CALL TO ORDER - Chairperson Ray Haynes called the meeting to order at 7:00 PM and declared a quorum present. 2. ROLL CALL 3. CONSIDER APPROVAL OF THE MINUTES OF MAY 13, 2002 REGULAR MEETING - The Commission reviewed the minutes of May 13, 2002 Regular Meeting, Charles Willey moved, seconded by Dewey Brown to approve the minutes. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison — Yes Charles Willey — Yes Dewey Brown - Yes The motion carried 4 -0. 4. OZ -02 -04 — Jerry Russell — A request to rezone Lot 1, Block 3 of Owasso Commercial Center from CS (Commercial Shopping Center) to CG (Commercial General). The subject property is located at 11501 E 76 Street North and is the former location of the Quik Trip Convenience Store. Tim presented the item and described the location. The applicant is requesting to rezone from CS (Commercial Shopping Center) to CG (Commercial General) in order to allow the sales of pre -owned automobiles. The subject property is currently developed but vacant. The Board of Adjustment unanimously denied a Special Exception request to use the property for auto sales without changing the zoning. Staff recommends denial of this request, due to the fact that there is CG zoning located elsewhere in the community. Also, this property is a gateway area to the City of Owasso. This use would not coincide with that of gateway areas as defined in the 2010 Master Plan. Notices were mailed to surrounding property owners and legal advertisement was published in the Owasso Reporter. Staff received two phone calls in opposition and one letter (attached). The Technical Advisory Committee reviewed the request at their May 29, 2002 meeting. Mr. Jerry Russell, the applicant, was present to answer questions and requested a brief presentation. He stated that Mays County Chrysler has sales lots in Tahlequah and Pryor at this time and are doing well. Each lot normally has around 25 cars on the lots with OWASSO PLANNING COMMISSION June 10, 2002 Page No. 2 three to four employees per dealership. Ray Haynes expressed his concerns with the rezoning stating that a Special Exception is really what should have been approved, that way the City of Owasso would have more control if Mayes Country Chrysler fails. Changing the zoning permanently could open this property to less desirable businesses. Ray Haynes moved to deny the rezoning request, Charles Willey seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison - Yes Charles Willey - Yes Dewey Brown - Yes The motion carried 4 -0 for denial. 5. OZ -02 -05 - DM Sokoloskv - A request to rezone approximately 40 acres of land from RE (Residential Estates) to RS -3 (Residential Single- Family High Density). The subject property is located north of E. 76' Street North, west of N. 145x' E. Avenue, and east of the Graceland Acres Addition. Tim presented the item and described the property location. The request is to rezone the property from RS -1 to RS -3 in order to allow single - family residential development. The property is undeveloped. If approved the subject property will be connected to the Elm Creek Sanitary Sewer Extension and acceleration/deceleration lanes will be required. Letters were sent to surrounding property owners and the legal ad was published in the Owasso Reporter. No letters were received opposing this request. Mr. D. M. Sokolosky was present to address concerns regarding this request. Also, several surrounding property owners were present to express opposition. Mr. Sokolosky asked to make a brief presentation. He stated that the rezoning if approved would allow approximately ten to fifteen more houses making a total of approximately 115 homes within this development. He also explained that the houses would not be "starter" homes; they would be roughly 1,750 square feet of living space with a lot width of 70 feet. The Owasso Zoning Code requires at least 65 feet width lots for RS -3 zoning but he is planning on at least 70 feet width lots. Staff recommends approval of OZ -02 -05 as requested. The following are comments /concerns from property owners in the area that attended the meeting: M. L. Jacobsen - 7489 North 147 East Avenue - Lindsay Management assured us in 1998 that we had no worries regarding the subject property because it will probably never get developed. Also, inquired sewer availability to this area. Gary Baxter - 7590 North 140 Place East - Had concerns with the good faith agreement of a PUD (underlying zoning of RS -1) and now trying to change that zoning. Why approve a PUD if it gets changed? Also had concerns with traffic in the area. The roads are not growing with the same pace of the developments. OWASSO PLANNING COMMISSION June 10, 2002 Page No. 3 Sharon Hagyari - 14506 East 76 Street North - Understands that Mr. Sokolosky would do a great job on this project but has concerns with the traffic it will create. Around 300 more vehicles in the area are just too many. Randi Farwell - 7585 North 143 East Avenue - The additional traffic is the major problem, has nothing against Mr. Sokolosky. She was hoping that there would be another way in and out of the property. Ray Haynes moved to approve the rezoning from RS -1 (Residential Single Family Low Density) to RS -3 (Residential Single Family High Density) subject to a minimum lot width of 70 feet, Charles Willey seconded the motion. A vote on the motion was recorded as follows: Ray Haynes - Yes Bill Ellison - Yes Charles Willey - Yes Dewey Brown - Yes The motion carried 4-0. Chairperson Ray Haynes announced a 10- minute recess at 8:00 PM. 6. OLS -02 -02 - Seavco - A request for a lot split on Lot 2, Block 1, Owasso Market H. The subject property is located on E. 96"' Street North, between the Wal -Mart and Lowe's facilities. Tim presented the item to the Commissioners. The subject property is zoned CS district (Commercial Shopping Center). Lot 2 of Block 1 currently has a lot width of over 412 feet and is dissected by several large easements. If approved it would create three lots and would allow development of the new lots much easier. Tract `C' would be made up of a Mutual Access Easement and could not be built upon. Tract `B' would be the westerly 180' of Lot 2 and Tract `A' would be the center portion of Lot 2. The Technical Advisory Committee reviewed the lot split with one comment from Washington County Rural Water District. They wanted it noted that they will be the water supplier to the site. Ray Haynes moved to approve the lot split subject to the Board of Adjustment approval of a Variance request on Tract #C, Dewey Brown seconded the motion. Plat Amendment - Elm Creek Commercial Corner Amended - A request for the review of a plat amendment for Elm Creek Commercial Corner, amending the front building line on Lots 6 and 7, Block 2, from 25 feet to 11 feet. The subject property is located at 8514 N. 128' E. Avenue. Tim presented the item. He explained that the applicant is requesting the plat amendment to allow the front building line to be reduced to 11 feet. If approved the applicant is planning to construct an addition to the office space. The request was reviewed by the Technical Advisory Committee at their May 29, 2002 meeting. There were no opposing comments from the utility companies or Public Works Department. Staff recommends approval of an amendment to the east building line of Lots 6 and 7, Block 2 of Elm Creek Commercial Corner Amended from 25 feet to 11 feet. Ray Haynes moved to approve the plat amendment, Charles Willey seconded the motion. Zoning Code Amendment - Staff Initiated - An amendment to the Owasso Zoning Code, Chapter 10 - Use Units, Section 1017 Automotive and Allied Activities which would require mini- storage units to be permitted by Special Exception only in all commercial zoning districts. Currently, mini - storage units are permitted outright in CG (Commercial General) and CH (Commercial High Intensity) zoning districts. Tim introduced the item to the Commissioners and explained that Owasso permits mini - storage units in CG (Commercial General) and CH (Commercial High Intensity) districts outright. A change in the zoning code that would require the Board of Adjustment to approve mini - storage units by Special Exception in all commercial districts is appropriate. The amendment being proposed by staff would appear to be the appropriate step to ensure a public review process. Staff is recommending Planning Commission approval on this request. Rooney — Assistant City Manager BACKGROUND: APPLICANT AND STATUS OF APPLICANT: Randall Loescher, applicant and purchaser of the subject property. REQUESTED ACTION AND PURPOSE: A request to rezone the subject property from OL (Office Light) to IL (Light Industrial) in order to allow for industrial /commercial use, more specifically, the use of mini - storage units. LOCATION AND SIZE: The subject property is located at the southwest corner of E. 116' Street North and Mingo Road. The subject property contains approximately 111,375 square feet, or 2.55 acres, more or less. The legal description of the subject property is Lot 1, Block 1, Hillside Estates. A location map is attached for your information and review. EXISTING LAND USE: The subject property is currently undeveloped. SURROUNDING LAND USE: The subject property is abutted by single - family residential dwellings on the south, all of which are a portion of the Hillside Estates Addition zoned AG (Agriculture). The subject property is abutted on the west by a large farm lot zoned AG (Agriculture). To the north of the subject property is E. 116°i Street North, while farther north are large acre lots developed with single - family dwellings zoned AG (Agriculture). The subject property is bordered on the east by Mingo Road, while farther east lies property zoned CS (Commercial Shopping Center), RD (Residential Duplex), and RS -3 (Residential Single - Family High Density). . APPLICABLE REGULATIONS: The Zoning Code for the City of Owasso, Chapter 15 "Amendments" and Chapter 7 'Industrial Land Uses ". SITE INFORMATION: No unusual development hardships are noted. SITE HISTORY: OZ -98 -10 — In August of 1998, a request to rezone the subject property from AG (Agriculture) to CS (Commercial Shopping Center) was heard by the Owasso Planning Commission. There was considerable public opposition to the request. The application was amended for a rezoning to OL ( Office Light) instead of CS (Commercial Shopping Center) and the request was unanimously approved. In the last three years, there have been numerous rezoning requests within a one mile radius, all of which seem to generate a large turn out. ANALYSIS: The applicants are requesting a rezoning of the subject property from OL (Office Light) to IL (Light Industrial) in order to allow for the use of the site for mini- storage units. Currently, mini - storage units are permitted by right in IH (Industrial Heavy), IM (Industrial Medium), IL (Industrial Light), CH (Commercial High Intensity) and CG (Commercial General) districts and by Special Exception requiring Board of Adjustment approval in all CS (Commercial Shopping Center) districts. At the time of application, the applicant was informed of the City of Owasso's intent to amend the zoning code to require mini- storage units to obtain a Special Exception in all levels of Commercial zoning (CS, CG, and CH) and thus the applicant request IL (Light Industrial) zoning. When considering this case, the Planning Commission can consider a "down zoning" to any Commercial classification if it feels it is appropriate. The 2010 Master Plan, not yet completed in August of 1998 when the first rezoning request was reviewed by the Planning Commission, shows the subject property as being appropriate for Low Intensity Office or Commercial development with a buffer on the southern edge of the subject property. Most likely, the buffer on the southern edge of the subject property was the direct result of citizen input on the 2010 Master Plan, as well as comments made within the August, 1998 Planning Commission meeting. Industrial zoning of any nature is not appropriate at this location. Not only would it be spot zoning and zoning that is not consistent with any patterns in the immediate area, but it would also be in conflict with the 2010 Master Plan. Industrial zoning is typically found adjacent to railways, along highways and service roads, and the zoning of the subject property to any classification would be unwise. As mentioned earlier in the report, however, staff believes the applicant just wants to obtain the ability to have mini- storage units on the subject property, and thus applied for IL zoning believing it would not be permitted by right in any commercial district. A rezoning of the subject property, specifically to CS (Commercial Shopping Center), would be appropriate in staffs opinion. Approximately 90 % of all commercial uses are permitted in the CS zoning classification either by right or by Special Exception. CS is the lowest intensity of the three commercial zoning classifications, and allows for a public input process on those uses that are permitted by Special Exception. This allows for a public input process on any use which may be viewed as objectionable by area residents. Uses such as automotive and allied services, mini- storage units, and multi- family dwellings would all fall into this category. While the applicant is requesting a zoning to permit mini- storage units outright, staff feels commercial zoning other than a CS (Commercial Shopping Center) zoning would also be inappropriate. Staff reviewed the zoning of property at every arterial intersection in Owasso. Arterial streets would be Mingo, Garnett, N. 129' E. Avenue, N. 145' E. Avenue, E. V, Street North, E. 86' Street North, E. 96h Street North, E. 106' Street North, and E. 116 " Street North. The following is the office, commercial, and industrial zoning breakdown of those intersections: I = OL (Office Light) 0 = OM (Office Medium) 18 = CS (Commercial Shopping Center) 4 = CG (Commercial General) 0 = CH (Commercial High Intensity) 1 = IL (Light Industrial) 0 = IM (Medium Industrial) 0 = IH (Industrial High Intensity) Clearly, the zoning patterns when two arterial streets intersect is for CS (Commercial Shopping Center). The subject property is the only property in the City of Owasso with an OL (Office Light) designation on an arterial street. It has been zoned in such a fashion for 4 years, and no development has occurred. It would appear that the need for OL zoning at this location is minimal and it would appear that CS would be most appropriate of all options. This case will largely depend upon public input. Staff, surprisingly, has received no phone calls or letters regarding this zoning request. Staff does anticipate public opposition to the request for IL zoning, and likely will not be in favor of a CS down zoning as well. Letters were mailed to surrounding property owners on June 17, 2002 and the legal advertisement was published on June 20, 2002. The subject property was posted on June 20, 2002. Copies of both the letters to property owners and the legal advertisements are attached for your information and review. RECOMMENDATION: Staff recommends denial of the rezoning request from OL (Office Light) to IL (Light Industrial), but recommends approval of the rezoning from OL (Office Light) to CS (Commercial Shopping Center).. The subject property is generally located at the southwest corner of E 116" St. N and Mingo Rd., further described as Lot 1, Block 1, Hillside Estates addition to the City of Owasso. Theron Warlick presented this item. He stated that a site plan would be submitted to the Planning Commission through a separate process. The Technical Advisory Committee reviewed this request at their July 29, 1998 meeting and no comments or concerns were expressed. Mr. Bob Bellemare, an area property owner, was present opposing the commercial zoning and had comments regarding traffic safety at the intersection of Mingo & 116th Street North. Mr. John Dix also a surrounding property owner was present to oppose the rezoning request. Ms. Linda Meeker, the owner of German Corner Gymnastics, were present to address concerns and answered questions. Acceleration /deceleration lanes would be considered at the time of site plan review. There was discussion regarding the possibility of rezoning the subject property to OL (Office Low Intensity) in lieu of CS (Shopping Center District). More specifically, to amend the building lines shown on Lot 11, Block 5 of the Willows of Silver Creek. Enclosed within your packet are both a copy of the Willows of Silver Creek plat, as well as the lot survey for the subject property. As you can see, the dwelling encroaches upon the front building line on N. 141' E. Avenue and E. 90' Street North. While the encroachment would meet minimum front yard setback requirements for the zoning district, it is in conflict with both the building line reflected on the plat, and the building line per the restrictive covenants of the addition. As a requirement for amending a plat, the applicant must supply the City of Owasso with the signatures of all property owners within the addition endorsing the approval of the proposed amendment. While a copy of those signatures has not been forwarded to staff at the time of the preparation of the staff report on this item, this is largely due to the amount of owners and accompanying signatures necessary. The plat amendment was reviewed by the Technical Advisory Committee at their June 26, 2002 regular meeting. At that meeting, utility companies and the City of Owasso Public Works Department are afforded an opportunity to comment on the proposed amendment and site any concerns regarding the request. No opposing comments were received by Planning staff. Staff has no objections to the request to change the building line on Lot 11, Block 5 of the Willows of Silver Creek, as it should not be detrimental to surrounding property owners in any manner. The lot in questions is a corner lot, and visual inspection by staff shows little if any noticeable impact. No visibility problem on the corner is created either. While the requirement for amending this plat is the "sign off' by 100% of the owners within the addition, staff would recommend that the Planning Commission make this requirement a condition of approval as 100% of the signatures have not been obtained at this time. Rather than table this item for action at a later date, staff would request that the Planning Commission permit the City to be the final review authority regarding the signatures. RUSSELL DATE: July 1, 2002 BACKGROUND: The City of Owasso has received a request for a review of a lot split from Mr. James G. Russell. The subject property is located on 9105 N. 137' E. Avenue and is described as Lot 18, Block 2, Nottingham Estates. The subject property is zoned RS -2 (Residential Single- Family Medium Density). A plat map of Nottingham Estates has been included within your packet for your information and review. The northerly 10' of Lot 18 of Block 2 of Nottingham Estates contains a walking access trail to the private park contained within Nottingham Estates. Because the original developer failed to list this area as a portion of the private park, or provide an easement for this access, this has become an issue. The lot owner of Lot 18, Block 2 is willing to split off the northern 10' portion of his lot in order to have this issue addressed. The 10' parcel would then be deeded to the Nottingham Estates Homeowner's Association for ownership and maintenance of the walking trail. The legal description of the proposed lot split is included on the plat of survey which is attached. The Owasso Technical Advisory Committee reviewed the lot split request at their June 26, 2002 regular meeting. At that meeting, no comments were received from staff and area utility providers. Planning staff had no comments regarding the request. Typically, when a lot split is proposed that does not meet the bulk and area requirements of the zoning district of which it is located, staff would also require a Variance request to be approved by the Board of Adjustment. While obviously, the ability to build a residential structure of any kind on the lot to be created is non - existent, staff would recommend that the Planning Commission prohibit the construction of any structure on the 10' strip as a condition of approval of the Lot Split request. If approved by the Planning Commission, this item is not forwarded to the City Council for action as the Planning Commission is the approving body for lot split requests. The subject property is located immediately west of the new RCB Bank on E. 96' Street North. A location map has been included within your packet. Review of the site plan by staff indicates that all necessary parking requirements have been met by the applicant as 60 parking spaces would be required by the applicant (1 space per 200 square feet of floor area) and a total of 94 have been provided, including 4 for the physically challenged. The subject property is zoned CS (Commercial Shopping Center) and landscaping has been indicated on the site plan. When one reviews this site plan, it would appear that the parking along the west side of the proposed project is located outside the confines of the property lines, and therefore would need to be corrected. However, an easement was provided to Owasso Land Trust when the property between the City of Owasso and Owasso Land Trust was sold. This easement allows for the use of the area for parking in a manner which is consistent with that which is presented in the site plan. The site plan was reviewed by the TAC Committee at their June 26, 2002 meeting. The following comments and /or concerns were noted at that meeting: 1. The proposed location of the tie in for the water line is incorrect and needs to be relocated to the west where the existing water main is located. 2. The sign is already located on site. 3. Sidewalks will be required along E. 96' Street North frontage. 4. Perimeter easements should be provided along all property lines. No other comments were noted by staff or utility providers. The applicant has provided an erosion control plan for the subject site during the time of construction that includes silt fencing around the perimeter of the lot. RECOMMENDATION: Staff recommends approval of the proposed site plan as presented with the following conditions of approval: I. The applicant needs to install signage for handicapped accessibility parking in compliance with ADA standards. 2. Sidewalk will be required across the frontage of E. 96" Street North. TO: THE PLANNING COMMISSION CITY OF OWASSO FROM: TIMOTHY ROONEY ASSISTANT CITY MANAGER SUBJECT: FINAL PLAT FIRST UNITED METHODIST CHURCH DATE: July 2, 2002 BACKGROUND The City of Owasso has received a request from BKL, Inc., to review a preliminary plat for First United Methodist Church Addition. First United Methodist Church Addition is located south of E. 106'h Street North, west of N. 145' E. A location map is included on the plat contained within your packet. The proposed plat is a one -lot, one -block addition that would contain 11.86 acres, more or less and is zoned RM -2 (Residential Multi- Family High Density). The proposed use of the site is a church, which is permitted by Special Exception through the Board of Adjustment. Because this is a one -lot, one -block addition, staff is reviewing this request as a final plat and will be seeking Planning Commission approval as a final plat. The Technical Advisory Committee reviewed the final plat for the First United Methodist Church Addition at their June 26, 2002 regular meeting. At that meeting, area utility companies have the opportunity to request additional service easements, as well as staff also being provided opportunities to comment and/or require corrections. The following comments were submitted regarding the Cross Timbers plat: 1. Washington County Rural Water District #3 requested a 20' utility easement along the north boundary of the plat. 2. Several of the utility companies requested that the easement on the west boundary of the plat be increased from 15' to 20'. 3. Certificate of Dedication needs to be provided. The plat contained within your packet has addressed all of the above concerns. There are no construction plans regarding this subdivision as development on the site will be tapping into existing infrastructure as a result of the Northeast Elementary and the Coffee Creek Addition. There are, however, six additional requirements regarding this plat and they are listed below: 1. The Elm Creek Interceptor payback fee would need to be paid by the applicants prior to obtaining signatures on the final plat. The Elm Creek Interceptor payback fee is $1,580 per acre, or $18,738.80 for the subject property. 2. In addition to the Elm Creek Interceptor payback fee, the applicants must also address a payback fee to Owasso Land Trust, the entity that extended the sewer lines from the Elm Creek Interceptor. The applicable fee for that payback is $1,000 per acre, or $11,860 for the subject property. I There is a Storm Siren Fee of $16 per acre that would need to be paid by the applicants. This fee would amount to $189.76. 4. Sidewalks will be required along E. 106'" Street North and N. 138"E. Avenue. 5. Acceleration/Deceleration lanes will be required along E. 106" Street North. 6. The address of 13800 E. 106' Street North needs to be added to the plat. Again, due to the nature of the plat being a one -lot, one -block addition, staff is requesting the Planning Commission act on this plat as a final plat in nature. If approved by the Planning Commission, the final plat will be forwarded to the City Council for action at the July 16, 2002 regular meeting.
