OWASSO PLANNING COMMISSION MINUTES OF REGULAR.MEETING Monday, May 7, 2012 The Owasso Planning Commission met in regular session on Monday, May 7, 2012 at Old Central per the Notice of Public Meeting and Agenda posted on the City Hall bulletin board at 3:00 p.m. on May 3, 2012. ITEM 1. CALL TO ORDER Dr. Callery called the meeting to order at 6:00 p.m. ITEM 2. ROLL CALL PRESENT ABSENT Dr. Paul Loving Dr. Mark Callery David Vines Tammy Laakso Alex Mills A quorum was declared present. STAFF Karl Fritschen Marsha Hensley Bronce Stephenson Daniel Dearing Warren Lehr Julie Lombardi Rodney Ray Dan Salts ITEM 3. CONSIDER APPROVAL OF THE MINUTES OF APRIL 9, 2012 REGULAR MEETING. The Commission reviewed the minutes. Alex Mills moved, seconded by Dr. Loving, to approve the minutes. A vote on the motion was recorded as follows: YEA: Callery, Loving, Vines, Laakso, Mills NAY: None Motion carried 5 -0. Item 4. Rezoning OZ 12- 02 /OPUD 12 -01, 9inetyEiaht - Consideration and appropriate action related to the request for the review and acceptance of a 15.29 acre Planned Unit Development with an underlying zoning of RM (Residential Multi - family) located south of Owasso Medical Campus and north of Owasso Market. OWASSO PLANNING COMMISSION May 7, 2012 Page No. 2 Bronce Stephenson presented a brief overview, recommending the Planning Commission approval of the rezoning #OZ 12 -02 /OPUD # 12 -01. David Vines moved, seconded by Alex Mills, to approve the above Planned Unit Development with an underlying zoning of RM (Residential Multi - family), subject to all staff and TAC requirements. A vote on the motion was recorded as follows: YEA: Callery, Loving, Vines, Laakso, Mills NAY: None Motion carried 5 -0. ITEM 5. Final Plat - Lakeridge Shopoina Center - Consideration and appropriate action related to the request for the review and acceptance of a final plat consisting of one (1) lot, one (1) block, on approximately 0.70 acres located at 12375 East 86th Street North. Bronce Stephenson presented a brief overview, recommending the Planning Commission approval of the Final Plat for Lakeridge Shopping Center. David Vines moved, to approve Lakeridge Shopping Center Final Plat, subject to striking the f6116wing TAC recommendation /comment: .1- • Consider moving the east side access 30' to the west. Replace with the following recommendation /comment: • The above motion is subject to all mutual access easements being noted on the Final Plat. Seconded by Alex Mills. A vote on the motion was recorded as follows: YEA: Callery, Loving, Vines, Laakso, Mills NAY: None Motion carried 5 -0. ITEM 6. Re- Approval of Final Plat - Villas at Stonebridge - Consideration and appropriate action related to the request for the review and acceptance of a final plat consisting of thirty -eight (38) lots in two (2) blocks on 5.2288 acres located on East 761h Street North and approximately 1/3 of a mile east of North 129th East Avenue. Bronce Stephenson presented a brief overview, recommending the Planning Commission approval of the Final Plat for the Villas at Stonebridge. Amendment to the 2025 Land Use Master Plan - Consideration and appropriate action related to a request for the review and acceptance of an amendment to the 2025 Land Use Master Plan to allow for residential multi - family development located south of Owasso Medical Campus and north of Owasso Market. Alex Mills moved, seconded by Dr. Loving, to approve the above amendment to the 2025 Land Use Master Plan. A vote on the motion was recorded as follows: YEA: Callery, Loving, Vines, Laakso, Mills NAY: None Motion carried 5 -0. ITEM 8. Public Hearing - Small Wind Enemy Systems - Consideration and appropriate action related to a request.to review and recommendation to the City Council of a draft for a proposed zoning code text amendment regarding Chapter 15, Small Wind Energy Systems. Karl Fritschen introduced the item and recommends approval of the proposed zoning code amendment to Chapter 15 of the Owasso Zoning Code. PUBLIC HEARING WAS OPENED AT 6:34 PM. The following comments were expressed: David Vines suggested considering a height requirement according to FFA. Maybe add some verbiage stating the distance of any nearby airports. Karl recommends any tower over sixty feet provide approval from FFA. Bronce reminded the Commissioners that all requests would be submitted as a Specific Use Permit. This type of permit would require notification to a 300' radius. PUBLIC HEARING WAS CLOSED AT 6:40 PM. Dr. Loving moved to approve the review and recommendation to the City Council of the OWASSO PLANNING COMMISSION May 7, 2012 Page No. 4 draft for the above zoning code text amendment, subject to consideration of the above comments. David Vines seconded the motion. A vote on the motion was recorded as follows: YEA: Callery, Loving, Vines, Laakso, Mills NAY: None Motion carried 5 -0. ITEM 9. Stephenson City Planner SUBJECT: Preliminary Plat-96th Street North Center PARCEL SIZE: 2.2 Acres ZONING: CG (Commercial General) DATE: June 11, 2012 BACKGROUND: The City of Owasso received a preliminary plat for review and approval of the 96th Street North Center. The 96th Street North Center proposes two (2) lots on one (1) block on approximately 2.2 acres of property. The applicant wishes to plat the property for the development of a Braum's Ice Cream and Dairy Store on Lot 1. Another commercial business is in the early stages of development on lot 2. The applicant is platting the property for the purposes of developing a Braum's Ice Cream and Dairy Store. The subject property is located appro>mately 332' east of the northeast corner East 961h Street North and North Garnett Road. Staff is working with the developer and surrounding property owners to develop a plan that will ensure this important commercial corridor develops in a safe yet attractive manner. It is the intent of City staff to reduce the number of curb cuts and to ma:amize the internal flow of traffic within commercial areas. Considering this, staff is working with the developer to reduce the number of curb cuts on the subject property from three (3) to two (2), making use of a mutual access easement located to the west of the subject property. By allowing the driveway for lot 2 to tie into the road on the lot west of the subject property, it reduces the extra curb cuts that would be necessary for lot 2 and for the development of the property to the west located on the hard corner of the intersection. Additional mutual access driveways and internal connections allow future development to share driveways and reduce traffic conflict points on East 96th St North. There is a 17.5' perimeter utility easement shown on the preliminary plat that will provide utility companies' access to service the development. Technical Advisory Committee (TAC): The Technical Advisory Committee reviewed the preliminary plat for the 96th Street North Center at their regularly scheduled meeting on May 23, 2012. The TAC comments are attached. Any development that occurs on the subject property must adhere to all subdivision, zoning, and engineering requirements including but not limited to paved streets, landscaping, and sidewalks. Sanitary sewer, police, fire, water, and EMS service will be provided by the City of Owasso. The property is subject to any applicable payback fees, including the Storm Siren fee of $35 per acre. This area falls within the Garnett Regional Detention Facility Payback area, which is assessed at $30,737 per acre. The applicant will have one (1) year to submit a final plat for the project from the date of Planning Commission Approval. The subdivision regulations state that any preliminary plat not receiving final plat approval within (1) year shall be null and void. RECOMMENDATION: Staff recommends the Planning Commission approve the preliminary plat subject to addressing all TAC and Engineering Department comments. ATTACHMENTS: A. Area Map B. Aerial Map C.
