CALL TO ORDER - Chairperson Duane Coppick called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF JUNE 13, 2005 REGULAR MEETING - The Commission reviewed the minutes of June 13, 2005 Regular Meeting, Ray Haynes moved, seconded by Marilyn Hinkle to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Kevin Vanover - Yes Marilyn Hinkle - Yes Duane Coppick - Yes Dan Draper - Recuse The motion carried 4 -0. 4. OA 05 -03 - A request from Kellogg Engineering for the annexation of approximately 87 acres located on the southwest corner of E. 96' St. N. and Mingo Rd. Chairperson Duane Coppick presented the item and Chip McCulley gave the staff report. The annexation review process was described. Chip explained that it is our understanding the applicant is requesting the annexation in order to begin a process that will result in the development of residential property. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed. At their June 29, 2005 meeting the Owasso Annexation Committee recommended approval of OA 05 -03. A short discussion was held regarding the intent for the property. Brian Kellogg with Kellogg Engineering stated that there will be a request for RS -2 zoning next month. Marilyn Hinkle moved to approve the annexation request; the motion was seconded by Dan Draper. Easement Closure -Ator Center — A request to review and approve an easement closure of a fifteen foot utility easement located in lots 2 and 3 of Block 9 as shown on the filed plat of Ator Heights Third Addition. The Chairperson presented the item and Chip reviewed the staff report. The applicant is requesting this review in order to take action relating to matters allowing for the closure of a 15' utility easement located in Lots 2 and 3 of Block 9 as shown on the filed plat. As a result of the road improvements along N Garnett Rd, the new configuration of the road has allowed for new 17.5' utility easements along Garnett. Therefore, the old utility easement is no longer needed. The Owasso Technical Advisory Committee reviewed the easement closure and recommended approval without condition. Staff recommends approval. Utility relocations were discussed briefly. Duane Coppick moved to approve the easement closure; the motion was seconded by Kevin Vanover. Preliminary Plat — Lake Valley II & III — A request to review and approve a preliminary plat proposing 364 lots, on approximately 118.44 acres of property zoned RS -3 (Residential Single - Family), located on the northeast corner of E. 1060' St. N. and N. 145' E Ave., directly east of Lake Valley Estates. Chip McCulley presented the staff report and described the location of the property. The development process was discussed. The applicant is requesting the review and approval so that they may plat and develop the property with single family homes. The property is zoned OPUD 01 -03 with underlying zoning of RS -3. The developer proposes to divide the property into 364 lots on 118.44 acres. The Technical Advisory Committee reviewed the preliminary plat at their June 29, 2005 meeting. The following recommendations were addressed: 1. Applicant must indicate a 17.5' utility easement along the frontage of all lots. 2. Applicant must indicate a 20' utility easement where the water main is shown on the plat. OWASSO PLANNING COMMISSION July 11, 2005 Page No. 3 3. Applicant must coordinate fire hydrants. 4. Applicant must indicate a 40' radius at the south entrance on N. 149' E Ave Discussion was held regarding East 110' Street North which will run opposite of the entrance into Ranch Acres Estates to the east. Commissioner Vanover had concerns with the quantity of RS -3 lots and hopes these 364 lots satisfies the need for RS -3 lots. The Commissioners also discussed the ditch that is shown on the eastside of the property. Duane Coppick moved to approve the preliminary plat subject to the above TAC and staff recommendations. Also subject to providing proper drainage if the ditch to the east falls into the boundaries of the plat. Ray Haynes seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Kevin Vanover - Yes Marilyn Hinkle - Yes Duane Coppick - Yes Dan Draper - Yes The motion carried 5 -0. 7. Final Plat - Owasso Industrial Park- A request to review and approve a final plat proposing 1 lot, on approximately 3.89 acres of property zoned IL (Light Industrial), located on the south of E. 5' Ave., approximately � /4mile west of the Mingo Valley Expressway. The Chair introduced the case and Chip McCulley presented the item. The applicant is requesting this review in order to facilitate 1 lot on 1 block on 3.89 acres. The Owasso Technical Advisory Committee reviewed the final plat at the June 29, 2005 regular meeting. The following TAC recommendations were addressed. 1. Applicant must locate adjacent property. 2. Applicant must indicate the building pad elevation of proposed building 3. Applicant must include detention in the deed of dedication. Questions were asked regarding the floodplain. Brian Kellogg with Kellogg Engineering stated that the northwest corner is the only part that will be built on at this time. The procedures for an earth change permit were explained by Joe Nurre of Public Works Department. Duane Coppick moved to approve the final plat for Owasso Industrial Park subject to the above staff and TAC recommendations, Kevin Vanover seconded the motion. Site Plan- Chick -Fil -A — A request to review and approve a site plan proposing a 4,237 sq ft restaurant facility on 0.82 acres of property located on Lot 2, Block 1, Owasso Market II, between Fuddruckers and F & M Bank. The Chair introduced the case and Chip reviewed the staff report. The development process and the surrounding land use were described. The applicant is requesting this review in order to facilitate a 4,237 sq ft restaurant on .89 acres. The property is zoned CS (Shopping Center District). The Owasso Technical Advisory Committee reviewed the final plat at the June 29, 2005 regular meeting. The following recommendations were addressed: 1. Applicant must locate adjacent water line. 2. Applicant must reconfigure lighting to meeting parking requirements. Mr. Ray Parrish, a representative of Chick -Fil -A was present to answer questions. Duane Coppick moved to approve the site plan for Chick -Fil -A subject to the above staff and TAC recommendations, Dan Draper seconded the motion. Site Plan -Three Lakes Office Park — A request to review and approve a site plan proposing a 3700 sq ft addition to a commercial facility on 0.92 acres of property located on Lot 2, Block 1 of Three Lakes Industrial Park also described as 8263 Owasso Expressway Suite A. The Chair introduced the item and Chip presented the staff report. The site plan review process was explained. The applicant is requesting this review in order to facilitate a 3,700 sq ft addition to a commercial facility on 0.92 acres. The Owasso Technical Advisory Committee reviewed the final plat at the June 29, 2005 regular meeting. The following recommendations were made: 1. Applicant must provide the city engineer with impervious area calculations. 2. HEARING DATE: Planning Commission: August 8, 2005 LOCATION The property is located on the northeast corner of E. 106' St. N. and N 129h E. Ave. A general area map has been attached for your review. EXISTING LAND USE Undeveloped / Large Lot Residential SURROUNDING LAND USE North: Agriculture South: Large Lot Residential East: Rejoice Christian School West: Large Lot Residential AG (Agriculture District) — Tulsa County SURROUNDING ZONING North: AG (Agriculture District) — Tulsa County South: AG (Agriculture District) — Tulsa County East: AG (Agriculture District) — Tulsa County West: AG (Agriculture District) —Tulsa County DEVELOPMENT PROCESS: The first step in the development of a piece of property in Owasso is annexation. Annexation is the method whereby land located outside the City limits is made a part of the City. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police and fire protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. When a property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. The third step in the development of a piece of property in Owasso is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. The fourth step in the development of a piece of commercial property in Owasso is the Site Plan. Site plans are reviewed by the TAC and Planning Commission. Issues such as building setbacks, parking, detention, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. ANNEXATION REVIEW PROCESS The annexation process is initiated when a property owner submits a petition to the City of Owasso requesting that the City bring the property into the City limits. The applicant must submit as part of the request a signed petition requesting the annexation, an accurate legal description and map of the property being requested for annexation and a certified 300' radius report so that staff may send legal notices to surrounding property owners. Upon receipt of all appropriate materials the staff initiates the review process which begins with a thorough analysis of the request. The primary consideration is the property's compliance with the Owasso Annexation Policy. The policy establishes a set of guidelines that define which properties are considered for annexation. The annexation request is then presented to the Owasso Annexation Committee for review and recommendation. The Annexation Committee is made up of staff, elected officials and citizens. The Committee reviews the petition for compliance with the Annexation Policy and establishes a recommendation to the Owasso Planning Commission. The Owasso Planning Commission holds a public hearing to determine if the property is compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso City Council. The Owasso City Council will make the final determination to annex the property or refuse annexation. If the property is annexed into the City limits an ordinance officially declaring the annexation is written and adopted by the City Council. Once adopted the ordinance is circulated to appropriate regional and national agencies for recording and altering maps. CONSIDERATIONS OF AN ANNEXATION The following annexation policy for the City of Owasso is provided as a guideline and should not be constructed as inflexible requirements for annexation. 1. While there is no minimum tract size, properties of larger than 20 acres are preferable. 2. All properties should be contiguous to existing City Limits. 3. All properties should be annexed into the City limits as the lowest zoning classification, that is, Agricultural (AG). Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the City will be legal, but non - conforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not meet City standards will not be improved by the City until brought to the City standard and accepted by the City Council. Such public facilities must be improved at owner's expense by the establishment of a special assessment district or some other financing method. 5. Where a City limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistency and allow City employees and citizens to know where the City boundaries are. 6. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. ANALYSIS Staff received a petition from Micheal Loffer, requesting the City to annex approximately 40 acres of property. At this time it is our understanding the applicant is requesting this annexation petition in order to begin a process that will result in the development of commercial property. If the property is annexed into the City the applicant will be required to follow normal development procedures which would include rezoning, preliminary and final plat review, and site plan review. If annexed, any development proposed for the property would be required to meet the Owasso Zoning Code and the Owasso Subdivision Regulations and any appropriate site engineering standards as proscribed by Public Works including but not limited to paved streets and sidewalks. The property would be served water and sewer by the City of Owasso. The Owasso 2015 Land Use Master Plan calls for residential development on the subject property. In regards to the Owasso Annexation Policy the request is larger than 20 acres and contiguous to existing City limits. No public infrastructure or development currently exists on the property; all public improvements will be made by the developer. If annexed, the subject property will acquire an AG (Agricultural District) zoning designation. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. To this date staff has received no phone calls or correspondence in opposition of the request. OWASSO ANNEXATION COMMITTEE At their July 27, 2005 meeting the Owasso Annexation Committee unanimously recommended approval of OA 05 -04. RECOMMENDATION Staff recommends approval of OA 05 -04. The Owasso City Council will make the final determination to annex the property or refuse annexation. If the property is annexed into the City limits an ordinance officially declaring the annexation is written and adopted by the City Council. Once adopted the ordinance is circulated to appropriate regional and national agencies for recording and altering maps. CONSIDERATIONS OF AN ANNEXATION The following annexation policy for the City of Owasso is provided as a guideline and should not be constructed as inflexible requirements for annexation. 1. While there is no minimum tract size, properties of larger than 20 acres are preferable. 2. All properties should be contiguous to existing City Limits. 3. All properties should be annexed into the City limits as the lowest zoning classification, that is, Agricultural (AG). Landowners may then petition for rezoning if they desire further development of their property. All legal uses annexed into the City will be legal, but non- conforming, which means that they may continue but cannot be expanded without proper zoning. 4. All public infrastructures that do not meet City standards will not be improved by the City until brought to the City standard and accepted by the City Council. Such public facilities must be improved at owner's expense by the establishment of a special assessment district or some other financing method. 5. Where a City limit boundary ends at a dedicated street, the boundary will not include the street right -of -way. This policy will establish consistency and allow City employees and citizens to know where the City boundaries are. S. Properties that are rejected for annexation should not be considered for annexation for a six month period after rejection by the City Council. ANALYSIS Staff received a petition from Calvin Swindel, requesting the City to annex approximately 40 acres of property. At this time it is our understanding the applicant is requesting this annexation petition in order to begin a process that will result in the development of residential property. If the property is annexed into the City the applicant will be required to follow normal development procedures which would include rezoning, preliminary and final plat review. If annexed, any development proposed for the property would be required to meet the Owasso Zoning Code and the Owasso Subdivision Regulations and any appropriate site engineering standards as proscribed by Public Works including but not limited to paved streets and sidewalks. The property would be served water by Washington Rural Water District #3 and sewer by the City of Owasso. The Owasso 2015 Land Use Master Plan calls for residential development on the subject property. In regards to the Owasso Annexation Policy the request is larger than 20 acres and contiguous to existing City limits. No public infrastructure or development currently exists on the property; all public improvements will be made by the developer. If annexed, the subject property will acquire an AG (Agricultural District) zoning designation. Staff published legal notice of the annexation petition in the Owasso Reporter and letters of notification were mailed to property owners within a 300' radius. To this date staff has received no phone calls or correspondence in opposition of the request. After annexation, the remaining steps in the development process include rezoning, platting, and site planning. One form of property division in addition to platting is a lot split. Lot splits are minor subdivisions of property into three or fewer tracts, and do not provide for any new public streets. Typically, this is an appropriate option for a land owner who wishes to take large undeveloped parcels of land and divide it into two or three smaller tracts. LOT SPLIT REVIEW PROCESS The Lot Split review process is initiated when a property owner submits an application to the City of Owasso requesting the review and approval of a lot split. Upon receipt of a complete application, the staff reviews the proposal for compliance with the Owasso Zoning Code, Subdivision Regulations and Engineering specifications. The proposed Lot Split is then presented to the Owasso Technical Advisory Committee (PAC) for review and recommendation. At that meeting, utility providers and City staff are afforded the opportunity to comment on the technical aspects of the development proposal. The TAC then forwards a recommendation to the Planning Commission. The Owasso Planning Commission conducts a public hearing to determine if the application is compliant with the Owasso Zoning Code, Subdivision Regulations, and Engineering criteria. The Planning Commission has the final determination on the application. ANALYSIS As stated above, the request is for a Lot Split of Lots 6 and 7, Block 3 of Honey Creek II. During the building process a home was build over the property line of Lot 7. The lot proposed to be split is an undeveloped residential lot to the East, Lot 6. Seven feet of Lot 6 will be attached to the adjacent lot 7. Both lots will still conform to the City of Owasso bulk and area requirements, with an average lot width of 65'. The proposed lot split will not involve any new streets, or the extension of municipal facilities, or the creation of any public improvements, and it will not adversely affect the remainder of the parcel or adjoining property. In addition, the proposed lot split will not be in conflict with any provision or portion of the Comprehensive Plan, Major Street and Highway Plan, Zoning Ordinance or Subdivision Regulations. SURROUNDING LAND USE: North: Undeveloped South: Rejoice Christian School East: Owasso Expressway West: Residential AG (Agriculture District) SURROUNDING ZONING: North: AG (Agriculture District) South: AG (Agriculture District) East: CS (Commercial Shopping) West: RS -3 (Residential Single - Family) DEVELOPMENT PROCESS: The four primary steps in the development of commercial property in Owasso include annexation, zoning, platting, and site planning. The third step in the development of property is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. After obtaining approval from the TAC and Planning Commission, the final plat is considered by the City Council. If approved, the final plat is filed with the office of the County Clerk and governs all future development on that property. ANALYSIS: The applicant is requesting this review in order to facilitate 3 commercial lots, on approximately 14.61 acres of property currently in the process of being rezoned to CS (Commercial Shopping). The Preliminary Plat meets all Owasso Zoning Code Bulk and Area requirements. The lot and block specifications established in the plat layout are adequate for commercial development. In a regional context, this proposed addition is in conformance with the Owasso 2015 Land Use Master Plan, as the area is forecasted for residential development. Already, there is an emerging pattern of relatively dense housing development occurring in the general area. TECHNICAL ADVISORY COMMITTEE: The Owasso Technical Advisory Committee reviewed the final plat at the July 27, 2005 regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity to comment on the plat and request any additions and/or concerns. The following TAC recommendation was addressed: 1. ANALYSIS The applicant is requesting the review and approval of the Lake Valley final plat proposing 110 residential lots, on approximately 36.56 acres of property. The property is zoned OPUD 01 -03 with an underlying zoning designation of RS -3 (Residential Single Family District). The PUD outlines the development standards for the property in a residential manner. The proposed layout for residential uses in the plat is allowed by right according to the zoning designation and is consistent with the approved Planned Unit Development. Whenever any subdivision of land is proposed, before any permit for the erection of a structure in such proposed subdivision shall be granted, the owner of the land or his agent shall apply for and secure both Planning Commission and City Council approval of a final plat for such proposed subdivision. The Final Plat review process gives the citizens of Owasso the opportunity to actively participate in the physical development and layout of the city. The development will be served by City of Owasso sewer and water by Rural Water District No. 3 — Washington County. Utility easements are established throughout the proposed addition so as to adequately accommodate utility services. Regional detention has been effectively addressed with the establishment of a detention facility located in the southern portion of the addition. The Final Plat lies within the Tulsa Technology Center Interceptor Area; therefore the developer is responsible for a payback of $1000 an acre at the time the plat is signed. The Lake Valley Final Plat meets Owasso Zoning Code Bulk and Area requirements. The lot and block specifications established in the plat layout are adequate for the development of single family homes. In a regional contest, this proposed addition is in conformance with the Owasso 2010 Land Use Master Plan, as the area is forecasted for residential development. Already, there is an emerging pattern ofrelatively dense housing development occurring in the general area. TECHNICAL ADVISORY COMMITTEE: The Owasso Technical Advisory Committee reviewed the final plat at the July 27, 2005 regular meeting. At that meeting, utility providers, as well as staff; are afforded the opportunity to comment on the plat and request any additions and/or concerns. The following TAC recommendations were addressed: 1. Applicant must indicate utility easements by Book and Page. 2. Applicant must indicate remove section B of the Water and Sewer Covenants. 3. ANALYSIS: The applicant is requesting this review in order to facilitate a 3,300 sq ft restaurant on 0.87 acres. The subject property is zoned CS (Shopping Center District). According to the City of Owasso Zoning Code, uses allowed in CS districts include offices, studios, restaurants, convenience stores, shopping centers, service stations, etc. The proposed development is consistent with the Owasso 2015 Land Use Master Plan as it calls for Commercial zoning in the area. It is also complimentary with the current development in the area. The Arby's site plan meets all Owasso Zoning Code and Subdivision regulations with the exception of the requirements stated as part of the Technical Advisory Committee recommendations. The bulk and area specifications for this site are more than adequate for the placement and accommodation of concurrent requirements imposed on commercial facility's such as that proposed in this site plan. TECHNICAL ADVISORY COMMITTEE The Owasso Technical Advisory Committee reviewed the final plat at the July 27, 2005 regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity to comment on the plat and request any additions and /or concerns. 1. Applicant must provide city engineer with drainage calculations. 2. Applicant must coordinate fire hydrants with Fire Marshal. 3. Applicant must dimension distance between drive lanes.
