4. Detachment — Larkin Bailey Foundation — A request for detachment of 268.79 acres,
more or less, generally described as a portion of the East Half (E /2) of the Northeast
Quarter (NE /4) and the Southeast Quarter (SE /4) of Section 25, Township 21N, Range
13E, along with a portion of the Southwest Quarter (SW /4) of the Northwest Quarter
(NW /4) and a portion of the West Half (W /2) of the Southwest Quarter (SW /4) of Section
30, Township 21N, Range 14E. The subject property is located at the north of E. 76
Street N. and west of the A.T. &S.F. Railroad right -of -way. (Ward 4)
Donna presented the case to the Commissioners and described the property location. This
case was first reviewed on August 30, 2001 at the special Annexation Committee
meeting. It was postponed, at that time, due to the lack of information. The Annexation
Committee reviewed the request again on November 8, 2001 and withheld
recommendation until additional information was received. The information was received
by the Planning Department and approval was granted at the December 6, 2001
Annexation Committee meeting. Staff recommends approval of the detachment.

5. Final Plat - Metro Heights II - A request for review of a final plat for Metro Heights II,
a 15.42 acre, 38 residential and 1 commercial lot subdivision located at the northeast
corner of E. 106` Street N. and N. Mingo Road and generally described as a portion of
the West Half (W /2) of the Southwest Quarter (SW /4) of Section 7, Township 21 North,
Range 14 East. (Ward 1)
Donna presented the case and described the property. She explained that an area of open
space has been provided between the residential and commercial portion of the site for
which will accommodate detention. Upon review of the preliminary plat several
surrounding property owners expressed concerns regarding drainage. A neighborhood
meeting was held so the applicant could inform those citizens about the drainage
engineering proposed. The Owasso Technical Advisory Committee reviewed the final plat
at the November 28, 2001 meeting. Staff recommends approval of the final plat for
Metro Heights U.
Ray Haynes moved to approve the final plat subject to staff and TAC recommendations.
Also, subject to the requirement of the developer, to construct a privacy type screening
fence, Charles Willey seconded the motion. The vote on the motion was as follows:

6. Preliminary Plat - Crossroads Business Park - A request for review of a preliminary
plat for Crossroads Business Park, a 39.92 acre, 12 lot subdivision located south of E.
116'h Street N. (State Highway 20) and west of N. 145' E Avenue and generally
described as a portion of the Northeast Quarter (NE /4) of Section 9, Township 21 North,
Range 14 East. The subject property is located within the Interchange Business Park
PUD (OPUD -21). (Ward 1)

Donna presented the item to the Commissioners. Donna reviewed the location of the
property and the zoning categories. The Technical Advisory Committee reviewed the
preliminary plat at their November 28, 2001 meeting. The PSO representative
encouraged the applicant to determine the electrical provider as soon as possible. Mr.
Pete Kourtis, the applicant, was present and stated that PSO will service this
development. Mr. David Charney requested a brief presentation to the Commissioners
regarding acceleration/deceleration lanes along the service road. He stated that the
service road would be built similar to that of a collector street. The average road is 26'
wide and this will be a 37' wide paved service road. Mr. Charney explained that he
would like the staff recommendation to read "The City of Owasso reserves the right to
require acceleration/deceleration lanes ". There was a brief discussion on detention.
Charles Willey urged the developer to pay close attention to a broader radius of the
corners or curb cuts in the subdivision.
Staff recommends approval of the Preliminary Plat for Crossroads Business Park subject
to the following conditions:
1. All TAC comments shall be address prior to submittal of the final plat; and
2. A 50' building setback shall be provided along the service road adjacent to
Lot 1, Block 2 and any future proposed lots fronting the service road and
along N. 145' E. Avenue adjacent to Lot 3, Block 3; and,
3. Curb cuts shall be limited to the minimum necessary along the proposed
service road; and
4. Acceleration/deceleration lanes shall be provided at all access points from
arterial streets and the service road; and,
5. Perimeter sidewalks shall be installed at the time of development along N.
145`s E. Avenue; and,
6. The Owasso Planning Commission reserves the right to require sidewalk
along State Highway 20, pending coordination with ODOT at the time of
future proposed improvements to the highway; and,
7. All required improvements postponed until completion of future
improvements to Highway 20 will be insured by escrow; and,
8. Adequate detention to service this phase of the Interchange Business Park
PUD shall be provided at the time of development; and,
9. A covenant stating "All improvement shall be 1) constructed and accepted
by the Owasso City Council, or 2) insured by performance bond naming
the City of Owasso co- obligee prior to approval of the plat by the Owasso
City Council" shall be included within the plat covenants or the text of the
plat; and,
10. The Deed of Dedication, Restrictions and Covenants shall be included
within the text of the plat or, if filed by separate instrument(s) shall include
within their text specific reference to one another; and,
11. The approved Outline Development and Text for Interchange Business
Park PUD (OPUD -21) shall be filed of record with the Tulsa County
Clerk and two recorded copies provided to the City Planner prior to

approval of the final plat; and,
12. As required by the Owasso Zoning Code for planned unit developments, a
provision for the establishment of a property owners' association shall be
added to the covenants associated with this plat; and,
13. The developer shall provide for the maintenance of any detention facility
by the property owners' association within the covenants associated with
this plat.
Ray Haynes moved to approve the preliminary plat for Crossroads Business Park subject
to the above TAC and staff recommendations. Also, subject to the following additional
recommendations:
- The City of Owasso reserves the right to require acceleration/deceleration
lanes.
- Pay close attention on a broader radius of the comers and increase the size if
necessary.

7. Preliminary Plat - Lake Valley - A request for review of a preliminary plat for Lake
Valley, a 24.85 acre, 83 lot subdivision located north of E. 106' Street N. and east of N.
145' E. Avenue and generally described as a portion of the Southwest Quarter (SW /4) of
Section 10, Township 21 North, Range 14 East. (Ward 1)
Donna presented the item and described the location. The Technical Advisory Committee
reviewed the plat at their November 28, 2001 meeting. Curtis Bryant with PSO
encouraged the applicant to determine who was to provide service to this subdivision.
The applicant was present and stated that it would PSO would be the provider. Mr.
Charney also stated that the storm water plan had been submitted and approved by the
City of Owasso. Ray Haynes had questions regarding the fencing that is to back up to
North 145`s East Avenue. Mr. Charney assured Mr. Haynes that there would be a
screening fence along North 145' East Avenue and it would be shown on the final plat.
Staff recommends approval of the preliminary plat for Lake Valley subject to the
following conditions:
1. All TAC comments shall be addressed prior to submittal of the final plat;

and,

8. Site Plan - Tulsa Teachers' Credit Union - Request for review of a site plan for Tulsa
Teachers' Credit Union, located approximately '/< mile east of N. Garnett Road and north
of E. 96" Street N. The subject property is described as Lot 1, Block 1, Tulsa Teachers'
Credit Union. (Ward 1)
Donna presented the item and described the property location. The applicant has
proposed a 5,866 square foot facility. Adequate parking has been provided on the site
plan. The applicant has provided 50 spaces including 2 handicap spaces. Jerry Emanuel,

from Sack and Associates, was present to address any concerns. This property abuts a
small lot rural residential along the west side. The Commissioners agreed that the
homeowners, on the west side of the subject property, deserve some type of screening.
The screening fence should begin at the parking lot to the north continuing to the end of
the drive aisle. The Technical Advisory Committee reviewed the site plan at the
November 28, 2001 regular meeting.
Staff recommends approval of the site plan for the Tulsa Teacher's Credit Union subject
to the following conditions:
1. All TAC comments shall be addressed prior to the issuance of a building
permit.
2. Provide a 6' opaque fence or wall along the west boundary of the property.
Ray Haynes moved to approve the site plan subject to the above TAC and staff
recommendations, also a 6' screening fence be constructed on the west boundary of the
property as long as there is residential property on that side. If the property to the west is
rezoned, for commercial activity, the screening fence will not be required. Bill Williams
seconded the motion. The vote on the motion was as follows:

9. Footing Survey Requirements — Discussion of footing survey being required or
suggested for residential construction.
Donna explained to the Commissioners the reason for the need of the Advisory
memorandum. She stated that action is needed due to the increasing amounts of
encroachments over building setback lines, property lines and /or easements. This is an
intermediate step prior to the requirement a footing survey.
Ray Haynes moved to approve the footing survey advisory memorandum to be added to
the items that the builders sign at the time of permit pick up. Also, a copy of the
Community Development Department Newsletter dated fall of 1997 (copy attached) shall
be presented to the builder. Bill Ellison seconded the motion. The vote on the motion

TULSA TEACHERS' CREDIT UNION

BACKGROUND
The Tulsa Teachers' Credit Union is requesting annexation of a 4.5 acre tract of land described as
the east four and one half (4.5) acres of the South Half of the Southwest Quarter of the Southwest
Quarter (S /2 SW /4 SW /4) of Section 17, Township 21N, Range 14E. The subject property is
located north of E. 96"' Street N. and 1/4 mile east of N. Garnett Road and is bound by rural
residential/agricultural property zoned AG (Agriculture) to the north, south and west, and by the
Owasso Market, zoned CS (Commercial Shopping) to the east.
Most of you will recognize this property as one which has been processed through the rezoning, plat
and site plan phases of development. It has become apparent that the property was never annexed
into the corporate limits of the City. In an attempt to resolve this issue with minimal inconvenience
to the applicant, staff has consulted with the City Attorney, Mr. Cates, regarding this issue. Mr.
Cates' advice was to process the annexation, then amend the ordinance rezoning the property
subsequent to the effective date of the annexation, and to request the applicant acknowledge their
understanding of the implications of the error and approve moving forward as advised.
Since the final plat and site plan did not require legal notification and were processed in good faith,
no new action was advised.
A letter was sent to Mr. Doug Aldridge, Tulsa Teachers' Credit Union, explaining the issue and the
schedule of necessary processes to occur with an acknowledgement signature and return requested.
The signed letter of acknowledgement is attached for your information and review.
There has, however, been some reconsideration by the City Manager and the City Attorney of
simply amending the existing ordinance rezoning the property so the schedule presented to the
applicant will be modified to reflect a full rezoning process.
This property is contiguous to existing city limits as required by the Annexation Policy. A copy of
the Annexation Policy and Procedures are attached for you information and review.
ANALYSIS
Most of the south half of Section 17, within which the subject property lies, is inside the city
limits of Owasso. There are a few rural residential dwellings, not yet annexed along the north
and west boundaries. However, the Spears property, located at the northeast corner of the
intersection of E. 96`h Street N. and N. Garnett Road and west of the subject property, is annexed
and zoned commercial. The Smith property to the south is annexed though still zoned
agriculture.
The subject property is shown on the Owasso 2010 Land Use Master Plan to be Low Density
Residential, Low Intensity. Based upon previous recommendations by the Commission
regarding the rezoning of the property, staff does support the annexation of this property for use
as the future location of the Tulsa Teachers' Credit Union.
The Owasso Annexation Committee reviewed the request at the January 10, 2001 Special
Meeting and recommended the property be annexed.
Staff recommends approval of the annexation of 4.5 acres located within the Southwest Quarter
(SW /4) of Section 17, Township 21N, Range 14E as requested by the Tulsa Teachers' Credit
Union.

It has come to my attention that the above - referenced property has not been annexed into the corporate
limits of Owasso.
I have consulted with Mr. Ron Cates, Owasso City Attorney, regarding this issue since we have,
apparently, processed all submittals for the property without actual jurisdiction. Mr. Cates' advised that,
since the processes were all done in good faith and, since no objections to the rezoning were recorded,
that we could resolve this issue by processing the annexation now and, upon the ordinance for the
annexation going into full effect, amend the zoning ordinance to reflect an approval date after annexation.
He feels the plat and site plan processes are less affected as no legal notifications were required. We will,
however, be unable to release the submitted building permit until this issue is resolved, as we are now
aware of our lack of jurisdiction.
The anticipated schedule for the remaining actions required will be as follows:

BACKGROUND
South Kansas & Oklahoma (SK &O) Railroad has requested the rezoning of approximately 5
acres generally described as a portion of Lot 1, Block 1, Atchison, Topeka & Santa Fe, located at
401 W. 2 "d Avenue, from IL (Industrial Light) to Ili (Industrial Heavy). A location map is
attached for your information and review.
ANALYSIS
The subject property is bound on the west by vacant, undeveloped rural property zoned AG
(Agriculture), on the north and east by the SK &O right -of -way and, further, by a portion of the
Bailey Ranch Golf Course and municipal neighborhoods, primarily residential, zoned RS -3
(Residential Single - Family, High Density), RM -1 (Residential Multi - Family, Low Density), and
CH (Commercial Heavy).
SK &O is requesting this rezoning to allow for the operation of a metals recycling business,
unassociated with railroad operations, within the boundary of their property. The recycling
operations are planned to occur within the confines of the rail yard, primarily between the two
sets of tracks. Due to the proximity of the proposed rezone area to the existing residential and
agricultural properties, as well as the western "gateway" as defined by the Downtown
Development District Concept Plan, staff has requested the applicant retain IL (Industrial Light)
zoning around the perimeter of the subject area. A plan showing the defined area is attached for
your information and review.
The Owasso 2010 Land Use Master Plan shows the subject property as Heavy Industrial.
Therefore, the requested rezoning to IH is in compliance with the comprehensive plan.
The legal description submitted by the applicant, while adequate for legal notification is not, in
staff s opinion, acceptable for the ordinance that will be required if the Planning Commission and
City Council approve this request. Staff has requested the applicant submit a precise, detailed
legal description, including bearings and precise acreage, and anticipates its receipt soon.
Through discussions with staff, the applicant has agreed to provide screening of the metals
recycling from E. 76`h Street N., the future Sertoma Club to the west and the residences to the
east, if required.
Notification letters were mailed to surrounding property owners on December 26, 2001 and legal
notification was published in the December 27, 2001 edition of the Owasso Reporter. No calls
or comments have been received by staff regarding this request.
RECOMMENDATION
Staff recommends approval of OZ- 02 -01, rezoning the subject property from IL (Industrial
Light) to IH (Industrial Heavy.

BACKGROUND
The Exchange Bank has requested Planning Commission approval of an amendment to the limits
of access approved as shown on the final plat of Exchange Bank - Owasso I located at the
northeast corner of E. 86th Street N. and N. Mingo Road. A location map is attached for your
information. The referenced final plat was approved by the Planning Commission on September
17, 2001, and by the City Council on October 2, 2001. A letter of request is attached for your
information and review.
ANALYSIS
Originally, the 50' access defined by the approved plat was shown abutting the northern
boundary of the subject property. A 125' Limit of No Access was shown south of the access.
The applicant is requesting to shift the access point 30' south, creating a 30' Limit of No Access
north of the drive and 95' Limit of No Access south of the drive. A plan showing proposed
changes to the access location is attached for your information and review.
The request was reviewed at the December 26, 2001 regular meeting of the Technical Advisory
Committee and no comments were generated at that time. Phil Lutz, Owasso Public Works, has
issued a letter to the applicant reflecting Public Works' and Community Development's support
for the requested amendment and requesting additional information. A copy of the letter of
response is attached for your information.
RECOMMENDATION
Staff recommends approval of the requested amendment to the Limits of Access shown on the
final plat of Exchange Bank - Owasso I.

sharp movements to allow a smoother and safer flow of traffic exiting the site front

BACKGROUND
Sack and Associates, agent for the owner, has requested a review of a lot split for Lot 1,
Block 2, Owasso Market H located in Section 17, Township 21 North, Range 14 East,
City of Owasso, Tulsa County, State of Oklahoma. The general location of the lot split is
west of the Lowe's site north of E. 96th Street N. and west of N. 119`h E. Avenue. A
location map is located on the Lot Split Exhibit for your reference.
ANALYSIS
The applicant is requesting Lot 1, Block 2, Owasso Market lI be split into three tracts.
Tract A is proposed to be 4 acres, more or less, and Tracts B and C are proposed 2 acres
in size, more or less. Legal descriptions are provided for your reference.
The site is currently zoned CS (Commercial Shopping) and will remain so zoned.
Tract A contains the detention facility located at the northwest comer of E. 961h Street N.
and N. 119`h E. Avenue. Tract B will accommodate a full- service car wash for which a
Special Exception (OBOA- 01 -20) has been granted by the Owasso Board of Adjustment,
allowing the location of a car wash within a CS zoning district. According to Sack &
Associates, all tracts will front N. 119`h E. Avenue.
The lot split was reviewed by the Technical Advisory Committee at their December 26,
2001 regular and no comments were made at that time.
RECOMMENDATION
Staff recommends approval of OLS- 02 -01.

BACKGROUND
Breisch & Associates has requested review of a final plat for Honey Creek at Bailey Ranch,
62.33 acre, 202 lot subdivision generally described as a portion of the Southwest Quarter (SW /4)
of Section 18, Township 21N, Range 14E. The subject property is located north of E. 96"' Street
N. and east of N. Mingo Road and is zoned RS -3/PUD (Residential Single - Family, High
Density/Planned Unit Development). A location map is shown on the plat for your convenience.
ANALYSIS
The submitted final plat is consistent with most of the requirements of the Lakes at Bailey Ranch
PUD, resubmitted after expiration, concurrently with.this plat. The applicant has shown 15' side
yard setbacks on the secondary frontage of corner lots. The recommended conditions of
approval for the PUD and preliminary plat stated the minimum side yard setback on corner lots
should be 25'. The applicant is currently modifying the plat to reflect this requirement, and staff
expects to have updated plans for your review at the time agenda packets are distributed.
The Owasso Technical Advisory Committee reviewed the final plat at the December 26, 2001
regular meeting. The only comments recorded were from Public Works regarding drainage.
There was discussion regarding the street ties to the Kelly -Ann addition to the east. The TAC
was updated on the philosophy of the single connection.
The PUD requires a detailed certified drainage report be submitted at the time of platting. The
preliminary plat for Honey Creek at Bailey Ranch was approved subject to a report and plans
showing detention location and details being submitted to and approved by Public Works as a
requirement of final plat. Adequate detention must be provided at the time of Phase I
development. At the time of this staff report, the applicant had not resolved drainage issues to
the satisfaction of Public Works. The applicant should coordinate directly with Public Works
regarding this requirement. Staff recommends this final plat not be forwarded to City Council
for review until all drainage issues are resolved to the satisfaction of the Public Works
Department.
The proposed development is subject to a $16.00/ acre siren fee, totaling $1026.72. Also, to be
assessed at the time of building permit, will be a court settlement fee of $50 per water tap. Prior
to the builder's payment for a building permit, a receipt from Washington County Rural Water
District #3 verifying payment of the referenced fee must be presented to the City of Owasso. It
is staffs understanding this developer has, in the past, chosen to pay this fee at the front end on
behalf of the builders. This option is available to the developer, if desired.
DEQ permits for the extension of water and sanitary sewer mains were received by Public Works
on January 9, 2001. A copy of the permits are attached for your review.
RECOMMENDATION
Staff recommends approval of the Final Plat for Honey Creek at Bailey Ranch subject to the
following conditions:
1. All building setbacks along rights -of -way be a minimum of 25'; and,
2. All drainage issues be resolved to the satisfaction of the Public Works Department prior to
forwarding this plat to City Council for review; and
3. Siren fee be paid prior to forwarding the plat to City Council for review; and

CONSTRUCTION ACTIVITY:
The summer of 1997 is history and leaves us with record permit totals. Residential permits
through October total 298 compared to 252 permits last year at this time, representing an
18 % increase from last year. This has resulted in over thirty -two million new construction
dollars for the year. The total number of residential permits issued in 1996 was 293. It's
estimated we will end 1997 with 330 to 340 residential permits.
Commercial permits through October total 21 compared to 20 for all of 1996. This has
resulted in over eight million new construction dollars for the year.
Enclosed are historical statistics on residential and commercial permits, along with a current
lot inventory and availability list.
Also included, is a list of items that need to be addressed by the builders and their sub-
contractors. Improving their knowledge of these items will help expedite the final inspection
process. Again, we appreciate your help and look forward to working with you on making
Owasso, OKLAHOMA'S PREMIERE HOMETOWN.
SALES STATISTICS -
Statistics for the 3rd quarter of 1997 by Market Data Research, Inc., indicated new home
sales in Owasso were responsible for 37% of all sales activity for the Metro Tulsa Area.
This is a slight decline in new home sales from the 44% reported for the second quarter
1997. This is the highest rate for new home sales in all the surrounding cities in themetro
area including Tulsa. The figures also reflect a continuing increase for the third quarter of
1997 in overall median price in Owasso. The median sale price of $103,900.00 registered an
increase of 6.54% from the previous quarter's price of $97,525.00. The median square foot
price also increased 4.15% to $60.20 from $57.80. Average sale prices reported were
$118,078.00 and $61.40 per square foot.
FOOTING INSPECTION CHANGE -
Effective January 1, 1998 all footing inspections will require that property lines be string
lined to ensure that proper setbacks and side yard requirements are met. This is due to an
increase in the amount of Variance and Easement Closing requests through the Board of
Adjustment and Planning Commission.
