CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF MARCH 12, 2002 REGULAR MEETING - The Commission reviewed the minutes of March 12, 2002 Regular Meeting, Charles Willey moved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison — Yes Charles Willey — Yes Dewey Brown - Yes The motion carried 4 -0. 4. OPUD -01 -01 — Partial Abandonment — D M Sokoloskv — A request to partially abandon this Planned Unit Development by eliminating the 15+ acre industrial tract on the east side. The PUD contains 26.68 acres and is located on the south side of E. 1160 St. N. between N. Mingo Road and the SK &O railroad tracks and is described as a portion of Government Lot one (1), in the Northwest Quarter (NW /4) of the Northwest Quarter (NW /4) of Section 7, Township 21 North, Range 14 East. The Chair introduced the item and the staff review was given by Stan Ewing. The applicant is requesting the abandonment of the easterly 15 acres that had previously been rezoned from AG for IL (Light Industrial) use in the PUD. In September 17, 2001 the applicant presented a rezoning request for the easterly 15 -acre from IL to RS -3 (Residential Single Family, High Density). There was discussion at that meeting regarding the need to amend or abandon OPUD- 01 -01. This request will abandon the 15 -acre industrial portion of the PUD and will allow the City Council to approve the RS -3 rezoning. The Technical Advisory Committee reviewed this request at their March 27, 2002 meeting and had no objections. Staff supports the partial abandonment of the easterly 15 acres of industrial outlined in OPUD- 01 -01. Ray Haynes moved to approve the Partial Abandonment to allow for RS -3 (Residential OWASSO PLANNING COMMISSION April 9, 2002 Page No. 2 Single Family), Charles Willey seconded the motion. OPUD -01 -01 — Minor Amendment -Brent Scott — A request to reduce the required 10' x 5' side yard to 5' x 5' side yards within the 9.53 acre duplex portion of this Planned Unit Development. The PUD contains 26.68 acres and is located on the south side of E. 116" St. North between N. Mingo Road and the SK &O railroad tracks and is described as a portion of Government Lot one (1), in the Northwest Quarter (NW /4) of the Northwest Quarter (NW /4) of Section 7, Township 21 North, Range 14 East. The Chair introduced the case and the staff review was presented by Stan Ewing. The applicant is requesting a text amendment to the Outline Development Plan to allow the side yards be modified from 10' & 5' to 5' & 5' to that portion of OPUD -01 -02 identified as the Residential Duplex district. Staff supports the Minor Amendment to OPUD -01 -01 (Amended). Ray Haynes questioned how many additional lots, if approved, will this create. He stated that only 30' would be gained by approving this amendment; the regulation is set for residential housing and has concerns with approving the request. The applicant was not present to address concerns. Ray Haynes moved to deny the Minor Amendment, not to allow the modification. The developer must meet the side yard requirements as in the Owasso Zoning Code. Charles Willey seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison - Yes Charles Willey — Yes Dewey Brown - Yes The motion carried 4 -0 and the Minor Amendment was denied. 6. OPUD -02 -02 — Garrett Creek — A request for a PUD Zoning Overlay for the 126.05 acre tract contained in the preceding OZ -02 -03 Garrett Creek rezoning. (This is associated with following OZ -02 -03 Garrett Creek Re- zoning Application. The staff wishes to present the Rezoning and the PUD together.) Stan presented the item and explained the concept of a PUD and stated that staff would like to propose concurrent review of OPUD -02 -02 and OZ- 02 -03. The applicant is requesting the approval of a rezoning, which contains 126.05 acres undeveloped. The OWASSO PLANNING COMMISSION April 9, 2002 Page No. 3 request is to rezone the 126.05 acres from AG to 23.05 acres of RS -3 (Residential Single Fancily High Density) and 16.46 acres of CS (Commercial Shopping). The remaining 86.54 acres will stay zoned AG. The City of Owasso will serve the development with sanitary sewer. Washington Rural Water District #3 will provide water service. The applicant has effectively utilized the site and its existing features and has thoughtfully arranged various land uses. Staff received a few calls mainly for an explanation of a Planned Unit Development. The applicant was present to answer questions. There were concerns from the Commissioners regarding 86.54 acres remaining AG (Agriculture). Concerns were expressed regarding the possibility of the remaining AG area being sold with the detention area not being complete. Stan assured the Commissioners that all storm water detention will be constructed in the first phase of the project. Staff recommends approval of OPUD -02 -02 and OZ -02 -03 subject to the following conditions: 1. Sidewalks along the perimeter of the development, except at those locations where the future business will actually front the arterial or service road shall be installed at the time of development. All other sidewalks shall be installed at the time of site construction. 2. Acceleration/deceleration lanes shall be required at all access points along arterial and service roads. 3. Detailed covenants and restrictions incorporating all conditions of the PUD and governing the unified design and function of the PUD shall be required at the time of platting. 4. The applicant's Outline Development Plan and Text shall be filed of record in the office of the Tulsa County Clerk and two recorded copies provided to the City Planner prior to the processing of any plat associated with the PUD. 5. Unless specifically set out in the standards and conditions of this PUD, commercial development shall meet all requirements of the CS (Commercial Shopping) district. 6. Unless specifically set out in the standards and conditions of this PUD, residential development shall meet all the requirements of the RS -3 (Residential Single- Family High Intensity) district. 7. Unless specifically set out in the standards and conditions of this PUD, townhouse development shall meet the requirements of the RTH (Residential Townhouse) district. 8. Unless specifically set out in the standards and conditions of this PUD, apartment development shall meet the requirements of the RM -1 (Residential Multi- Family Low Intensity) district. 9. All conditions imposed by the Owasso Technical Advisory Committee for subdivision plat approval shall be met as conditions of the PUD. 10. A detailed, certified drainage report be submitted to and approved by the Public Works Department prior to Planning Commission review of a final plat. 11. All covenants of any subdivision plat containing property within the PUD shall incorporate all PUD standards and conditions of approval and make the City of Owasso beneficiary. No building permit shall be issued within any portion of the PUD until all criteria outlined within Chapter 8 of the Owasso Subdivision Regulations are met by the developer. 13. Detailed landscape plans for individual sites shall be submitted at the time of site plan review. 14. Area markers, including associated landscaping and lighting, shall be submitted to and approved by the Owasso Planning Commission as required by the Sign Ordinance. 15. The Planning Commission reserves the right to prescribe additional buffering, screening and setbacks during the platting process. Ray Haynes moved to approve OPUD -02 -02 subject the above staff and TAC recommendations and subject to the completion of storm water drainage prior to occupancy of this development, Dewey Brown seconded the motion. Stan explained that staff is proposing a concurrent review of OPUD -02 -02 & OZ- 02 -03. The applicant is requesting the approval of a rezoning, which contains 126.05 acres undeveloped. The request is to rezone the 126.05 acres from AG to 23.05 acres of RS- 3 (Residential Single Family High Density) and 16.46 acres of CS (Commercial Shopping). The remaining 86.54 acres will stay zoned AG. Preliminary Plat — Watercolors at Coffee Creek — Request for review of a 4.7+ acre Preliminary Plat containing 39 townhouse lots. The site is located between Coffee Creek subdivision and the US Highway 169 collector road immediately North of E. 103rd St. N. and is described to be located in the West Half of the Northeast Quarter (W /2, NE /4) of Section 16, Township 21 North, Range 14 East. Stan presented the above item to the Commissioners. He stated that the submitted preliminary plat is consistent with the requirements of the Coffee Creek PUD zoning district. An open air space has been provided in the southerly portion of the site. This site will also provide the required detention. A $16.00 per acre siren fee, totaling approximately $91.20 will be assessed on the property prior to release of the final plat. Also the $1,580.00 per acre Elm Creek Interceptor Payback fee. The Owasso Technical Advisory Committee reviewed this item at their March 27, 2002 meeting. Mr. David Charney, the applicant, was present. Minimum standards on townhomes were discussed briefly. Mr. Charney requested to address the Commissioners. He stated that the condominiums will be an upscale, gated community with a view of the lake. There will be an association for the common areas, which will see that the trim is repainted on a regular basis and landscaping is cared for. He also explained that the streets will be maintained privately. Every unit has a two car garage; the parking lot shown on the plat is for guests. Staff recommends approval of the Preliminary Plat for the Watercolors at Coffee Creek subject to the following conditions: 1. That all TAC comments be addressed prior to approval of the final plat, and 2. All lots shall meet the minimum standards as set forth under the Townhomes Development Standard outlined in OPUD -18, and 3. That no building permits shall be issued within any portion of the proposed development until all requirements of the Owasso Subdivision Regulations, Chapter 8 "Building Permits" are fulfilled, and 4. Provision of perimeter sidewalks along E. 103`d Street N. and along the "Public Collector Street shall be included within the deed of dedication of the plats, and 5. Maintenance of open space and storm water facilities shall be provided within the text of the deed of dedication, and 6. A covenant stipulating that "the proposed subdivision shall meet or exceed all requirements of OPUD -18, the Owasso Subdivision Regulations and the Owasso Zoning Code" shall be included in the text of the plat, and 7. A covenant stipulating that "All improvements shall be 1) constructed and accepted by the Owasso City Council, or 2) insured by performance bond naming the City of Owasso co- obligee" shall be provided before building permits will be issued" shall be added to the text of the plat. Ray Haynes moved to approve the preliminary plat request subject to the above staff and OWASSO PLANNING COMMISSION April 9, 2002 Page No. 6 TAC recommendations, Bill Ellison seconded. Preliminary Plat — Garrett Creek Parkway — A request for review of a 16.46 acre commercial subdivision containing 4 lots in 3 blocks. The site is located on the south side of E. 116°t St. N. adjacent to US Highway 169 and is generally described as a portion of the Northwest Quarter (NW /4) of Section 9, Township 21 North, Range 14 East. Stan presented the item and described the location. The preliminary plat is consistent with the requirements of the Garrett Creek PUD. An area of open space has been provided in the center portion of the overall commercial site that will accommodate required detention. A $16 per acre siren fee will be assessed on the property prior to release of the final plat for filing. The Owasso Technical Advisory Committee reviewed the preliminary plat at the March 27, 2002 regular meeting. The applicant was present to address concerns. Discussion was held regarding the width on the east entrance. Ray Haynes expressed concerns with the possible congestion of 116'' Street North. Staff recommends approval of the Preliminary Plat for Garrett Creek Parkway subject to the following conditions: 1. That all TAC comments be addressed prior to approval of the final plat, and 2. All lots shall meet the minimum standards as set forth under the Zoning Code for the CS zoning district, and 3. That no building permits shall be issued within any portion of the proposed development until all requirements of the Owasso Subdivision Regulations, Chapter 8 "Building Permits" are fulfilled, and 4. Provision of perimeter sidewalks along E. 116th Street N. and along the commercial collector streets shall be included within the deed of dedication of the plats, and 5. Maintenance of open space and storm water facilities shall be provided within the text of the deed of dedication, and 6. A covenant stipulating that "the proposed subdivision shall meet or exceed all requirements of OPUD- 02 -03, the Owasso Subdivision Regulations and the Owasso Zoning Code" shall be included in the text of the plat, and 7. A covenant stipulating that "All improvements shall be 1) constructed and accepted by the Owasso City Council, or 2) insured by performance bond naming the City of Owasso co- obligee" shall be provided before building permits will be issued" shall be added to the text of the plat. OWASSO PLANNING COMMISSION April 9, 2002 Page No. 7 Following discussion, Ray Haynes moved to approve the preliminary plat request subject to the above staff and TAC recommendations and subject to Oklahoma Department of Transportation requirements being met. Also, subject to a better design on the egress and ingress into the entrances, Charles Willey seconded. Preliminary Plat — Garrett Creek Estates — Request for review of a 23.05 acre single family subdivision containing 91 lots. The site is located at the southwest corner of E. 116'" St. N. and N. 125' E. Ave. and is generally described as a portion of the Northwest Quarter (NW /4) of Section 9, Township 21 North, Range 14 East. Stan presented the case and described the location of the property. The submitted plat is consistent with the requirement of the Garrett Creek PUD. The applicant has provided an area for the required detention. A $16.00 per acre siren fee, total $368.80, will be assessed on the property prior to release of the final plat. The Technical Advisory Committee reviewed the plat at their March 27, 2002 meeting. Minimum lot widths of RS -3 (Residential Single - Family High Intensity) criteria were discussed. Charles Willey had concerns with the flag lots on Lots 27 and Lot 22, Block 1. Staff recommends approval of the Preliminary Plat for Garrett Creek Estates subject to the following conditions: 1. That all TAC comments be addressed prior to approval of the final plat, and 2. All lots shall meet the minimum standards as set forth under the Zoning Code for the RS -3 zoning district, and 3. That no building permits shall be issued within any portion of the proposed development until all requirements of the Owasso Subdivision Regulations, Chapter 8 "Building Permits" are fulfilled, and 4. Provision of perimeter sidewalks along E. 116th Street N. and 129 E. Avenue along the residential streets shall be included within the deed of dedication of the plats, and 5. Maintenance of open space and storm water facilities shall be provided within the text of the deed of dedication, and 6. A covenant stipulating that "the proposed subdivision shall meet or exceed all requirements of OPUD- 02 -03, the Owasso Subdivision Regulations and the Owasso Zoning Code" shall be included in the text of the plat, and 7. New Planning Commission Meeting Date and Time — Discussion and appropriate action. Discussion was held regarding the possibility of moving the Owasso Planning Commission meetings to the second Monday of every month. The Commissioners agreed to the change. Mr. Rooney stated that he will inform the City Clerk and notify the Owasso Reporter. ADDENDUM TO AG ENDA Notice of addendum filed in the office of the City Clerk and posted on the City Hall bulletin board at 3:00 PM on Monday, April 8, 2002. All other matters set forth on the agenda filed at 5:00 PM on Tuesday, March 19, 2002 shall remain the same. The following is submitted for addendum thereof: 12. Site Plan Review — Sokolosky Mini - Storage — A request to review a Site Plan for Sokolosky Mini- Storage. The subject property is described as Lots 1, 2, 3, and 4 of Owasso Center and is located at the southwest corner of E. 86h Street North and Main Street. The subject property is zoned CG (Commercial General). The Chair introduced the case and the staff review was given by Tim Rooney, Assistant City Manager. The current zoning would allow for the development of mini - storage units by right at this location. The site plan shows five buildings with a total square footage of 32,700 square feet. The Technical Advisory Committee reviewed the site plan at their January meeting. All of the concerns have been addressed with the exception of the site - obstructing fence to be installed along the south property line. Oklahoma Natural Gas had comments regarding an existing gas main and easement bisecting the site. ONG has commented that they are not opposed to a partial closing of the easement. It is staff's opinion that the applicant should not be required to install sidewalks on E. 86' Street North because of the fact that it would be torn out when widening E. 860' Street begins. OWASSO PLANNING COMMISSION April 9, 2002 Page No. 9 The applicant was present. The following list was compiled from continents made by several area citizens Mary Melton (Manager of Mane Review) - Does not like the idea of a mini- storage next to her business. Had concerns with Mane Review being hidden. Henry Robinson (Owner of Mane Review) - The business will miss a lot of walk -in clients if they are hidden by the mini - storage. He had questions regarding the frontage requirements in a CG (Commercial General) District. Mike Robertson - 202 West ll'h - Questioned the type of fencing required in a commercial district. Also, concerns regarding the business hours. Does not like the idea of a 24 hour mini- storage across the street from his home. Ray Haynes stated that he was surprised Mr. Sokolosky is putting in a mini- storage at this location but the zoning is there and there is nothing we can do about it. Dewey Brown expressed appreciation to Mr. Rooney for the comment that a mini - storage is allowed by right in a CG Distrist and we could be approving a site plan for something much worse. Staff recommends approval of the proposed site plan as presented with the following condition: 1. Applicant must obtain successful closing of the utility easement as described in correspondence from ONG (see attached). Following discussion, Ray Haynes moved to approve the site plan for Sokolosky Mini - Storage subject to the above staff recommendation along with the follow conditions: 2. Conditional upon approval of a partial closing of the easement 3. Money placed in an escrow account for sidewalks along E. 86' Street North 4. Restricting access into the establishment from 12:OOAM through 6:OOAM S. Site obstructing fence to be wood and brick column construction, would encourage 8' tall 6. Consider sharing signage with the Mane Review Dewey Brown seconded the motion. Chairperson Secretary Date ' 1 AI_ TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY ASSISTANT CITY MANAGER SUBJECT: PARTIAL EASEMENT CLOSING REQUEST LOT 33, BLOCK 5, COUNTRY ESTATES IV CLAYBROOK DATE: May 7, 2002 BACKGROUND: The City of Owasso has received a request for the closing of a portion of a utility easement described as the northeasterly five feet of the southwesterly 11 foot utility easement located on Lot 33, Block 5, Country Estates IV Addition. The subject property is currently developed with a single - family dwelling; however no utilities are located within that portion of the utility easement that the applicant is seeking to be closed. A location map has been attached for your information and review. The applicant is seeking partial closure of the easement in order to construct an in- ground swimming pool in the rear yard. The site plan, also attached for your information and review, indicates that an eyebrow of the kidney shaped pool would encroach into the platted 11 foot utility easement. Please note, however, that the in- ground pool must remain a minimum of 6 feet from the rear property line, meaning that only 5 feet of the utility easement could be closed. Requests for input from the Technical Advisory Committee were sent via the TAC Agenda packet to SW Bell, Cox Cable, AEP, and ONG; as well as city utilities. The TAC meeting was conducted on May 1, 2002 at 2:00 PM in the Main Conference Room at City Hall. No comments were received regarding the partial easement closing at that meeting other than the proposed pool maintaining the required setback of 6 feet from the rear property line. Staff has no objections to the partial easement closing request. If the Planning Commission approves the partial easement closing, this item will be forwarded to the City Council for action at the May 21, 2002 regular meeting. RECOMMENDATION: Staff recommends approval of the partial easement closing request, thus closing the northeasterly 5 feet of the southwesterly 11 foot utility easement on Lot 33, Block 5, Country Estates IV. OKLAHOMA MEMORANDUM TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY ASSISTANT CITY MANAGER SUBJECT: FINAL PLAT CROSS TIMBERS DATE: May 8, 2002 BACKGROUND The City of Owasso has received a request from Donald and Debbie Williams to review a preliminary plat for Cross Timbers Addition. Cross Timbers Addition is located immediately west of Northeast Elementary School and the Coffee Creek Addition, east of the Owasso Expressway between 96' Street North and 106' Street North. A location map is included on the plat contained within your packet. The proposed plat is a one -lot, one -block addition that would contain .93 acres, more or less and is zoned CG (Commercial General). Because this is a one- lot, one -block addition, staff is reviewing this request as a final plat and will be seeking Planning Commission approval as a final plat. The Technical Advisory Committee reviewed the final plat for the Cross Timbers Addition at their May 1, 2002 regular meeting. At that meeting, area utility companies have the opportunity to request additional service easements, as well as staff also being provided opportunities to comment and /or require corrections. The following comments were submitted regarding the Cross Timbers plat: 1. Add Limits of No Access to the street frontage of the plat to match up with that which is being proposed on the site plan. (see next agenda item) 2. Add 2.5 feet to the northerly 17.5 foot utility easement, thus creating a total easement of 20 feet. File same as separate instrument with rights to Washington County Rural Water District #3. 3. In Section I, subsection D of the Deed of Dedication, add wording that includes Washington County Rural Water District #3 as they are the water supplier to the subject property. 4. Add the address of 13620 E. 103rd Street North to the plat. The plat contained within your packet has addressed all of the above concerns. There are no construction plans regarding this subdivision as development on the site will be tapping into existing infrastructure as a result of the Northeast Elementary and the Coffee Creek Addition. There are, however, four additional requirements regarding this plat and they are listed below: 1. Sidewalks will need to be added along the E. 103'' Street North frontage. 2. The Elm Creek Interceptor payback fee would need to be paid by the applicants prior to obtaining signatures on the final plat. The Elm Creek Interceptor payback fee is $1,580 per acre, or $1,469.40 for the subject property. 3. In addition to the Elm Creek Interceptor payback fee, the applicants must also must address a payback fee to Owasso Land Trust, the entity that extended the sewer lines from the Elm Creek Interceptor. The applicable fee for that payback is $1,000 per acre, or $930 for the subject property. 4. There is a Storm Siren Fee of $16 per acre that would need to be paid by the applicants. This fee would amount to $14.88. Again, due to the nature of the plat being a one -lot, one -block addition, staff is requesting the Planning Commission act on this plat as being a final plat in nature. If approved by the Planning Commission, the final plat will be forwarded to the City Council for action at the May 21, 2002. ENNEUM�1 TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY ASSISTANT CITY MANAGER SUBJECT: SITE PLAN SOKOLOSKY STORAGE FACILITY DATE: April 8, 2002 All Ed Sokolosky has submitted a site plan for a mini- storage facility that would be located at the southwest corner of E. 86' Street North and Main Street. The subject property is described as Lot 1,2,3, and 4 of Owasso Center. A location map is included on the site plan within your packet. The current zoning of the property is CG (Commercial General) which would allow for the development of mini - storage units by right at this location. A review of the site plan indicates a proposed facility that comprises five buildings with a total square footage of 32,700 square feet. Two parking spaces at the leasing office for the facility are provided, one of which is designated for handicapped parking - van accessible. Based on the size of the office, two spaces would be appropriate. The Technical Advisory Committee reviewed the site plan at their January regular meeting. At that meeting, utility companies and staff are afforded the opportunity to make comments and/or corrections. The following are the concerns noted at that meeting: 1. Site obstructing fence, minimum of 6' in height, required between proposed use and residential properties to the south. 2. Perimeter sidewalks will be required 3. No landscaping indicated on site plan 4. Need drainage plan 5. ONG - Existing gas main and easement bisecting the site The applicant has addressed Items 1-4 as the site obstructing fence will be installed along the south property line. Sidewalk currently exists on the Main Street frontage, and could be required along the E. 86h Street North frontage, however it would be torn out when widening to E. 86' Street begins later this year. It is staff's opinion that the applicant should not be required to install sidewalks on E. 86th Street North. Landscaping is now included on the site plan and a copy of this site plan will be provided to you at Tuesday evening's meeting. The drainage plan is also attached. Item 5 - the existing gas main and easement bisecting the site remains to be addressed. The gas line serves both the Trail's End BBQ (owned by the applicant) and the Mane Review Beauty Salon. ONG has commented that they are not opposed to a partial closing of the easement, provided that the Trail's End requests that their present gas service be shut off and removed. The applicant also owns the Trail's End site, and therefore, there are no concerns with that requirement. A copy of the correspondence from ONG is attached for your information and review. Because there is a needed partial closing of the utility easement, which would once again require review by the Technical Advisory Committee, and approvals by both the Planning Commission and the City Council, an approval of the site plan would need to be conditioned upon that successful closing of the easement. While this is not a manner in which we typically process site plans, this application has been through two TAC reviews and literally lost in the shuffle between the change in City Planners. It is staff's desire for the Planning Commission to approve the site plan conditioned upon successful closing of the easement so that the applicant can begin to seek out funding for his project rather than be delayed further. I will be in the office all day on Tuesday and will be happy to discuss any questions you may have prior to the meeting on Tuesday evening. RECOMMENDATION: Staff recommends approval of the proposed site plan as presented with the following condition: 1.
