CALL TO ORDER — Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF THE JANUARY 17, 2002 SPECIAL MEETING. Charles Willey moved to approve the minutes of the January 17, 2002 meeting, Dewey Brown seconded the motion. Annexation — Garrett Creek Development — A request for review of a petition for annexation of a 126.05 acre parcel of land generally described as a portion of the W/2 of Section 9, Township 21N, Range 14E and located south of E. 116's Street N. (State Highway 20) between N. 129' E Avenue and U.S. Highway 169. (Ward 1) Donna presented the case to the Commissioners and described the property location. She stated that the subject property is zoned AG and will remain so upon annexation. Washington County Rural Water District #3 will provide water service. Notification of the annexation request was published in the Owasso Reporter. The Technical Advisory Committee reviewed this request and offered no comment. The Owasso Annexation Committee reviewed the request and recommended approval. Staff recommends approval of this annexation request. There were questions from the Commissioners regarding the purpose of the slender piece of land that stretches to the south and parallel with Hwy 169. The applicant, Mr. Alan Blaksley was not present to answer their questions. Mr. Willey suggested the item to be tabled until a time that the applicant can be present. Final Plat - The Village of Silver Creek - A request for review of a Final Plat for The Village of Silver Creek, a 16.63 acre, 65 lot subdivision located north of E. 86' Street N. and west of N. 145' E Avenue and generally described as a portion of the East Half (E /2) of the Southeast Quarter (SE /4) of Section 21, Township 21 North, Range 14 East. The subject property is located within the Silver Creek PUD (OPUD -14). (Ward 3) Donna presented the item to the Commissioners and described the location of the property. The property is zoned PUD with RS -2 underlying zoning. Issues with lot sizes and setbacks seen at the preliminary plat review are now resolved. The required detention is provided in the southeast portion of the site. The Technical Advisory Committee reviewed the plat; the applicant has addressed the comments from that meeting. Staff recommends approval of the Final Plat for The Village of Silver Creek. There were concerns with the detention area. Mr. Ron Tracy from Tracy Consulting was present and requested to approach the podium for a brief explanation of the detention issue. Mr. Tracy explained that Lot 16 is an unbuildable lot and is planned to be used for detention purposes only. Donna suggested that the covenants for the Bradfords of Silver Creek may have to be amended to show that Lot 16 is dedicated to detention. Ray Haynes moved to approve the final plat subject to a separate instrument being filed identifying Lot 16 of The Bradfords of Silver Creek be utilized for stormwater detention only, Charles Willey seconded the motion. Final Plat - Silver Creek Church of the Nazarene - A request for review of a Final Plat for Silver Creek Church of the Nazarene, a 18.06 acre, 1 lot subdivision located north of E. 860' Street N. and west of N. 145' E Avenue and generally described as a portion of OWASSO PLANNING COMMISSION February 12, 2002 Page No. 3 the East Half (E /2) of the Southeast Quarter (SE /4) of Section 21, Township 21 North, Range 14 East. (Ward 3) Donna presented the item. She explained that the submitted plat is consistent with the requirements of the OM (Office Medium) zoning district. The church will provide on -site detention. The Owasso Technical Advisory Committee reviewed the final plat at their regular meeting. The applicant has addressed all the issues from that meeting. Staff recommends approval of the Final Plat for the Silver Creek Church of the Nazarene. Ray Haynes moved to approve the Final Plat, Bill Williams seconded the motion. Site Plan — Silver Creek Church of the Nazarene — A request for review of a site plan for Silver Creek Church of the Nazarene, generally described as a portion of the East Half (E /2) of the Southeast Quarter (SE /4) of Section 21, Township 21 North, Range 14 East and located north of E. 86' Street N. and west of N. 145" E Avenue. Donna presented the item. The applicant is proposing a 14,600 square foot facility with 3650 square feet of sanctuary. The applicant has provided 95 parking spaces including 4 handicap spaces. The applicant has also provided plans showing sidewalks and curbing. The Owasso Fire Department has requested the applicant to provide an access drive, minimum 18' wide to the rear of the building. The Technical Advisory Committee reviewed the site plan at their January 30, 2002 meeting. Staff recommends approval of the site plan for the Silver Creek Church of the Nazarene subject to the following conditions: 1. All sidewalk and curb and gutter shall remain as shown on the site plan; and 2. Perimeter sidewalk shall be provided along N. 145' E. Avenue; and 3. Access drive shall be 36' wide with 35' radius at the entrance; and 4. Acceleration/deceleration lanes shall be provided as required; and 5. A minimum 18' drive be provided to rear of building for emergency access. There was a brief discussion on the amount of parking spaces for a facility of this size. Mr. Ron Tracy with Tracy Consulting was present to address concerns. Also discussed OWASSO PLANNING COMMISSION February 12, 2002 Page No. 4 was the detention for this site. Mr. Tracy stated that Lots 19 & 18 will be used as drainage; it will flow through those two lots. Charles Willey expressed concerns with drainage going across this area. The Commissioners asked if Phil Lutz with Owasso Public Works Department had a problem with this drainage plan.when they reviewed. Donna stated that Mr. Lutz had no comments other the requirement of a drainage easement. Ray Haynes suggested that this item be tabled until the next Planning Commission meeting in order to give the Public Works Department time to review the drainage. Ray Haynes moved to table the site plan review for the Silver Creek Church of the Nazarene until the next Owasso Planning Commission meeting, Charles Willey seconded the motion. Lot Tie Agreement — Jim Stallings — A request for review of a Lot Tieing Agreement for Lots 4 & 5, Block 3, Hillside Estates, located at 11438 N 96" E. Avenue. (Ward 3) Donna presented the item to the Commissioners and described the location. The applicants own both lots 4 and lot 5. They had constructed an attached garage on the property line. An encroachment of the attached garage was noticed and the applicant was advised that he needed to acquire a lot tie agreement and a building permit. The Technical Advisory Committee reviewed the proposed closing at their regular meeting. No comments were recorded. The lot tie does not affect any platted utility easements, as there are none along the common lot line of the two subject lots. Staff recommends approval of the Lot Tie Agreement. Mr. and Mrs. Stallings, the applicants, were present to answer any questions from the Commissioners. Approval and granting of the lot tie agreement will ensure that the following occur: 1. The property owner shall thereafter have the right to construct on the common lot line between Lots 4 & 5, Block 3, Hillside Estates; and 2. The property owner shall have the right to use the combined lots as if they were a single lot of record; and 3. Neither lot may be sold separately in the future; and 4. All other improvements shall comply with all ordinances of the City of Owasso. Bill Williams moved to approve the Lot Tie Agreement, Charles Willey seconded the motion. Lot Tieing Agreement - Robert Benzel - A request for review of a Lot Tieing Agreement for Lots 12 & 13, Block 1, Central Park, located at 12709 E 91" Street N. (Ward 1) Donna presented the item to the Commissioners. She explained that the lot tie agreement does not affect any utility easements. The Technical Advisory Committee reviewed the lot tie request and had no comments. Mr. Benzel owns both lots and plans to construct a single family home across both. Mr. Robert Benzel, the applicant, was present to answer questions. Staff recommends approval of the Lot Tie Agreement, combining Lot 12 & 13, Block 1, Central Park. Approval and granting of the lot tie agreement will ensure that the following occur: 1. The property owner shall thereafter have the right to construct on the common lot line between Lots 4 & 5,. Block 3, Hillside Estates; and 4. The property owner shall have the right to use the combined lots as if they were a single lot of record; and 5. Neither lot may be sold separately in the future; and 4. Partial Easement Closing - Sack & Associates - A request for a review of the partial closing of a recorded 100' Drainage Easement located within Tract B, Lot 1, Block 2, Owasso Market U. The subject property is located north of E. 9601 Street N. and west of N. 119' E. Avenue. (Ward 1) OWASSO PLANNING COMMISSION February 12, 2002 Page No. 6 Donna presented the case and described the location. The applicant is proposing the installation of a 60' concrete pipe and filling the open channel. The Technical Advisory Committee reviewed the proposed closing with one comment from ONG, requiring a 30" cover required at the south end. Discussion was held regarding the silt buildup in the detention pond. Mr. Jerry Emanuel was present to address concerns. Mr. Emanuel stated that the planned trickle channels will help with the silt problem. Staff recommends approval of the partial closing of the recorded drainage easement (Book 6431, Page 520) subject to the following conditions: 1. Public Works requirements as stated below shall be completed prior to Council release of the easement closing: a. Remove silt deposits from the west detention pond and construct trickle channels from the two pond inlets to the outlet works; and b. Open the junction box at the north perimeter (north of Lowe's) and construct wing walls to direct runoff from the north into the box and the existing 60 -inch pipe. Ray Haynes moved to approve, subject to the above TAC and Public Works requirements and subject to the detention area and the drainage pipes being cleaned out, Dewey Brown seconded the motion. OZ -02 -02 Tulsa Teachers' Credit Union - A request for review of the rezoning of a 4.5 acre tract from AG (Agriculture) to CS (Commercial Shopping). The subject property is generally described as a portion of the South Half (S /2) of the Southwest Quarter (SW /4) of the Southwest Quarter (SW /4) of Section 17, Township 21N, Range 14E and. located north of E. 96 h Street N. and east of N. Garnett Road. (Ward 1) Donna presented the case and described the location of the property. She briefed the Commissioners on the background of this item. The item was brought before the Commission on August 18, 2001. The subject property was not annexed into the corporate limits of Owasso. Annexation was approved at the January 17, 2002 special Planning Commission meeting, then with City Council approval on January 22, 2002. Letters were mailed to surrounding property owners on January 24, 2002 and legal notification was published. No calls were received by staff. Staff recommends approval of OZ- 02 -02. Ray Haynes moved to reopen Item N4 for review. Bill Williams seconded the motion. Mr. Alan Blaksley was present to address concerns regarding the rezoning request. Mr. Haynes explained that the Owasso Planning Commission meeting starts at 7:00 PM and expects the applicant to be present in order to answer questions. The vote on the motion to reopen and review Item #4 was as follows: Ray Haynes - Yes Bill Williams - Yes Bill Ellison — Yes Charles Willey — Yes Dewey Brown — No The motion carried 4 -1. Once again, Donna Sorrells presented the item to the Commissioners. Discussion was held regarding the purpose of the slender piece of property that runs parallel with Hwy 169. Mr. Alan Blaksley explained that a large amount of traffic is expected and wanted to have ample access in and out of the area. A service road will be constructed after approval from Oklahoma Department of Transportation. Mr. Haynes asked if attendees had any questions for the Commissioners or Mr. Blaksley. Mr. Bill Jacob of 11039 North 129 East Avenue expressed concerns regarding the annexation of this property. Mr. Jacob owns a Christmas tree farm and a blackberry business south of the proposed site. He stated that the trees and the berries need to be sprayed with chemicals frequently He wanted the Commissioners also to be aware that he burns trash, clippings from the trees and brush on his land. Mr. Haynes assured Mr. Jacobs that his property would not be affected by this annexation. Ms. Peggy Blunt, an Owasso resident, stated that she is in favor of the annexation; she feels that it will do a lot for Owasso and feels comfortable with what they are doing. Ray Haynes moved to approve the annexation as submitted, Charles Willey seconded the motion. Sorrells — City Planner CONCEPT OF A PUD The concept behind a Planned Unit Development is to provide a creative alternative to a conventional development where a particular tract is under common ownership or control, and a detailed plan (Outline Development Plan) for the development of the tract as a unit is proposed and submitted for public input and review. The PUD allows for greater creativity and flexibility than could be achieved by traditional zoning in the planning and development of large parcels of land. The use of a PUD technique is a way to amend a zoning ordinance in accordance with a complete, coordinated plan of development for a larger parcel, rather than piecemeal the changes by using variances of the zoning regulations. BACKGROUND In September, 1994, the Planning Commission reviewed a request (OZ- 94 -05) by DLH Engineering, on behalf of Mr. & Mrs. Caudle, to rezone the subject property from AG (Agriculture) to CS (Commercial Shopping). As a companion to the referenced rezoning request, another request (OZ- 94 -06) was submitted to rezone the property to the west, now Caudle Estates, from AG (Agriculture) to RS -2 (Residential Single - Family, Medium Density). At that time, staff recommended the request OZ -94 -05 be approved with CS on the east 300 feet (fronting along N. Garnett Road) of the North Half of the Northeast Quarter of the Northeast Quarter (N /2 NEA NE /4) of Section 19, Township 21N, Range 14E and the remaining west 276.43 feet zoned RS -2 "to be tied into the applicant's requested RS -2 zoning in rezoning case OZ- 94 -06 ". Subsequently, in December, 1997, Caudle Estates was platted on only the property included within rezoning request OZ- 94 -06. Consequently, the west 276.43 feet associated with OZ -94- 05 has been "orphaned" from Caudle Estates and does not provide adequate width to be developed as residential. For example, the minimum lot width within the RS -2 district is 75 feet. Based on the minimum lot area of 9000 square feet and minimum lot width of 75 feet, the lot depth must be 120 feet. At most, a developer could construct one street with lots along each side generally measuring 80 feet wide by 113 feet deep. The developer also would be limited by the maximum cul -de -sac length of 600 feet, as well as the minimum turn - around radius of 50 feet. Staff recommended the applicant consider a Planned Unit Development on the subject property to maximize development flexibility. STAFF ANALYSIS The Zoning Code identifies that the Planning Commission shall conduct a public hearing and shall determine: 1. Whether the PUD is consistent with the Comprehensive Plan. 2. Whether the PUD is in harmony with the existing and expected development of the surrounding areas. 3. Whether the PUD is a unified treatment of the development possibilities of the project site. 4. Whether the PUD is consistent with the stated purpose and standards of the PUD ordinance. a. Permit innovative land development while maintaining appropriate limitation on the character and intensity of use assuring compatibility with adjoining and proximate properties; b. Permit flexibility within the development to best utilize the unique physical features of the particular site; c. Provide and preserve meaningful open space; d. Achieve a continuity of function and design within the development. CONSISTENCY WITH COMPREHENSIVE PLAN The Owasso 2010 Land Use Master Plan shows a typical 5 acre Commercial/Office tract at the southwest comer of E. 96`h Street N. and N. Garnett Road. The remainder of the subject property is shown on the Master Plan as Medium- Intensity Residential which could include duplexes, townhouses or patio homes. According to the Owasso Zoning Code, the 3.78 acre CS (Commercial Shopping) portion of the subject property could accommodate as much as 82,493 square feet of commercial building area. The applicant has proposed distributing the square footage, as allowed for the 3.78 acres of CS zoning, over the northern 70 %, more or less, of the subject property as appropriate under the Planned Unit Development supplemental zoning. The applicant also proposes preserving the southern 30% of the site as natural open space to preserve the existing flood plain. Harmony with Existing and Expected Development The existing and expected residential development immediately surrounding the subject property will be well served by the neighborhood commercial which, upon approval, this development will offer. Legal. Planning and Site Engineering The applicant has identified the terrain of the subject property as relatively flat with one minor ridge line and one major drainageway which flows east to west across the southern part of the property and soils which are typical for the area and create no unusual development problems. Detention facilities are not specifically designated within the subject property. If unified detention facilities are to be proposed, all facilities must be constructed and functional prior to release of a building permit for a site which will utilize such facilities. A detailed drainage report is required by the Public Works department at the time of the first plat submitted within the PUD. Sewer and water are available to the site. This property will be subject to the Ator Relief Line payback fee assessment of $325 per acre at the time of platting. Sidewalks will be required along all public rights -of -way associated with the subject property. Perimeter sidewalks must be installed at the time of overall development, while the internal walks may be constructed as individual lots /sites are developed. Acceleration/deceleration lanes are required at all access locations along arterials. The Owasso Technical Advisory Committee reviewed the PUD Outline Development Plan and Text at the January 30, 2002 regular meeting. A copy of the memorandum detailing comments generated is attached for your information and review. Notification letters were mailed to surrounding property owners on February 19, 2002 and legal notification was published in the February 21, 2002 edition of the Owasso Reporter. Unified Treatment of the PUD Subject Area The applicant has effectively utilized the site and its existing features and thoughfully arranged various land uses proposed within the PUD. A property owners' association will be established, and, at the time of platting, detailed covenants and restrictions incorporating all conditions of the PUD and governing the unified design and function of the various uses shall be submitted. RECOMMENDATION Staff recommends approval of OPUD -02 -01 subject to the following conditions: 1. The applicant's Outline Development Plan and Text shall be filed of record in the office of the Tulsa County Clerk and two recorded copies provided to the City Planner prior to the processing of any plat associated with the PUD. 2. Sidewalks along the perimeter of the development shall be installed at the time of development. All other sidewalks shall be installed at the time of site construction. 3. Acceleration/deceleration lanes shall be required at all access points along arterial roads. 4. A detailed drainage report shall be submitted to and approved by the Public Works department prior to the processing of any plat associated with the PUD. 5. Detailed covenants and restrictions incorporating all conditions of the PUD and governing the unified design and function of the PUD shall be required at the time of platting. 6. Unless specifically set out in the standards and conditions of this PUD, commercial development shall meet all requirements of the CS (Commercial Shopping) district. 7. Within the PUD, the maximum building floor area shall not exceed 82,493 square feet. S. All conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval shall be met as conditions of the PUD. 9. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. 10. No building permit shall be issued within any portion of the PUD until all criteria outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the developer. 11. Detailed landscape plans for individual sites shall be submitted at the time of site plan review. 12. Area markers, including associated landscaping and lighting, shall be submitted to and approved by the Owasso Planning Commission as required by the Sign Ordinance. 13. The subject property is CG/PUD (Commercial General/Planned Unit Development) and is located within the Interchange Business Park PUD. The property is bound on the north by undeveloped rural residential/agriculture, on the west by U.S. Highway 169 right -of -way and, further, by undeveloped rural residential/agriculture and on the east and south by the remainder of the Interchange PUD. ANALYSIS The applicant has proposed a 4,600 square foot convenience store facility. According to the Owasso Zoning Code, the parking requirement for this facility is 1 space per 200 square feet building floor area. Based on this requirement, the applicant is required to provide 23 spaces including 1 handicap, van accessible spaces. The applicant has provided 38 spaces including 2 handicap spaces. One loading berth is required by code for this facility and has been provided. A landscape plan for the subject property has been reviewed and approved by staff. No screen fencing is required as the property does not abut a residential district. Sidewalk and acceleration/deceleration lanes are not required since this site does not front onto an arterial or service road. On -site detention is provided. The Owasso Technical Advisory Committee reviewed the site plan at the January 30, 2002 regular meeting. Comments received were minimal and included: • Coordinate directly with the Owasso Fire Department for hydrant location(s). • Ground - mounted signage along U.S. Highway 169 corridor should be moved north so as not to interfere with overhead PSO lines.
