OWASSO PLANNING COMMISSION MINUTES OF REGULAR MEETING Monday, March 12, 2012 The Owasso Planning Commission met in regularsession on Monday, March 12, 2012 at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 3:00 p.m. on March 8, 2012. ITEM 1. CALL TO ORDER Dr. Callery called the meeting to order at 6:05 p.m. ITEM 2. ROLL CALL PRESENT ABSENT Dr. Mark Callery Dr. Paul Loving David Vines Tammy Laakso Alex Mills A quorum was declared present. STAFF Karl Fritschen Marsha Hensley Bronce Stephenson Daniel Dearing Chelsea Harkins ITEM 3. CONSIDER APPROVAL OF THE MINUTES OF FEBRUARY 13, 2012 REGULAR MEETING. The Commission reviewed the minutes. David Vines moved, seconded by Tammy Laasko, to approve the minutes. A vote on the motion was recorded as follows: YEA: Callery, Loving, Vines, Laakso, Mills NAY: None Motion carried 5 -0. Item 4. PUBLIC HEARING - US -169 NORTH OVERLAY DISTRICT - CONSIDERATION AND APPROPRIATE ACTION RELATED TO A REQUEST TO REVIEW AND RECOMMENDATION TO THE CITY COUNCIL OF A DRAFT FOR A PROPOSED NEW OVERLAY DISTRICT COVERING THE NORTHERN PORTIONS OF THE US -169 CORRIDOR. OWASSO PLANNING COMMISSION March 12, 2012 Page No. 2 Karl Fritschen introduced the item. Mr. Fritschen stated that a public, open house meeting was held on March 5th in order to answer any questions that citizens may have. The Owasso Economic Authority has reviewed this item several times and City Council reviewed the draft twice. The overlay is designed to protect the future of the city and will be used to protect undesirable uses. If this draft is approved, it doesn't require any changes to the surrounding neighborhoods. Bronce Stephenson presented a brief overview, recommending the Planning Commission approval of the draft for the proposed new overlay district. He presented a slide show depicting undesirable types of development and signs. Also shown were desirable multi - tenant signs and desirable, compatible buildings. Notification letters were sent to surrounding property owners within 300' of the proposed overlay district and posted in the Owasso Reporter. The following are questions and comments from the Commissioners: David Vines - What changes were made from the March 5th open house meeting and City Council comments? • The underlined portion in the draft are the changes /additions that were made. Alex Mills - How much of the proposed district is not in the city limits of Owasso? • A good amount is out of the city limits. If property is not annexed we cannot force annexation. It must be the request of the property owner. Paul Loving - Is this like we are amending the Owasso Master Plan? • Yes, this overlay will be shown on the master plan. Paul Loving - Will this create conflict with Tulsa County planning? • No, there is no future planning within our fence line. PUBLIC HEARING WAS OPENED AT 6:35 PM. Approximately 45 Owasso residents were present. The following comments /questions were expressed: Marion Watkins - 12122 North 145 East Avenue - Doesn't trust the city. He will let somebody buy his property and they can deal with the city. • Bronce affirmed that this overlay district proposal will ensure the orderly development of the area. It will protect what is there and it will protect the future businesses. Ron Paris -14100 East 122 Street North - If we can vote on this, he votes no. OWASSO PLANNING COMMISSION March 12, 2012 Page No. 3 Johnny Yeary -14000 East 126 Street North -This is all double talk. You can annex my property whenever you want. He is tired of the city pushing folks out of their homes. Bronce explained that property cannot be annexed unless the property owner agrees. Grant Stewart -Commercial Real Estate Broker for Garrett Creek Commercial Center - He appreciates the fact that Owasso is trying to protect the most valuable corridor. What other cities have an overlay district in place? He had concerns regarding the restrictions of outdoor storage of supplies. What will be the process? Who maintains the boulevards that will be required with a 5,000 sq. ft. building? It seems that an overlay district would create a city to be more difficult to develop in. • Bronce stated that Stillwater, Edmond, Broken Arrow and Tulsa all have overlay districts. He also described the site plan process. Don LeMieux- 9908 North 129 East Avenue - Would be interested in selling his property for commercial use. Janyce Duncan - 13108 East 106 Street North - It seems that a lot of this district is not in the city limits. What if we want a chicken processing plant to be constructed, who would say yes, you can or no, you cannot? What would be the advantage of being in the city limits of Owasso? • Karl stated that if the property is not within the city limits it would be Tulsa County that decides if that use is appropriate. The advantage of being in the city limits would be police protection, sanitary sewer and water. Sharon Yeary -14000 East 126 Street North - Wants to see pastureland surrounding her. Several of the businesses on East 76 Street North and East 86 Street North are closing, leaving the buildings empty. Also, Tyann Plaza is not fully occupied. Would like to vote no. • Bronce explained that there is a possibility of a second overlay on the south end of Owasso. Mark Fleia -14124 East 122 Street North - Can you be annexed if surrounded by four sides of city limits? Could Collinsville put in a casino at East 126 Street North? • Bronce stated that we cannot annex property without the consent of the property owner. With regards to the possibility of a casino being constructed at East 126 Street North, that area is out of the City of Owasso's jurisdiction. Connie Warlick -13302 East 104 Street North - She has lived there for 18 years, would like to sell her property. Peter Jackson -11836 North 129 East Avenue - Had questions regarding the Morrow property. Will the residential portion change to commercial zoning? OWASSO PLANNING COMMISSION March 12, 2012 Page No. 4 Don Fort -13204 East 103 Street North - Wants to sell his property. PUBLIC HEARING WAS CLOSED AT 7:25 PM. Chelsea Harkins requested a brief presentation. Ms. Harkins thanked the citizens for coming to the meeting and explained that the proposed overlay is to protect the community while we are growing. We are trying to bring in high paying jobs and want Owasso to look aesthetically pleasing. This proposed overlay district is to protect your personal property and compliment Owasso. The Owasso Economic Development Authority has reviewed this item and has endorsed this draft. Tammy Loasko moved, seconded by Dr. Loving, to approve the above draft for the new overlay district. A vote on the motion was recorded as follows: YEA: Callery, Loving, Vines, Laakso, Mills NAY: None Motion carried 5 -0. Item 5. REPORT ON ITEMS FROM THE FEBRUARY 22, 2012 TAC MEETING. Item b. SYSTEM REQUIREMENTS A small wind energy system is permitted in any zoning district. 00 B. Minimum Lot Size. No wind energy system shall be erected on any lot less than one acre in size. C. Total Height. For property sizes between one acre and two acres, the total height shall not exceed 60 feet. For property sizes between two and five acres, the total height shall not exceed 80 feet. For property sizes greater than five acres, the total height shall not exceed 100 feet. D. Location. No small wind energy system shall be located in any front or side yard. E. Setbacks. 1. A small wind energy system shall be set back from the nearest property line, public road right -of -way and communication and electrical line not less than 1.5 times its total height. 2. No small wind energy system shall cause permanent and material interference with television or other communication signals. 8. Overspeed Controls. Every small wind energy system shall be equipped with both manual and automatic overspeed controls. G. Permit Applications. Stephenson, City Planner SUBJECT: Preliminary and Final Plat, Willis Farms Addition PARCEL SIZE: 29.998 acres ZONING: Commercial Shopping (CS) DATE: April 2, 2012 BACKGROUND: The City of Owasso received a Preliminary and Final Plat application for review and approval of the Willis Farms Addition. The Willis Farms Addition plat proposes six (6) lots on approximately 29.998 acres of property. The applicant wishes to plat the properly for the development of a commercial area. The properly has historically been used as single - family residential and agricultural land. The applicant is platting the property for the purposes of developing a commercial area with one larger tenant and five smaller parcels for future development. Cross access easements are proposed to provide internal access to the smaller lots, ensuring that no additional curb cuts are made onto E. 96th St N. Three (3) driveways are proposed along E 96th St N and two (2) driveways along the service road at the west of the subject property according to site plan. There are utility easements located along the perimeter of each lot and internally on lot 1, providing the necessary access for all required utilities. A Reserve area 'A' is proposed to handle the detention for the future development of lots 2,3,4,5 and 6. The detention for lot 1 will be contained on the lot itself. The subdivision regulations state that any final plat that is not recorded in Tulsa County within 6 months of approval shall be null and void. Any development that occurs on the subject property must adhere to all subdivision, zoning, and engineering requirements including but not limited to paved streets, landscaping, and sidewalks. Sanitary sewer, police, fire, water, and EMS service will be provided by the City of Owasso. The property does not fall within a sanitary sewer payback area, but will be subject to the Storm Siren fee of $35 per acre. Technical Advisory Committee (TAC): The Technical Advisory Committee reviewed the preliminary and final plat for the Willis Farms Addition at their regularly scheduled meeting on March 28, 2012. The TAC comments are attached. RECOMMENDATION: Staff recommends the Planning Commission approve the preliminary and final plat for Willis Farms Addition subject to addressing all TAC and Engineering Department comments. Public Works- Drainage study needs to be provided for approval. • Address the possibility of traffic bottlenecking at the western exit.
