CALL TO ORDER — Marilyn Hinkle called the meeting to order at 6:04 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF JUNE 7, 2010 REGULAR MEETING — The Commission reviewed the minutes of June 7, 2010 regular meeting. Dr. Callery moved to approve the minutes and Dr. Loving seconded the motion. A vote on the motion was recorded as follows: Marilyn Hinkle - Yes Dr. Paul Loving — Yes Dr. Mark Callery — Yes The motion was approved 3 -0. 4. Easement Closure — Consideration and appropriate action related to a request to review an easement closure on property located '/4 of a mile north of East 10e Street North and just due east ofthe Owasso Expressway. Marilyn Hinkle presented the item and Larissa reviewed the staff report. The location and the surrounding land use were described. The tract is zoned for office medium and is currently vacant with future plans to construct a Tulsa Technology Center Campus. The applicant desires to close the 15' utility easement that runs west to east through the center of the tract. The easement is currently vacant. The property will be served by Rural Water District No. 3 Washington County, municipal wastewater, police, fire and EMS service. The request was reviewed by Technical Advisory Committee on June 23, 2010. There were no comments made in regards to this item. A representative from Crafton -Tull Architects was present to address any concerns. Staff recommends approval. Dr. Callery moved to approve, Marilyn Hinkle seconded. Preliminary Plat — Cambridge Medical Park — Consideration and appropriate action related to a request to review a preliminary plat proposing three commercial lots, in one block, on 4.39 acres of land, located appro)dmately'/4 of a mile north of East 96 s Street North and' /2 of a mile East of North Garnett Road. Marilyn Hinkle presented the item and Larissa reviewed the staff report. The location and the surrounding land use were described. The tract is zoned for office medium. The development process was described. The applicant is requesting the review and approval so that they may plat and develop the property with medical office uses. The developer would like to create 3 lots, in 1 block, on 4.39 acres of land. Sewer service and water service will be provided by Rural Water District No.3 of Washington County. The property is subject to storm siren payback fees of $35.00 per acre. The plat was reviewed at the Technical Advisory Committee on June 23, 2010. Mr. Dennis Blind was present to address any concerns. The plat was approved with the following condition: e Add language for Rural Water District No.3 Washington County Dr. Callery moved to approve subject to the above condition, Marilyn Hinkle seconded. Final Plat — Carrington Point I - Consideration and appropriate action related to a request to review a final plat consisting 171 residential lots, in 5 blocks, on approximately 45 acres of land, located on the south side of East 86s' Street North and about a quarter of a mile west of North Memorial Drive. Marilyn Hinkle presented the item and Larissa reviewed the staff report. The location and the surrounding land use were described. The tract is zoned a mixed use ofRS -2 and RS -3 zoning designations. The development process was described. The applicant is requesting the review and approval so that they may plat and eventually develop the property with single -family residential uses. The developer would like to create 171 lots, in 5 blocks, on approximately 45 acres. The preliminary plat was heard at the October 8, 2007 Planning Commission meeting, OWASSO PLANNING COMMISSION July 12, 2010 Page No. 3 and was approved 3 -0 with 14 conditions. The preliminary plat was heard again at the May 10, 2010 and was approved with the following conditions: • Add language to the deed restrictions and covenants that would allow for a public trail easement through reserve area "D" at some point in the future. • Check to make sure there is no obstruction at the entry feature. • Bring Lots 1, 47, 48, Block 3 into compliance with the bulk and area requirements for an RS -2 zoning designation. • Remove existing structures (i.e. gravel drives, metal buildings, etc.) for the face ofthe plat. • Identify portions of the plat which are zoned RS -2 and those which are zoned RS -3. All the above conditions have been met. Any development that occurs on the subject property must adhere to all subdivision, zoning and engineering requirements including but not limited to paved drives and stone water detention. Sewer service and water service will be provided by the City of Owasso. The property is subject to storm siren payback fees of $35.00 per acre and the Barnes sanitary sewer fee of $80.36 per acre. The Carrington Pointe I final plat was reviewed at Technical Advisory meeting on June 23, 2010. The staff and committee members had the following comments: State that the developer is responsible for upkeep on all reserve areas until the Home Owners Association is established. A secondary access for emergency vehicles must be completed upon the issuance of thirty building permits. Dr. Callery moved to approve subject to the above conditions, Marilyn Hinkle seconded. Chairperson Vice Chairperson Date MEMORANDUM TO: PLANNING COMMISSION CITY OF OWASSO FROM: LARISSA DARNABY CITY PLANNER SUBJECT: OLS -10-03 DATE: August 3, 2010 BACKGROUND: The City of Owasso received a request for the review and approval of a Lot Split proposing to split approximately 3.2 acres of land into three individual parcels. LOCATION: The subject property is located near the southwest comer of South Main Street and East 76h Street North. South City of Owasso Industrial Light Intensity West City of Owasso Agricultural DEVELOPMENT PROCESS: The first step in the development of a piece of property in Owasso is annexation. Annexation is the method whereby land located outside the City limits is made a part of the City. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. When a property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. One type of rezoning that a developer may choose to seek is a Planned Unit Development, or PUD. When a development proposes to exhibit a mixture of uses with specific regulations and standards unique to a particular tract of land, a PUD is often the preferred land use control mechanism. The third step in the development of a piece of property in Owasso is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. After the preliminary plat has been reviewed by the City and various utility companies, construction plans for the development's infrastructure are typically submitted. These plans include specifications and drawings for stormwater drainage, streets and grading and erosion control, waterlines, stormwater detention, and wastewater lines. Often, approval is required of other agencies, such as the Department of Environmental Quality for wastewater collection and the US Army Corps of Engineers for properties that may be development sensitive. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. After obtaining approval from the TAC and Planning Commission, the final plat is considered by the City Council. If approved, the final plat is filed with the office of the County Clerk and governs all future development on that property. Another form of property division that can be considered in some cases is a lot split. Lot splits are minor subdivisions of property into three or fewer tracts, and do not provide for any new public streets. Typically, this is an appropriate option for a land owner who wishes to take large undeveloped parcels of land and divide it into two or three smaller tracts. If the development is non - residential the fourth step in the development of a piece of property in Owasso is the site plan. Site plans are reviewed by the TAC and Planning Commission. Issues such as building setbacks, parking, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. If the development is residential a site plan accompanies a building permit for each individual lot. The site plan for the residential development on the lot is reviewed by the City Planner for compliance with the zoning code and the provisions of the final plat. LOT SPLIT REVIEW PROCESS: The Lot Split review process is initiated when a property owner submits an application to the City of Owasso requesting the review and approval of a lot split. The application shall be accompanied by the correct fee, legal description of the undivided tracts and tracts to be created, and survey, site plan or drawing that shows the existing and proposed conditions. Upon receipt of a complete application City staff will begin reviewing the proposal for compliance with the Owasso Zoning Code, Subdivision Regulations and Engineering criteria. The proposed Lot Split is then presented to the Owasso Technical Advisory Committee (TAC) for review and recommendation. At that meeting utility providers and City staff are afforded the opportunity to comment on the technical aspects of the development proposal. The TAC then forwards a recommendation to the Planning Commission. Finally, the Owasso Planning Commission holds a public hearing to determine if the application is compliant with the Owasso Zoning Code, Subdivision Regulations, and Engineering criteria. The Planning Commission has the final determination on the application, as lot splits are not forwarded to City Council, ANALYSIS: As stated above, the requested lot split creates three individual lots. The applicant indicated a desire to sell the two of the lots and maintain ownership of the lot that currently is occupied with a structure being used as a real estate office. The lot proposed to be split is currently developed with a vacated bank building, a real estate office, and a portion that is being leased to Lennox Co. for storage. The lot, in its current state, has frontage along East 76`i' Street North and South main Street. If approved Tract "1" would be .165 acres in size with 142.59' of frontage along West P Avenue, proposed Tract "2" would be .289 acres in size with 75.90' of frontage along West 3d Avenue, and proposed Tract "A" would be 2.748 acres in size with 300' of frontage along South Main Street and 462.28' of frontage along East 76a` Street North. The property is zoned with a mixture of Commercial High Intensity and Agricultural designations with a portion of the lot being a non - conforming land use. With the non- conforming land use being in existence, any expansion or construction must be brought to current Zoning Code and Engineering Regulations (examples would be screening, landscaping, and drainage requirements). A lot split is a minor subdivision of previously subdivided land. The Planning Commission may approve a lot split that creates no more than three (3) lots fronting on an existing, dedicated street, which does not involve any new street or road, or the extension of municipal facilities, the creation of any public improvements, and is not in conflict with any provision or portion of the Comprehensive Plan, Major Street and Highway Plan, Zoning Ordinance (unless approved by the Board of Adjustment) or these regulations. Upon receipt of a complete application city staff will begin reviewing the proposal for compliance with the Owasso Zoning Code, Subdivision Regulations and Engineering specifications. The proposed final plat will then be presented to the Owasso Technical Advisory Committee (TAC) for review and recommendation. At that meeting utility providers and city staff are afforded the opportunity to comment on the technical aspects of the development proposal. The TAC will forward a recommendation to the Planning Commission. The Owasso Planning Commission will hold a public hearing to determine if the application is compliant with the Owasso Zoning Code, Subdivision Regulations, and Engineering criteria. The Planning Commission will forward a recommendation to the City Council. The Owasso City Council will then determine if the final plat meets city specifications and approve, deny, or approve the final plat with conditions. If the City Council approves the Final Plat the applicant will then produce copies of the approved Final Plat for signatures from the appropriate officials and file it with the county clerk's office. The applicant will provide the city with three signed and recorded plats along with an 8 '/z X 11 copy and an electronic copy for records. ANALYSIS: The current owner /developer of the subject property plans to develop the area with a college campus in one lot, on approximately fifty -three acres of land. The property has frontage along North 14& Avenue East, and this is where their main access point will be. A secondary access point will be from North 14511 East Avenue. According to the Owasso Land Use Master Plan, the subject property is located in an area that is designated for the college use. Considering this statement, the Tulsa Technology Center plat conforms to the goals, objectives, and policies of the Owasso Zoning Code and Land Use Master Plan. Upon further investigation, staff discovered that the TIC properly described by the legal description for the final plat contained 3 different zoning classifications: office medium (OM) covering 30 acres, commercial shopping (CS) covering 14.65 acres, and agricultural (AG) covering 10.66 acres (see Exhibit A). While two of the zoning classifications permit a college campus (CS and OM), the AG zoned portion does not. This presents a conflict with respect to the campus being located in the AG zoned portion of the property. In order to ensure a unified zoning pattern for the TTC site, the City of Owasso requests that 25.31 acres be rezoned from Agricultural and Commercial Shopping zoning designations to Office Medium zoning. The subject tract was previously two separate tracts, with one tract consisting of 10.66 acres zoned Agricultural, and another tract consisting of 14.65 acres zoned Commercial Shopping. The purpose of this case Is to bring unity to the TTC final plat by rezoning the CS and AG sections to Office Medium, similar to the remaining portion of the property. In 2000, the 10.66 acre tract was intended to be rezoned to an Office Medium designation (Case OZ 00 -03). However, upon further research a scrivener's error was identified within the legal description that was placed on the ordinance. In 2000, the applicant submitted a separate drawing, which illustrated the intent of what was to be rezoned; however, due to the scrivener's error in the legal description, the 10.66 acre tract was omitted (see Exhibit B). Since all property owners within 300' of the 10.66 acre tract were notified at that time, the evidence suggests that this was merely an error within the legal description. In 2001, the 14.65 acre tract was rezoned as part of OPUD 01 -04 which contained a total of 89.34 acres. This tract was rezoned to a Commercial Shopping zoning designation, which allows a college campus as a permitted use. In light of the scrivener's error, staff finds it is in the best interest to rezone the entire TTC parcel, containing 3 different zoning designations, to one zoning designation, Office Medium. These two tracts being comprised of 25.31 acres will bring the entire Tulsa Technology Center Plat into an Office Medium zoning designation. A general area map of the properties being rezoned is attached for review. The properly is served by Rural Water District No. 3 of Washington County and City of Owasso sanitary sewer, police, fire, and EMS service. DEVEI,OPMENT PROCESS: The first step in the development of a piece of property in Owasso is annexation. Annexation is the method whereby land located outside the city limits is made a part of the city. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. When a property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. One type of rezoning that a developer may choose to seek is a Planned Unit Development, or PUD. When a development proposes to exhibit a mixture of uses with specific regulations and standards unique to a particular tract of land, a PUD is often the preferred land use control mechanism. The third step in the development of a piece of property in Owasso is platting. A preliminary plat is required for any development that proposes to divide land into two or more lots. Preliminary plats illustrate the development concept for the property, and are often modified significantly after being reviewed by the Technical Advisory Committee (TAC), and the Owasso Planning Commission. Sometimes, difficult development issues such as existing utility lines, wells, or easements are brought to light at the preliminary plat stage and must be remedied prior to development. After the preliminary plat has been reviewed by the City and various utility companies, construction plans for the development's infrastructure are submitted. These plans include specifications and drawings for stormwater drainage, streets and grading and erosion control, waterlines, stormwater detention, and wastewater lines. Often, approval is required of other agencies, such as the Department of Environmental Quality for wastewater collection and the US Army Corps of Engineers for properties that may be development sensitive. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. After obtaining approval from the TAC and Planning Commission, the final plat is considered by the City Council. If approved, the final plat is filed with the office of the County Clerk and governs all future development on that property. The fourth step in the development of a piece of property in Owasso is the site plan. Site plans are reviewed by the TAC. Issues such as building setbacks, parking, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. LEGAL CONSIDERATIONS OF ZONING REQUESTS: Section 1500 of the Owasso Zoning Code outlines the city's policy on zoning amendments. The code states that amendments will be adopted to recognize changes in the Comprehensive Plan, or to recognize changing conditions in a particular area or in the jurisdictional area. Zoning changes must be based on two fundamental questions: 1) Does the requested zoning allow a land use that is appropriate for the subject property, and 2) Is the requested zoning in conformance with the Owasso Land Use Master Plan? Development considerations such as traffic, roads, grading, drainage, stormwater detention, utilities, rights -of -way, etc, are not to be considered until the platting stage of development. At the platting (and site planning) stage, the Planning Commission, municipal staff, and the Technical Advisory Committee work with the applicant to solve these types of specific development concerns. The proposed development for this property is unknown. CONFORMANCE TO MASTER PLAN DESIGNATION: The requested zoning designation, Office Medium (OM), is consistent within the Owasso Land Use Master Plan's designation for the property. ANALYSIS: The properly is generally located '/2 of a mile north of East 106th Street North, just east of the Owasso Expressway and is adjacent to compatible zoning designations. The requested Office Medium zoning designation, which will allow for the future development of a college campus, is found to be in accordance with the Owasso Land Use Master Plan.
