(Ward 1) OWASSO PLANNING COMMISSION MINUTES OF SPECIAL MEETING Tuesday, January 17, 2002 Owasso City Hall 111 North Main, Owasso, Oklahoma MEMBERS PRESENT Dewey Brown Charles Willey Bill Ellison MEMBERS ABSENT Ray Haynes Bill Williams STAFF PRESENT Donna Sorrells Stan Ewing Marsha Hensley The agenda for the special meeting was posted in the north entrance to City Hall, 111 North Main Street, on January 15, 2002 at 5:00 PM. 1. CALL TO ORDER - Vice Chairperson Charles Willey called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF THE DECEMBER 11, 2001 REGULAR MEETING. Bill Ellison moved to approve the minutes of the December 11, 2001 meeting, Dewey Brown seconded the motion. The vote on the motion was as follows: Bill Ellison - Yes Charles Willey - Yes Dewey Brown - Yes The motion carried 3 -0. 4. Annexation - Tulsa Teachers' Credit Union - A request for annexation of 4.5 acres, more or less, described as the east four and one half (4.5) acres of the South Half of the Southwest Quarter of the Southwest Quarter (S /2 SW /4 SW /4) of Section 17, Township 21N, Range 14E. The subject property is located at the north of E. 96 Street N. and east of N. Garnett Road. (Ward 1) Donna presented the case to the Commissioners and described the property location. A request for rezoning, along with a plat and site plan request were approved at a previous meeting. It was then discovered that the subject property was never annexed into the corporate limits of the City of Owasso. A letter was sent to Tulsa Teachers' Credit Union explaining the issue and the schedule of processes. This property is contiguous to existing city limits and the Annexation Committee reviewed and approved the request at their January 10, 2002 special meeting. Donna explained the process and stated that the City of Owasso will waive the fees for legal notifications which will be republished. No new action will take place regarding the final plat and the site plan since they did not require legal notifications. The Planning Commission will hear the rezoning request at their regular scheduled meeting on March 12, 2002. It will then be presented to the City Council at the March 19, 2002 meeting. The building permit will be issued after review and approval, of the rezoning, by the City Council. Mr. Jerry Emanuel of Sack & Associates was present to answer questions regarding the annexation. Staff recommends OWASSO PLANNING COMMISSION January 17, 2002 Page No. 2 approval of the annexation. Charles Willey moved to approve the annexation, Dewey Brown seconded. OZ -02 -01 - SK &O Railroad - A request for rezoning approximately 5 acres from IL (Industrial Light) to IH (Industrial Heavy). The subject property is generally described as a portion of Lot 1, Block 1, Atchison Topeka & Santa Fe and located north of E. 76' Street N. and approximately 3/8 mile east of N. Mingo Road. (Ward 4) Donna presented the case and described the location of the property. This rezoning request is to allow for the operation of a metals recycling business. The operations are planned to occur primarily between the two sets of tracks. The Owasso 2010 Land Use Master Plan shows the property as Heavy Industrial. Staff has requested the applicant to submit a precise legal description, which includes bearings and precise acreage. The railroad has agreed to a buffer around the perimeter of the property. Notification letters were mailed and legal notification was published in the Owasso Reporter. No calls have been received by staff. Staff recommends approval of the rezoning from IL (Industrial Light) to III (Industrial Heavy). Several surrounding property owners were present to express their concerns with the rezoning request. Mr. Jimmy Russell addressed the Commissioners, stating that he would like the Commissioners to review the type of business that is requesting approval, he voiced objections to a junkyard on this property. Mr. Russell advised the Commissioners to tour this type of facility in other cities. He also stated that he and his family live in Owasso because there is not a lot of industrial in the area. Mr. Brad Snow, the applicant, was not present to answer questions. Mr. Randy Noonkester of 404 East 2"d Street had concerns with heavy truck traffic in the area. Dewey Brown would like a better definition of metal recycle, such as, what type of metal. Charles Willey had concerns regarding the pollution, noise and the large trucks that a metal recycle business will create. Charles Willey moved to deny the rezoning, Bill Ellison seconded the denial. Change of Limits of No Access — Exchange Bank — A request for review of a change to the platted Limits of No Access located along N. Mingo Road, Lot 1, Block 1, Exchange Bank Owasso I. The subject property is located at the northeast corner of N. Mingo Road and E. 861h Street N. (Ward 2) Donna presented the item and described the location. The 50' access defined by the approved plat was shown abutting the northern boundary of the subject property. The applicant is requesting to shift the access point 30' south which will create a 30' Limit of No Access north of the drive and 95' Limit of No Access south of the drive. The Technical Advisory Committee reviewed this request at their December 26, 2001 meeting. Bill Lewis from Lewis Engineering was present to address concerns. Staff recommends approval of the requested amendment. Charles Willey moved to approve the requested amendment to the Limits of Access as shown on the final plat, Bill Ellison seconded the motion. The vote on the motion was as follows: Bill Ellison — Yes Charles Willey — Yes Dewey Brown — Yes The motion carried 3 -0. 7. OLS- 02 -01— Sack & Associates — A request for review of a Lot Split on Lot 1, Block 2, Owasso Market R. The subject property is located north of E. 96' Street N. and west of N. 119'h E. Avenue. (Ward 1) Donna presented the item and described the location. The applicant is requesting Lot 1, Block 2, Owasso Market II be split into three tracts. Tract A is to be approximately 4 acres and Tract B and C are proposed 2 acres in size, more or less. The site is zoned CS (Commercial Shopping). The request was reviewed by the Technical Advisory Committee and no comments were made. All tracts will front N. 119 E. Avenue. Final Plat - Honey Creek at Bailey Ranch - Request for review of a Final Plat for Honey Creek at Bailey Ranch, a 62.33 acre, 202 lot subdivision located north of E. 96" Street N. and east of N. Mingo Road and generally described as a portion of the Southwest Quarter (SW /4) of Section 18, Township 21 North, Range 14 East. (Ward 1) Donna presented the item and described the location. Donna distributed an updated copy of the plat. The Technical Advisory Committee reviewed the plat at their December 26, 2001 meeting. Public Works had issues regarding drainage. Donna explained that the drainage issues have been resolved to the satisfaction of Public Works. Staff recommends approval of the final plat. Bill Ellison brought attention to three flag lots shown on the plat. There was discussion regarding flag lots in previously approved plats. Mr. Alan Ringle from Breisch & Associates was present and stated that he didn't remember discussion on flag lots at the time of approval on the PUD. He explained that it would be difficult to modify at this time and it will not happen again. Also, briefly discussed were the islands in the cul -de -sacs. There were concerns that the islands are protruding beyond the curb. Mr. Ringle assured the Commissioners that the islands will be behind the base of the curbs. Staff recommends approval of the Final Plat for Honey Creek at Bailey Ranch subject to the following conditions: 1. Siren fee be paid prior to forwarding the plat to City Council for review Charles Willey moved to approve the final plat subject to the above staff and TAC recommendation, Bill Ellison seconded the motion. Sorrells — City Planner BACKGROUND Garrett Creek Development Company is requesting annexation of a 126.05 acre, more or less, tract of land described as a portion of the West Half (W /2) of Section 9, Township 21N, Range 14E. The subject property is located south of E. I I6`h Street N. between N. 129`h E. Avenue and U.S. Highway 169, and is bound by rural residential/agricultural property zoned AG (Agriculture) to the north, south and west, and to the east by the U.S. Highway 169 right -of -way, and further by the Interchange Business Park and Robinson Business Park, both with PUD (Planned Unit Development) supplemental zoning with CS (Commercial Shopping), CG (Commercial General), OM (Office Medium) and IL (Industrial Light) underlying zoning. A location map is attached for your information and review. The subject property is currently zoned AG (Agriculture) and will remain so zoned upon annexation. Property annexed by the City of Owasso is required to be zoned the lowest zoning classification (AG) unless the applicant requests a zoning classification previously approved by the County in which the property lies be retained. A copy of Owasso's annexation policy is attached for you information and review. If annexation is approved, the subject property will have to be platted prior to development. Sanitary sewer can serve the property from the east or the west. Washington County Rural Water District #3 will provide water service. The applicant has consulted directly with the rural water district regarding their ability to provide adequate water supply to the sight. The district's consulting engineers have assured the applicant the district can provide more than adequate supply. Notification of the annexation request was published in the January 24, 2002 edition of the Owasso Reporter. Upon approval by the Planning Commission, the application will be forwarded to the City Council for review and approval. Two consecutive notifications will appear in the February 21 and 28, 2002 editions of the Owasso Reporter prior to the request being heard by the Council. A copy of the procedures for annexation are attached for your information and review. The Technical Advisory Committee reviewed this request at their January 30, 2002 regular meeting and offered no comment. The Owasso Annexation Committee reviewed the request at their meeting held January 31, 2002 and recommended approval. RECOMMENDATION Staff recommends approval of this annexation request. Avenue. A location map is attached for your information and review. The subject property is zoned OM (Office Medium). The property is bound on the north, south and west by undeveloped single - family residential portions of the Silver Creek PUD and to the east by N. 145`" E. Avenue right -of -way and, further, by the Preston Lakes PUD. ANALYSIS The applicant has proposed a 14,600 square foot facility with 3650 square feet of sanctuary. According to the Owasso Zoning Code, the parking requirement for this facility is 1 space per 40 square feet sanctuary floor area. Based on this requirement, the applicant is required to provide 91 spaces including 4 handicap (1 van accessible) spaces. The applicant has provided 95 spaces including 4 handicap spaces. No loading berth is required by code for this facility. A landscape plan for the subject property has been reviewed and approved by staff. The applicant will provide a wood screen fence around the rear and side boundaries of the property as required when abutting residential zoning districts. The site plan submitted shows several items, sidewalks and curbing, to be omitted. All sidewalks and curbing shown are required and should remain as shown. No perimeter walk has been shown. The applicant has provided for two 31' entrance drives. Staff recommends the drives be widened to 36' to allow for one entrance as well as left and right exit from the site. Acceleration/ deceleration lanes are required but not shown. The applicant has shown a 15' radius on the entrance drives. A 35' radius is required at the entrances from the acceleration/ deceleration lanes. The Owasso Fire Department has requested the applicant provide an access drive, minimum 18' wide, to the rear of the building. The two lots are described as Lots 4 & 5, Block 3, Hillside Estates. Mr. and Mrs. Stallings own both subject lots. An attached garage has been constructed which lies on the property line. The Stallings were unaware of the need to file a lot tie agreement to, effectively, amend the property lines and the associated setbacks. However, application for a building permit would have brought the issue to staffs attention prior to construction. The issue of the encroachment was realized after the applicant was notified by the Building Inspector to acquire a building permit after significant construction had already occurred. Approval and granting of the lot tie agreement between the Stallings and the City of Owasso will ensure that the following occur: 1. This closing request affects the remainder of the drainage easement not previously closed to accommodate Lowe's water tank. An exhibit showing the area to be closed is attached for your review. ANALYSIS The applicant has proposed the installation of a 60" concrete pipe and filling of the open channel. The drainage easement could then be reduced to 50' in width. Public Works has approved the piping of the channel subject to the developer of Owasso Market completing certain other requirements related to drainage. A copy of a letter sent to the developer by Public Works is attached for your information and review. Upon review, staff has determined there will be no detrimental effect due the requested partial closing. The Technical Advisory Committee reviewed the proposed closing at the January 30, 2002 regular meeting. A memorandum detailing the comments received is attached for your information and review. Public Works Department personnel have reviewed and approved the stormwater drainage revision submitted by Sack and Associates to extend the 60 -inch drain pipe south to the detention pond. This approval is contingent upon completion of other drainage work. As we discussed, there are two work items which were required in the Owasso Market II drainage plans which have not been completed. Also, the outlet works structures for both detention ponds constructed in the Phase I development have been damaged by previous high flows. Attached are photographs that show the extent of damage. The approach and outlet aprons at the west pond were never completed and eroson has undercut the outlet apron. Reinforcing bars to support baffle blocks protrude from the aprons. The blocks were never installed. The outlet works at the east pond has been damaged by erosive flows to the extent that the structure is in danger of collapsing. Additional high flows may cause a total collapse, loss of the structure and flooding downstream. Rehabilitation of these structures must obtain your immediate attention and these items should be included with the work to be done at Owasso Market II. Sorrells — City Planner BACKGROUND Tulsa Teachers' Credit Union, applicant, has submitted a request for rezoning from AG (Agriculture) to CS (Commercial Shopping) on property located north of E. 96`h Street N. and east of N. Garnett Road. The subject property is approximately 4.5 acres in size. The subject property is currently vacant and undeveloped. The property is bound on the west by rural residential, zoned AG (Agriculture) and, further, by CG (Commercial General) at the northeast comer of N. Garnett Road and E. 96`h Street N.; on the north by rural residential, zoned AG (Agriculture) and, further by Bailey Ranch Estates, zoned RS -2/PUD (Residential Single - Family, High Density/Planned Unit Development); on the east by Owasso Market, zoned CS (Commercial Shopping); and on the south by rural residential and Oklahoma Natural Gas, zoned AG (Agriculture), and further east, RCB Center, zoned CS (Commercial Shopping). This item was first brought before the Commission at the August 18, 2001 regular meeting. At that time, however, the subject property had not been annexed into the corporate limits of Owasso. Annexation of the subject property was approved by the Planning Commission at the January 17, 2002 special meeting and, subsequently, by the City Council at the January 22, 2002 regular meeting. The ordinance formally accepting, adding and annexing the property was approved by the Council at the February 5, 2002 regular meeting. ANALYSIS The applicant is requesting rezoning on a parcel of land, approximately 4.5 acres in area, from AG (Agriculture) to CS (Commercial Shopping). The Owasso 2010 Land Use Master Plan designates this land as low- intensity residential. However, it is apparent that the Comprehensive Plan shows a commercial boundary in the area of the subject property that conforms exactly to the first plat of Owasso Market. The subsequent addition of land and platting of Owasso Market II, established a precedence for the extension of the commercial to the west. The Comprehensive Plan shows commercial on the south side of E. 96 °i Street N. west to a point aligned with the west side of the subject property. It is staffs opinion, given these factors, that the requested rezoning is appropriate for this site. The proposed use for the south portion of the subject property abutting E. 96`h Street N. is a Tulsa Teachers' Credit Union branch. This is a low- intensity use which will provide a positive buffer between the residential and Owasso Market. The northern (rear) portion of the site will be reserved for future development and will be, subject to a recorded access easement, oriented toward the new N. 119`' E. Avenue running between Lowe's and the existing detention facility. Letters were mailed to surrounding property owners on January 24, 2002 and legal notification of the proposed rezoning was published in the January 25, 2002 edition of the Tulsa Daily Commerce and Legal News.
