The Owasso Planning Commission met in regular session on Monday, September 8, 2014
at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall
bulletin board at 4:00 p.m. on September 4, 2014.

ITEM 4. Presentation of the Character Trait of the Month - Diligence
ITEM 5. Approval of Minutes from August 11, 2014 Regular Meeting.
The Commission reviewed the minutes.
David Vines moved, seconded by Tim Miller, to approve the minutes from the August 11,
2014 meeting. A vote on the motion was recorded as follows:

ITEM 6. OPUD 14 -02 /07 14 -05 - Consideration and appropriate action related to the
request for the review and acceptance of a planned unit development,
proposing a duplex development, with the underlying zoning of RD (Residential
Duplex) District. The subject property is located at 203 East 3rd Street (Lots 1 & 2,
Block 1, Original Town of Owasso).
Bronce Stephenson presented an overview. The Technical Advisory Committee
reviewed the PUD application on August 27, 2014. Comments have been addressed.
Notice was published in the Owasso Reporter and notices were sent to the surrounding
property owners. Staff recommends approval of PUD 14 -02.
The following are comments expressed by several surrounding property owners:
Pat Marlar- 306 North Birch - This development will be an improvement over what is
currently there. There are different types of animals that live on that lot, would like to
see them gone.
Brenda Ackart- 403 E 3rd - There are several rental properties around this location.
Rental property brings our property values down. Opposes the development of
duplexes. Kids catch the school bus there. Find a different piece of land.
Amanda Sedon - 404 E 31d- Opposed to duplexes. Concerned with four more families
coming into the neighborhood. It will increase traffic.
Wade Garrett - 402 E 31d PI - Opposed to duplexes. Opposed to rental property at that
location. People that rent want to trash it up, not mow and maybe have a meth lab.
Would rather have a parking lot there.
Brian Evans - 205 North Birch - A letter of opposition was presented to the
Commissioners (attached). Mr. Evans could not attend the meeting.
Mr. Fritz, the applicant, explained that the duplexes will be two bedrooms and hope to
cater to older adults or younger couples. No animals will be permitted and we screen
the applicants in order to get the right fit. The cost of the duplexes will be
approximately $160,000.00 - $170,000.00 each. If the renter doesn't mow we will have it
mowed and charge the renter.
David Vines moved, seconded by Tim Miller, to approve the above planned unit
development request. A vote on the motion was recorded as follows:

ITEM 7. Final Plat - Lake Valley V - Phase 2 - Consideration and appropriate
action related to the request for the review and acceptance of a final
plat proposing eighty -two (82) lots, in four (4) blocks on approximately
15.5569 acres. The general location is Y2 mile south of East 1 16th Street
North (SH 20) and east of North 1451h East Avenue.
Karl Fritschen presented an overview. The location was described. The Technical
Advisory Committee reviewed the plat at the August 27, 2014 meeting. Applicable
payback fees will be due at the time of filing the plat. Elm Creek sewer payback of
$1,580.00 per acre and a storm siren fee at $35.00 per acre. Mr. Tim Terral stated that
there will be a pocket park within the development. Staff recommends approval of
the final plat for Lake Valley V, Phase Il.
A brief discussion was held regarding the possibility of an agreement, to be signed by the
applicant, stating that all state, local and federal requirements will be followed during
the construction of Lake Valley V, Phase ll.
David Vines moved, seconded by Tammy Laakso to approve the final plat, subject to
TAC and Staff recommendations and the following condition:
• The applicant shall sign an agreement stating that all state, local and federal
requirements be followed during the construction of Lake Valley V, Phase II.
A vote on the motion was recorded as follows:

ITEM 8. Lot Split - #OLS 14 -06 - Consideration and appropriate action related to the
request for the review and acceptance of a lot split which would split a
28.22 acre tract into three (3) tracts, a 19.80 acre tract, a 2.80 acre tract,
and a 5.61 acre tract. The property is located near the northeast corner of
North Garnett Road and East 106th Street North.
Karl Fritschen presented an overview. The location was described. The Technical
Advisory Committee reviewed the lot split at the August 27, 2014 meeting. Staff
recommends approval of lot split #OLS 14 -06 with the following condition:
• The property shall be platted prior to any development.
Tammy Laakso moved, seconded by Tim Miller to approve the lot split subject to the
above condition. A vote on the motion was recorded as follows:

ANALYSIS:
The applicant requests vacation of the existing plat "The Sevens." The applicant is simply
vacating the existing plat in order to re -plat the subject property with fewer lots. The original
Sevens plat consisted of five lots and two reserve areas, with the intention of selling the lots to
individual commercial developers. One of the lots was intended to be to location of a future
hotel. There is now a single commercial development that wishes to combine the lots to allow for
one larger parcel, with a smaller lot kept for the hotel. The vacated plat area will be
subsequently re- platted as the new Sevens plat, so there will be no lapse in the properly being
platted.
RECOMMENDATION:
Staff recommends approval of the vacation of the plat for the Sevens.

THIS VACATION OF PLAT AND TERMINATION OF DEED OF DEDICATION AND
RESTRICTIVE COVENANTS of THE SEVENS, PLAT NO. 6267 [ "Vacation "] is dated this
day of 2014.
WHEREAS the Plat and Deed of Dedication of THE SEVENS was recorded in the office
of the Tulsa County Clerk as Plat No. 6267 on February 3, 2009, and
WHEREAS the undersigned Shanta Hotel, LLC, an Oklahoma limited liability company,
Shiv Inn, LLC, an Oklahoma limited liability company, successor,by conversion to Shiv Inn, Inc.,
an Oklahoma corporation, and S & B Hotel, LLC, an Oklahoma limited liability company, are the
sole and only owners of all of the land included in the Plat of THE SEVENS, none of the lots
having been sold or conveyed to any other party, and
WHEREAS it is in the best interests of the owner of the property affected thereby to vacate

ANALYSIS:
An application has been submitted for a re- plat /final plat of The Sevens, a commercial plat that
has been approved but never developed. The original concept of the Sevens was to create a
commercial plat that offered a number of building lots for commercial businesses and a lot for a
hotel at the southwest corner along Garnett. The property never developed and now a
commercial tenant has proposed to combine all the lots for a single user. The lot of the
proposed hotel will remain, but the rest of the lots will become one lot. A re -plat will simply
approve a new layout of the lots, but will keep the dedications made in the original plat.
Access will be provided to the property through two entrances along N Garnett Rd, with the
main entrance aligning with E 19th St N, where a new traffic light will be proposed. A PUD was
originally approved on the project, but under the old PUD rules in the zoning code, the PUD
expired and is now null and void.
The plat will consist of two (2) lots in one (1) block and will retain the name The Sevens. There will
be no public streets on the site. Perimeter utility easements will provide for needed utility
connections upon development of the property. A fire access easement will be provided at the
northeast corner of the site, providing an emergency connection point from the subject
property to the adjacent hotel. A 'crash' gate will be placed in this area to only allow
emergency access.
Any development that occurs on the subject property must adhere to all subdivision, zoning,
and engineering requirements including but not limited to paved streets, landscaping, and
sidewalks. This property does fall within the US -169 Overlay and will have to be designed to meet
these requirements.
The property is served water by Owasso water, sanitary sewer, police, fire, and EMS service.
Utility easements are established throughout the proposed addition so as to adequately
accommodate utility services.
In a regional context, this proposed addition is in conformance with the Owasso 2030 Land Use
Master Plan, as the area is shown for commercial uses.
TECHNICAL ADVISORY COMMITTEE:
The Final Plat for The Sevens Re -plat was reviewed by the Owasso Technical Advisory Committee
at their regularly scheduled meeting held September 24, 2014. At that meeting, utility providers
and city staff were afforded the opportunity to comment on the application and request any
changes or modifications. The applicant has addressed all TAC comments.
RECOMMENDATION:
Staff recommends approval of the Final Plat of The Sevens, re- platting the property.

BACKGROUND:
The City of Owasso received a request for consideration and appropriate action related to the
review and acceptance of a unified sign plan request for the Sevens Unified Sign Plan. The
property is currently being re- platted with two lots on one block. Lot one (1) will be developed as

UNIFIED SIGN PLAN REVIEW PROCESS:
A unified sign plan (USP) is an application requesting approval of a comprehensive sign permit
establishing the size, location and design of signage on property being developed as a unit. The
purpose of a USP is to provide for the establishment of signage criteria that is tailored to a
specific development or location, which may vary from the provisions of this Code. The intent of
a USP is to provide flexibility in the sign criteria of the Owasso Zoning Code that promotes
superior design through architectural integration between - the site, buildings and other signs
that may be on or near the subject property.
National or international franchises shall be given reasonable consideration with respect to
company standard logos and lettering styles that are an integral part of the franchise image
and identity. The consideration shall not be without restriction and shall be within the boundaries
of sound zoning practice and planning and in harmony with the general purpose and intent of
the unified signage plan.
All unified sign plans are subject to the following restrictions;
(1) All unified sign plans shall include the location, size, height, construction material, color,
type of illumination and orientation of all proposed signs.
(2) All unified sign plans shall be reviewed by the City of Owasso Planning Commission and
shall conform to all conditions imposed by said Commission prior to the issuance of a sign
permit.
(3) Unified Sign Plans shall include all signage to be located within the perimeters of the
subject site whether in excess of the provisions of the current sign code or not.
(4) Unified Sign Plans may not propose a total sign square footage exceeding three (3)
square feet of signage per every one (1) linear foot of street frontage of the subject
property.
(5) Unified Sign Plans may not include any prohibited sign.
ANALYSIS:
The subject property falls within the US -169 Overlay district, where sign heights are restricted to
twenty (20) feet along Garnett Road and twenty -five (25) feet along US -169 for individual
parcels. The re -plat of the Sevens consists of two (2) parcels, with lot one (1) the only lot with
direct frontage along US -169. The applicant is requesting a Unified Sign Plan (USP) to allow for
the construction of one (1) 30' foot multi- tenant pole sign along the frontage of US -169, three (3)
individual wall signs (shown on the attached drawings), and one (1) single tenant eight (8) foot
monument style sign along the frontage of Garnett Road. The thirty (30) foot multi- tenant pole
sign along the highway frontage of US -169, will serve to accommodate signage for both lots one
(1) and two (2) of the re -plat of the Sevens. Limiting the entire property to one (1) pole sign for
two businesses along US -169 is more desirable and aesthetically pleasing than the potential of
two pole signs along the highway frontage. The USP does not propose a pole sign along Garnett
road, but rather a monument style sign. Again, this is a more desirable option than a twenty (20)
foot pole sign allowed by right. Wall signage placement and design for three wall faces is shown
on the attached drawings.
The thirty (30) foot multi- tenant sign will have two ninety -one (91) square foot areas for each
tenant with the pole placed in a split face block base. The monument sign indicated on the USP
is designed as a single tenant sign to be a maximum of eight (8) feet in height by ten (10) feet in
width with a fifty (50) square foot area containing the sign cabinet, The sign will be constructed
on a split -faced block base. The signs are proposed to be internally lit, with no additional lighting
planned. All the proposed signs are designed to complement the proposed architecture of the
Main building, completing a unified design of the site elements
Typically a unified sign plan is created for multiple - parcels (i.e. the Sam's site). With the
exception of the multi- tenant sign along US -169, the other signs identified in the USP cover only
the business occupying lot (1). However, this particular USP is unique in the sense that lot (2) has
an approved site plan for a hotel facility and approved building plans (although no permit has
been issued). Both of these documents indicate one (1) six (6) foot monument sign along
Garnett Road, and as such lot (2) will be restricted to a sign of this height.
RECOMMENDATION:
Staff recommends approval of the USP for the Sevens with the following conditions:
1. The signs remain only internally lit
2. Create a landscape bed at the base of the monument sign along Garnett as per the US-
169 Overlay District requirements.
3. Lot two (2) shall be restricted to a six (6) foot high monument sign as indicated on the
approved site and building plans.
4. Wall signs shall conform to the illustrations provided as part of the this USP

subject property is not platted and Is part of a larger piece of property known as the Morrow

The applicant is requesting a lot split to create a new lot that will be 0.895 acres in size for the
purpose of developing a restaurant facility.

ANALYSIS:
The CS zoning district requires a minimum lot frontage of 150 feet. The lot that would be created
from the proposed lot split leaves 125 feet of frontage. However, access from the lot would be
taken from an adjoining thirty -six (36) foot wide Mutual Access Easement (MAE) on the property
immediately to the west (to be recorded by separate instrument). Given this, the propose lot
would not have a driveway cut taking access from 116th St. N. One of the intents of the
minimum frontage requirement of 150 feet was to account for access points on commercial lots.
Because this lot will not have an access point within its boundaries and will take access from the
MAE to the west, staff does not foresee an issue with the reduced lot frontage, and in fact is
supportive of the concept of consolidating driveways. When the property to the west develops,
it too will use the MAE to access 116th St. N., thus reducing the need for extra curb cuts. No other
impacts regarding current access points, fire protection, private utility services, detention, or
setbacks are anticipated.
Any development that occurs on any of the subject property must adhere to all subdivision,
zoning, and engineering requirements including but not limited to paved streets, landscaping,
and sidewalks. Sanitary sewer service will be provided by City of Owasso and water by
Washington County Rural #3.
TECHNICAL ADVISORY COMMITTEE:
The Technical Advisory Committee (TAC) reviewed the lot split at their regularly scheduled
meeting on September 24, 2014. All TAC comments have been addressed by the applicant.
RECOMMENDATION:
Staff recommends approval of the lot split subject to the property being platted.

ANALYSIS:
The final plat for K -MAC provides a lot for the development of a restaurant facility located just
west of the existing McDonalds restaurant facility located at 116th St. N. and 135th E. Ave. The
plat shows one lot on one block with access to 116th St. N. taken from a joint access drive to be
recorded by separate instrument on the property to the west. This access point will align the
entrance with the west entrance in the Garrett Creek Shopping center adjacent to the Sonic
Restaurant. Therefore, the K -MAC lot will not have an internal access point connecting to 116th
St. North. The joint access drive will actually serve to consolidate access at one location that is
perpendicular to an existing drive to the south, which is more desirable from a safety and traffic
flow perspective.
Perimeter and interior utility easements will provide utility companies adequate access to
provide service and maintain service to the proposed development. The City of Owasso will
provide sanitary sewer service. Any development that occurs on the subject property must
adhere to all subdivision, zoning, and engineering requirements including but not limited to
paved streets, landscaping, and sidewalks. Any site plan submitted on the subject parcel shall
adhere to the requirements of the US -169 Overlay and those outlined in OPUD 05 -02. The
proposed commercial use for the property conforms to the land use prescribed under the 2030
Owasso Land Use Master Plan.

ANALYSIS:
An application has been submitted for a final plat of Rejoice Christian Campus for the
development of a K -12 Private Christian School. A portion of the property is currently utilized by
Rejoice Church which has operated on the site for number of years. The plat for Owasso Freewill
Baptist where the church is currently located will be vacated and the entire tract will be platted
as the Rejoice Christian Campus, with a lot for the school and for the church. Access will be
provided to the property through entrances on N 129th E Ave and E 1061h St N. The plat also
provides access to a future service road to the east of the proposed development.
The plat will consist of two (2) lots in one (1) block. There will be no public streets on the site.
Perimeter utility easements will provide for needed utility connections upon development of the
property. Due to the nature of a project of this magnitude that will include a church, elementary
school, mid -high school, performing arts center, sports stadium and numerous other sports
facilities, utility and drainage easements are run throughout the site. The applicant has worked
with the City, the water districts and the multiple utilities to provide adequate access points to
each of the uses on the campus.
This plat dedicates a small portion of area to be used for right -of -way for a future US -169 service
road that would be continued from the Garrett Creek Commercial development to the north, all
the way down to E 106th St N. The area to be dedicated is a portion of the parking lot used by
the Rejoice church. This dedication will allow for the construction of the service road in its
current planned alignment.
Any development that occurs on the subject property must adhere to all subdivision, zoning,
and engineering requirements including but not limited to paved streets, landscaping, and
sidewalks. This property does fall within the US -169 Overlay and will have to be designed to meet
these requirements. The applicant has submitted a site plan and civil engineering plans for staff
review. Approved earth moving work has commenced on the site.
The property is served water by Washington County Rural Water District #3, Owasso sanitary
sewer, police, fire, and EMS service. Utility easements are established throughout the proposed
addition so as to adequately accommodate utility services.
In a regional context, this proposed addition is in conformance with the Owasso 2030 Land Use
Master Plan, as the area is shown for transitional uses,
TECHNICAL ADVISORY COMMITTEE:
The Final Plat for The Rejoice School was reviewed by the Owasso Technical Advisory Committee
at their regularly scheduled meeting held September 24, 2014. At that meeting, utility providers
and city staff were afforded the opportunity to comment on the application and request any
changes or modifications. The applicant has addressed TAC comments.
RECOMMENDATION:
Staff recommends approval of the Final Plat for Rejoice Christian Campus.
