MINUTES OF REGULAR MEETING
Monday, January 7, 2013
The Owasso Planning Commission met in regular session on Monday, January 7, 2013 at
Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin
board at 10:00 a.m. on January 3, 2013.

The Commission reviewed the minutes.

ITEM 4. Final Plat - Encore at Elm Creek I - Consideration and appropriate action
related to a request for the review and the acceptance of a final plat
proposing one (1) lot, one (1) block on approximately 4.01 acres, located
on the northwest corner of East 116'h Street North and North 1451h East
Avenue.
Bronce reviewed the staff report with the Commissioners. There was discussion regarding
limits of no access.
David Vines moved, seconded by Alex Mills, to approve the final plat subject to the
following modifications regarding access points.

BACKGROUND:
The City of Owasso received a final plat for review and approval of the Reserve at Elm Creek.
The Reserve at Elm Creek Final Plat proposes fifty one (51) lots in three (3) blocks on
approximately 19.75 acres. The applicant wishes to plat the property for the development of a
single - family residential subdivision. The subject property is located at the northwest corner of
the intersection of E 661h St N and N 129th E Ave.

ANALYSIS:
The Reserve at Elm Creek final flat proposes fifty one (51) lots in three (3) blocks on
approximately 19.75 acres of property. The applicant wishes to plat the property for the
development of a single - family residential subdivision. The zoning on the property is governed
under a PUD (PUD- 04 -01), with Single- Family (RS -3) underlying zoning. The final plat was
approved in September of 2011, but the approval has expired. Therefore, the applicant is
requesting re- approval of the unchanged Final Plat.
Perimeter and interior utility easements will provide utility companies adequate access to
provide and maintain service to the proposed development. Any development that occurs on
the subject property must adhere to all subdivision, zoning, and engineering requirements
including but not limited to paved streets, landscaping, and sidewalks. The City of Owasso will
provide EMS, Police, Fire and sanitary sewer service, with water provided by Rogers County Rural
Water District. The development will be subject to the Storm Siren fee of $35 per acre and will be
subject to the Elm Creek Interceptor payback of $1,580 per acre. The applicant will have six (6)
months to file the final plat from the date of City Council approval.
Technical Advisory Committee (TAC):
The Technical Advisory Committee reviewed the final plat for the Reserve at Elm Creek at their
regularly scheduled meeting on June 22, 2011. All TAC comments were addressed and no
changes have been made since that review.
RECOMMENDATION:
Staff recommends Planning Commission approval of the Reserve at Elm Creek final plat.

DEED OF DEDICATION
Dominion Corporation, an Oklahoma corporation (the "Developer "), being the sole owner of
the following described real estate situated in the City of Owasso, Oklahoma:

Section , Township _ North, Range _ East of the I.B. &M., Tulsa County,
Oklahoma;
has caused the same to be engineered, surveyed, staked and platted into lots, blocks, streets and
reserve areas in conformity to the accompanying plat and survey thereof, which plat is made a part
hereof (the "Plat "), and has caused the same to be named THE RESERVE AT ELM CREEK, an
Addition to the City of Owasso, Tulsa County, State of Oklahoma (the "Addition ").
1. Public Streets and Utility Easements. The Developer dedicates to the public, for
public use forever, the easements and rights -of -way as shown on the Plat for the several purposes of
constructing, maintaining, operating, repairing and replacing any and all streets and public utilities
including storm and sanitary sewer, communication lines, electric power lines, transformers,
pedestals, gas and water lines, together- with all fittings and equipment for each such facility and any
other appurtenances thereto, with the right of ingress and egress to and upon said easements and
rights -of -way for the uses and purposes thereof.
2. Underground and Electric and Communication Service. In connection with the
installation of underground electric, telephone and cable television services, all lots are subject to the
following:
A. No overhead pole lines for the supply of electric service, telephone and cable
television service shall be located in the Addition. Street light poles or standards may
be served by underground cable, and elsewhere throughout the Addition, all supply
lines shall be located underground in the easement ways reserved for general utilities
and streets shown on the plat. Service pedestals and transformers as sources of
supply at secondary voltages, may be also located in such easement ways.
B. Except to houses on lots adjacent to the East and South property lines of the Addition
as described in subparagraph (A) above, which maybe served from overhead electric
service lines, telephone lines and cable television cables, underground service cables
to all houses which may be located on all lots in said Addition may be run from the
nearest service pedestal or transformer to the point of usage determined by the
location and construction of such house as may be located upon each said lot;
provided that upon the installation of such a service cable to a particular house, the
supplier of electric service, telephone or cable television service shall thereafter be
deemed to have a definitive, permanent, effective and exclusive right -of -way
easement on each lot covering a five foot strip extending 2.5 feet on each side of such
service cable extending from the service pedestal or transformer to the service
entrance on said house.
C. The supplier of electric, telephone, and cable television service, through its proper
agents and employees shall at all times have the right of access to all such easement
ways shown on the plat or provided for in this dedication for the purposes of
installing, maintaining, removing, or replacing any portion of said underground
electric, telephone, or cable television so installed by it.
D. The owner of each lot shall be responsible for the protection of the underground
electric, telephone, and cable television facilities located on his property and shall
prevent the alteration of grade or any construction activity which may interfere with
said electric, telephone or cable television facilities. The Company will be
responsible for ordinary maintenance of underground electric, telephone, or cable
television facilities, but the owner will pay for the damage or relocation of such
facilities caused or necessitated by acts of the owner, its agents or contractors.
E. The foregoing covenants concerning underground electric, telephone, and cable
television facilities shall be enforceable by the supplier of electric, telephone or cable
television service, and the owner of each lot agrees to be bound thereby.
3. Underground Gas Service. Underground service lines to all homes maybe run from
the nearest service connection to the point of usage determined by the location and construction of
the home•, provided that upon the installation of such a service line to a home, the supplier of gas
service shall thereafter be deemed to have a definitive, permanent, effective and exclusive right -of-
way easement on said Lot, covering a five foot (5') strip extending 2.5 feet on each side of such
service line, extending from the service connection to the service entrance on the home. All gas
meters shall be physically located at or near the service entrance to the home.
The supplier of gas service, through its proper agents and employees, shall at all times have
right of access to all such easementways shown on the Plat, or provided for in this Declaration for
the purpose of installing, maintaining, removing or replacing any portion of said underground gas
facilities so installed by it.
The Owner of each Lot shall be responsible for the protection of the underground gas
facilities located on its Lot and shall prevent the alteration of grade or any construction activity
which may interfere with said gas facilities. The supplier of gas services will be responsible for
ordinary maintenance of underground gas facilities, but Declarant will pay for damage or relocation
of such facilities caused by acts of Declarant or its agents or contractors.
The foregoing covenants concerning underground gas facilities shall be enforceable by the
supplier of gas service, and the Owner of each Lot agrees to be bound hereby.
4. Water, Sanitary and Storm Sewer. Owners shall be responsible for the protection of
the public water mains and sanitary sewer facilities located on their lots and shall prevent the
alteration of grade in excess of three feet from the original contours or any construction activity
which may interfere with said facilities. Said alteration of grade restrictions shall be limited to
easement areas.
The City shall be responsible for ordinary maintenance of public water mains and public
sanitary sewer facilities, but the owner will pay for damage or relocation of such facilities caused or
necessitated by acts of the owner or his agents or contractors. The City shall have the right of access
with its equipment to all easement ways shown on the Plat for installing, maintaining, removing or
replacing any portion of the underground water and sewer facilities. The foregoing covenants
concerning water and sewer facilities shall be enforceable bythe City, and the owner of the lot agrees
to be bound hereby.
5. Sanitary Disposal. No outside toilets or septic tank systems shall be allowed in the
Addition and all sanitary arrangements must comply with local and state health requirements.
6. Landscape and Paving Re air. The Owner of each lot shall be responsible for the
repair and replacement of any landscaping and paving located within the utility easements in the
event it is necessary to repair any underground water, sanitary sewer mains, storm sewers, electric,
natural gas, telephone, or cable television service. No lot owner shall plant any trees or shrubbery in
dedicated utility easements of right -of -way which would potentially endanger, threaten, or hann any
utilities located within said easements or rights -of -way. If it is determined that any trees or
shrubbery located within said easements or rights -of -way are damaging or endangering utilities in
said easements or rights -of -way, the city shall have the right to remove said trees or shrubbery upon
five (5) days notice thereof at the lot owner's expense, or within such time the lot owner mayremove
same.
7. Homeowners' Association. A homeowners' association, known as "Reserve at Elm
Creek Association," an Oklahoma corporation (the "Association "), has been or shall be established
pursuant to 60 O.S.1991, § 851, et sec ., to maintain the entryway and the reserve areas in Southern
Links and for such other purposes as shall be deemed advisable. All lawful acts, if any, of the
Association, made under and pursuant to its Certificate of Incorporation and By -Laws shall be
binding upon the lots contained in the Addition and the owners thereof Membership in the
Association shall consist of all owners of lots in the Addition and of such additional property
designated by the Developer.
Annual assessments shall be made on a per lot basis as provided in the Conditions,
Covenants and Restrictions for the Addition promulgated by the Developer. Such assessments shall
be a lien upon the lot assessed. Any such lien maybe foreclosed by the Association and the lot owner
shall be responsible for all costs and attorneys fees incurred by the Association in connection with
such suit. No lot shall be entitled to more than one (1) vote, regardless of the number of owners.
A. Right to Purchase Insurance. The Association may purchase, carry and maintain in
force various insurance coverages that the Board, in its discretion, determines to be
necessary, reasonable and prudent to protect the Association and its Board, agents,
employees, Members and Owners against claims brought against the Association as a
result of the performance or nonperformance of its duties under this Declaration. The
coverages provided by the Association shall be in such amounts and with such
deductibles, endorsements and coverages as shall be considered by the Board, in its
discretion, to be good, responsible insurance practice for properties similar in
construction, location and use to the Property.
B. Adequacy of Insurance. It shall be the responsibility of the individual Owner to
satisfy himself as to the adequacy of the insurance limits and coverage obtained by
the Association. The Association accepts no liability of any kind for the adequacy of
the coverage with respect to meeting the individual Owner's needs. It shall be the
duty of each Owner to request to review the coverages provided by the Association
and determine whether or not he needs additional coverage to satisfy his individual
needs or responsibilities.
C. Insurance Proceeds. The Association shall use the net proceeds of any property
insurance to repair and replace any damage or destruction of property covered by the
insurance, either to its original design and condition or, in the reasonable discretion
of the Board, to a different design, condition or state. Net proceeds shall include, but
are not limited to, proceeds attributable to insurance carried by the Association for
the benefit of other third parties. Any balance from the proceeds of such insurance
paid to the Association, as required in this article, remaining after satisfactory
completion of repair and replacement shall be retained by the Association as part of
the general reserve fund for repair and replacement of the Common Areas. If the
proceeds of insurance carried by the Association are insufficient to repair or replace
any loss or damage covered or intended to be covered by that insurance (including
any deductible), the Board may either levy a Special Assessment to cover the
deficiency or otherwise provide funds to cover the deficiency in such manner as the
Board shall determine.
8. Reserve Area. The Area designated on the Plat as a Reserve Area is hereby retained
by the Developer for later description by separate instrument as apark area, buildable lot, dedication
of a public street, or such other purpose as the Developer shall decree advisable, all without having
to vacate, or partially vacate, the plat. The Developer shall maintain the Reserve Area in a neat and
presentable condition until such time as it is conveyed.
9. Set -back Lines. No buildings, outbuildings, structures, or parts thereof shall be
constructed or maintained on lots nearer to the property lines than the set -back lines provided herein
or shown on the accompanying plat. Unless otherwise provided by easement or set -back lines shown
on the accompanying plat, the minimum building set -back lines for dwellings or other outbuilding
strictures shall be:

On all lots where there is both a twenty -five foot set -back line and a fifteen foot set -back line
adjacent to a public street, the portion of the lot containing the twenty-five foot set -back shall be
considered the front yard and the dwelling shall face this portion of the lot.
10. Compliance with Code. All lots are subject to the uses, restrictions and requirements
of the Code of the City of Owasso.

a retail commercial space. The subject property is located along E 116th St N, between

establishing the size, location and design of signage on property being developed as a unit. The
purpose of a USP is to provide for the establishment of signage criteria that is tailored to a
specific development or location, which may vary from the provisions of this Code. The intent of
a USP is to provide flexibility in the sign criteria of the Owasso Zoning Code that promotes
superior design through architectural integration between - the site, buildings and other signs
that may be on or near the subject property.
National or international franchises shall be given reasonable consideration with respect to
company standard logos and lettering styles that are an integral part of the franchise image
and identity. The consideration shall not be without restriction and shall be within the boundaries
of sound zoning practice and planning and in harmony with the general purpose and intent of
the unified signage plan.
All unified sign plans are subject to the following restrictions:
(1) All unified sign plans shall include the location, size, height, construction material, color, type
of illumination and orientation of all proposed signs.
(2) All unified sign plans shall be reviewed by the City of Owasso Planning Commission and shall
conform to all conditions imposed by said Commission prior to the issuance of a sign permit.
(3) Unified Sign Plans shall include all signage to be located within the perimeters of the subject
site whether in excess of the provisions of the current sign code or not.
(4) Unified Sign Plans may not propose a total sign square footage exceeding three (3) square
feet of signage per every one (1) linear foot of street frontage of the subject property.
(5) Unified Sign Plans may not include any prohibited sign.
ANALYSIS:
The applicant is requesting a Unified Sign Plan to allow for the construction of two (2) larger
multi- tenant signs and monument signs for the individual parcels. The two (2) multi- tenant signs
are proposed at the corner of E 961h St N and N 129th E Ave and along the US -169 service road in
the northern portion of the Sam's property. The individual tenant monument signs are proposed
for lots 2 through 5 of the Sam's development, along E 96th St N. Placing the multi- tenant signs at
these locations, along with limiting the height and type of sign on the individual parcels
minimizes the visual impact to the residential properties to the south and southeast of the Sam's
property.
The multi- tenant signs are proposed to be a maximum of forty (40) feet in height and
constructed mainly of split -faced block at a width of 1 1' 8 ". The portion of the sign that contains
the tenant information is partially cantilevered out from the main body of the sign and a
decorative cap is proposed at the top of the sign. The monument signs on the individual parcels
are designed to be a maximum of ten (10) feet in height and constructed on a split -faced block
base. The tenant signage space is approximately 4'9" by 20', with a decorative cap. The signs
are proposed to be internally lit, with no additional lighting planned. All the proposed signs are
similar in architectural style to complement the Sam's Club building, completing a unified design
of the site elements.
RECOMMENDATION:
Staff recommends approval of the unified sign plan for the Sam's Club shopping center with the
following conditions:
1. The signs remain only internally lit and no LED signage of any type be allowed on any of
the parcels.
2. A maximum ten (10) foot tall monument sign be the only signage allowed on the
individual sites, besides building and directional signage.
3. Create a landscape bed at the base of each sign.
