The Owasso Planning Commission met in regular session on Monday, July 7, 2014 at Old
Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin
board at 10:00 a.m. on July 3, 2014.

The By -Laws of the Owasso Planning Commission state that the Commission shall have a
chairperson and vice - chairperson, and that election of said officers shall be held
annually at the first meeting of the Commission after July 1 of each year.
The Chair opened the floor for nominations for Chairperson. Dr. Paul Loving was
nominated by David Vines, with the nomination being seconded by Tammy Laakso.
Hearing no further nominations, the nominations were declared closed and Dr. Loving
was elected Chairperson by acclamation.
ITEM 6. Election of Planning Commission Vice Chairperson
The Chair opened the floor for nominations for Vice Chairperson. Tammy Laakso was
nominated by David Vines, with the nomination being seconded by Tim Miller. Hearing

ITEM 9. Rezoning #OZ 14 -04— Duvall - Consideration and appropriate action
related to the request for the review and acceptance for the rezoning of
approximately 18.8124 acres, from AG (Agricultural) District to CS
(Commercial Shopping) District. The property is located one - quarter mile
north of the northeast corner of Garnett Road and East 1061h Street North.
Bronce Stephenson presented an overview. The applicant is leaving a 50' strip of land
zoned AG between the Maple Glen neighborhood to the north, providing a buffer
between the commercial and high density single - family residential uses. Staff is
recommending the Planning Commission approval of the above rezoning. Notice was
published in the Owasso Reporter and notices were sent to the surrounding property
owners.
Mrs. Deming (11714 East 109 Street North) asked to speak to the Commissioners. Mrs
Deming is opposed to the rezoning. She had concerns with criminal activity if it is
commercial property. She has concerns with kids will jump over her fence into her
backyard. She stated that citizens are being strangled by progress in Owasso.
David Vines suggested to table the item until next month. This action will allow time for
the adoption of the GrOwasso Land Use Master Plan.
Tammy Laakso moved, seconded by Tim Miller, to table the rezoning request until the
August 11, 2014 Planning Commission meeting.
A vote on the motion was recorded as follows:

ITEM 10. GrOwasso 2030 Land Use Master Plan — Consideration and appropriate
action related to the review for the review and acceptance of the

Bronce Stephenson presented an overview, recommending the Planning Commission
send a recommendation for adoption of the GrOwasso 2030 Land Use Master Plan to
the City Council.

ANALYSIS:
The applicant is proposing to rezone a piece of property just to the north of the intersection of E
106th St N and N Garnett Rd. The applicant is requesting a zoning designation of Commercial
Shopping (CS). The property sits north of commercial property at the northeast corner of the
intersection of E 106th St N and N Garnett Rd. Residential properties lie to the north and east of
the subject property. The applicant is leaving a strip of land zoned AG between the Maple Glen
neighborhood to the north, providing a buffer between the commercial and high density single -
family residential uses. This AG property could not be developed with any commercial use. This
area is planned for commercial growth and the intersection at E 106th St N and N Garnett Rd is
currently being improved due to higher use in the area. CS zoning would allow for commercial
uses as seen throughout much of the Owasso area, but would exclude high - intensity
commercial uses.
Any development that occurs on the subject property must adhere to all subdivision, zoning,
and engineering requirements including but not limited to paved streets, landscaping, and
sidewalks. The City of Owasso will provide sanitary sewer service.
COMPREHENSIVE PLAN CONSISTENCY:
The GrOwasso 2030 Land Use Master Plan identifies the subject property and its surroundings as
having a future land use of commercial. The proposed rezoning to Commercial Shopping will
be in conformance with the Land Use Master Plan.
RECOMMENDATION:
Staff recommends approval of the rezoning request OZ- 14 -04, rezoning the subject property from
AG to CS.

SUBJECT: Specific Use Permit — AT &T Cell Tower (SUP- 14 -01)

BACKGROUND:
The City of Owasso received an application for review and approval of a Specific Use Permit
(SUP- 14 -01) for the construction of a new cell tower located at 13720 E 86TH St N. The subject
property is located approximately 1/2 mile east of N 1291h E Ave and E 86th St N.
The applicant has provided plans showing the proposed tower and all related equipment that
would be associated with the tower. Additionally, the applicant has provided a map of all cell
towers in the immediate area and a coverage map, showing the 'before' and 'after' coverage
if the tower were to be approved.
Letters were mailed to surrounding property owners within 300' of the subject property and the
notification was published in the Owasso Reporter. Staff received no calls regarding the
proposed permit.
This item was taken before the Planning Commission in May and was denied with a 3 -2 vote in
order to allow the applicant to make modifications to their proposal and to allow staff time to
look at the City requirements. After an in depth analysis, staff determined the Owasso's zoning
code was quite out of date and did not allow for telecommunications companies to be
competitive in the area market. Staff made changes to the code requirements and took them
to the Planning. Commission and City Council, where they were both approved. Now this
application is back for consideration, meeting all code requirements.

ANALYSIS:
SUP 14 -01 is a request for a Specific Use Permit to allow a cellular communications tower on
property zoned CS. The property is currently developed and is being used as a shopping center.
AT &T is the company seeking the permit and states that they are attempting to fill a gap in their
coverage area. The proposed 150' tall monopole would be located on the east side of the strip
shopping center, which is the service area for the current businesses.
The subject property is zoned CS and a communications tower is allowed only with the issuance
of a Specific Use Permit (SUP). Through the SUP process, the Planning Commission and City
Council may alter or vary zoning code requirements on a case by case basis, though an SUP
traditionally proposes a use that is above and beyond what is normally allowed in a certain
zoning district. SUP approval is usually combined with additional requirements such as screening,
greater setbacks, additional landscaping and other measures to reduce the impact of a greater
or more intense use.
In this case, the only major impact is the height of the structure and there is no real way to
screen or reduce the impact of height. Sometimes, telecommunication towers are required to
be shaped like trees in order to reduce the impact, but those are traditionally in areas that are
heavily forested. Other ways that impacts are reduced is by hiding the towers in church
steeples, attaching them to existing infrastructure (such as the City has allowed on the Ram
water tower), or by requiring them to function as flag poles. The flag pole option would be a
possibility, but this design would not allow other cellular carriers to co- locate their equipment on
the poles, which is preferred.
TELECOMMUNICATIONS ACT:
It is important to be cognizant of Federal laws dealing with telecommunication towers (source,
Federal Communications Commission). The Telecommunications Act of 1996 preserves local
governments' ability and authority to regulate the placement, construction and modification of
telecommunication facilities. The Act does state that regulations essentially must be uniform and
that preference or special exception cannot be given to one carrier that will not be extended
to another. The Section from the 1996 Telecommunications Act:
(a) NATIONAL WIRELESS TELECOMMUNICATIONS SITING POLICY- Section 332(c) (47 U.S.C.
332(c)) is amended by adding at the end the following new paragraph:
(7) PRESERVATION OF LOCAL ZONING AUTHORITY -
(A) GENERAL AUTHORITY- Except as provided in this paragraph,
nothing in this Act shall limit or affect the authority of a State or
local government or instrumentality thereof over decisions
regarding the placement,
construction, and modification of personal wireless service
facilities.
(B) LIMITATIONS -
(i) The regulation of the placement construction, and
modification of personal wireless service facilities by any
State or local government or instrumentality thereof --
(/) shall not unreasonably discriminate among providers of
functionally equivalent services, and
(II) shall not prohibit or have the effect of prohibiting the
provision of personal wireless services.
(ii) A State or local government or instrumentality thereof
shall act on any request for authorization to place,
construct, or modify personal wireless service facilities within
a reasonable period of time after the request is duly filed
with such government or instrumentality, taking into
account the nature and scope of such request.
(iii) Any decision by a State or local government or
instrumentality thereof to deny a request to place, construct
or modify personal wireless service facilities shall be in writing
and supported by substantial evidence contained in a
written record.
(iv) No State or local government or instrumentality thereof
may regulate the placement, construction, and modification
of personal wireless service facilities on the basis of the
environmental effects of radio frequency emissions to the
extent that such facilities comply with the Commission's
regulations concerning such emissions.
(v) Any person adversely affected by any final action or
failure to act by a State or local government or any
instrumentality thereof that is inconsistent with this
subparagraph may, within 30 days after such action or
failure to act, commence an action in any court of
competent jurisdiction. The court shall hear and decide such
action on an expedited basis. Any person adversely
affected by an act or failure to act by a State or local
government or any instrumentality thereof that is inconsistent
with clause (iv) may petition the Commission for relief.
Typically staff encourages cellular companies to communicate with the owners of other towers
for space so they can co- locate. However, the government cannot force one company to
locate on another's tower. The applicants have stated that they have attempted to co- locate
on existing towers, but would be unable to provide the upgrade in service they feel this new
tower will accomplish.
OWASSO ZONING CODE:
The proposed tower would be located approximately 350 feet from the nearest residential
structure, one of the apartment buildings of the Greens Owasso. The closest single - family
residential structure is approximately 500 feet from the proposed tower and located in the
Brentwood Estates neighborhood. Code requires a 2:1 tower height to distance ratio from single
family structures and this application falls within allowable distance.
Section 1520.6.2.i states "New telecommunication towers must be a minimum distance of 1/2 mile
from any other telecommunication tower, unless in a by right district." The nearest tower is
located behind Hodson Elementary and is approximately 3,165 feet (0.59 miles) from the
proposed location.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee reviewed the Specific Use Permit at their regularly scheduled
meeting on February 26, 2014. All TAC comments have been addressed by the applicant.
RECOMMENDATION:
Staff recommends approval of the SUP for the telecommunications tower.

BACKGROUND:
The City of Owasso received a lot split application for review and approval of OLS 14 -04. The
subject property is platted as Lot 1, Block 2 of the Smith Farm Market Place shopping center.
The property is zoned CS and requires a minimum lot frontage of 150 feet.
When the IHOP restaurant was built on the north portion of Lot 1, Block 2, there was a small
undeveloped portion of the property on the south side of the building. This vacant lot has been
marketed by the property owner for several years. Recently, interest was shown by a medical
clinic to develop an urgent care walk -in clinic on this property. The applicant wants to purchase
the land fee simple and thus needs to have an individual deeded lot. However, the frontage
on Lot 1 is only 297.65 feet and thus could not be split unless a variance were approved allowing
a reduction in the lot frontage requirement.
On July 22, 2014 the Board of adjustment approved a variance for the subject property allowing
a reduction of the lot frontage requirement. This action allows a lot split to occur for the
proposed medical clinic to locate on a separate lot. The variance was approved subject to the
following conditions.
• No new driveway cuts shall be permitted, other than what has been shown on the filed
Smith Farm Market plat.

ANALYSIS:
The proposed lot split proposes to split Lot 1, Block 5 of Smith Farm Market, which was originally
platted in 2004. As mentioned the purpose of the request is to allow for the development a
medical clinic on a separate lot.
A lot split on the property would leave 166.60 feet of frontage for the north lot (IHOP) and 131.05
feet of frontage for the south lot, which is for the proposed the medical clinic. Access is
controlled by one driveway, which is platted. Detention was also accounted for with a full build
out scenario of Lot 1, as the property directly to the east has an existing detention pond that was
sized accordingly. The Board of Adjustment's action allows for a reduction in the lot width
requirement for the subject property. No other impacts regarding current access points, fire
protection, private utility services, detention, or setbacks are anticipated.
Any development that occurs on any of the subject property must adhere to all subdivision,
zoning, and engineering requirements including but not limited to paved streets, landscaping,
and sidewalks. Water and sanitary sewer service will be provided by City of Owasso.
TECHNICAL ADVISORY COMMITTEE:

meeting on July 23, 2014, All TAC comments have been addressed by the applicant.

The City of Owasso received a lot split application for review and approval of OLS- 14 -05. The
subject property is platted as Lot 2, Block 5 Owasso, Cherokee Nation Indian Territory. The
subject property is located near North 3rd Street and Atlanta.

ANALYSIS:
The proposed lot split essentially combines 16 feet of the westernmost portion of Lot 2, Block 5
Owasso, Cherokee Nation Indian Territory with Lot 1 Block 5 of the Starlane subdivision. The
applicant, who lives on Lot 1 Block 5 of the Starlane subdivision, desires to enlarge his lot by
adding the 16 feet to it. The property owner of the subject property, Debra White, has endorsed
the application.
RS -3 zoning requires a lot width of 65 feet and lot area of 7000 square feet. The resulting 2 lots
from this action will still meet the base zoning and dimensional requirements of the RS -3 district.
Lot 1, Block 5 of the Starlane subdivision will become 75.25 feet wide and Lot 2, Block 5 of the
Owasso, Cherokee Nation Indian Territory lot will become 92.3 feet wide. No other impacts
regarding current access points, fire protection, private utility services, detention, or setbacks are
anticipated.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed the lot split at their regularly scheduled
meeting on July 23rd. All TAC comments have been addressed by the applicant.
RECOMMENDATION:
Staff recommends approval of the lot split, subject to Planning Commission recommendation.
