CALL TO ORDER - Dan Draper called the meeting to order at 6:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF FEBRUARY 12, 2007 REGULAR MEETING - The Commission reviewed the minutes of February 12, 2007 regular Meeting. David Vines moved to approve the minutes, Dan Draper seconded the motion. A vote on the motion was recorded as follows: Marilyn Hinkle - Yes David Vines - Yes Kevin Vanover - Recuse Dan Draper - Yes The motion was approved 3 -0. 4. Annexation OA -07 -02 A request to review and approve the annexation of approximately 1.0 acre, located on the south side of East 96' Street North 1 /4nile west of North 145" East Avenue. Dan Draper presented the item and the staff report was reviewed. The development process and the annexation review process were described. During the review of the preliminary plat for Nottingham Hills it was noticed that a small portion of the plat was not within the city limits. The preliminary plat proposes 58 lots in a gated residential community. Letters were mailed to surrounding property owners and legal advertisement was published in the Owasso Reporter. The Owasso Annexation Committee reviewed the request at its meeting on February 28, 2007. The committee recommended approval. The staff recommends approval of the annexation of OA 07- 02. Marilyn Hinkle moved to approve the annexation. The motion was seconded by Dan Draper. Rezoning OZ- 07 -01- A request to review and approve the rezoning approximately 18.7 acres from AG (Agriculture) to RS -3 (Residential Single Family), located on the south side of East 76'h Street North at approximately North 138'h East Avenue, just east of Crown Colony Estates. Dan Draper presented the item and the staff report was reviewed. A request was received to review and approve the rezoning of 18.7 acres from agriculture to residential single - family. In June of 2005 the City of Owasso approved OPUD 05 -01, a proposed planned unit development comprised of 166.28 acres. It is the applicant's intent to develop the property as a part of Crown Colony II. Letters were mailed to surrounding property owners and the legal advertisement was published in the Owasso Reporter. David Vines moved to approve the rezoning. The motion was seconded by Marilyn Hinkle. A vote on the motion was recorded as follows: Dan Draper - Yes Marilyn Hinkle - Yes David Vines - Yes Kevin Vanover - Yes The motion was approved 4 -0. 6. Preliminary Plat - Preston on the Park - A request to review and approve a preliminary plat proposing 94 residential lots, on approximately 27.88 acres of property zoned OPUD 15 (Residential Single Family), located on the north side of East 86's Street North '1/4nile west of North 161" East Avenue, just east of Centennial Park. Dan Draper presented the item and the staff report was reviewed. The surrounding land use and the development process were described. The applicant is requesting this review in order to facilitate 94 lots, on approximately 27.88 acres of property. The Technical Advisory Committee reviewed the plat at the February 28, 2007 meeting and made the following recommendations: • Applicant needs to identify pond (on the west side) as a pond • Applicant needs to correct the closure of the legal description • Show proposed fire hydrant locations • Possibly show another access into park area OWASSO PLANNING COMMISSION March 12, 2007 Page No. 3 • $44,050.40 sewer payback fee due at final plat • $446.80 storm siren fee due at final plat Discussion was held regarding the consideration of another access into the park area. The applicant stated that they have reviewed that possibility and there is not room for another access. Also discussed was drainage for the entire Preston Lakes subdivision. Joe Nurre explained that Public Works will keep a bookkeeping of all the drainage plans for all of the phases of Preston Lakes. Dan Draper moved to approve the preliminary plat subject to the Staff and TAC recommendations. Also subject to, Public Works monitoring the detention as the phases are built. Site Plan - Precision Components - A request to review and approve a site plan proposing a 2,944 sq. ft. office addition to the existing facility, located at 209 E. 5t' Ave. Dan Draper presented the item and the staff report was reviewed. The development process was described. The addition will bring the total square footage of the development to 38,144 sq. ft. Storm water detention is provided in the existing detention area. The request was reviewed at the regularly scheduled Technical Advisory Committee meeting on February 28, 2007. At that meeting, the committee recommended approval of the site plan without conditions. Kevin Vanover moved to approve the site plan; the motion was seconded by Dan Draper. Site Plan - Owasso Vo -Ae - A request to review and approve a site plan proposing a 9,000 sq. ft. educational facility, located north of East 86`h Street North, just east of the Owasso High School. OWASSO PLANNING COMMISSION March 12, 2007 Page No. 4 Dan Draper presented the item and the staff report was reviewed. The development process was explained. The applicant is requesting this review in order to construct a 9,000 sq. ft. educational facility. The facility will be used as classroom space for the Vo -Ag program. The existing Vo -Ag facility will remain to the west as the FFA barn. The request was reviewed at the regularly scheduled Technical Advisory Committee meeting on February 28, 2007. At that meeting, the committee recommended approval of the site plan without conditions. Kevin Vanover asked to see the overall site plan. Mr. Danny Baldwin with Wallace Engineering was present and handed out an updated site plan that showed all of the surrounding school properties. Kevin Vanover moved to approve the site plan; the motion was seconded by Marilyn Hinkle. Chairperson Vice Chairperson Date MEMORANDUM TO: PLANNING COMMISSION CITY OF OWASSO FROM: CHIP MCCULLEY CITY PLANNER SUBJECT: OZ 07 -02 DATE: April 2, 2007 BACKGROUND The City of Owasso has received a request to review and approve the rezoning of approximately 1.0 acre, from AG (Agriculture) to RS -2 (Residential Single Family), located on the south side of East 96th Sheet North, K mile west of North 145th East Avenue. A general area map has been attached for your review. EXISTING LAND USE Large Lot Residential SURROUNDING LAND USE North: Large Lot Residential South: Developing as Nottingham Hills East: Large Lot Residential West: Developing as Nottingham Hills PRESENT ZONING AG (Agriculture) DEVELOPMENT PROCESS: The first step in the development of a piece of property in Owasso is annexation. Annexation is the method whereby land located outside the City limits is made a part of the City. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police and fire protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. Specific development concerns, such as drainage, traffic, water /wastewater services, and stormwater detention are not able to be considered at the zoning stage of the development process. The third step in the development of a piece of property in Owasso is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. After the preliminary plat has been reviewed by the City and various utility companies, construction plans for the development's infrastructure are typically submitted. These plans include specifications and drawings for stormwater drainage, streets and grading and erosion control, waterlines, stormwater detention, and wastewater lines. Often, approval is required of other agencies, such as the Department of Environmental Quality for wastewater collection and the US Army Corps of Engineers for properties that may be development sensitive. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. After obtaining approval from the TAC and Planning Commission, the final plat is considered by the City Council. If approved, the final plat is filed with the office of the County Clerk and governs all future development on that property. ANALYSIS The applicant is requesting to rezone approximately 1.0 acre from AG (Agriculture) to RS -2 (Residential Single Family), located on the south side of East 9e Street North, '/4 west of North 145th East Avenue. During the review of the Preliminary Plat for Nottingham Hills it was noticed that a very small portion on of the plat was located outside the city limits of the City of Owasso. The small 1.0 acre tract was annexed into the City of Owasso last month, and if the rezoning is approved, the one acre tract will still have to go though the final platting process and meet the Owasso Subdivision Regulations and any appropriate site engineering standards as prescribed by Public Works. This will be the final step for the proposed residential development proposing 58 lots in a gated residential community, on approximately 28 acres. The request is consistent with the Owasso Land Use Master Plan as it calls for residential development in the area. Letters were mailed to surrounding property owners and the legal advertisement was published in the Owasso Reporter. To date, the staff has not received any comments from citizens concerning this rezoning request. RECOMMENDATION Staff intends to recommend approval of OZ 07 -02. ATTACHMENTS: 1. EXISTING LAND USE Undeveloped SURROUNDING LAND USE North: St. John Owasso South: Owasso market East: Undeveloped/Cambridge Park Development West: Undeveloped/Cambridge Park Development PRESENT ZONING CS (Commercial Shopping) DEVELOPMENT PROCESS: The second step in the development of a piece of property in Owasso is land subdivision. Besides land subdividing, the other steps in the development process include rezoning, platting, and site planning. One form of property division besides platting is a lot split. Lot splits are minor subdivisions of property into three or fewer tracts, and do not provide for any new public streets. Typically, this is an appropriate option for a land owner who wishes to take large undeveloped parcels of land and divide it into two or three smaller tracts. LOT SPLIT REVIEW PROCESS The Lot Split review process is initiated when a property owner submits an application to the City of Owasso requesting the review and approval of a lot split. Upon receipt of a complete application, the staff reviews the proposal for compliance with the Owasso Zoning Code, Subdivision Regulations and Engineering specifications. The proposed Lot Split is then presented to the Owasso Technical Advisory Committee (TAC) for review and recommendation. At that meeting, utility providers and City staff are afforded the opportunity to comment on the technical aspects of the development proposal. The TAC then forwards a recommendation to the Planning Commission. The Owasso Planning Commission conducts a public hearing to determine if the application is compliant with the Owasso Zoning Code, Subdivision Regulations, and Engineering criteria. The Planning Commission has the final determination on the application. ANALYSIS: As stated above, the request is for the approval of lot split of 12.43 acres located west of North 129th East Avenue, just north of the Owasso Market. Two lots are proposed: 1 lot is to be 11.54 acres in size (St. John Owasso), and the other lot is to be 0.89 acres. It is the applicant's intent to develop the 0.89 acre site for commercial purposes as approved in the minor amendment to the PUD approved in February of 2007. The site will still have to go though the platting, and site plan review process and meet the Owasso Subdivision Regulations and any appropriate site engineering standards as proscribed by Community Development and Public Works. A lot split is a minor subdivision of previously subdivided land. The Planning Commission may approve a lot split that creates not more than three (3) lots, not in conflict with any provision or portion of the Comprehensive Plan, Major Street and Highway Plan, Zoning Ordinance (unless approved by the Board of Adjustment) or these regulations. TECHNICAL ADVISORY COMMITTEE: The request was reviewed at the regularly scheduled Technical Advisory Committee meeting on March 28, 2007. ANALYSIS: The applicant is requesting this review in order to facilitate 11 commercial lots, on approximately 29.66 acres of property zoned CS (Commercial Shopping) located at the northeast corner of East 96th Street North and North 129th East Avenue. The Preliminary Plat meets all Owasso Zoning Code Bulk and Area requirements. The lot and block specifications established in the plat layout are adequate for commercial development. One concern however is the opportunity the development has to remove the dangerous S -curve in the access road on the west side of the development. This concern was discussed in length at the Owasso Technical Advisory Committee meeting on March 28th with the applicant and the applicants engineer. The staff feels confident that a resolution to the problem can be achieved. The preliminary plat is a working document and can be altered through the process. In a regional context, this proposed addition is in conformance with the Owasso 2015 Land Use Master Plan, as the area is forecasted for commercial development. Already, there is an emerging pattern of commercial uses occurring in the general area. TECHNICAL ADVISORY COMMITTEE: The Owasso Technical Advisory Committee reviewed the preliminary plat at the March 28, 2007 regular meeting.
