Monday, March 11, 2013
The Owasso Planning Commission met in regular session on Monday, March 11, 2013 at
Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin
board at 4:00 p.m. on March 7, 2013.

ITEM 4. Preliminary Plat - Maple Glen IV - Consideration and appropriate action
related to a request for the review and the acceptance of a preliminary
plat proposing ninety -two (92) lots on seven (7) on approximately 24.35
acres, located on the east side of Maple Glen III and approximately a half
of a mile north of East 106th Street North.
Bronce reviewed the staff report with the Commissioners. Staff recommends approval of
the preliminary plat for Maple Glen IV. The Technical Advisory Committee reviewed the
plat at their regularly scheduled meeting on February 27, 2013.

Mr. and Mrs. Knickerbocker (12104 East 110 Street North) was present to express their
desire for privacy fencing along the east side of the subdivision. Maple Glen IV will back
up to their west side property line. Mr. Knickerbocker suggested to continue the wood
fencing with metal posts that exists at the north end of the Maple Glen IV. Bronce stated
that he would find out about the possibility of fencing by the final plat stage.
Dr. Loving moved, seconded by David Vines, to approve the preliminary plat subject to
TAC and Staff recommendations.

ITEM 5. Final Plat - Maple Glen III - Consideration and appropriate action related
to the request for the review and acceptance of a final plat proposing

located on the east side of Maple Glen II and approximately a half of a
mile north of East 1061h Street North.
Bronce reviewed the staff report with the Commissioners. The Technical Advisory
Committee reviewed the plat at their regularly scheduled meeting on February 27, 2013.
Staff recommends approval of the final plat for Maple Glen III.
David Vines moved, seconded by Tammy Laakso, to approve the final plat subject to
TAC and Staff recommendations.

Bronce reviewed the staff report with the Commissioners. The Technical Advisory

Background:
On April 9, 2013 the City of Owasso received a planned unit development /rezoning application
for review and approval of a request to rezone a tract of land from OM to the underlying zoning
of RM (Residential Multi- family), with a Planned Unit Development (PUD) overlay. The subject
property is located south of Owasso Medical Campus and north of Owasso Market for a
proposed change of the Land Use Master Plan. The proposed PUD for an apartment complex is
a use found in the transitional category of the land use plan. The location of the subject
property is within a commercial use area, which does not recommend apartment uses. The
location of the subject property is such that it functions as a transitional area between higher
intensity commercial uses and lower intensity office uses, which fits into the overall concept of
the 2025 Land Use Plan. Finally, the Land Use Plan is a fluid document that periodically requires
updating. It has been 5 years since the Plan was updated, so it is expected that amendments
will occur from time to time as the Plan becomes more outdated.
Owasso Land Use Master Plan:
The Owasso Land Use Master Plan (Plan) is a document representing desired future land use and
transportation patterns for the physical development of the community. It serves as an adopted
statement of growth policy for the city, and provides the basis for land use decisions such as
zoning changes. The Plan is not meant to predict every possible scenario, but rather serve as a
guide in helping to make decisions as well as offer some predictability to the public in terms of
location and intensity of future uses.
Analysis:
It was brought to Staff's attention that the 2025 Land Use Master Plan needs a revision, that
changes the designated future land use for the parcels involved in OPUD 12 -01 /OZ 12 -02
Commercial to Transitional. The transitional land use classification represents that there should
be transitional zone from residential development to non - residential development. The principal
uses in this classification would be single - family attached (duplexes and townhouses), multi-
family apartments, neighborhood offices and planned office parks. The area immediately north
and west of the subject property is developing in this fashion.
In analyzing the request, staff considered two key factors: first, what is the highest and best use
of the property, and second, is the proposed land use distribution consistent and compatible
with existing development patterns in the area. The staff believes that the answer to both
questions is 'yes ". The Owasso 2025 Land Use Map calls for this area to be commercial in the
future, but RM (Residential Multi - family) zoning would appear to be in compliance with the goals
stated in the plan and the existing development in the area.
Amending the Plan to show this area as transitional is appropriate in terms of the proposed multi-
family zoning and use and does not appear to adversely impact the surrounding properties and
in fact supports them.
Recommendation:
Staff recommends approval of the amendment to the Owasso 2025 Land Use Master Plan for
the area identified changing the designation from Commercial to Transitional.

BACKGROUND:
The City of Owasso received a request for an amendment to a Planned Unit Development (PUD)
development called 91netyEight (PUD- 12 -01). The applicant purchased an additional two (2)
lots, totaling approximately 4.88 acres of contiguous property and would like to incorporate it
into the apartment complex currently under development. The subject property is located
along East 98th Street North and E 991h St N immediately north of the Owasso Market
development and to the south of the St. Johns Owasso medical campus. The applicant also
submitted a rezoning request with this PUD that would rezone the property from OM (Office
Medium) to RM (Multi - Family Residential), allowing for the development of an apartment
complex.

CONCEPT OF A PUD:
The concept of a Planned Unit Development is to provide a creative alternative to conventional
development where a particular tract is under common ownership or control and where a
detailed development plan, outlining the development of the tract as a unit is proposed and
submitted for public review. The use of a PUD technique is a way to amend a zoning ordinance
in accordance with a complete and coordinated plan of development for a larger parcel,
rather than piecemeal individual changes using the variance process.
ANALYSIS:
The amendment to the 9inetyEight development proposes an additional 58 units making a total
of a 342 -unit apartment complex on 19.53 acres. The apartments are proposed as low -rise
buildings 3- stories in height with a mixture of one and two- bedroom units. The 91netyEight site will
provide a number of amenities for the residents and includes large areas of open space for
recreation. The provided amenities as identified in the PUD document include: a clubhouse with
exercise facilities and recreation area; a pool and spa; a covered outdoor barbeque area;
fishing pond surrounded by a walking path; and gated access to the complex.
The City of Owasso will provide sanitary sewer service, with water provided by Washington
County Rural Water District #3.
If the PUD amendment is approved, the applicant would provide final development plans for
administrative review and approval by City staff. PUD applications presented to the Planning
Commission are for approval of the uses, the overall plan as it relates to the immediate area,
and the concept for the development.
City staff published legal notice of the PUD amendment request in the Owasso Reporter and
mailed notices to property owners within a 300' radius of the subject property.
COMPREHENSIVE PLAN CONSISTENCY:
The Owasso 2025 Land Use Master Plan identifies the subject property and its surroundings as
having a future land use of commercial. An amendment to the Land Use Master Plan
accompanies the request for the proposed 9inteyEight PUD amendment. With the change to
the Land Use Master Plan to a transitional classification, the proposed project will be in
conformance with the Land Use Master Plan.
HARMONY WITH THE EXISTING AND EXPECTED DEVELOPMENT:
This proposal appears to be consistent with the current and expected development of the area.
Apartment complexes are often proposed in areas that are adjacent to single - family residential
developments and there are concerns from neighboring property owners. This proposal places
the apartments between two established commercial and medical uses, not requiring great
buffering or transitional uses. This is a rare case when an apartment development would be a
great fit for the area with minimal impacts on surrounding properties. As the Owasso Medical
Campus continues to develop, this apartment development will still be a compatible use and
should not adversely affect any future or current development. This development will provide
housing opportunities for employees of current and future commercial and medical uses in this
area and provide the opportunity for residents to walk to work, shopping, and eating
establishments.
PLANNING ISSUES:
Future planning issues must still be considered if the PUD amendment is approved. If approved,
the applicant will be required to adhere to all City of Owasso subdivision regulations and
engineering requirements.
According to the Owasso Zoning Code, the Planning Commission shall hold a public hearing on
any PUD application and determine the following:
1. Whether the PUD is consistent with the Comprehensive Plan.
2. Whether the PUD is in harmony with the existing and expected development of surrounding
areas.
3. Whether the PUD is a unified treatment of the development possibilities of the project site.
4. Whether the PUD is consistent with the stated purpose and standards of the PUD ordinance.
a. To permit innovative land development while maintaining appropriate limitation on
the character and intensity of use assuring compatibility with adjoining and
proximate properties;
b. To permit flexibility within the development to best utilize the unique physical
features of the particular site;
c. To provide and preserve meaningful open space; and
d. To achieve a continuity of function and design within the development.
TECHNICAL ADVISORY COMMITTEE REVIEW:
This item was taken to the TAC for review on April 24, 2013 and the comments from this meeting
are attached.
RECOMMENDATION:
Recommend to the City Council that the amendment to the 91netyEight PUD with underlying zoning
of RM be approved subject to addressing all TAC comments as well as any conditions from the
Planning Commission,

BACKGROUND & ANALYSIS:
The City of Owasso received a lot split application for review and approval of OLS- 13 -01. The
subject property is 30.06 acres in size and is home to a portion of the Greens Owasso
Apartments. A new phase was added to the Greens Owasso in 2012 on a separate tract from
the existing apartments. During construction, a portion of one the new buildings was built slightly
over the property line onto the tract containing the existing apartments. This lot split would
remove a small tract of land from the original tract (Tract D) and subsequently add it to the
newly developed tract (Tract B). This action simply cleans up lot lines and ensures that there are
no title issues surrounding the development. No new lots are created, rather this is just taking a
piece of one adding and giving it to another. The process is a lot split and a subsequent lot
combination.
Technical Advisory Committee (TAC):
The lot split was reviewed by the Owasso Technical Advisory Committee on April 24, 2013. No
comments were made.

SUBJECT: Final Plat -96th Street North Center - Amendment

BACKGROUND:
In September of 2012, the City of Owasso received a final plat for review and approval of the
961h Street North Center. The subject property is 2.2 acres in size and is comprised of two (2) lots
on one (1) block. The eastern lot is the planned site for a new Broum's Ice Cream and Dairy
Store.
This property was annexed into the City of Owasso by Ordinance No. 737 and the property was
rezoned to CG (Commercial General) by Ordinance No. 992.
As a part of the 2012 approval, the plat showed a mutual access easement on the west side of
the property to facilitate a shared driveway with the property to the west. Only 20 feet of the
MAE was shown on the plat, with 30 feet on the neighboring property. The property owners
have been unable to agree on an alignment of the shared road. Because only 20 feet of limit of
access to E 96th Street N was shown on the plat due to the planned shared driveway, there is not
enough room for a driveway to be placed that will serve the western lot. The mutual access
remains on the plat to allow the western neighbor to connect to be able to access this drive
once they develop. The intention behind the shared driveways is to reduce the number of curb
cuts along 96th St. N. Once the western property develops they will need to connect to existing
driveways and will have to continue to the trend and planning principle of interconnectedness
and reduction of curb cuts onto arterial roads.

The subject property is located approximately 332' east of the northeast corner E 96th St N and N
Garnett Road. The only change from the original plat is the MAE expanding from 20 feet to 30
feet and the Limit of Access changing from 20 feet to 30 feet on the western boundary.

at their regularly scheduled meeting on April 24, 2013, The TAC comments are attached.
Any development that occurs on the subject property must adhere to all subdivision, zoning,
and engineering requirements including but not limited to paved streets, landscaping, and
sidewalks. Sanitary sewer will be provided by the City of Owasso.
RECOMMENDATION:
Staff recommends the Planning Commission approve the amended final plat for 96th Street North
Center.
