8. Zonine Code Amendment — Staff Initiated - An amendment to the Owasso
Zoning Code, Chapter 10 — Use Units, Section 1017 Automotive and Allied
Activities which would require mini - storage units to be permitted by Special
Exception only in all commercial zoning districts. Currently, mini - storage units
are permitted outright in CG (Commercial General) and CH (Commercial High
Intensity) zoning districts.

The agenda for the regular meeting was posted at the north entrance to City Hall on May 6, 2002

1. CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM
and declared a quorum present.

3. CONSIDER APPROVAL .OF THE MINUTES OF APRIL 9, 2002 REGULAR
MEETING - The Commission reviewed the minutes of April 9, 2002 Regular Meeting,
Charles Willey moved, seconded by Dewey Brown to approve the minutes. A vote on the

4. Partial Easement Closing - Catherine and Duane Claybrook - Request for approval of
a partial closing of a recorded Utility Easement located with Lot 33, Block 5, Country
Estates IV, located at 10756 E. 120 Ct North.
Tim presented the item and described the location. The Technical Advisory Committee
reviewed the request at their May 1, 2002 meeting. No comments were received other
than the proposed pool requires a setback of 6 feet from the rear property line. No
utilities are located within that portion of the utility easement. Staff recommends
approval of the partial easement closing request, thus closing the northeasterly 5 feet of
the southwesterly 11 foot utility easement on Lot 33, Block 5, Country Estates IV. The
applicants, Mr. and Mrs. Claybrook, were present to address concerns. The
Commissioners questioned Mr. Claybrook on the exact location of the pool wall. Mr.
Claybrook assured the Commissioners that the wall would be located 6 feet from the rear
property line. Mr. Haynes suggested that a survey be conducted prior to installation. Mr.
Rooney recommended the Pool Permit be flagged upon issuance in order for the
inspectors to double -check the measurements upon site inspection.

5. Final Plat - Cross Timbers- Debbie Williams - Request for review of a Final Plat for
the Cross Timbers Addition, a 0.93 acres, 1 lot Subdivision described as the NW /4 of the
SW/4 of the NE /4 and the NE /4 of the SE /4 of the NW /4 of Section 16, Township 21
North, Range 14 East, located on the south side of E. 103rd Street N., immediately west
of the Northeast Elementary - School.
Tim presented the item and described the property location. The proposed plat is a one-
lot, one -block addition and is zoned CG (Commercial General). Staff is reviewing this
request as a final plat. The Technical Advisory Committee reviewed the final plat at their
May 1, 2002 meeting. The comments /concerns have been addressed on the plat within
your packet. Staff recommends approval of the final plat subject to the following
requirements:
1. Sidewalks will need to be added along the E. 103'd Street North frontage.
2. The Elm Creek Interceptor payback fee would need to be paid by the
applicants prior to obtaining signatures on the final plat. The Elm Creek
Interceptor payback fee is $1,580 per acre, or $1,469.40 for the subject
property.
3. In addition to the Elm Creek Interceptor payback fee, the applicants must
also address a payback fee to Owasso Land Trust, the entity that extended
the sewer lines from the Elm Creek Interceptor. The applicable fee for
that payback is $1,000 per acre, or $930 for the subject property.
4. There is a Storm Siren Fee of $16 per acre that would need to be paid by
the applicants. This fee would amount to $14.88.
Charles Willey moved to approve the final plat subject to the above Staff and TAC
recommendations, Bill Williams seconded the motion. A vote on the motion was recorded

6. Site Plan Review — Cross Tim]
review of a Site Plan for the Cros
ws Daycare — Debbie Williams — A request for a
Timbers Daycare. (See Agenda Item #5).
Tim presented the item to the Commissioners. He stated that the applicant has met all
necessary parking requirements. The property is zoned CG (Commercial General) and a
landscaped area has been indicated on the site plan. Also, the applicant has provided an
erosion control plan during the time of construction. The Technical Advisory Committee
reviewed the site plan at their May 1, 2002. Staff recommends approval of the proposed
site plan as presented with the following conditions of approval:
1. The proposed location of the sign needs to be relocated to the south, out of
the utility easement. A separate permit will be required for the sign.
2. The applicant needs to install sign age for handicapped accessibility parking
in compliance with ADA standards.
3. The trash dumpster needs to be enclosed.
4. Sidewalk will be required across the frontage of E. 103' Street North.
5. Washington County Rural Water District #3 requested that the meter can
be relocated outside of any paved area.

BACKGROUND
APPLICANT AND STATUS OF APPLICANT: Jerry Russell, applicant and sub lessee of the
subject property.
REQUESTED ACTION AND PURPOSE: A request to rezone the subject property from CS
(Commercial Shopping Center) to CG (Commercial General) in order to allow for commercial use,
more specifically the sale of pre -owned automobiles.
LOCATION AND SIZE: The subject property is located at 11501 E. 76'n Street North and it's
the former location of Quik Trip. The subject property contains approximately 20,000 square feet,
more or less. A copy of the complete legal description is contained within the application for
rezoning which is attached for your information and review, as well as a location map.
EXISTING LAND USE: The subject property is currently developed but vacant.
SURROUNDING LAND USE: The subject property is abutted on the north by Captain D's
Seafood Restaurant zoned CS, and on the east by Braums Restaurant also zoned CS. The subject
property is bordered on the south by E. 76' Street North, while farther south is Wendy's
Restaurant zoned CH (Commercial High Intensity). The subject property is bordered on the west
by the Owasso Expressway service road.
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments" and Chapter 6 "Commercial Land Uses ".
SITE INFORMATION: No unusual development hardships are noted.
SITE HISTORY: At the April meeting of the Board of Adjustment, a request for a Special
Exception to allow a pre -owned auto sales lot in a CS (Commercial Shopping Center) district was
unanimously denied.
ANALYSIS
The applicants are requesting a rezoning of the parcel from CS (Commercial Shopping Center) to
CG (Commercial General) in order to allow for the use of the site for pre -owned auto sales by
right. As mentioned previously, the Board of Adjustment unanimously denied a Special Exception
request to utilize the property for auto sales without changing the zoning.
Staff would also recommend denial of this request, by first agreeing with what was cited by the
Board of Adjustment. The Board stated that there was CG zoning located elsewhere in the
community where a use such as the one that is being proposed could be located, and perhaps more

appropriate. Also, it was presented that the subject property was a gateway area to the City of
Owasso, as identified in the 2010 Master Plan, and thus a use such as the one being proposed
would not coincide with that of gateway areas as defined in the 2010 Master Plan and the desire to
improve upon them.
Additionally, the applicant is requesting CG zoning on a corner in the community where CG
zoning is not typically located. A review of the interchange areas at 76th, 86th, 96th ,106th, and
116th Streets North and the Owasso Expressway finds that out of a possible 20 commercial
"corners ", only 1 has the designation of CG (Commercial General) zoning and it remains
undeveloped. The intensity of zoning being requested at this location is not only inappropriate, it
is not consistent with land uses immediately adjacent to the site, all of which are first level
commercial use intensity.
Notices were mailed to surrounding property owners on May 16, 2002 and the legal advertisement
was published in the Owasso Reporter on May 16, 2002 as well. A copy of both have been
attached for your information and review, as well as the list of property owners within 300 feet of
the request. Additionally, the subject property was posted on May 13, 2002.
Staff has received two phone calls in opposition of the request. Staff informed the individuals to
either attend the meeting or submit their comments opposing the request in writing so that they
could be presented to the Planning Commission. No letters were received at the time of packet
preparation by the Community Development Department.
RECOMMENDATION
Staff recommends denial of the rezoning request from CS (Commercial Shopping Center) to CG
(Commercial General).

Notice is hereby given that a public hearing will be held before the
Owasso Planning Commission, in the Owasso Community Center,
Owasso, Oklahoma, at 7:00 P.M. on the 10th day of June, 2002.
At that time and place, consideration will be given to the proposed

3. OBOA -02 -09 — Mayes County Chrysler — A request for a Special Exception of the
Owasso Zoning Code Chapter 6, Section 610 "Principal Uses Permitted in Commercial
Districts ", to allow for pre -owned vehicle sales on property zoned CS (Commercial
Shopping). The subject property is described as Lot 3, Block 1, Owasso Commercial
Center and is 1, Gated at 11501 E 76h Street No., the former location of QuikTrip;
(Attachment #1) (Continued from the March 26, 2002 regular meeting)
Tim Rooney presented the item and the property location was described. The property is
zoned CS (Commercial Shopping) which does not allow automobile sales by right.
Letters were mailed to surrounding property owners and legal notification was published
in the Owasso Reporter. One letter of objection was received from a nearby property
owner. Staff recommends denial for this Use Exception. The site is a "Gateway" into the
City of Owasso and believes that this exception use is undesirable at this location. The
applicant was not present. Joe Ramey, the Chairperson, asked the Members if there were
any questions regarding this request.
Vicki Tapp moved deny the above special exception request, Jim Igarta seconded the
motion. A vote on the motion was recorded as follows:

The motion carried for denial 4 -0.
4. OBOA -02 -14 — Gene Mayfield — A request for a Special Exception of the Owasso
Zoning Code Chapter 10, Section 1002 "AREAWIDE SPECIAL EXCEPTION USES" to
allow a Non - Permanent Vendor in a CS (Commercial Shopping) district. The subject
property is described as Lot 1, Block 2, Elm Creek Commercial Center and is located at
the Southwest comer of the intersection of E. 86`h St. No. and N. 125 E Ave. The
proposed use is a Snow Cone vender.

Dear Owasso Planning Commission Members:
I regret that I will be unable to attend your scheduled meeting June 10, 2002. Please
accept this letter as my voice of objection to the request to rezone Lot 1, Block 43.
(located at 11501 E..76h Street North) of Owasso Commercial Center from CS
(Commercial Shopping Center) to CG (Commercial General). I do not believe rezoning
this property is in the best interest of our community.
I understand that a used car dealership is pursuing locating on this property, but cannot do
so under current zoning. I also understand why they would desire this location because it
is highly visible, proximal to a major entrance of Owasso, and close to other similar
dealerships where clustering provides for "feeding off of each other ". However, for the
same reasons, I believe Owasso must use prudent judgment, through zoning, in the types
of businesses allowed in this prime location.
This location is a prime gateway into our community. Already there are a
disproportionate number of used car dealerships that are highly visible along the freeway
(Including an obnoxious flashing sign visible on Highway 169 long before arrival at the
76fl' Street exit). I believe a used car dealership at this location would look junky and
tacky. None of the other properties at this intersection is zoned CG and there is value in
-- continuing with consistency in zoning. In my observation of other communities, used car
dealerships tend to be located in deteriorated, low socioeconomic areas. We do not want
Owasso to give this impression or to develop this reputation. Please consider the
appearance of our community and deny this zoning request.

APPLICANT AND STATUS OF APPLICANT: DM Sokolosky, applicant and owner of the
subject property.
REQUESTED ACTION AND PURPOSE: A request to rezone the subject property from RS -1
(Residential Single - Family Low Density) to RS -3 (Residential Single - Family High Density) in
order to allow for single - family residential development, more specifically, individual housing lots.
LOCATION AND SIZE: The subject property is located north of E. 76' Street North, between
N. 129" E. Avenue and N. 145' E. Avenue, and contains a total of approximately 39.68 acres,
more or less. The subject property is, however, separated by the golf course owned by the
Lindsay Management Company. If approved, residential development would uccar between the
Graceland Acres addition and the golf course, as well as between the golf course and what would
be N. 1451 E. Avenue. A copy of the complete legal description is contained within the
application for rezoning which is attached for your information and review, as well as a location
map.
EXISTING LAND USE: The subject property is currently undeveloped.
SURROUNDING LAND USE: The subject property is abutted on the north by the golf course
owned by the Owasso Golf and Athletic Club. The subject property is bordered on the east by
what would be the alignment of N. 145' E. Avenue, while farter east is residential development in
Roger's County. The subject property is bordered to the south by E. 76' Street North, while
farther south is Tulsa County residential development zoned RE (Residential Estates). The subject
property is bordered on the west by the Graceland Acres addition zoned RE and an undeveloped
property zoned AG (Agriculture).
APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15
"Amendments" and Chapter 4 "Residential Uses ".
SITE INFORMATION: No unusual development hardships are noted.
SITE HISTORY: The subject property was rezoned to RS -1 in January of 1998, along with the
remaining property involved in the Lindsay Management rezoning of the Golf and Athletic Club
property. Zoning on that property consists of OM (Office Medium) for the golf course, RM -1
(Residential Multi- Family) for the apartments, and CS (Commercial Shopping Center) for the
Albertson's area.
ANALYSIS
The applicant is requesting a rezoning of two tracts of land from RS -1 (Residential Single - Family
High Density) to RS -3 (Residential Single - Family High Density) in order to allow for the use of
the site for residential development. As mentioned previously, the subject property is already
approved for use in a single - family residential manner; however, the applicant is now seeking a
higher density of this type of use.
Often times, the role of a City Planner is that of a rumor squelcher, and that role was evident in the
last two weeks. This is not an application for apartment, multi - family, or low income housing.
The homes will not be "starter" homes, and the homes will be on sanitary sewer. The applicant is
simply requesting to build a single - family residential development at a higher density (more
dwelling units per acre) than that which was previously approved by the Planning Commission and
City Council in 1998.
While the subject property is bordered or located near several subdivisions that have a lower
density than that which is being proposed, this is in large part due to the unavailability of sanitary
sewer service at the time they were developed. With the development of the Owasso Greens and
Athletic Club, entire new areas of undeveloped land were effectively opened up to development
potential as sanitary sewer service was made available where it previc. =.sly was not. This is not
only evident in this rezoning request, but has occurred recently in the Preston Lakes area and the
areas around the City's owned golf course as well.
Staff has met with the applicant, Mr. DM Sokolosky, regarding the request in order to be able to
address questions and /or concerns regarding the request. As mentioned earlier in this report, the
homes will be required to be connected to sanitary sewer which will be brought to the subject
property from the Elm Creek Sanitary Sewer Extension. Streets would be required to be curb and
gutter. Mr. Sokolosky has stated that the homes would be a minimum of 1,750 square feet and
would not be "starter" in nature.
While the request is for RS -3 zoning which is a minimum lot width of 65', Mr. Sokolosky has
assured staff that no lots will be smaller than 70' in width; and in fact, it is likely that some will be
wider than that. If there was a zoning classification requiring a 70' lot width minimum, the
applicant would be requesting that zoning. The RS -2 zoning minimum is 75'.
Staff has spoken with several nearby or adjacent property owners regarding the request. As stated
previously, initially most were concerned as to whether or not the subject property was going to be
apartments. Once that issue was addressed, some seemed to understand that the property would
develop in a single - family residential nature, but were concerned with lot size, house size, house
type, etc. The most common concern expressed was traffic in the area.
If approved for development in any zoning classification, the developer is required to install and
acceleration/deceleration lane adjacent to entrances off of E. 76' Street North. This will aid
and /or assist traffic from this addition into entering on to E. 76' Street North, as well as traffic
turning into this addition while heading west. Please note that this is a City of Owasso
requirement, and that additions that develop in Rogers and Tulsa County are not required to make
this type of improvement.
While staff concurs that traffic on E. 76" Street North has increased, a denial of this zoning will
not improve that problem. In fact, just the opposite. Addressing the traffic volumes and
improvements needed to E. 76' Street North will require joint efforts by the City of Owasso, Tulsa
County, and Rogers County as it is not one entities problem to correct, but rather several. The
more each entity has constituents that live along this road, the more likely the problems will be
addressed.
The subject property was posted the week of Memorial Day and letters were sent to surrounding
property owners. The legal ad was published in the Owasso Reporter on May 23, 2002. No
letters opposing this request have been received by staff.
RECOMMENDATION:
Staff recommends Planning Commission approval of OZ -02 -05 as requested.

BACKGROUND:
The City of Owasso has received a request for a review of a lot split from Seayco - THE Owasso
Market II. The subject property is located on E. 96' Street North, between the Super Wal -Mart
and Lowes sites. More specifically, the applicant is requesting a lot split of Lot 2, Block 1 of
Owasso Market II. The subject property is zoned CS (Commercial Shopping Center) and both a
plat of Owasso Market 11 and the proposed lot split is attached for your information and review.
Lot 2 of Block 1 of Owasso Market II currently has a lot width of slightly over 412 feet and a
depth of up to 280 feet, dissected by several large easements. This lot split, if approved, would
create three commercially zoned lots at the above described location instead of one, and while not
changing the easements, would align them along the new lot lines making development of the
new lots much easier.
Tract `C' would effectively be made up of a Mutual Access Easement and could not be built
upon. Currently this mutual access easement, along with an 11 foot utility easement, renders the
east 92 feet of Lot 2 as it exists useless. Tract `B' would be the westerly 180' of Lot 2, and
Tract `A' would be the center portion of Lot 2. The 20' utility easement and 10' waterline
easement would be contained along the shared property lines of Tract `A' and "B ", rather than
dissecting the middle of a potential lot. Attached, for your information and review, are complete
legal descriptions for all three of the tracts to be created.
The Owasso Technical Advisory Committee reviewed the lot split request at their May 29, 2002
regular meeting. At that meeting, the only comments received were from Washington County
Rural Water District. Washing County Rural Water District wanted it noted that they are the
water supplier to the site, not the City, and that they had no objections to the request provided
utility easements were not moved. Staff had no comments regarding the request.
A final item of note is the bulk and area requirements for CS (Commercial Shopping Center)
zoned property. The minimum lot width is 100 feet, and the applicants are requesting to create a
lot that is 92 feet. With this requirement in mind, the applicants are applying to the Owasso
Board of Adjustment for a Variance of this requirement. While typically staff would not
necessarily be in favor of such a request, the lot is covered by a mutual access easement and
cannot be built upon anyway.

request at their regular meeting on June 25, 2002. Staff would recommend that the Board of

ELM CREEK COMMERCIAL CORNER

BACKGROUND:
The City of Owasso received a request from Dr. Greg Strathe to amend a building line on a lot
located within the previously approved Elm Creek Commercial Comer Amended Addition.
More specifically, to amend the east building line shown on Lots 6 and 7 of Block 2 from 25 feet
to 11 feet.
Enclosed within your packet are both a copy of the Elm Creek Commercial Corner; Amended
plat, as well as a proposed site plan for Lots 6 and 7. As you can see, the east building line of
Lots 6 and 7 of Block 2 is 25 feet and the applicant is desirous of constructing an addition to the
office space but the confines of the building line do not allow it.
As a requirement for amending a plat, the applicant must supply the City of Owasso with the
signatures of all property owners within the addition endorsing the approval of the proposed
amendment. Attached are copies of those signatures for your review.
The plat amendment was reviewed by the Technical Advisory Committee at their May 29, 2002
regular meeting. At that meeting, utility companies and the City of Owasso Public Works
Department are afforded an opportunity to comment on the proposed amendment and site any
concerns regarding the request. No opposing comments were received.
Staff has no objections to the request to change the building line on Lots 6 and 7, Block 2 of Elm
Creek Commercial Corner as the requested change will not be detrimental to surrounding
property owners in any manner. If the proposed amendment were to be approved and the
building addition constructed, the building would still be approximately 22 feet behind the curb,
11 feet behind the property line, and would not create any visibility problems as the subject
property is not a corner lot.
RECOMMENDATION
Staff recommends approval of an amendment to the east building line of Lots 6 and 7, Block 2 of
Elm Creek Commercial Corner Amended from 25 feet to 11 feet.

BACKGROUND:
The City of Owasso currently permits mini- storage units in CG (Commercial General) and CH
(Commercial High Intensity) districts outright, while it requires approval from the Board of
Adjustment by means of a Special Exception in a CS (Commercial Shopping Center) district. It
appears that at the time of establishing the zoning code, mini - storage units were not as widely
popular as they are today for the consumer, nor was there any thought given to the amount of
growth that the City of Owasso would experience. Additionally, the possibility of potentially
valuable sales tax generating property being occupied by mini- storage units is not desirable.
Staff believes a change in the zoning code that would require the Board of Adjustment to approve
mini - storage units by Special Exception in all commercial districts is appropriate. It would allow
the City to review each proposal on a case by case basis, consider the development trends of the
area, the future development potential of the subject and surrounding property, and allow for
public input on a process that is currently restricted in two of the three commercial zoning code
classifications.
Staff spoke with Planners from cities of Owasso's size prior to bringing this amendment request
to your attention. Some of the issues presented in this report are a direct result of those
conversations, with all in agreement that a strict application of a Tulsa based zoning code may
not always be in the best interest of its surrounding cities. It is staffs opinion that this is such a
case. While certainly not a model for planning but a city that has experienced substantial growth,
Kingman, AZ does not allow mini- storage units at all in its least intense commercial district, and
requires a review similar to that of the Board of Adjustment in the two most intense commercial
districts. The amendment being proposed by staff, while not as restricting as that of Kingman's,
would appear to be the appropriate step to ensure a public review process.
If the proposed amendment is approved by the Planning Commission, this item will be forwarded
to the Owasso. City Council on June 18, 2002 for approval.
