The Owasso Planning Commission met in regular session on Monday, January 12, 2015 at
Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin
board at 4 :00 p.m. on January 8, 2015.

ITEM 6. Rezoning #OZ 14 -08, 9917 East 106 Street North - Consideration and
appropriate action related to the request for the review and acceptance
for a rezoning of approximately 17.49 acres, from AG (Agriculture) District
to RS -3 (Residential Single Family) District.
Bronce Stephenson presented an overview. The location was described. There is a
storm siren fee of $35.00 per acre; Medowcrest sewer payback fee of $867.00 per acre.
Harley Swan with Kellogg Engineering was present to answer any questions.
Staff recommends approval of the request to rezone to Residential Single Family (RS -3).

ANALYSIS:
Lots 41 and 42 were combined at some point in the past and the proposed lot split essentially
divides the lots down the middle. The new lots will be oriented in a north -south direction with the
frontage along E. 114 +h St. N. RS -3 zoning requires a lot width of 65 feet and lot area of 7000
square feet. The resulting lot split will create two tracts, A and B. Tract A will have 100 feet of
frontage and contain 12,500 SF. Tract B will have 80 feet of frontage and contain 10,000 SF
square feet. All other RS -3 district base zoning and dimensional requirements will be still met with
the proposed lot split. No other impacts regarding current access points, fire protection, private
utility services, detention, or setbacks are anticipated. Any construction on the property will be
required to adhere to all current adopted building and development codes of the City of
Owasso. It should also be noted that in order to access a public sewer main, Tract B will be
required to either record an easement across Tract A or perform a road bore to access the
sewer across E. 114th St. N.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed the lot split at their regularly scheduled
meeting on January 28, 2014. All TAC comments have been addressed by the applicant.
RECOMMENDATION:.
Staff recommends approval of the lot split, subject to Planning Commission recommendation.

ANALYSIS:
In September 2014, the City Council approved OPUD 14 -02, which allowed duplex units to be
placed on Lot 2, with Lot 1 retaining the single family home and storage building. In order to
create lots of record for the duplex units, a lot split is being requested for Lot 1. A lot split is also
being requested for Lot 2, mainly to add an additional 5 feet to the easternmost lot that will be
created on Lot 2. Essentially, the lot split proposes creating two lots on each of the existing single
lots. Each of the duplex lots will have 75 feet of frontage, which exceeds the minimum
requirements of the duplex zoning district.
Any construction on the property will be required to adhere to all current adopted building and
development codes of the City of Owasso and meet the requirements of OPUD 14 -02.
TECHNICAL ADVISORY COMMITTEE:
The applicant stressed he needed to move forward with the duplex project quickly due to
financing issues and asked that it be placed on the February Planning Commission agenda. As
such the application for this lot split was emailed to all members of the Technical Advisory
Committee (TAC) for review and comment. There was only one TAC comment regarding the
proposed lot split, which came from the Owasso Public Works Department and is as follows.
Tract 1 would require and easement across tract 2 for sanitary sewer service, and tract 1 would
have to bore across 3rd Street for water service or get an easement back across tract 1 to get
service off the water line along Birch.
RECOMMENDATION:
Staff recommends approval of the lot split, subject to addressing TAC comments.

BACKGROUND:
The City of Owasso received a final plat for review and approval of the Hickory Creek II
development. This development proposes twenty -three (23) lots in three (3) blocks on 7.6 acres
of land. The applicant wishes to plat the property for the development of a single- family
residential subdivision. This is phase II of the Hickory Creek development. The subject property is
located at the northwest corner of the intersection of E 66th St North and N 129th E Avenue.

ANALYSIS:
PUD- 10 -01, approved in March of 2011, allows for this development to have smaller lots than
would be allowed by standard zoning (50 ft. wide rather than 65 ft.) The Hickory Creek II
development would be accessed with an entrance from E 661h St N and N 129th E Avenue and
would connect to the original phase to the west. A one hundred (100) foot Grand River Dam
Authority (GRDA) utility easement lies along the eastern side of the subject property.
Appropriate utility and drainage easements are proposed throughout the plat that will allow for
the movement of stormwater and the placement of utilities to serve this development and future
developments in the area. Any development that occurs on the subject property must adhere
to all subdivision, zoning, and engineering requirements including but not limited to paved
streets, landscaping, and sidewalks. The City of Owasso will provide sanitary sewer service, with
water provided by Rogers County Rural Water District.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee JAC) reviewed the final plat for Hickory Creek at their
regularly scheduled meeting on October 22, 2014. The TAC comments have been addressed by
the applicant.
RECOMMENDATION:
