The agenda for the regular meeting was posted at the north entrance to City Hall on September
12, 2005 at 9:00 AM.

and declared a quorum present.

3. CONSIDER APPROVAL OF THE MINUTES OF AUGUST 8, 2005 REGULAR
MEETING - The Commission reviewed the minutes of August 8, 2005 Regular Meeting,
Ray Haynes moved, seconded by Kevin Varover to approve the minutes. A vote on the
motion was recorded as follows:

4. Annexation OA -05 -06 — A request to review and approve the annexation of
approximately 19.50 acres, located on the northeast corner of E. 121 St. N. and Garnett
Road.
Chairperson Duane Coppick presented the item and the staff report was reviewed. The
development and annexation review process was described. The applicant is requesting
approval to annex approximately 19.50 acres. It is our understanding that the applicant is
requesting this annexation petition in order to begin a process that will result in the
development of both commercial and residential property. The Owasso Annexation
Committee reviewed the request at the August 31, 2005 meeting and reconnnended
approval. Staff published legal notice in the Owasso Report and letters of notification
were mailed to property owners within a 300' radius. No phone calls have been
received. The 2015 Land Use Master Plan calls for residential development, therefore, a
request to amend the Master Plan is the next item. Staff recommends approval. Several

nearby property owners were present to express opposition. The following are their
comments:
Mike Henley - 12116 N 113 E Ave - He presented a letter of opposition to the
Commissioners (attached). Does not oppose the annexation, wants it to remain
residential. There is ample commercial property in Owasso.
Jerry Long -11113 E 120 Ct No - Would like the property to remain residential.
Loren Kimes - 12114 N 111 E Ave - Would like the property to remain residential.
Discussion was held concerning tabling this item and also tabling the next item, due to the
absence of the applicant. Commissioner Vanover suggested that we vote on the
annexation request but table the amendment request.
Duane Coppick moved to table this item until the applicant can be present; the motion
was seconded by Ray Haynes. A vote on the motion was recorded as follows:

5. Amendment to Master Plan - A request to revise the 2015 Land Use Master Plan to
allow for Commercial use of the western 4.87 acres of the subject property, located on
the northeast corner of E. 121 St. N. and Garnett Road. Currently the entire 19.50 acre
tract adjacent is planned for residential development.
Chairperson Duane Coppick presented the item and the staff report was reviewed. Staff
received a petition from Mr. & Mrs. Thompson, requesting the revision of the Master
Plan in order to allow Commercial use at the subject property. Staff published legal
notice and letters of notification were mailed to property owners within a 300' radius.
Mr. Mike Henley stated opposition to the amendment.

6. Annexation OA -05 -07 — A request to review and approve the annexation of
approximately 4.875 acres, located on the southeast corner of E. 121 St. N. and Garnett
Rd.
The Chairperson presented the item and the report was reviewed. The development and
annexation review process was described. The applicant is requesting approval for
annexation in order to begin a process that will result in commercial property. The
Owasso Annexation Committee reviewed the request at the August 31, 2005 meeting and
recommended approval. Staff published legal notice in the Owasso Report and letters of
notification were mailed to property owners within a 300' radius. No phone calls have
been received. Staff recommends approval. Mr. Bob Buss was present to answer any
questions. Mr. Buss stated that it is his understanding a retail center is planned at this
location. Mr. Mike Henley expressed opposition.

E. 121 St. N. and Garnett Road. Currently the 4.875 acre tract is planned for residential
development.
The Chairperson presented the item and staff report was reviewed. The location of the
property was described. Staff received a petition from Mr. Bob Buss, requesting the
revision of the Master Plan in order to allow Commercial use at the subject property.
Staff published legal notice and letters of notification were mailed to property owners
within a 300' radius. The Owasso 2010 land use master plan, the previous master plan
for Owasso, designated this property and the property on the north side of 121" St. for
future commercial use. Staff recommends approval. Mr. Larry Allen (12169 No 118 E
Ave) was present to oppose to commercial development. He expressed concerns with
stormwater runoff in the area. The Treasurer of the Assembly of God, Mr. J.B.
Alexander (7612 N 127 E Ave), requested the Commissioners to consider tabling this
item in order to give the church more time to discuss what type of commercial business
should go there.

The Chair introduced the case and staff reviewed the report. The development process
was discussed. Staff published legal notice of the rezoning request in the Owasso
Reporter and letters of notification were mailed to property owners within a 300' radius.
No calls have received from the public in regard to the request. Staff recommends
approval of the rezoning.

The Chair introduced the case and staff reviewed the report. The commercial process
was explained. The request is consistent with the Owasso Land Use Master Plan. Letters
were mailed to surrounding property owners and legal advertisement was published.
Staff recommends approval of the rezoning. Mr. Loffer, the applicant, was present to
address concerns. The possibility of a north side buffer was discussed. Mr. Loffer
explained that he has no definite plans on the type of development for this property.

10. Easement Closure - Arden Wilkinson - A request to review and approve an easement
closure of 70.41 Sq Ft of a 10' utility easement located on the north side of Lot 5 of
Block 11 as shown on the filed plat of the Elm Creek Estates First Addition.
The Chair introduced the item and staff report was reviewed. The easement closure
review process was described. The applicant is requesting this review in order to allow
the closure of 70.41 sq ft of a 10' utility easement. The request was reviewed at the
regularly scheduled Technical Advisory Committee meeting on August 3151. TAC and
staff recommends approval of the easement closure.

11, Preliminary Plat - BMC Medical Office Building One - A request to review and
approve a preliminary plat proposing 1 lot, on approximately 1.15 acres located at the
Bailey Medical Center.
The Chair introduced the item and staff report was reviewed. The applicant is requesting
this review in order to facilitate one lot on approximately 1.15 acres. The subject
property lies in an area planned as part of OPUD 01 -02, The Lakes at Bailey Ranch and
calls for the property to be utilized in a manner consistent with RS -3 zoning. The
applicant has received a special exception from the Board of Adjustment to operate Use
Unit 5 on the property. The Owasso Technical Advisory Committee reviewed the
preliminary plat at the August 31, 2005 regular meeting. The following TAC
recommendation was addressed:
1. PSO and ONG needs standard covenant language included on plat.

12. Final Plat - Garrett Creek Center Phase II - A request to accept a final plat proposing
3 commercial lots, on approximately 46.76 acres of property zoned CS (Commercial
Shopping District), located on the southwest corner of E. 116'h St. N. and the Owasso
Expressway.
The Chair introduced the item and staff reviewed the report. The platting process was
described. The applicant is requesting this review in order to facilitate 3 commercial lots
on approximately 46.76 acres of property zoned CS. The Owasso Technical Advisory
Committee reviewed the preliminary plat at the August 31, 2005 regular meeting. The
following TAC recommendation was addressed:
1. Applicant must indicate the total acreage on the plat.
Detention was discussed briefly. Ms. Nicole Peltier with Deshazo, Tang & Associates
was present to address concerns.
Kevin Vanover moved to approve the final plat subject to the above TAC and Staff
recommendation. Also subject to the following additional recommendations:
• Applicant must show a listing of book & page numbers.
• Applicant must note on the final plat that the Garrett Creek Homeowners
Association is to maintain the detention pond in order to assure proper drainage of
this area.

ft facility on 13.85 acres of property located on Lot 1, Block 1, Garrett Creek Center
Phase II; on the southwest corner of E. 1061h St. N. and the Owasso Expressway.

The Chair introduced the item and the staff report was reviewed. The development
process was described. The applicant is requesting the review and approval of the site
plan in order to facilitate a 102,828 sq ft commercial facility. The Owasso Technical
Advisory Committee reviewed the final plat at the August 31, 2005 regular meeting. The
following TAC recommendations were addressed:
1. Applicant must provide 25' minimum entrance return radius.
2. Applicant must locate the looped water line in the easement.
3. Applicant must provide a 5' sidewalk along N 135'h E Ave.
4. Applicant must adhere to the Owasso sign and outdoor lighting ordinance.
Discussion was held regarding the length of the drive - through area. Also discussed
briefly was proposed detention. Nicole Peltier explained that the detention will be
handled in a pond located at the northeast corner in green space.
Duane Coppick moved to approve the site plan subject to the above TAC and Staff
recommendations. Also subject to the following conditions:
• . Applicant must provide a temporary curb on the southeast property line of the lot.
• Applicant must realign the front drive isle.
Applicant needs to coordinate with the Owasso Fire Department

plan proposing a 7,171 sq ft restaurant facility on 1.79 acres of property located on Lot 1,
Block 1, Tyann III, south of E. W' St., 2 lots west of Oklahoma National Bank.
The Chair introduced the item and the staff report was reviewed. The development
process was described. The property is zoned CS. The applicant is requesting this review
in order to facilitate a 7,171 sq ft restaurant on 1.79 acres. The Owasso Technical
Advisory Committee reviewed the final plat at the August 31, 2005 meeting. The
following TAC recommendations were addressed:
1. Applicant must indicate a 5' sidewalk along the Owasso Expressway prior to
building permit issuance.
2. The applicant must provide the city engineer with storm water calculations.

Staff recommends approval subject to the conditions above. Discussion was held
regarding whether a handrail was planned for the east side of the property. Joe Nurre
stated that he believes there are plans for a handrail at that location. Steve Compton was
present to representing the applicants. There were concerns expressed regarding the
thickness of the parking lot asphalt.
Duane Coppick moved to approve the site plan subject to the above TAC and Staff
recommendations. Also subject to the following conditions:
• Applicant must enlarge easterly curb radius to 25'
• Applicant must move the handicap signs to the north of the sidewalk and provide
bumper blocks.
• Applicant must show lighting details on site plan.

was described. The Owasso Technical Advisory Committee reviewed the site plan at the
August 31, 2005 regular meeting. The following recommendation was made:
1. Applicant must provide additional detail of the proposed retaining wall in the
form of sheet C08 prior to the issuance of the building permit.
Staff recommends approval. A brief discussion was held regarding the required amount
of parking spaces.

BACKGROUND
The City of Owasso has received a request to review and approve the annexation of
approximately 241.74 acres, located on the east side of N. 129th E. Ave. between E 116x` St N.
and E 126th St N.
LOCATION
The property is located on the east side of N. 129th E. Ave. between E 1161s St N. and E 126th St
N. A general area map has been attached for your review.

AG (Agriculture District) — Tulsa County
DEVELOPMENT PROCESS:
The first step in the development of a piece of property in Owasso is annexation. Annexation is
the method whereby land located outside the City limits is made a part of the City. Property
owners and land developers sometimes choose to have their property annexed into Owasso in
order to receive Owasso municipal services, such as police and fire protection, refuse collection,
and sanitary sewer.
The second step in the development of a piece of property in Owasso is rezoning. When a
property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In
order to develop the property, the land must be zoned for particular kinds of uses, such as
residential, office, commercial, or industrial. Rezoning decisions are made in accordance with
the growth policy displayed in the Owasso Master Plan.
The third step in the development of a piece of property in Owasso is platting. A preliminary
plat is required for any development that proposes to divide land into two or more lots.
Preliminary plats illustrate the development concept for the property, and are often modified
significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso
Planning Commission. Sometimes, difficult development issues such as existing utility lines,
wells, or easements are brought to light at the preliminary plat stage and must be remedied prior
to development.
ANNEXATION REVIEW PROCESS
The annexation process is initiated when a property owner submits a petition to the City of
Owasso requesting that the City bring the property into the City limits.
The applicant must submit as part of the request a signed petition requesting the annexation, an
accurate legal description and map of the property being requested for annexation and a certified
300' radius report so that staff may send legal notices to surrounding property owners.
Upon receipt of all appropriate materials the staff initiates the review process which begins with
a thorough analysis of the request. The primary consideration is the property's compliance with
the Owasso Annexation Policy. The policy establishes a set of guidelines that define which
properties are considered for annexation.
The annexation request is then presented to the Owasso Annexation Committee for review and
recommendation. The Annexation Committee is made up of staff, elected officials and citizens.
The Committee reviews the petition for compliance with the Annexation Policy and establishes a
recommendation to the Owasso Planning Commission.
The Owasso Planning Commission holds a public hearing to determine if the property is
compliant with the Owasso Annexation Policy and establishes a recommendation to the Owasso
City Council.
The Owasso City Council will make the final determination to annex the property or refuse
annexation. If the property is annexed into the City limits an ordinance officially declaring the
annexation is written and adopted by the City Council. Once adopted the ordinance is circulated
to appropriate regional and national agencies for recording and altering maps.
CONSIDERATIONS OF AN ANNEXATION
The following annexation policy for the City of Owasso is provided as a guideline and should
not be constructed as inflexible requirements for annexation.
1. While there is no minimum tract size, properties of larger than 20 acres are preferable.
2. All properties should be contiguous to existing City Limits.
3. All properties should be annexed into the City limits as the lowest zoning classification,
that is, Agricultural (AG). Landowners may then petition for rezoning if they desire
r
further development of their property. All legal uses annexed into the City will be legal,
but non - conforming, which means that they may continue but cannot be expanded
without proper zoning.
4. All public infrastructures that do not meet City standards will not be improved by the
City until brought to the City standard and accepted by the City Council. Such public
facilities must be improved at owner's expense by the establishment of a special
assessment district or some other financing method.
5. Where a City limit boundary ends at a dedicated street, the boundary will not include the
street right -of -way. This policy will establish consistency and allow City employees and
citizens to know where the City boundaries are.
6. Properties that are rejected for annexation should not be considered for annexation for a
six month period after rejection by the City Council.
ANALYSIS
Staff received a petition from Owasso Land Trust, requesting the City to annex approximately
241.74 acres of property. At this time it is our understanding the applicant is requesting this
annexation petition in order to begin a process that will result in the development of both
commercial and residential property. The request is consistent with the Owasso 2015 Land Use
Master Plan as it calls for commercial development along the southern border of the property
along E 116Uh St. N., and the Northeast comer of E 126th St N and the Owasso Expressway. The
remaining acreage will develop for Residential purposes.
If the property is annexed into the City the applicant will be required to follow normal
development procedures which would include rezoning, preliminary and final plat review. If
annexed, any development proposed for the property would be required to meet the Owasso
Zoning Code and the Owasso Subdivision Regulations and any appropriate site engineering
standards as proscribed by Public Works including but not limited to paved streets and
sidewalks. The property would be served water by Washington Co. rural water district #3 and
sewer by the City of Owasso.
In regards to the Owasso Annexation Policy the request is larger than 20 acres and it is
contiguous to existing City limits. No public infrastructure or development currently exists on
the property; all public improvements will be made by the developer. If annexed, the subject
property will acquire an AG (Agricultural District) zoning designation.
Staff published legal notice of the annexation petition in the Owasso Reporter and letters of
notification were mailed to property owners within a 300' radius.

BACKGROUND
Kellogg Engineering has submitted a request to review and approve a preliminary plat proposing
236 residential lots, on approximately 87 acres of.property zoned RS -2 (Residential Single -
Family), located on the southwest comer of E. 96 h St. N and Mingo Rd.

DEVELOPMENT PROCESS
The four primary steps in the development of commercial property in Owasso include annexation,
zoning, platting, and site planning.
The third step in the development of property is platting. A preliminary plat is required for any
development that proposes to divide land into two or more lots. Plats illustrate the development
concept for the property, and are often modified significantly after being reviewed by the
Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes,
difficult development issues such as existing utility lines, wells, or easements are brought to light
at the preliminary plat stage and must be remedied prior to development.
Once the property development proposal shows a division of lots that is acceptable to both the
developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the
layout and dimension of lots included on the final plat, right -of -way widths, easements, and other
physical characteristics that must be provided for review by the City. After obtaining approval
from the TAC and Planning Commission, the final plat is considered by the City Council. If
approved, the final plat is filed with the office of the County Clerk and governs all future
development on that property.
ANALYSIS
The applicant is requesting this review in order to facilitate 236 residential lots, on approximately 87
acres of property zoned RS -2 (Residential Single- Family). According to the Owasso Zoning Code,
single family uses are included in Use Unit 6, and are allowed by right on property zoned RS -2.
The Preliminary Plat meets all Owasso Zoning Code Bulk and Area requirements. The lot and block
specifications established in the plat layout are adequate for the development of single family homes.
The applicant has dedicated 60 feet of right of way along Mingo Rd, and 50 feet along E 96 s St. N. to
allow room for future road improvements.
In a regional context, this proposed addition is in conformance with the Owasso 2015 Land Use
Master Plan, as the area is forecasted for residential development. Already, there is an emerging
pattern of relatively dense housing development occurring in the general area such as The
Fairways and New Brunswick.
TECHNICAL ADVISORY COMMITTEE
The Owasso Technical Advisory Committee reviewed the final plat at the September 28, 2005
regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity
to comment on the plat and request any additions and/or concerns. The following TAC
recommendations were addressed:
1. The applicant must provide a 35' radius on exit onto Mingo Rd & 96s St. N.
2. The applicant must establish a permanent easement around the drainage reserves.
3. Establish a permanent easement around the drainage reserve.
4. The applicant must show a drainage easement dedicated to convey overland drainage
5. The applicant must show access to detention areas.
6. The applicant must show limits of no access along Mngo Rd
RECOMMENDATION
Staff recommends approval of the Bailey Range Preliminary Plat subject to the above conditions.

approval of a final plat for The Bailey Medical Center Medical

The applicant is requesting this review in order to facilitate one lot on approximately 1. 15 acres.
The subject property lies in an area planned as part of OPUD 01 -02, The Lakes at Bailey Ranch. The
Planned Unit Development (PUD) calls for the property to be utilized in a manner consistent with RS -3
(Residential) zoning. The PUD goes further to say that all uses allowed by right or special exception in
an RS -3 district are allowed on the property. The applicant has received a special exception from the
Owasso Board of Adjustment to operate Use Unit 5: Community Services, Cultural, and Recreational
Facilities on the property. This action in effect allows a hospital or medical center to be developed on
this property even though it is zoned for residential development.
The proposed development is compatible with Owasso Master Plan and consistent with current
development trends in the general area. The final plat is in compliance with the Owasso Zoning
Code's Bulk and Area requirements. The Bailey Medical Office Building will be a multi -level
medical office building with doctor's offices, health labs, and have the capability to do minor out
patient surgeries.
