicant's intent to combine this small acreage with that of the Owasso High School campus for the construction of a new Vo -Ag facility with the city limits of Owasso. If the property is annexed into the City the applicant will be required to follow normal development procedures which would include site plan review of the proposed facility. If annexed, any development proposed for the property would be required to meet the Owasso Zoning Code and the Owasso Subdivision Regulations and any appropriate site engineering standards as proscribed by Public Works including but not limited to paved streets and sidewalks. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. ANNEXATION COMMITTEE: The Owasso Annexation Committee reviewed the request at its meeting on January 24, 2007. At that meeting, the committee unanimously recommended approval of the annexation. EXISTING LAND USE The majority of the property is yet undeveloped. The subject property. is located 0.3 miles: northwest of the intersection of E. 96th St. N. and N. 129th E. Ave.; immediately north of the Owasso Market. Sherrill Acres (large lot residential) occupies the property to the north and is zoned RE while the Owasso Market shopping center resides to the south and is zoned CS. Bailey Ranch Estates (single family residential) is located immediately west and zoned RS -3 and the property to the east are planned for office use and zoned CS and OL. PRESENT ZONING OPUD 04 -03 (The Owasso Medical Campus Planned Unit Development) CONCEPT OF A PUD: The concept of a Planned Unit Development is to provide a creative alternative to conventional development where a particular tract is under common ownership or control and where a detailed development plan, outlining the development of the tract as a unit is proposed and submitted for public review. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete and coordinated plan of development for a larger parcel, rather than piecemeal individual changes using the variance process. The supplemental zoning district PUD must be approved by the City Council as a prerequisite to the Planned Unit Development. Ordinance No. 808, adopted in February, 2005 requires all new multi - family developments be included within a Planned Unit Development. ANALYSIS: The Owasso Medical Campus development is comprised of 66.42 acres located approximately 675 feet west of North 129" East Avenue and northwest of the intersection of US Highway 169 and North 129"' East Avenue. The project lies south of Sherrill Acres and east of Bailey Ranch Estates II. The project site is currently platted as Owasso Medical Campus (approved August 17, 2004) and is presently zoned OM (Office Medium Intensity District). This amendment to the original Owasso Medical Center PUD -04 -03 is to allow for a small portion of the site for commercial shopping uses. None of the newely proposed commercial property would be closer than 250' from the residential property lines of Bailey Ranch Estates II. Other than the allocation of commercial uses, this amendment does not deviate from the original PUD in that the Owasso Medical Campus is still proposed as a multi -use medical campus. The proposed uses for the remainder of the undeveloped portions of the PUD are medical and general office buildings, a retirement village and commercial uses. The retirement village will offer a number of potential uses, including but not limited to independent living residences, as living residences, rehabilitation facilities, continuing care facilities and skilled nursing facilities. Based on the needs and lifestyles of the individual residents, this area will also include one or more of the following types of residences: multi - family, single family, and /or duplex home sites. Most of the structures in the development will be low rise in nature, generally 1 to 2 stories in height. With a medical campus theme for the Owasso Medical Campus PUD, open space and associated landscaping will be an important component in the development of this project. The existing pond, located in Tract E, the Senior Living/Office portion of the project, has been improved and is being utilized to provide storm water detention and an aesthetic enhancement to the site. A 50 foot Building Line and 30' Landscape Buffer is located along the north and west property lines. While vehicular access and parking will be allowed within portions of this buffer area, the 50 foot Building Line and 30' Landscape Buffer will allow for a logical and aesthetically pleasing transition from the residential areas to the north and west to the project site. An interconnecting sidewalk and trail system will allow easy access to all areas of the development. The development still proposes two tie -ins to Bailey Ranch Estates subdivision to the west. Both proposed streets are connecting to establish street stubs in the residential subdivision. E. 100"' St. N. in the northwest comer of the PUD is a neighborhood collector street in Bailey Ranch Estates designed to accommodate thru traffic. It could be utilized as a direct route from points in northwestern Owasso to the hospital development in the event of an emergency. Therefore this access will be remained closed to through traffic, with the use of crash gates. It would only be used in the event of an emergency. N. 118"' E. Ave. in the western portion of the PUD is a local subdivision street through Bailey Ranch Estates. Staff views this connection as a local ingress /egress to the neighborhood. The street pattern within Bailey Ranch Estates would discourage additional thru traffic. The connection would allow local residents an additional option to accessing commercial development to the south. Pedestrian traffic is likely to be in demand between the PUD and surrounding uses and within the PUD. Sidewalks and crosswalks will be required along all public roadways developed as a part of this PUD. In analyzing the request, the staff has worked with the applicant to separate the areas of future commercial use from the existing Bailey Ranch Estates subdivision. It remains our view that office use and senior living use would be appropriate buffers from the residential area to the west and future commercial uses to the east. The applicant and their engineer, Tulsa Engineering and Planning, conducted a neighborhood meeting on the evening of January 31 at the St. John Owasso Medical Office Building to inform nearby residents of the proposal. Two households were represented, and the engineer reports that one of the households, whose residents live in a house bordering the property, appeared to be mildly opposed to the plan. According to the Owasso Zoning Code, the Planning Commission shall hold a public hearing on any PUD application and determine the following: 1. Whether the PUD is consistent with the Comprehensive Plan. 2. Whether the PUD is in harmony with the existing and expected development of surrounding areas. 3. Whether the PUD is a unified treatment of the development possibilities of the project site. 4. Whether the PUD is consistent with the stated purpose and standards of the PUD ordinance. . a. To permit innovative land development while maintaining appropriate limitation on the character and intensity of use assuring compatibility with adjoining and proximate properties; b. To permit flexibility within the development to best utilize the unique physical features of the particular site; c. To provide and preserve meaningful open space; and d. To achieve a continuity of function and design within the development. FUTURE PLANNING ISSUES: Future planning issues must still be considered if the PUD is approved. If approved, the applicant must submit a plat, site plan, and infrastructure plans that must be approved by the City of Owasso. Sidewalks will be required along all public rights -of -way associated with the subject property. Perimeter sidewalks must be installed at the time of overall development, while the internal walks may be constructed as individual lots are developed. The applicant has identified the terrain of the area as relatively flat terrain. The existing soils on the site would appear to create no unusual development problems that are not typically encountered in development in and around the City of Owasso. The staff published legal notice of the PUD request in the Owasso Reporter and mailed notices to property owners within a 300' radius of the subject property and has had a handful of inquiries to date, mostly from citizens wanting clarification about what the request means. LOT TIE REVIEW PROCESS The Lot tie review process is initiated when a property owner submits an application to the City of Owasso requesting the review and approval of a lot tie. Upon receipt of a complete application, the staff reviews the proposal for compliance with the Owasso Zoning Code, Subdivision Regulations and Engineering specifications. The proposed Lot Tie is then presented to the Owasso Technical Advisory Committee (TAC) for review and recommendation. At that meeting, utility providers and City staff are afforded the opportunity to comment on the technical aspects of the development proposal. The TAC then forwards a recommendation to the Planning Commission. The Owasso Planning Commission conducts a public hearing to determine if the application is compliant with the Owasso Zoning Code, Subdivision Regulations, and Engineering criteria. The Planning Commission has the final determination on the application. ANALYSIS: As stated above, the request is for the approval of a lot tie of two tracts of property. The applicant is proposing the combination of a 0.33 acre tract to that of the larger acreage of the Owasso Nigh School Campus, allowing for the construction of a new Vo -Ag Building as apart of the Owasso High School Improvements. The applicant will be required to submit a site plan as well as a building permit to the City of Owasso prior to construction. EXISTING LAND USE Undeveloped SURROUNDING LAND USE North: Jack of Clubs bar South: Car Wash and used car sales East: Brookfield Crossing subdivision West: Country Estates subdivision PRESENT ZONING CS (Commercial Shopping District) DEVELOPMENT PROCESS: The four primary steps in the development of commercial property in Owasso include annexation, zoning, platting, and site planning. The third step in the development of property is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. After obtaining approval from the TAC and Planning Commission, the final plat is considered by the City Council. If approved, the final plat is filed with the office of the County Clerk and governs all future development on that property. ANALYSIS: The applicant is requesting this review in order to facilitate 5 commercial lots, on approximately 7.40 acres of property. The Final Plat meets all Owasso Zoning Code Bulk and Area requirements. The lot and block specifications established in the plat layout are adequate for commercial development. This item was tabled at the December Planning Commission, and was sent back to the Owasso Technical Review Committee for review. The two main concerns for further review were Washington County Rural Water District water line locations, and the addition of a 50' building line along Garnett Road. The applicant has since revised the plat and addressed those concerns. The applicant has met with the rural water districts board of directors and is aware of the districts blanket easement throughout the property, and is in the process of relocating a 2" water line and the 50' building line is now shown on the final plat. Whenever any subdivision of land is proposed, before any permit for the erection of a structure in such proposed subdivision shall be granted, the owner of the land or his agent shall apply for and secure both Planning Commission and City Council approval of a final plat for such proposed subdivision. The Final Plat review process gives the citizens of Owasso the opportunity to actively participate in the physical development'and layout of the city. TECHNICAL ADVISORY COMMITTEE: The Owasso Technical Advisory Committee reviewed the final plat at the January 24, 2007 regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity to comment on the plat and request any additions and /or concerns. The following TAC recommendations were addressed: • Water line plans need to be submitted to Public Works • Indicate a 20' utility easement on the south side of the property • Additional easement language is needed in the covenants for utility providers • The plat is subject to a $16 an acre storm siren fee Infrastructure plans that govern drainage, detention, streets, erosion control, water, and wastewater will be reviewed concurrently by the City Engineer's office. The subject property is now at the site planning stage of development. Site plans are reviewed by the TAC and Planning Commission. Issues such as building setbacks, parking, detention, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. SITE PLAN REVIEW PROCESS The Site Plan review process is initiated when a developer or builder of a particular project submits an application for a site plan review to the City of Owasso. Once the final site plan is received and reviewed for compliance with the conditions of approval, the applicant may proceed with the development process. ANALYSIS The applicant is requesting this review in order to facilitate a 10,101 sq. ft. restaurant on 2.35 acres. The subject property is zoned CS (Shopping Center District). According to the City of Owasso Zoning Code, uses allowed in CS districts include offices, studios, restaurants, convenience stores, shopping centers, service stations, etc. The proposed development is consistent with the Owasso 2015 Land Use Master Plan as it calls for Commercial zoning in the area. It is also complimentary with the current development in the area. The Cracker Barrel site plan meets all Owasso Zoning Code and Subdivision regulations with the exception of the requirements stated as part of the Technical Advisory Committee recommendations. As apart of the TAC requirements the Owasso Fire Department is requiring that the Mutual Access Drive to the east of the property be completed prior to the issuance of any occupancy permit. This requirement is a public safety concern of the Fire Marshal, as two points of entry to the site are needed for emergency access. The bulk and area specifications for this site are more than adequate for the placement and accommodation of concurrent requirements imposed on commercial facility's such as that proposed in this site plan. It will be provided water and sewer services by the City of Owasso. The development must adhere to the City of Owasso's outdoor lighting, landscaping, and sign codes. Storm water calculations must be submitted to the city engineer and approved before the issuance of a building permit. TECHNICAL ADVISORY COMMITTEE The Owasso Technical Advisory Committee reviewed the final plat at the January 24, 2007 regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity to comment on the plat and request any additions and/or concerns.
