at Old Central per the Notice of Public Meeting and Agenda posted at City Hall, 200 S.

ITEM 6. Specific Use Permit 16 -03 Auto Dealership - Consideration and
appropriate action relating to the request for the review and
acceptance of a specific use permit to allow for a car dealership on
property zoned CS (Commercial Shopping) zoning district. The subject

property is located on the east side of US -169 service road approximately
'A mile south of E 1061h St N and is within the US -169 Overlay District.
Bronce Stephenson presented the staff report. The property location was described.
The Owasso Technical Advisory Committee reviewed the final plat at their August 24,
2016 meeting. Staff recommends approval of the specific use permit request, subject to
Planning Commission recommendation with the conditions listed below:
• Signage shall be limited to a height of 20 feet and only monument sign type. No
additional signage other than signage on the building shall be allowed (does
not include directional signage).
• No digital signage shall be used on the property.
• No banners, flags, balloons, inflatables, temporary signs, streamers or other
advertising methods shall be allowed to be used on the site or attached to any
vehicles. Any short-term (3 days or less) tents or tent sales shall be subject to
approval by the Community Development Department.
No vehicles shall be allowed to be displayed outside of the site within the public
right -of -way.
• Any vehicle display ramps shall be built as berms and lined with rock and /or
landscaping. No metal display racks shall be allowed.
• No exterior loudspeakers shall be allowed on the back side of the development.
• A minimum 6' opaque screening fence shall be required along the backside of
the project.
• All non - essential lighting shall be turned off from the hours of 9PM to 6AM.
• Additional landscaping shall be provided on the site, subject to staff approval.
A portion of the landscaping may be "banked" for use off -site in public areas.
• All standards of the US -169 Overlay shall be met.
• All site lighting shall be LED.
• White vinyl fencing (per Owasso standard) shall be installed along US -169
frontage for length of property.
Discussion was held regarding the flag pole height. Also discussed was certain
requirements of the 169 overlay district, such as the side and back wall facades.
Mr. Vines moved, seconded by Mr. Miller, to approve SUP 16 -03, subject to staff and TAC
recommendations listed above. Also, subject to the following recommendations:
• Landscape plan will be reviewed at the site plan stage.
• Loading and unloading of vehicles shall be on site only.
• Commissioners will approve a 120' flagpole with the FAA approval.
A vote on the motion was recorded as follows:

ITEM 7. Final Plat - Somerset of Owasso - Consideration and appropriate action
relating to the request for the review and acceptance of a final plat
proposing forty -five (45) lots in six (6) blocks. The general location is N 140th
E Ave and E 96th St N and is approximately 9.53 acres. The property is
zoned PUD 16-01 with the underlying zoning of RS -3 (Residential Single -
family) zoning district.
Karl Fritschen presented the staff report and described the property location.
The Owasso Technical Advisory Committee reviewed the final plat at their August 24,
2016 meeting. Staff recommends Planning Commission approval of the final plat.
Mr. Miller moved, seconded by Mr. Vines, to approve the final plat, subject to the
staff and TAC recommendations. A vote on the motion was recorded as follows:

Bronce presented the staff report on the possible creation of a TIF - district in
downtown Owasso. Dr. Loving moved to nominate Mr. Vines to serve on
the review committee. The motion was seconded by Mr. Miller. A vote on

ANALYSIS:
The Final plat for Carrington Pointe II will add 93 lots to the existing Carrington Pointe
development and bring the neighborhood total lot count to 279. New public streets and
Infrastructure will be built with this phase of the development. Stormwater will be handled by a
detention area that was platted with Carrington Pointe I.
Perimeter and interior utility easements will provide utility companies adequate access to
provide service and maintain service to the lots within the proposed development. Any
development that occurs on the subject property must adhere to all subdivision, zoning, and
engineering requirements including but not limited to paved streets, landscaping, and sidewalks.
The City of Owasso will provide Police, Fire, EMS and sanitary sewer service, with water provided
by Washington County Rural Water District #3.
TECHNICAL ADVISORY COMMITTEE (TAC):
The Technical Advisory Committee reviewed the Final Plat for Carrington Pointe II at their
regularly scheduled meeting on September 28, 2016. The TAC comments are attached.
RECOMMENDATION:

ANALYSIS:
The Final Plat for Oklahoma Central Credit Union proposes one (1) lot in one (1) block. The
property is situated at the northeast corner of E 116th St N and N 129th E Ave and is approximately
2.37 acres in size. The property was annexed in November 2005, under ordinance 832 and PUD
05 -02A was approved in August 2015. The property is part of the Morrow Place PUD 05 -02A with
underlying zoning of CS. This location was called out as development area "D" in the PUD
document and allows commercial and multifamily uses, so the proposed development would
be in compliance with the PUD.
The final plat proposes three (3) Mutual Access Easements (MAE); two (2) along the eastern
boundary and one (1) along the north boundary. These MAE's will ensure cross access with
future developments to the north and east. Additionally, the driveway to E 1 I 61 St N will be a
right -in and right -out only, as left turns will not be permitted because E 116th St N will eventually
be widened as a boulevard with center medians. Preliminary plans for the proposed road
improvements to E 116th St N and N 129th E Ave were supplied to the applicant, and the plat
accounts for future road improvements. This Final Plat also dedicates the necessary right -of way
for the expansion of the N 1291h E Ave & E 116th St N intersection. Perimeter utility easements
have been provided that will allow utility companies adequate access to provide service and
maintain service to the proposed development.
The City of Owasso will provide Police, Fire, EMS and sanitary sewer service, with water service
provided by Washington County Rural #3. Any development that occurs on the subject
property must adhere to all subdivision, zoning, and engineering requirements including but not
limited to paved streets, landscaping, and sidewalks. The property lies within the US -169 Overlay

overlay district as well as those outlined in PUD 05 -02A, if applicable.

scheduled meeting on September 28, 2016.
RECOMMENDATION:

SUBJECT: Change of Access, Ator Center II Amended

BACKGROUND:
The City of Owasso received a request from the Cowen Engineering Group for a change of
access for Lot 2, Block I of Ator Center II Amended. The change of access request involves
shifting one of the current Limits of Access (LOA) southward approximately 40 feet in order to
avoid a large stormwater structure and manhole that lie within the current LOA and would
prohibit the placement of a driveway. The City Engineer is in support of the request.
The Owasso Subdivision Regulations allow a change of access to be processed by the
Community Development Department with a letter and exhibit submitted from the owner or
owner's engineer requesting a change of the recorded limits of access from a filed plat and
the reason for the request. The Technical Advisory Committee shall review the proposed
change of access and evaluate whether the proposed changes would increase problems
with the public traffic flow, utility easements and the implementation of various plans
adopted by the City, or would create problems with the flow of traffic on private streets
owned by persons other than the applicant. The Community Development Department;
submits a report to the Planning Commission who shall review the proposed change of .
access and either approve, approve with conditions or disapprove. The process is similar to a
lot split where the Planning Commission Chairperson signs the instrument along with the
owner or owner's agent that executes the change. This instrument is then filed at the Tulsa
County Clerk's office.

ANALYSIS:
The final plat for Ator Center II was amended and approved by the City Council on March 15,
2016. The amended plat reestablished new Limits of No Access and Limits of Access along
Garnett road and for small portions of E 87th St N based on new lot configurations. When site
plans for new developments are prepared, the access points establish where the driveways will
be located. Recently a site plan for a hotel project was submitted to staff for review on Lot 2,
Block 1. The driveway for the facility was placed within the limits of access location denoted on
the filed plat, however, the City Engineer noticed that a major stormwater structure was in the
middle of the proposed driveway. This is not a desirable situation to have a storm structure in the
middle of a driveway to a commercial use that generates a significant amount of vehicle trips.
This would also be a major expense to relocate the structure.
The request brought forth seeks to move the limits of access on the current recorded plat
southward approximately 40 feet, which will eliminate the conflict with the driveway and
stormwater structure and result in safer driveway into the proposed hotel site for the public. The
shift in the access location will not cause any alignment issues with driveways to the east across
Garnett, because none currently exist. The City Engineer supports the change in access.
A change of access to a filed plat requires Planning Commission approval and a subsequent
instrument to be signed by the Commission chairman that is recorded at the office of Tulsa
County Clerk.
RECOMMENDATION:
Staff recommends approval of the change of access for Lot 2, Block], Afar Center II.

Per the discussion this day at the TAC Meeting regarding the Home2 Suites Site Plan and
Change of Access, there was discussion regarding the existing Limits of No Access and Access
Location per the filed Ator Center II plat, and the conflict with those locations with an existing
storm sewer inlet on North Garnett Road.
It was discussed and agreed that the Access would be modified so that the entrance to the site
would move southward enough to miss the inlet. Essentially the radius for the entrance would
begin at the southern end of the inlet apron.
A written agreement describing the formal approval of the relocation of the Access and Limits of
No Access shall be processed and filed appropriately with Tulsa County so that the revision to
the filed plat Access Limits is recorded for reference with the filed Ator Center II plat.
Please advise promptly if there are any comments above that are not in general agreement with
the discussion from the TAC meeting.

BACKGROUND & ANALYSIS:
When the 2030 GrOwasso Land Use Plan was adopted by the City Council in July 2014, a special
planning area was denoted on the map outlining the downtown area. This section reads as
follows:
Downtown Development District
Part of the adopted 2004 Downtown Plan, this area is identified as a key
redevelopment area. Industrial uses and intensive commercial zoning should be
avoided. Rather, low intensity pedestrian scale commercial, office, and
residential uses above retail should be encouraged, as well as attractive
architecture. Signage should also be carefully controlled with an emphasis on
pedestrian 'scale. Consideration should be given to one or more of the following:
implementation of mixed use zoning or form based codes, preparation of small
area plan, preparation of an overlay district, and formation of an architectural
review board.
Recent developments associated with the 2015 Downtown Overlay District and the potential
creation of a Tax Increment Financing (TIF) District for the downtown area, have created the
need to revisit the Downtown Development District Boundary identified on the 2030 Land Use
Plan map in relation to the proposed boundary. Staff believes that it is important to have the
maps of the Overlay District and the potential TIF District match the map of the Land Use Master
Plan, creating the need for this map amendment.
The following is an excerpt from Executive Summary of the adopted 2030 Land Use Plan
document.
Recognizing that unforeseen changes may occur, the Plan is a flexible document
that provides a reliable tool for evaluating development proposals. Procedures
are available allowing amendments to the Plan where warranted. Amendments
will be evaluated based on how they maintain the goals of the Plan and if the
change is consistent with the overall concepts of the Plan.
The potential downtown redevelopment activity, the newly created Redbud District and the
potential creation of a TIF District for the original town area of Owasso represent a significant
change since the adoption of the 2030 Land Use Master Plan, therefore this change is necessary.
RECOMMENDATION:
Staff recommends the boundary for the Downtown Development District depicted on GrOwasso
2030 Land Use Master Plan be modified as shown on the draft dated 10.6.2016.
