CALL TO ORDER — Duane Coppick called the meeting to order at 6:20 PM and declared a quorum present. 2. ROLL CALL 3.. CONSIDER APPROVAL OF THE MINUTES OF JANUARY 8, 2007 REGULAR MEETING - The Commission reviewed the minutes of,January 8, 2007 regular Meeting. Duane Coppick moved to approve the minutes, Dan Draper seconded the motion. A vote on the motion was recorded as follows: Duane Coppick - Yes David Vines - Yes Dan Draper - Yes The motion was approved 3 -0. 4. Annexation OA 07 -01 - A request to review and approve the annexation of approximately .33 acres, located north of East 86`h Street North, just east of the Owasso High School. This annexation will be accompanied by a lot tie, combining this small acreage with that of the Owasso High School for the construction of a new Vo -Ag facility. Duane Coppick presented the item and the staff report was reviewed. The development process was described. The applicant is requesting to annex approximately 0.33 acres to combine this small acreage with the Owasso High School campus for the construction of a new Vo -Ag facility. Letters were mailed to surrounding property owners and legal advertisement was published in the Owasso Reporter. The Annexation Committee reviewed the request on January 24, 2007 and recommended approval of the annexation. Dan Draper moved to approve the annexation; the motion was seconded by David Vines. OPUD Amendment 04 -03 Owasso Medical Campus- A request to review and approve an amendment to a proposed 66.42 acre mixed use Planned Unit Development at the northwest corner of North 1291h East Avenue and the Owasso Expressway, just north of the Owasso Market. Duane Coppick presented the item and the staff report was reviewed. The amendment to the original Owasso Medical Campus PUD is to allow for a small portion of the site for commercial shopping uses. None of the newly proposed commercial property would be closer than 250' from the residential property lines of Bailey Ranch Estates II. Most of the structures in the development will be low rise in nature, generally 1 to 2 stories in height. The applicant and their engineer conducted a neighborhood meeting to inform nearby residents of the proposal. Two households were present. The staff published legal notice of the request in the Owasso Reporter and mailed notices to property owners within a 300' radius. The staff recommends approval of the amendment. Mr. Michael Garrett with Four Points Development made 'a brief presentation. He discussed the existing surrounding land use along with the proposed land use. Mr. Jerry Ledford with Tulsa Engineer and Planning explained the possible land use for Tract H. Mr. Willis Roberts (9911 North 120 East Avenue) desired clarification that Tract I would remain senior living /office use with no commercial zoning. Duane Coppick moved to approve the amendment as stated. Tracts A, B, D and G shall be governed by the use of OM (Office Medium) and CS (Commercial Shopping) District. The use of CS (Commercial Shopping) shall be added to Tract H. The motion was seconded by Dan Draper. Lot Tie - Owasso School District - A request to review and approve a lot tie of two lots. The applicant is proposing the combination of two tracts of property allowing for the construction of a new Vo -Ag Building, located north of East 860' Street North, just east of the Owasso High School. Duane Coppick presented the item and the staff report was reviewed. The surrounding land use and the development process were described. The applicant will be required to submit a site plan as well as a building permit. The request was reviewed by the Technical Advisory Committee and was approved without condition. Preliminary Plat — Ginger Glen — A request to review and approve a preliminary plat proposing 99 residential lots, on approximately 23.84 acres of property zoned OPUD 04 -04 (Residential Single Family), located on the east side of Garnett Road 1/2 mile north of East 106" Street North. Duane Coppick presented the item and the staff report was reviewed. The development process was described. The applicant is requesting this review in order to facilitate 99 residential lots, on approximately 23.84 acres. The plat consists of an average lot size of 5,800 sq. ft. and contains a 3.49 acre reserve of green space and water detention. The request was reviewed at the regularly scheduled Technical Advisory Committee meeting on January 24, 2007 and had the following recommendations: • Indicate perimeter sidewalk adjacent to Garnett Rd. • Indicate fire hydrant locations • Label the 20' utility easement at the entrance off Garnett Rd • Coordinate with Cox regarding additional easements Discussion was held regarding the proposed plans for the detention facility. Duane Coppick moved to approve the Preliminary Plat for Ginger Glen subject to the above TAC and Staff recommendations. Also subject to, the city engineers monitoring the detention as the phases are built. The motion was seconded by Dan Draper. Final Plat — Kevs Landin - A request to review and approve a final plat proposing 139 residential lots, on approximately 39.06 acres, located on the west side of North 129 " East Avenue, approximately ' /2mile north of East 66'h Street North, just south of the Baptist Retirement Village. OWASSO PLANNING COMMISSION February 12, 2007 Page No. 4 Duane Coppick presented the item and the staff report was reviewed. The development process was explained. The applicant is requesting this review in order to facilitate 139 residential lots, on approximately 39.06 acres of property zoned RS -3 (Residential Single- Family). This item was tabled at the December Planning Commission, and was sent back to the Owasso Technical Committee for review. The two main concerns were a second access to the first phase of development for emergency accessibility and storm water detention. A temporary second access has been provided to the south of the property and detention for both phases has been provided. The request was reviewed at the regularly scheduled Technical Advisory Committee meeting on January 24, 2007. At that meeting, the committee recommended approval of the site plan with the following recommendations: • Indicate perimeter sidewalk adjacent to N. 1291h E. Ave. • Storm siren fee of $624.00 as well as $61,620.00 sanitary sewer payback are due at filing • Include in language in covenants that prohibits additional fill on Lots 1 — 10, Block 4 without a permit from the City of Owasso. Duane Coppick moved to approve the Final Plat subject to the above TAC and Staff recommendations. Also subject to, the city engineers monitoring the detention as the phases are built. Final Plat — Wedel Centre — A request to review and approve a final plat proposing 5 commercial lots in 1 block, on approximately 7.40 acres, located east of North Garnett Road just north of East 116°i Street North. Duane Coppick presented the item and the staff report was reviewed. The development process was explained. The applicant is requesting this review to facilitate a commercial development. The property is zoned CS (Commercial Shopping). This item was tabled at the December Planning Commission and sent back to the Technical Review Committee for review. The two concerns were Washington County Rural Water District water line locations, and the addition of a 50' building line along Garnett Road. The plat has been revised. The request was reviewed at the regularly scheduled Technical Advisory Committee meeting on January 24, 2007. At that meeting, the committee recommended approval of the final plat with the following recommendations: • Water line plans need to be submitted to Public Works • Indicate a 20' utility easement on the south side of the property OWASSO PLANNING COMNIISSION February 12, 2007 Page No. 5 • Additional easement language is needed in the covenants for utility providers • The plat is subject to a $16 an acre storm siren fee Detention facilities for the development were discussed. Joe Nurre with the City Engineer' s office explained that the owner of this property does not want to create a portion of the subdivision as detention. The development will have parking lot detention; detention will be placed in a drainage easement area so that the structures remain with that property. Duane Coppick moved to approve the final plat subject to the above TAC and Staff recommendations; the motion was seconded by David Vines. Site Plan — Cracker Barrel — A request to review and approve a site plan proposing a 10,101 sq. ft. commercial facility, located on the southeast of East 96`h Street North and the Owasso Expressway, just north of the Tyann Plaza Shopping Center. Duane Coppick presented the item and the staff report was reviewed. The development process was explained. The applicant is requesting this review to facilitate a 10,101 sq. ft. commercial development. The property is zoned CS (Commercial Shopping). The proposed site plan is situated on a highly visible and accessible segment of the Owasso Expressway. The development must adhere to the City of Owasso's outdoor lighting, landscaping and sign codes. The Owasso Technical Advisory Committee reviewed the site plan at their January 24, 2007 meeting and had the following comments: • East drive must be complete prior to restaurant opening • Coordinate with the Fire Marshal for an additional hydrant Mr. Kevin Kerbo with Cracker Barrel made a brief presentation. He stated that he would love to have approval of this site plan and is looking forward to coming to Owasso. Duane Coppick moved to approve the site plan for Cracker Barrel subject to the above TAC and Staff recommendations; the motion was seconded by Dan Draper. Site Plan - Forrest Creek Office II - A request to review and approve a site plan proposing a 9,650 sq ft. commercial facility, located on Lot 12, Block 1 of Forrest Creek Business Park, west of the service road just north of the Arizona restaurant. Duane Coppick presented the item and the staff report was reviewed. The development process was explained. The applicant is requesting this review to facilitate a 9,650 sq ft building on one 0.68 acres tract. The property is zoned CG (Commercial General). The development must adhere to the City of Owasso's outdoor lighting, landscaping and sign codes. The Owasso Technical Advisory Committee reviewed the site plan on January 24, 2007 and had the following comments: • Indicate a fire hydrant at the southeast corner. Drainage issues were discussed. Also discussed was the possibility of a unified sign permit in order to accommodate all of the businesses in this development. Dan Draper moved to approve the site plan for Forrest Creek Office II subject to the above TAC and Staff recommendations; the motion was seconded by David Vines. Site Plan - Owasso High School - A request to review and approve a site plan proposing a 299,334 sq. ft. educational addition to the existing Owasso High School, located at the northeast corner of East 86"' Street North and North 129 " East Avenue. Duane Coppick presented the item and the staff report was reviewed. The development process was explained. The applicant is requesting this review to facilitate an 117,027 sq. ft. educational addition on 70.82 acres, currently occupied by the High School and the 8 "' Grade Center. The addition will bring the total square footage of the High School to 299,334, with a lot coverage increase of 3.80 %. The Owasso Technical Advisory Committee reviewed the site plan on January 24, 2007 and had the following comments: • Storm water calculations must be approved by the City Engineer. Mr. Danny Baldwin with Wallace Engineering was present to address any questions or concerns. He stated that there might be a few changes made to the plans; possibly an OWASSO PLANNING COMMISSION February 12, 2007 Page No. 7 additional access point along East 86`h Street North. Duane Coppick moved to approve the site plan for the Owasso High School subject to the above TAC and Staff recommendations. Also subject to, coordinating all access and entrance points with city staff and with the review and approval of the city engineering department. The motion was seconded by David Vines. EXISTING LAND USE Large Lot Residential SURROUNDING LAND USE North: Large Lot Residential South: Developing as Nottingham Hills East: Large Lot Residential West: Developing as Nottingham Hills PRESENT ZONING (Agriculture) Tulsa County DEVELOPMENT PROCESS: The first step in the development of a piece of property in Owasso is annexation. Annexation is the method whereby land located outside the City limits is made a part of the City. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police and fire protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. The third step in the development of a piece of property in Owasso is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. ANNEXATION REVIEW PROCESS The annexation process is initiated when a property owner submits a petition to the City of Owasso requesting that the City bring the property into the City limits. The applicant must submit as part of the request a signed petition requesting the annexation, an accurate legal description and map of the property being requested for annexation and a certified 300' radius report so that staff may send legal notices to surrounding property owners. Upon receipt of all appropriate materials the staff initiates the review process which begins with a thorough analysis of the request. The annexation request is then presented to the Owasso Annexation Committee for review and recommendation. The Annexation Committee is made up of staff, elected officials and citizens. The Committee reviews the petition for compliance with the Annexation Policy and establishes a recommendation to the Owasso Planning Commission. The Owasso Planning Commission holds a public hearing to determine if the property is compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso City Council. The Owasso City Council will make the final determination to annex the property or refuse annexation. If the property is annexed into the City limits an ordinance officially declaring the annexation is written and adopted by the City Council. Once adopted the ordinance is circulated to appropriate regional and national agencies for recording and altering maps. ANALYSIS The applicant is requesting to annex approximately 1.0 acre, located on the south side of East 96b Street North, '/4 west of North 145' East Avenue. During the review of the Preliminary Plat for Nottingham Hills it was noticed that a very small portion on of the plat was located outside the city limits of the City of Owasso. By annexing this small 1.0 acre tract, the preliminary plat proposing 58 lots in a gated residential community, on approximately 28 acres of property will be allowed to move forward in the development process. However if approved, the one acre tract will still have to go though the rezoning process and meet the Owasso Subdivision Regulations and any appropriate site engineering standards as proscribed by Public Works. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. ANNEXATION COMMITTEE: The Owasso Annexation Committee reviewed the request at its meeting on February 28, 2007. At that meeting, the committee unanimously recommended approval of the annexation. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. After the preliminary plat has been reviewed by the City and various utility companies, construction plans for the development's infrastructure are typically submitted. These plans include specifications and drawings for stormwater drainage, streets and grading and erosion control, waterlines, stormwater detention, and wastewater lines. Often, approval is required of other agencies, such as the Department of Environmental Quality for wastewater collection and the US Army Corps of Engineers for properties that may be development sensitive. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. After obtaining approval from the TAC and Planning Commission, the final plat is considered by the City Council. If approved, the final plat is filed with the office of the County Clerk and governs all future development on that property. The fourth step in the development of a piece of property in Owasso is the site plan. Site plans are reviewed by the TAC and Planning Commission. Issues such as building setbacks, parking, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. ANALYSIS The City of Owasso has received a request to review and approve the rezoning of approximately 18.7 acres from (AG) Agriculture to (RS -3) Residential Single- Family. In June of 2005 the City of Owasso approved OPUD 05 -01 (Crown Colony II) a proposed planned unit development (PUD) comprised of 166.28 acres. The development concept behind the Crown Colony II PUD is residential single family with an underlying zoning of RS -3 (Residential) containing a maximum of 500 dwelling units. It is the applicant's intent to develop the property as a part of Crown Colony II. The request is consistent with the Owasso Land Use Master Plan as it calls for residential development in the area. Letters were mailed to surrounding property owners and the legal advertisement was published in the Owasso Reporter. To date, the staff has not received any comments from citizens concerning this rezoning request. RECOMMENDATION Staff recommends approval of OZ 07 -01. ATTACHMENTS: 1. The third step in the development of property is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. After obtaining approval from the TAC and Planning Commission, the final plat is considered by the City Council. If approved, the final plat is filed with the office of the County Clerk and governs all future development on that property. ANALYSIS: The applicant is requesting this review in order to facilitate 94 residential lots, on approximately 27.88 acres. The proposed development is part of the Preston Lakes Planed Unit Development that was approved in August of 1998. The approved planned unit development called for a maximum of 172 dwelling units, allowing 5.53 dwelling units per acre total density. The proposed preliminary plat consists of 94 proposed lots with a total of 3.37 dwelling units,per acre total density. Whenever any subdivision of land is proposed, before any permit for the erection of a structure in such proposed subdivision shall be granted, the owner of the land or his agent shall apply for and secure both Planning Commission and City Council approval of a final plat for such proposed subdivision. The Final Plat review process gives the citizens of Owasso the opportunity to actively participate in the physical development and layout of the city. The development will be served by City of Owasso sewer and water. The development will be subject to a $1,580 an acre sewer payback fee and $16 dollar an acre storm siren fee due when the final plat is filed. The Preliminary Plat meets Owasso Zoning Code Bulk and Area requirements. Detention for the development is provided to the west as part Preston Lakes development. The lot and block specifications established in the plat layout are adequate for;the development of single family homes. The proposed development will have pedestrian access to Centennial Park located to the Northwest of the subdivision. TECHNICAL ADVISORY COMNHTTEE The Owasso Technical Advisory Committee reviewed the preliminary plat at the February 28, 2007 regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity to comment on the plat and request any additions and/or concerns. At the meeting the committee recommended approval of the plat subject to the conditions below: • Applicant needs to identify pond (on the west side) as a pond • Applicant needs to correct the closure of the legal description • Show proposed fire hydrant locations • Possibly show another access into park area • $44,050.40 sewer payback fee due at final plat • $446.80 storm siren fee due at final plat These modifications will appear in the final plat for the development. Infrastructure plans that govern drainage, detention, streets, erosion control, water, and wastewater will be reviewed concurrently by the City Engineer's office. The addition will bring the total square footage of the development to 38,144 sq. ft., with an increase of impervious area of 2,101.75 sq. ft. No new parking spaces are required as the existing facility has provided 97 spaces, 48 spaces are required for a building of this size and nature. Storm water detention is provided in the existing detention area. The proposed development is consistent with the Owasso 2015 Land Use Master Plan, it is also complimentary with the current development in the area.
