The Owasso Planning Commission met in regular session on Monday, November 7, 2011

The Commission reviewed the minutes of September 12, 2011 regular meeting.

Item 4. ZONING CODE AMENDMENT - CLOSING PROCESS - CONSIDERATION AND
APPROPRIATE ACTION RELATED TO A REQUEST TO REVIEW AND
RECOMMENDATION TO THE CITY COUNCIL OF A PROPOSED CHANGE OF
THE PROCESS FOR CLOSING AN EASEMENT.
Bronce Stephenson presented the item, recommending Planning Commission approval
of the Owasso Zoning Code amendment for a proposed change of the process for
closing an easement.
Discussion was held regarding the need for City Council to review and approve the
easement closure.

Alex Mills moved, seconded by Tammy Laakso, to approve the above amendment to
the Owasso Zoning Code with the following added language:
The City of Owasso shall retain the right to reopen any public way or easement
without expense to the City. The public way or easement may be reopened by
ordinance when:
1. The City of Owasso City Council deems it necessary, or
2. An application of the property owners owning more than one half in area of
the property abutting the public way or easement to be closed is filed with
the City of Owasso Community Development Department with subsequent
approval by City Council.
It is also suggested that applicants vacate the public way or easement by proceeding
through district court. A public way or easement can only be vacated after the City
Council approves the closing ordinance and the ordinance is taken to the court.
Vacating the public way or easement forecloses on the City's right to reopen the
public way or easement. No building permit may be issued for any development of an
area in the easement or right -of -way unless the easement or right -of -way has been
closed and vacated.
A vote on the motion was recorded as follows:

Item 5. ZONING CODE AMENDMENT - DEFINITIONS - CONSIDERATION AND
APPROPRIATE ACTION RELATED TO A REQUEST FOR THE REVIEW AND
RECOMMENDATION TO THE CITY COUNCIL THE ACCEPTANCE OF A
PROPOSED CHANGE OF THE DEFINITIONS CHAPTER.
Bronce Stephenson presented the item, recommending Planning Commission approval
of the Owasso Zoning Code amendment - Definitions for Amenity and Accessory
Dwelling Unit.
Bronce explained that Staff has made all the modifications discussed at the September
12, 2011 Planning Commission meeting.
After brief discussion David Vines moved, seconded by Alex Mills, to approve the above
zoning code amendment with the below verbiage stricken:
Accessory Dwelling Unit: A subordinate residential unit incorporated within, attached
to, or detached from a single - family residential unit and having its own sleeping and
sanitation facilities. This term shall refer to guest suites, mother -in -law quarters, and
similar type uses. Such subordinate unit shall not be olheFwlse segregated in ownership

PROPERTY CHARACTERISTICS:
The subject property is 20.1632 acres in size and comprised of 78 lots which are part of the entire
Lake Valley V Development.
ANALYSIS:
The applicant is requesting the review and approval of the final plat consisting of seventy eight
(78) lots in five (5) blocks in order to construct single family homes as part of the Lake Valley
development. The use of the property is governed by PUD 08 -01, which allows single family
homes. The property adjoins Chestnut Farms Estates to the east, which is comprised of 2.5 acre
home sites in Rogers County. The lots sizes in Lake Valley V, Phase I are significantly smaller and
average 5,500 to 6,000 SF.
The proposed final plat provides a reserve area on the east side of the property, which allows
access to utilities and stormwater drainage feature in Reserve Area D.
Any development that occurs on the subject property must adhere to all subdivision, zoning,
and engineering requirements including but not limited to paved streets, landscaping, and
sidewalks. The property is subject to all platting fees which include the Tulsa Technology Center
interceptor payback at $1,000.00 per acre and storm siren fee at $35.00 per acre.
The property is served water by Washington County Rural Water District #3, and Owasso, sanitary
sewer, police, fire, and EMS service. Utility easements are established throughout the proposed
addition so as to adequately accommodate utility services. All of the lots meet all of the bulk
area requirements of PUD 08 -01.
In a regional context, this proposed addition is in conformance with the Owasso 2015 Land Use
Master Plan, as the area is shown for residential uses.
TECHNICAL ADVISORY COMMITTEE:
The Final Plat for Lake Valley V, Phase I was reviewed by the Owasso Technical Advisory
Committee at their regularly scheduled meeting held January 25, 2012. At that meeting, utility
providers and city staff were afforded the opportunity to comment on the application and
request any changes or modifications. The minutes from the TAC meeting are attached.
RECOMMENDATION:
Staff recommends the Planning Commission approve the final plat for Lake Valley V, Phase I,
subject to addressing the TAC comments.

BACKGROUND:
The City of Owasso received a request for consideration and appropriate action related to the
review and acceptance of the Garrett Creek Commercial Unified Sign Plan. The property
contains a Reasors grocery store and is part of a commercial development along E. 1 16th Street
North called the Shops at Garrett Creek, located directly west of US -169. The physical address of
the site is 1 1560 North 1351h Street East. The site is comprised of 13.8 acres.

UNIFIED SIGN PLAN REVIEW PROCESS:
A unified sign plan (USP) is an application requesting approval of a comprehensive sign permit
establishing the size, location and design of signage on property being developed as a unit. The
purpose of a USP is to provide for the establishment of signage criteria that is tailored to a
specific development or location, which may vary from the provisions of this Code. The intent of
a USP is to provide flexibility in the sign criteria of the Owasso Zoning Code that promotes
superior design through architectural integration between - the site, buildings and other signs
that may be on or near the subject property.
National or international franchises shall be given reasonable consideration with respect to
company standard logos and lettering styles that are an integral part of the franchise image
and identity. The consideration shall not be without restriction and shall be within the boundaries
of sound zoning practice and planning and in harmony with the general purpose and intent of
the unified signage plan.
All unified sign plans are subject to the following restrictions:
(1) All unified sign plans shall include the location, size, height, construction material, color, type
of illumination and orientation of all proposed signs.
(2) All unified sign plans shall be reviewed by the City of Owasso Planning Commission and shall
conform to all conditions imposed by said Commission prior to the issuance of a sign permit.
(3) Unified Sign Plans shall include all signage to be located within the perimeters of the subject
site whether in excess of the provisions of the current sign code or not.
(4) Unified Sign Plans may not propose a total sign square footage exceeding three (3) square
feet of signage per every one (1) linear foot of street frontage of the subject property.
(5) Unified Sign Plans may not include any prohibited sign.
ANALYSIS:
The applicant is requesting a Unified Sign Plan to allow for the construction of a single sign for the
Garrett Creek shopping center. The sign area will allow for eleven (1 I) tenant signs to be placed
on the face of the sign and will include the Garrett Creek label at the top of the structure. The
sign has a structural base with a decorative rock fascia. Two (2) structural poles support the sign.
The sign is designed at a height of fifty (50) feet and approximately fourteen (14) feet in width.
Considering that a large residential area exists to the west and south, staff has concerns about
the sign height and recommends the applicant reduce the height to forty (40) feet to help
mitigate any negative impacts to the adjoining neighborhood. Additionally, staff suggests that
the decorative stone used for the base be extended up the sign in order to create a more
attractive sign that blends in with the character of the Garrett Creek Commercial development.
Staff also suggests that the area around the sign base be planted with attractive landscaping
material.
RECOMMENDATION:
Staff recommends approval of the unified sign plan for the Garrett Creek Commercial shopping
center with the following conditions:
1. Decrease the sign height by ten (10) feet to a maximum total height of forty (40) feet.
2. Continue the stone from the base of the structure up the poles to at least the base of the
sign area.
3. Create a landscape bed at the base of the sign.

BACKGROUND
The Community Development Department is currently working on a comprehensive update of
the Owasso Zoning Code. Chapter 9 of the Zoning Code addresses off - street parking
requirements and was identified as one of the key areas needing an update. The current
Chapter 9 lacks a comprehensive approach for the safe development of off - street parking
areas in commercial and residential areas, lacks key information critical to site designers, and is
antiquated in many areas. The new chapter provides the needed updates to the current
Chapter 9 and provides opportunities for alternative design methods and construction materials.
The information provided within the proposed new parking chapter will facilitate the efficient
design of driveways, aisles, pedestrian walkways, parking stalls and promote the safe movement
of traffic in commercial areas. Additionally, these changes encourage the use of 'green'
materials and methods establishing Owasso as a progressive and environmentally responsible
community in Oklahoma.
The proposed new parking chapter also proposes language that will provide opportunities and
alternatives to parking situations which have arisen in older portions of Owasso where off - street
parking is limited, forcing some residents to park in yard areas which are subject to code
enforcement. Much like the recently adopted landscape chapter, these proposed changes
offer a variety of choices for those designing parking areas while at the same time ensuring that
Owasso provides for the health, safety and welfare of drivers, bicyclists and pedestrians.
This proposed new chapter complements the principles outlined in the recently adopted Quality
of Life Initiative. Additionally, this chapter provides design alternatives that allow for more
'green' development complementing the 'Go- Green' Initiative. The City of Owasso adopted
the 'Go Green' Initiative in 2009, with a goal of bringing about positive change in the way the
City operates and develops. The language contained within the new proposed Chapter 9
complements the recently adopted Landscape Chapter of the Owasso Zoning Code, works
with existing plans and initiatives and other planned updates of the Owasso Zoning Code.
PROPOSED AMENDMENT TO THE ZONING CODE:
The proposed amendment to the City of Owasso Zoning Code replaces the existing Chapter 9
with a new Chapter 9, Off - Street Parking.
RECOMMENDATION:
Staff recommends Planning Commission approval of the proposed zoning code amendment.

Documentation of how permeable paving systems would be installed shall be
provided for review and approval. Permeable paving systems include but are

All private parking lot surfaces shall be maintained in such a way as to ensure a
safe and flat travel surface. Potholes, large cracks, and pieces of paving that
are missing shall be replaced and /or repaired. Curbing shall be repaired or
replaced whenever it becomes broken. Failure to maintain parking lots in a

safe manner shall constitute a Zoning Code violation and shall be subject to
enforcement.
9.1.3 STRIPING
All parking spaces, required ADA improvements, drive lanes, no- parking areas,
and all other required components shall be clearly striped or delineated. All
striping shall be clearly maintained and visible. If striping is faded or becomes
removed, it shall be replaced in the exact layout as approved. Failure to meet
these criteria shall be handled as a Zoning Code violation and shall be subject
to enforcement.

9.3.3 COMPACT PARKING SPACE DESIGN
Compact parking is an option for new development, but is not required. For
any parking tot, up to 10% of the parking stalls may be constructed as compact
parking spaces. Compact parking spaces shalt be a minimum of eight and a half
(8.5) feet wide and a minimum of seventeen (17) feet long. All compact
parking areas shall provide a landscape strip or raised area with stamped
concrete at least 8.5 feet wide and 3 feet deep at the front of each space.
The rear of the compact parking spaces shall align with all other parking spaces
in the row. Signage shall be provided for each compact space. See Figure 9.1.

9.3.4 MOTORCYCLE PARKING
A. Motorcycle parking is encouraged to be provided for all businesses.
Parking spaces designed to be used only as motorcycle spaces shall be
designed according to these standards. Signage and appropriate striping
shall be provided for all motorcycle parking areas. Any business that

automobile parking space by one (1), up to a maximum of ten (10)

9.3.7 QUEUING REQUIREMENTS

Curbs cuts for all residential driveways shall meet the City of Owasso
standards. Driveways shall be a minimum of ten (10) and a maximum of
thirty -five (35) feet in width. All driveways or other improvements that
require cutting or modifying a City sidewalk, curb, gutter, storm water
conveyance system or street shall require a curb cut permit through the
City of Owasso. All curb cuts or association modifications shall follow
City of Owasso Design Standards.
