CALL TO ORDER - Duane Coppick called the meeting to order at 6:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF FEBRUARY 11, 2008 REGULAR MEETING - The Cormnission reviewed the minutes of February 11, 2008 regular meeting. Marilyn Hinkle moved to approve the minutes and David Vines seconded the motion. A vote on the motion was recorded as follows: David Vines - Yes Dan Draper - Yes Marilyn Hinkle - Yes Duane Coppick - Yes The motion was approved 4 -0. 4. Rezonine - A request to review and approve the rezoning of approximately 2,417 acres from AG (Agriculture) to CS (Commercial Shopping), located at 11102 East 126' Street North. Duane Coppick presented the item and the staff report was reviewed. Larissa described the property location and stated that the site is 2.417 acres in size. The development process was described. She also explained that the subject property is designated by the comprehensive plan as future commercial zoning. Letters were mailed to surrounding property owners and the legal advertisement was published in the Owasso Reporter. No phone calls have been received. Staff recommends approval of OZ 08 -02. Duane Coppick moved to approve the rezoning; Dan Draper seconded the motion. Preliminary Plat - Villas at Stonebridge - A request to review and approve a preliminary plat proposing thirty -eight (38) attached single family residential (townhouse) lots, on approximately 4,9952 acres of property zoned Planned Unit Development 07 -02, on property located on 76' Street North and approximately 1/3' of a mile east of North 129' Avenue East, immediately west of the Crown Colony subdivision. Duane Coppick presented the item and the staff report was reviewed. Larissa explained that the property is currently undeveloped and is zoned OPUD- 07 -02. The subject site is 4.9952 acres in size. The development process was described. The proposed development for this property is attached single family residential dwelling units. The property will be subject to all payback fees including storm siren fees of $16 per acre, and a sanitary sewer fee of $1,580.00 per acre. The Technical Advisory Committee reviewed the plat on February 27, 2008. The following comments were provided: • Show the lot numbers in Crown Colony Addition • Identify the pond on the plat • Reference the FIRM panel • Correct the Deed of Dedication • Show a 20' easement in the lot frontage and provide shared access • Need hydrants on the west side of the development The staff recommends approval of the preliminary plat. Mr. Brad Jackson with Coon Engineering answered questions regarding parking and stormwater run off. Duane Coppick moved to approve the preliminary plat subject to the TAC and Staff recommendations. Also subject to, the center median being maintained by the Villas at Stonebridge Homeowners Association. The motion was seconded by David Vines. Final Plat - Prestige Pond - A request to review and approve a final plat proposing forty -two (42) single family residential lots, on approximately 25 acres of property zoned Planned Unit Development ##12, located on the northwest corner of East 106' Street North and North 161" East Avenue. Larissa described the property location and the development process was described. The applicant is requesting the review and approval of a preliminary plat so that they may plat and eventually develop the property with single family residential development proposing 42 lots on 25 acres zoned RS -2. The Technical Advisory Committee reviewed the request on February 27, 2008, the following comments were provided: • Show dimensions and bearing to the section comer & identify the point of beginning • Show the dedication of the road right of way • Show a utility easement on N 161 E Ave & E 106 St No • Show FIRM map panel • Show sidewalks in the reserve areas • Show a drainage easement on the west side of Lots 1 - 5, Block 1 • Show a 20' easement at Reserve B and Lot 14, Block 1 • Show a water line easement along N 161 E Ave & E 106 St No • Change the language in the Deed of Dedication to facilitate above changes. Staff recommends acceptance of the final plat. Discussion was held regarding the language in the Deed of Dedication regarding the maintaining of the reserve areas. The applicant was not present. Duane Coppick moved to approve the final plat for Prestige Pond subject to the above TAC and Staff recommendations. Also subject to the following modification in Section 1113 in the Deed of Dedication: • All reserve areas, drainage easements and parks be owned and maintained by the Homeowners Association. DATE: MARCH 28, 2008 BACKGROUND: The City of Owasso has received a request for the annexation of approximately 5 acres, located at 10602 North 97'" East Avenue. It is the intention of the owners to sell the property for future development. Annexation is the method whereby land located outside the city limits is made a part of the city. Property owners and land developers sometimes choose to have their property annexed into Owasso in order to receive Owasso municipal services, such as police protection, refuse collection, and sanitary sewer. The second step in the development of a piece of property in Owasso is rezoning. When a property is annexed into Owasso, by law it must come in classified for AG Agricultural use. In order to develop the property, the land must be zoned for particular kinds of uses, such as residential, office, commercial, or industrial. Rezoning decisions are made in accordance with the growth policy displayed in the Owasso Master Plan. One type of rezoning that a developer may choose to seek is a Planned Unit Development, or PUD. When a development proposes to exhibit a mixture of uses with specific regulations and standards unique to a particular tract of land, a PUD is often the preferred land use control mechanism. The third step in the development of a piece of property in Owasso is platting. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. A final plat illustrates the layout and dimension of lots included on the final plat, right -of -way widths, easements, and other physical characteristics that must be provided for review by the City. The fourth step in the development of a piece of property in Owasso is the site plan. Site plans are reviewed by the TAC and approved by city staff. Issues such as building setbacks, parking, access, landscaping, and building footprint are presented in the site plan. Once a site plan is approved, the development is clear to apply for a building permit and to submit construction plans for the building's foundation, plumbing, electrical system, and HVAC. ANALYSIS: The purpose of the applicant's annexation request is to bring the property into the City Limits of Owasso in order to receive city services such as City Police protection. The property is currently zoned AG (Agricultural General District) in Tulsa County and would remain this same classification upon annexation. Prior to any action relative to a rezoning request, a rezoning sign will be posted on the property and property owners within 300' will be notified. All development that occurs on the subject property must adhere to all subdivision and zoning requirements including but not limited to paved streets and sidewalks. Residential sewer and water service will be provided by the City of Owasso. Staff published legal notice of the annexation petition in the March 13, 2003 edition of the Owasso Reporter. Staff has received no phone calls or correspondence concerning the request. TECHNICAL ADVISORY COMMITTEE: The Technical Advisory Committee reviewed the request on March 26, 2008. There were no negative concerns regarding the Annexation request. OWASSO ANNEXATION COMMITTEE: The Owasso Annexation Committee reviewed the request on March 26, 2008. There was discussion in regards to future dedication of road right -of -way on 10e Street North Avenue and 97 East Avenue. The Owasso Annexation Committee recommended approval with no negative concerns. Marsha Hensley Assistant City Planner MEMORANDUM TO: PLANNING COMM I CITY OF OWASSO FROM: LARISSA DARNABY CITY PLANNER SUBJECT: LOT SPLIT 08 -01 DATE: MARCH 31, 2008 BACKGROUND: The City of Owasso has received a request for the approval of a Lot Split proposing to split Lot 1 of Block 2, Owasso Market 11, a commercial subdivision, into two parcels. The legal descriptions of the two strips of land are included with this report. LOCATION: The subject property is located at 9700 & 9800 North 119A East Avenue. An area map is included with this report. EXISTING LAND USE: Kenosha Car Wash and Lube Shop CS (Commercial Shopping) SURROUNDING ZONING: All property surrounding this property is CS (Commercial Shopping). DEVELOPMENT PROCESS: The first step in the development of a piece of property in Owasso is annexation. After annexation, the remaining steps in the development process include rezoning, platting, and site planning. One form of property division in addition to platting is a lot split. Lot splits are minor subdivisions of property into three or fewer tracts, and do not provide for any new public streets. Typically, this is an appropriate option for a land owner who wishes to take large undeveloped parcels of land and divide it into two or three smaller tracts. The subject property is already part of a piece of property that is annexed and platted. A site plan for the site will not be necessary, since the 25' being split from the existing lot will be attached to the lot immediately to the north, and that northern lot is already developed. LOT SPLIT REVIEW PROCESS: The Lot Split review process is initiated when a property owner submits an application to the City of Owasso requesting the review and approval of a lot split. Upon receipt of a complete application, the staff reviews the proposal for compliance with the Owasso Zoning Code, Subdivision Regulations and Engineering specifications. The proposed Lot Split is then presented to the Owasso Technical Advisory Committee (TAC) for review and recommendation. At that meeting, utility providers and City staff are afforded the opportunity to comment on the technical aspects of the development proposal. The TAC then forwards a recommendation to the Planning Commission. The Owasso Planning Commission conducts a public hearing to determine if the application is compliant with the Owasso Zoning Code, Subdivision Regulations, and Engineering criteria. The Planning Commission has the final determination on the application. ANALYSIS: As stated above, the request is for the approval of a Lot Split proposing to split Lot 1 of Block 2, Owasso Market Il, a commercial subdivision, into two parcels. The proposal is to split 10,880 square feet of land from the existing parent tract. This would create two parcels. Tract 1 is recognized as the Car Wash and would be 70,900 square feet in size. Tract 2 is recognized as the Lube Shop and would be 10,880 square feet in size. The lot proposed to be split is developed commercially with the tract containing a carwash and a Lube Shop. The purpose of the lot split is to facilitate the sale of the lube shop to a separate party. The buyer of the lube shop intends to purchase the carwash by the end of the year. The entrance into both facilities is located on North 119th East Avenue. There is a proposed cross access agreement located to the south of the Lube Shop. The proposed lot split will not involve any new streets, or the extension of municipal facilities, or the creation of any public improvements, and it will not adversely affect the remainder of the parcel or adjoining property. In addition, the proposed lot split will not be in conflict with any provision or portion of the Comprehensive Plan, Major Street and Highway Plan, Zoning Ordinance or Subdivision Regulations. TECHNICAL ADVISORY COMMITTEE: The request was reviewed at the regularly scheduled Technical Advisory Committee meeting on March 26, 2008. After the preliminary plat has been reviewed by the City and various utility companies, construction plans for the development's infrastructure are typically submitted. These plans include specifications and drawings for stormwater drainage, streets and grading and erosion control, waterlines, stormwater detention, and wastewater lines. Often, approval is required of other agencies, such as the Department of Environmental Quality for wastewater collection and the US Army Corps of Engineers for properties that may be development sensitive. Once the property development proposal shows a division of lots that is acceptable to both the developer and the City of Owasso, a final plat application is submitted. The property was rezoned on January 15, 2008 to a Planned Unit Development Number 07 -02 Zoning District to facilitate the proposed use. The designation outlines the development standards for the property in a single family residential manner. The approved text of the Villas at Stonebridge PUD that provides supplemental standards for the development of this property is included in the packet. The proposed layout for the attached Single Family Residential (Townhomes) use associated with the plat is allowed by right according to the zoning designation and the Planned Unit Development. According to the final plat, the developer would like to create thirty -eight (38) attached single family residential (townhome) lots on 4.9952 acres of land, in one block. The main access into The Villas at Stonebridge will be from East 760' Street North. The applicant has shown a total of 114' feet to be designated for ingress and egress, and this includes two points of access. The point of access on the west is recognized as the entrance to subdivision and has a total of 53' designated for ingress, The point of access on the east side of the tract is recognized as the exit and has a total of 61' designated for egress. The proposed plat illustrates a 20' utility easement in the front of the lot and a 17.5' utility easement in the rear. In addition to the front and rear easements there are 5' utility easements located on the sides of each structure. In addition to the existing utility easements displayed on the final plat, AEP/PSO requested that an addition ten foot utility easement be dedicated along the front of Common Area "F" in order to loop their service lines around. There are several common areas identified on the Final Plat of the Villas at Stonebridge. Common areas "A ", "B ", and "C" are located in the center of the property. These common areas will contain parking spaces, sidewalks, and green space. Common Areas "D" and "E" are located on the northern end of the property on either sides of the point of access and will contain green space and perimeter fencing. Common area "F" is located in the southeast corner of the property and contains a dry detention pond that will serve as the properties main drainage facility. Any development that occurs on the subject property must adhere to all subdivision, zoning and engineering requirements including but not limited to paved drives and stonn water detention. Sewer service and Water service will be provided by the City of Owasso. The property will be subject to all payback fees including Storm Siren fees of $16 per acre, and a sanitary sewer fee of $1,580.00 per acre. TECHNICAL ADVISORY COMMITTEE: The Owasso Technical Advisory Committee reviewed the final plat at the March 26, 2008 regular meeting. At that meeting, utility providers, as well as staff, are afforded the opportunity to comment on the plat and request any additions and/or concerns. The Final Plat proposes one (1) lot in one (1) block on 1.28 acres of property. The applicant wishes to plat the property so that they may develop a heating and air conditioning unit commercial sales facility. HEARING DATE: The Owasso Planning Commission will consider the final plat on April 8, 2008. LOCATION The subject property is located on South Main just to the west of the Brookwood Apartments, east of the Owasso Public School's 7a' Grace Center, North of the Kum & Go site, and to the South of the Jesse Addition. The 100' that is designated for ingress and egress would consist of two 50' points of access. Any development that occurs on the subject property must adhere to all subdivision, zoning and engineering requirements including but not limited to paved streets and sidewalks.
